NO. 71-212 ADOPTED AS AMENDED 00- Mr. Maurice Fleishman, architect, and Mr. Robert Grimsgaard, his associate, who have been working on designs for a new police facility-city hall complex, presented renderings and summaries of each. He stated that construction of such a complex on the site presently occupied by City Hall appeared quite feasible to them, as the site could easily accommodate the planned facilities, including adequate parking. He stated that sub- stantial savings would be made by utilizing city-owned property, thus avoiding the acquisition of new land. Mr. Fleishman presented drawings labeled Schemes A, B and C» each depicting different methods of proposed construction, and explained the advantages and/or disadvantages of each, such as proper protection for certain police vehicles, a rifle range, etc. included in or excluded from the different renditions. He elaborated on Scheme C, stating that this was a compromise between an ideal program and a minimum program, and the one he felt best suited to the needs of the City. In Scheme C the jail facilities are located in the basement of the building, with the prisoner loading below grade, the rifle range is provided, which will serve a dual function as a civil defense facility and as such would be eligible for federal construction grants. He stated that, in conclusion, they recommended adoption of Scheme C as the most satisfactory solution. Mr. Fleishman reviewed the cost estimates; he stated that Scheme C had a total estimated cost of $1,994,456, as compared to $1,670,000 for Scheme B. Councilman McCaron asked whether it was known how much federal aid could be obtained for Scheme C to be applied to the total cost. Mr. Grimsgaard stated they had not investigated this aspect thoroughly, because they were not sure the program would proceed. Councilman King stated the Chief of Police had looked into this area rather deeply, and there probably would be considerable savings from federal funding. Councilman King asked whether the cost estimates were based on today's wage scale or projected future scales, and Mr. Fleishman replied that they were based on today's. Mr. Fleishman stated he would leave the drawings so that they could be studied in further detail if desired. Mayor Gregory thanked Mr. Fleishman and Mr. Grimsgaard for their presentation. Councilman McCaron stated that he would like to thank Mr. Grimsgaard publicly at this time for drawing up the sketches for the bus stops and donating his time to this service for the City. There were no written protests. City Engineer French stated that when this matter had been considered at the last meeting. Mr, Colwick suggested that since Phi Hips Petroleum had received the notices, perhaps the owner, Mr. Devere, was not aware of the Council's proposed action. The Council continued the matter until this meeting to insure that Mr. Devere had been properly notified. Mr. French stated that the City had been in contact with the property owner, who indicated that he was satisfied with the recommendation of Phi Hips Petroleum Company, and they had assured him that a representative would be present at this meeting if they felt it was needed. He recommended that the shed shown In the photographs be demolished, the substandard garage be brought up to Code or demolished, and that a general lot cleanup be accomplished. TESTIMONY WAS GIVEN BY: Harry Taylor, 21440 Covlna Hills Road, Cavlna, stated that the tenants on this property had left it In a deplorable condition; they had moved, and he stated he would like to rehabilitate the structures for rental purposes. The tenants had moved two other families into the house, and Mr. Taylor stated it had taken quite a while to get them to move out after they had been given notice. He stated it would probably take about a month to dean the premises up. Affidavit of Mailing, and Affidavit of Posting. City Clerk Balkus stated she had the three affidavits. COUNCILMAN MC CARON MOVED THAT THE CITY COUNCIL RECEIVE AND FILE THE AFFIDAVITS OF PUBLICATION. City Attorney Flandrick stated that the purpose of the hearing was to allow any property owner likely to be assessed for any costs in the district to protest the manner in which the work was done and/or the manner in which the assessments are proposed to be spread. City Clerk Balkus stated that written protests had been received from Joe and Adeline Bartolo, Mr. Y. M. Molina, and Mr. Glen Robinson. She read each protest in its entirety, Copies in official files) City Engineer French reviewed the Bartolos' protest, and his memorandum dated August 16, 1971 pertaining to same, addressed to the City Attorney. He stated that none of the work the Bartolos had complained about was part of the assessment district, and that in terms of cost, he felt it might be less expensive for the City to remove the work in the area, and if the Bartolos made application for a lot split, a variance, etc. In the future, this work would probably be a condition. Councilman King stated that if the Bartolos had not dedicated this property but were interested in retaining the improvements made, the City should bear the cost. City Attorney Flandrick pointed out that the work which the Bartolos were contending was done improperly had not been assessed to them, as it was not done as part of the district. Councilman McCaron stated that since the work the Bartolos were protest! no was not Dart of the district perhaps the City Engineer could prepare a report to be brought back after conferring with the Bartolos to be sure they understood what the City was proposing with regard to the work and the costs. Mr. and Mrs. Bartolo were present to affirm their protest. Mayor Gregory asked whether the complaint was regarding the driveway, rather than the curb return. Mr. Joe Bartolo stated both, as well as the loss of property. Planning Director Gordon stated that several weeks ago he had talked to Mrs. Bartolo regarding putting a third house on the corner property, which is a single lot; he told her it might be possible, but that she would have to bring in an exact plot plan for a definite answer. Councilman King concurred with Councilman McCaron, in that inasmuch as the work was not part of the district, the Bartolos should come in to the City Engineer's office to see if a mutually agreeable solution could be reached. Discussion followed regarding the letter of protest from Mr. Y. M. Molina, Assessment No. 5. Councilman McCaron corrmented that explanation of the costs had been made at the hearing on the district. City Engineer French stated that apparently there was an error in Mr. Molina*s calculations, in that dividing his total assessment $427.86) by the frontage US1), the amount would be $3.62 per foot, not $6.58 as Mr. Molina indicated. Mr. French stated that the original estimate given to Mr. Molina was over $500, so his actual cost was under the estimate. He further indicated that the $2.25 per foot quoted to Mr. Molina was under the open-end contract in effect at that time; however, today's open-end contract is much more than that. Mayor Gregory suggested that the City Engineer write a letter to Mr. Molina explaining the reasons for the amount of his assessment. Discussion followed regarding the letter of protest from Mr. Glen Robinson, 4708 Walnut, regarding the northerly 66 feet of Lot 87, Tract 4624. DISCUSSION RE PROTEST OF MR. Y. M. MOLINA WALNUT ST. A/D ASSESSMENT NO. 5 DISCUSSION RE PROTEST OF MR. GLEN ROBINSON 4708 WALNUT Mr. Robinson, in his letter, requested that Xerox copies of the breakdown of costs be furnished to all principals in the district, and that the final hearing on the assessment district be postponed until everyone had had an opportunity to know the exact breakdown of the costs. City Attorney Flandrick commented that these figures had been available at the Cily Clerk's Office and the City Engineer's Office for about a month, and that the City Engineer had given the figures to Mr. Robinson within the past several days. City Engineer French stated that everybody in the district had been sent a notice indicating what the individual cost would be. Mr. Glen Robinson was present to affirm his protest. He stated he felt the costs of setting up the district were excessive, and he felt the work could have been one without an assessment district. He would like a chance to study the cost breakdown to see why the costs were so high, and suggested that there should be a revolving fund in the City to take care of this type of thing, such as attorney's fees, etc. Mayor Gregory pointed out that when condemnation pro- ceedings are necessary the costs go up, and Mr. Robinson had refused to cooperate by dedicating in the first instance; further. Councilman King had spent a lot of time with Mr. Robinson trying to help him have a better understanding of the situation; and also that all the information had been brought out at the numerous hearings on the district, where Mr. Robinson had been present. Mr. Robinson stated that, in his opinion, the estimates had been way out of line. Councilman King reviewed the procedure which had been followed toward forming the assessment district, and again commented that had a11 the property owners dedicated in the beginning, the costs of the district would have been lower. Mr. Robinson stated he understood this, but felt a review was needed to see what could be done with the mechanics of it so it would not be repeated. Councilman King stated he could see no reason to hold the matter over, but Invited Mr. Robinson to come in and get together with the staff to try to formulate some other solution to the problem. City Attorney Flandrick reiterated that the figures on the assessment district were a matter of public record and had been available for over a month. TESTIMONY WAS GIVEN BY: Mrs. Joy Robinson, 4708 Walnut Street, stated the City had removed a tree which shaded her bedroom; she had been promised a replacement, which was sent, but which was only about the size of a broomstick. She stated the tree had been removed from ground that was not dedicated, and she would tike to have an adequate replacement. City Engineer French stated that he had told Mr, Robinson they would replace the tree with one bigger than the regular street trees which are usually planted, but a regular street tree was delivered and planted in error. He stated that they would contact a nursery and replace the tree with a larger tree. The City Attorney asked City Engineer French whether he had designed the project, and whether he was familiar with it and the 1911 Act proceedings. Mr. French replied affirmatively. The City Attorney asked the City Enolneer whether the work had been completed In accordance with the adopted plans and specifications to Ms satisfaction, and he replied It had. The City Attorney asked whether the assessments had been prepared by and under the direction of the City Engineer, and Mr. French stated they had. The City Attorney asked whether the assessments were spread In proportion to the estimated benefits on a oroperty-by-property basis, and the City Engineer replied that they were. The City Attorney asked what the basic formula In spreading the costs was, and Mr. French replied that It was on the front footage basis. The City Attorney asked what the nature of the benefits received by the properties; the City Engineer stated that the benefits, in his opinion, were better traffic control, street drainage, better delineation of the proper- ties, and better service to the properties. The City Attorney asked whether, in the City Engineer's opinion, the benefits to the properties on which there had been protests were commensurate with those to the other properties, and the City Engineer stated they were. The Cily Attorney asked whether, in the City Engineer's opinion, the cost of the assessment district per se Is commensurate with the benefits derived from the district, and the City Enqineer replied in the affirmative. Councilman McCaron asked whether there was a possibility any of the costs could be reduced. City Engineer French stated that the only way any item in the District could be reduced at this time would be for the City Council to make a contribution to the District to pay for part of the cost; the cost of acquisition, assessment spread, attorney's fees, etc* had already been contracted for, plus the costs of mailing, publishing, etc., which had already been paid. Mr. French commented that the City had provided all of the engineering and surveying, asphalt hookup to the driveways, pave-out of the street, heater remixing the existing streets, plus one-inch capping of the whole street to make it uniform, at no cost to the property owners. Councilman McCaron stated that it appeared the City had contributed sub- stantially to the District, and he could see nothing to be gained by continuing the hearing. He stated that the reason for the Commission's recommendation of rezoning is that the property had been completely developed with single-family homes, and the street is presently substandard. Both Dundry and Corak when fully dedicated will have forty feet of right-of-way. He stated that R-3 potential is almost zero* Mr. Gordon stated that a letter of protest had been filed by the San Gabriel Valley Water Company. Discussion followed regarding the difficulties which might be encountered in attempting to develop the area as^R-3. Councilman King commented that, in his opinion, the lesser zone is far more compatible to any area than is a high-density zone, because people who feel there is a possibility that surrounding properties might be zoned R-3 tend to let their property deteriorate, and he felt that by R-1 zoning there was a good chance the area would be upgraded. Councilman Hamilton asked whether rezoning to R-1 would affect the Water Company's usage. Planning Director Gordon stated it would not, in that it would still be a residential zone and the privileges would remain the same. Mr. French reviewed his memorandum on the subject, which stated that Section 8104(b)(4) requires that as a con- dition of issuance of a building permit, faulty or defective curbs, gutters, sidewalks or drive approaches will be repaired or removed and reconstructed; the policy adopted by the Council as a part of 66-S-17 required replacement of curb and gutter and allowance of credit for concrete work within the parking area, whether covered by permit or not. He stated that both situations should be treated the sane, and a uniform policy was needed. He stated that the General Plan was done In 1959, and the amount of development which has taken place In the ensuing 12 years has made It grossly outdated. He stated that two elements of the General Plan were scheduled for revision In 1971-72: a) Commercial Elements, and b) Community Design Element. He stated the Commercial Elements segment was large, and would be worked on at a future time. The Community Design Study is a plan to open up vacant land in residential areas deep lots) for development by providing new local streets, and was done in 1959 as part of the General Plan. The original map shows proposed locations of new local streets, and the lots which would be created when these streets open up. The map should be updated to show streets which have been built since 1959, to delete future streets which are not now considered necessary or desirable or are uneconomical to build because of buildings, etc., and to add new future streets. Mr. Gordon stated they would also like to set up a program for adopting specific plans, and set up a fund to open up the areas by providing access. He stated that the Planning Commission and the staff would be studying the matter over the next three or four months, and further reports will be forthcoming. Mayor Gregory commented that the meetings were very worthwhile, though very time consuming, and stated she felt that from the Friends of the Library", the Woman's Club, and the many others Involved with the library, a citizen could be appointed who would have the time and Interest In the Library Counci'., and who would welcome such an appointment. Councilman Hamilton, the City's delegate, stated that business commitments had kept him from attending the meetings, and he felt appointing a citizen member was a good Idea. Councilman King stated he felt It was a good Idea also, in that It would give another citizen an opportunity to become Involved In the affairs of the co-unity.
