The motion carried and was so ordered. 00- Acting City Manager Balkus stated there were amendments to the Claims and Demands Resolution. She stated that during the budget study sessions, there was discussion regarding purchase of a car for the Police Department; after checking six vehicles from various sources, a vehicle had been found which It appeared would provide the service needed with a minimum of repair. She stated that In this Instance It would be Impractical to go out to bid. and the welfare of the public would be promoted by dispensing with formal bids. It was reconnended that the formal bidding procedure be waived and authorization be given to draw a warrant In the amount of $1.473 for purchase of the car. COUNCILMAN KING MOVED THAT FORMAL BIDDING PROCEDURE BE WAIVED AND AUTHORIZATION BE GRANTED FOR PURCHASE OF A CAR FOR THE POLICE DEPARTMENT IN THE AMOUNT OF $1.473. COUNCILMAN BLEWETT SECONDED. Continued from 9/1/71) Proper postings and mailings had been accomplished. There were no written protests. City Engineer French presented photographs of the property; he stated this Is a single-family residential unit In a C-zone. He Indicated that there were numerous building violations. He stated the staff had recomnended demolition of the R-1 structure, and a general lot cleanup. City Attorney Flandrick Indicated that. In his opinion, the fact that the structure Is out of zone Is not a basis for demolition. In response to a question by Councilman Hamilton, City Engineer French stated the owner does live out of town; however, he had been notified by certified mall, and had Indicated receipt of such notifications; however, there Is no record of any response from the owner. Discussion followed regarding the practicability of rehabilitating the structure to bring It up to Code, and whether demolition of the structure because of the zoning factor alone would have any legal ramifications. Mayor Gregory pointed out that the structure had been posted by the Health Department as being unfit for human occupancy* City Engineer French Indicated that public nuisances have. In the past, been ordered to be rehabilitated to meet the Code within a certain period of time, or be demolished, and the property will not be occupied until It meets the criteria of the Building Department and the Health Department. City Attorney Flandrick stated that the procedure of declaring the property a nuisance and ordering abatement within a certain period of time, then If there Is a lack of compliance with the abatement order, demolition could be accomplished; this would have given the owners sufficient time and notice of the City's Intended action. Councilman Hamilton stated the owner should be notified that the nuisance must be abated within 90 days or the structure would be demolished. City Attorney Flandrick stated that the staff report should be amended to reflect this, and that subparagraph 1 of the RecwMendatlon should direct that, within a period of 90 days, the main R-l structure be rehabilitated to meet the requirements of the Code, and If not, that same be demolished. NO. 71*230 ADOPTED It was the time and place fixed for a public hearing on AZC-49, an amendment to the Baldwin Park Zoning Code, Part II, Definitions'1, Section 9422.B, to add the definition of a bedroom. The proposed definition would classify all dens, studies, etc., as bedrooms for the purpose of determining the minimum square footage of houses and apartments. Initiated by the Baldwin Park Planning Commission. Proper publication, postings and mailings had been accomplished. Planning Director Gordon reviewed his report on AZC-49, stating that In October 1966 the City adopted Its present Ordinance which set minimum dwelling sizes, based on the number of bedrooms, i.e., one bedroom, 850 sq. ft., two bedrooms, 1,000 sq. ft., three bedrooms, 1,300 sq. ft., and four bedrooms, 1,450 sq. ft. He stated that bedroom" Is not defined in our Code; therefore, many builders call one of the bedrooms a den, study, sewing room, etc., which allows them to build a smaller unit than was Intended by the iPlanning Conrfsslon and the City Council. He stated that a solution would be to add the definition of a bedroom to the Code; however, a problem which might be encountered Is that this might deter the current building boom In the City because of the required Increase In the size of the houses which are built,.and the cost of the house would naturally increase with the increase in size. He stated that the Planning Commission felt that the new definition should be adopted without changing the minimum sizes; they felt that a lot of thought was given the matter when the sizes were adopted In 1966, and also that a larger house Is a better house; the Planning Commission also felt that the minimum sizes recommended by the staff were too small. Mr* Gordon stated that the Planning Commission also held a separate public hearing on reducing the house sizes, per the staff's reconnendatlon, and the Commission agreed to drop this Item from the agenda. TESTIMONY WAS GIVEN BY: TESTIMONY Jbhn Gibson. 3853 N. Dundry, stated he had lived In JOHN GIBSON Baldwin Park since 1949; he was speaking tonight as 3853 N. DUNDRY a representative of the Baldwin Park Chamber of Commerce, and on his own behalf as a resident* f He stated he and thp Chamber members felt It would be a mistake to make the change that the Planning Commission had advocated, and they felt the recommendation of the staff was a better one. He stated they felt that the Increase In size requirements would materially affect the number of houses that are being built In the City. He commented that the Planning Commission's Idea was undoubtedly to upgrade the City, but he did not feel this would be the result, because If building decreases, pretty soon you would have only older houses, which would not be replaced by new construction* Mr, Gibson stated that, after talking with builders, he did not feel that as property became vacant, such as through demolishing of public nuisances, etc., there would be a speculative builder who would come In and build a larger home, because on today's market, houses In Bcildwin Park will not sell for as much as those In surrounding comnunities. Mr. Gibson further commented that many people who would like to purchase homes just cannot afford It, and the economists are predicting that by 1980, 20% of the families in the United States will be residing In trailer homes because they will not be able to afford single-family homes or apartments, and he did not feet that trailer homes w111 upgrade the City. He stated he would like to see the houses kept at a reasonable level, and he felt the staff had done this In their recommendation; he felt the staff recommendation would be adequate to protect our community and permit the upgrading of the conmunlty In an orderly manner. Councilman McCaron asked Mr. Gibson whether F.H.A. would finance 2-bedroom homes. Mr. Gibson stated he could not answer that positively; however. It was difficult to find any lender who would finance 2-bedroom homes today, because It Is felt that 2-bedroom hores are not adequate for a normal family; quite a few lenders w111 loan on existing 2-bedroom homes, but not on new homes. He stated that F.H.A. does not furnish money for construction; they only insure the loan for construction. Councilman King asked Planning Director Gordon whether he knew the percentage of homes that were built last year In West Covlna In confomance with their standards of 1,000 sq. ft. minimum. Mr. Gordon stated he was not sure; however, he thought they were building 3-bedroom homes of around 1,100 sq. ft., based on the prices he had observed in advertisements. He co-Dented that he had stepped off the rooms In the hones that are being discussed, and had concluded that 1,250 sq. ft. for a 3-bedroom home, by definition. Is a comfortable homes 350 sq. ft.. In his opinion, makes a good. 4-bedroom hoM» and Is not substandard. He stated that If you are going to degrade, all aspects would have to be brought Into the picture economics, density^ etc.; If you are going to lower the standards, you can also go too far In the other direction, and then you have a blighted area. Councilman Hamilton asked whether you could put an 1,150 sq. ft* home on a 5,000 ft. lot and still have the proper setbacks; Planning Director Gordon replied that It Is tight, but It can be done, without a variance, the setback problems occur when. In several years, an owner may wish to made a room addition or something similar. Jay Angelo, realtor, 3123 Baldwin Park Boulevard, stated then* Is much Interest and attention being given to upgrading Baldwin Park, however, he doesn't feel that it Is necessary to Increase the size of the houses to do this. He stated that last year and during the early part of this year, there had bffen a surge of requests for vacant lots, but at the present time. It was down to nothing, and would remain that way unfit this matter was resolved. He stated Council should be practical when considering the size of houses, because of the number of small and scattered lots In the City. He stated he had read and concurred with the staff report and felt It was a practical situation. Councilman McCaron asked Mr. Angelo what square footage he would recomnend, Mr. Angelo replied that he felt 1,100 sq. ft. was a practical situation for a 3-bedroom home, and the cost factor must be considered, because most of the sales In Baldwin Park are V«A. and F.H.A., most people do not pay cash to the loan, so you have to stay within a practical value. Councilman King asked what Mr. Angelo felt the average size of a bedroom should be, not Including the closet area. Mr. Angelo replied 10 x 12, and a master bedroom of about 14 x 16; however. It would be according to an individual's taste; a 10 x 10 bedroom would be adequate for some people. Jams R. Skirl, 1845 Via Palomares, San Olmas, represent- ing Leadership Construction Company, stated that when the Planning Co—ission had given this matter consideration In 1966, many factors were different; loan companies were loaning at a very high rate, and It did not matter what size house you built, because the loan company was building It, and a lot of the profit was coming right from the loan company. He stated that the proposed changes would require his company to add from 150 to 200 sq. ft. to their conventional houses, at an expense of from $1,500 to $2,000 per house. Mr. Smirl stated that they had been interested In building apartment units In the City, but loan companies are reluctant to loan money for R-3 development within Baldwin Park because of the stringent rules regarding R-3 development which were passed In 1966. He stated that since that time, there had been only one large R-3 development, which had been a government-subsidized housing project. He Indicated that It was good for a city to have some government-subsidized projects, but not to the point where most other types of conventionally financed projects were excluded. He stated that Baldwin Park Is very Interested In bringing new business and Industry to the City, and one of the first things developers will look at Is the population of the city and the construction, he referred to the Construction Index which appears In retailing and trade magazines In relationship to the desirability of areas, and If the construction factor Is not high. It will hinder the area. He stated that since the beginning of the year, the cost of lots In Baldwin Park had gone up 20% because of the demand upon them by developers, which Is helpful to the property owners; assessed valuation also goes up, which Increases the tax revenue. If the demand for R-1 property Is no longer there, because of the new standards, the property will revert back to Its old level. Councilman King asked the sizes of the homes built by Leadership Construction. Mr. Smirl stated they built 1,125 sq. ft. for a 2-bedroom and den home, and 1,325-1.350 sq. ft. for a 3-bedroom and den home. Councilman McCaron asked Mr. Smirl what minimum sizes he recommended, for selling, resale value, etc. He stated that th^y built 3-bedroom homes of 1,125 to 1,150 sq. ft., the reason being that the demand Is there for that product, and this Is the best marketable size at the present time. Councilman King asked whether Mr. Smirl found that the 4-bedroom homes of approximately 1,325 sq. ft. were adequate and the people liked them and the size was compatible. Mr. Smirl replied this was correct, and several homeowners testified to this effect at the Planning Commission hearing. Councilman King stated he had suggested 1,350 sq. ft. for a 4-bedroom, and felt that If you drop It any lower, you are getting into some small 4-bedrooms. Coral Investments, that Is building 1,100 sq. ft. houses and they are selling for over $20,000, but they are nice houses and they serve a purpose. He stated that In order to sell the larger houses, you have to Increase the cost, and the Important thing Is to keep the cost down, because people Just cannot afford the payments Mr. /teCoy stated that he felt If the required size of the houses was reduced, you would get more building; he also commented that the Codes should be maintained, because that Is what will make the houses stand up. He further stated that an effort would be made to abate the weed and rubbish problem and other nuisance type problems which exist* Mr* Gordon stated that the Planning Comnlsslon had made a visit to the area recently, and It was the general consensus that the area south of Nubia should be residential, and as much as Nubia Street Itself as possible should be residential. North of Nubia, each street has Individual problems, and there are some tentative suggestions. He stated he felt the main concentration should be on rehabilitation, an accelerated public works program, good, clear-cut zoning, and zoning enforcement, Councilman Hamilton asked what Is being done to get enclosures In the business areas for the trash containers. Mr. Gordon stated that, after being contacted, most of the markets had agreed to put up some type of view-obscuring structure. Councilman Blewett asked how soon we could expect a plan of action and Implementation of this plan of action In the area. Planning Director Gordon replied that probably In about two months, the Planning Commission would be ready to hold public hearings and, hopefully, the matter would be before Council In about three months. 00- Acting City Manager Balkus reported on applica- APPLICANTS FOR tlons received for the position of City Manager, stating CITY MANAGER that to date 52 applications had been received. She suggested that the City Council consider adjourning to a meeting to review the applications, and select those to be Interviewed by an oral board. Discussion followed, during which City Attorney Flandrick stated that probably the best procedure would be to have the candidates' applications screened" by the Council, eliminating those who did not qualify for the appointment, and then have the top candidates Interviewed by an oral board, and then by the Council. He stated his company had held all escrows, contingent upon City approval of certain things, and that they could not continue to hold up escrows; they had. In fact, already defaulted on two escrows* He stated that. In his opinion, there was a matter of urgency involved, Mr. Smirl further stated that, as he understood It, It was legal In the City to build a 2-bedroom and den home, so you were not talking about changing the rules. Councilman King commented that he felt 1,225 sq. ft* was an adequate size for a 3-bedroom home, and any less than that would be substandard; he felt 1,325 sq. ft. would be minimum for a 4-bedroom home* Councilman Blewett stated that this would be adding inore to the buyer's monthly payment, and this Is what should be avoided, because many people could not afford to upgrade themselves because the monthly payments would be too high. In answer to Councilman Blewett's question. City Attorney Flandrick stated that the house sizes could be set at this meeting by adopting an urgency ordinance, setting the 3-and-4-bedroom figures at 1,150 and 1,300 sq. ft. respectively, and which would Include the definition of a bedroom as stated In the Planning Commission's memo- randum. Councilman McCaron stated he felt there should be more latitude for design, and his reconmendatlon would be 1,100 and 1,350 sq, ft.; however, he would agree to 1,300 sq. ft. for the 4-bedroom. Councilman Hamilton stated he was In favor of the urgency ordinance, and since the builders felt the staff's reconnendatlon of 1,150 and 1,300 sq. ft. was acceptable, he would go along with this also. As there was no one else In the audience desiring to speak either In behalf of or In opposition to AZC-49, Mayor Gregory declared the public hearing closed. COUNCILMAN MC CARON MOVED THAT THE CITY ATTORNEY BE DIRECTED TO PREPARE AN URGENCY ORDINANCE INCORPORATING THE DEFINITION OF A BEDROOM AS RECOMMENDED BY THE PLANNING COMMISSION, AND SETTING THE MINIMUM SIZES FOR 3-BEDROOM AND 4-BEDROOM HOUSES IN THE R-1 ZONE AT 1,150 AND 1.300 SQ.
