Wallace, 1207 El Vega Street, La Canada. Copy In official files) regarding 71-S-28. TESTIMONY WAS GIVEN BY: Alexander E. Wallace, 1207 El Vega Street, La Canada, was present to affirm his written protest. He stated he was authorized to speak on behalf of his neighbor, Mr. Edwards, who had also been assessed for street Improvements. He stated that through a cooperative effort on the part of himself and Mr. Edwards, these two parcels could be developed and/or sold, provided the zoning were more flexible, and he had had offers of purchase In the past, contingent upon M-1 zoning, but the M-T zoning application had been denied. He stated that the property was freeway-oriented, and the surrounding environment provided great flexibility as to possible usage. Mr. Wallace stated there were taxes to be paid on the parcel, along with a sewer assessment and this assess- ment. and he was considering abandoning the parcel, or else obtain a legal opinion which basically would say that In the case of assessment there should be some correlation between the benefits an owner receives and the amount of assessment, and he did not believe there was any correlation In his case. He further stated he did not feel It was equitable to tax and assess property until the amounts of these taxes and assessments exceed the market value of the property. He asked whether the City had the power to suspend the assessment, or part of It, until the property could be developed. In answer to Mayor Gregory's question, Mr. Wallace stated that both his and Mr. Edwards' properties were vacant lots. City Engineer French pointed out that the Improvements that had been put In would be required as part of development costs, and If no action was taken by Mr. Wallace toward payment, the costs would go on the taxes, and should the property be Improved, Die taxes would have to be brought current and this would not require a cash outlay at the present time. Councilman McCaron asked whether Mr. Wallace had made an attempt to apply for a zone change. He stated they had had an offer In writing, contingent upon change of zoning, and he found out It would cost about $350 to apply for a zone change, Mr. Gordon had Informed him he could only make a recommendation, and that the final decision would be up to the Planning Commission. Mr. Wallace stated there had been R-3 development adjacent to his property recently. He further stated he would like to obtain some sort of an opinion from Council before he Invested the $350 to apply for a zone change. Mayor Gregory stated this would not be proper or legal. Planning Director Gordon stated he had discussed the matter with Mr. Wallace, and Mr. Wallace was proposing R-3 zoning In order to put subsidized housing on the property. Garland Harmon, 3132 Syracuse, stated he did not feel M-l would be proper zoning for this property, but if it were zoned R-3. apartments would look a lot better than the lots did at present, because the property was being used for dumping trash. It was the time and place fixed for a public hearing on 71-S-29, on the west side of Westcott Avenue between Garvey Avenue and Torch Street, for curb, gutter, side- walk and drive approach, to hear any protests in regard to costs. RESOLUTION NO. 71-262 CONFIRMING THE CITY ENGINEER'S REPORT REGARDING CERTAIN SPECIAL ASSESSMENTS 71-C-20) COUNCILMAN HAMILTON MOVED THAT RESOLUTION NO. 71-262 BE ADOPTED AND FURTHER READING BE WAIVED. COUNCILMAN KING SECONDED. There were no objections. The motion carried and was so ordered. 00- The matter of an amendment to the Personnel Rules and Regulations was considered at this time. City Attorney Flandrick stated that discussion had been held with representatives of the various employees associations regarding proposed language to accornnodate the floating holiday", and he stated it was proposed that a section be added to the Personnel Rules and Regulations to read as follows: Section 208. Floating Leave. Each full time officer and employee of the City shall accrue one day's leave with pay, per annum, which said leave shall be taken, whenever possible, on the birthdate of such officer and/or employee, provided that the actual date for the use of such leave shall be subject to the approval of the officer or employee's department head." He stated this would take the leave out of the category of holidays and/or vacations. Mark Reid, CLOCEA representative, stated that the Baldwin Park Employees Association concurred with the language as drafted by the City Attorney, and would be In favor of Council's adopting a resolution to this effect. Officer Joe Ensminger, representing Baldwin Park Police Association, questioned the retroactive portion of the section. City Attorney Flandrick replied that the Council, as of July 1, 1971, approved by motion the additional one-day accrual, so it would be effective as of July 1. She recomnended approval of both applications subject to receipt of insurance, business license, and processing fee. COUNCILMAN BLEWETT MOVED THAT THE TEMPORARY USE PERMITS BE APPROVED SUBJECT TO THE STATED CONDITIONS. COUNCILMAN HAMILTON SECONDED. There were no objections. The motion carried and was so ordered. 00- Councilman Blewett requested that the matter regarding cost of reproduction of documents be deferred to the next regular meeting on December 1, 1971. There were no objections. 00- Acting City Manager Balkus presented a request for waiver of fees for the use of Park facilities by the San Gabriel Valley Y.W.C.A. She stated that It is the City's policy that when an event is revenue producing the use of public buildings is subject to fees; the City Attorney had clarified that any event not sponsored by the City does not qualify for free use and would constitute a gift of public funds. She recommended that the waiver of fees be denied. Mayor Gregory commented on the excellent program of the Y.W.C.A., and the involvement of many citizens of Baldwin Park. Parks Director Lucas indicated that In the past, there had always been a fee charged when revenue was produced by the event. Discussion followed regarding this particular activity compared to other activities held In the park, and Mr. Lucas explained briefly the differences in the various activities and the requirements for use of the buildings and fees. Mayor Gregory directed the City Attorney to research the matter to see if such an activity could qualify for waiver of fees, or possibly co-sponsorship with the Y.W.C.A. for this type of event. The motion carried and was so ordered. 00- City Engineer French reviewed his report regarding the improvement of Puente Avenue, stating that the County of Los Angeles proposes to improve Puente Avenue from 250 feet south of Francisquito Avenue to Nelson Avenue; a portion of the improvement will be within the City limits, and for the County to expend their funds on this improvement, jurisdiction must be transferred to the County. He stated that the work as proposed will not involve any cost to the City. RESOLUTION NO. 71-264 CONSENTING TO ESTABLISHMENT OF A PORTION OF PUENTE AVENUE WITHIN SAID CITY AS A PART OF THE SYSTEM OF COUNTY HIGHWAYS OF THE COUNTY OF LOS ANGELES. The motion carried and was so ordered. 00- City Engineer French reviewed the Traffic Committee Report dated November 17, 1971, stating that the Police Department had made a comprehensive study on parking enforcement. The net cost to the City would be $4,500 per year for parking enforcement. He stated that there was a definite problem In the City, in that regulations are being enacted which cannot be enforced because of lack of equipment and personnel, and he felt very strongly that we did have an obligation to the community to enforce these regulations. Councilman Hamilton concurred with Mr. French, stating that enforcement was needed in the business area, because of people who parked all day In spaces intended for customer parking; some park there and take the bus to Los Angeles, or share a ride with someone, etc. He stated if the two officers requested could not be budgeted at present, perhaps one could be approved to get the program underway. Councilman King agreed, stating that we did owe the people this service, and the ordinances and signs were not effective if they were not controlled, and he would recommend one officer be approved at this time. Councilman Blewett inquired as to whether it would be possible to use one of the federal positions under the Emergency Employment Act in this area. Chief Adams stated he was of the opinion that these positions were specifically spelled out when applied for. Mayor Gregory also pointed out that the Chief had requested badged personnel, rather than civilian, and the Chief stated that badged personnel would give a greater latitude than civilian personnel. Acting City Manager Batkus pointed out that patrolmen had been requested under the EEA, and possibly one of them could be used for this purpose. Councilman Blewett stated that this would be his suggestion to see how the program would work, and would also be a less expensive way to initiate such a program. Finance Director Duncan stated there had been a problem with recruitment of patrolmen, in that under the EEA applicants were restricted to residency in Baldwin Park, and difficulty had been experienced in recruiting from City residents. He cited various examples of situations where the equipment would be of great value and advantage to the City, In addition to saving a great deal of time In records checks and researching files. Discussion followed. DISCUSSION Councilman McCaron commented that he had attended a meeting this date where a program was presented demonstrating record keeping by light beams, which was in the process of being perfected, although still probably several years away; this process would allow even more condensation of records allowing storage of more in a smaller area* He stated that if such an Innovation were available and desirable in the future, the proposed 5-year program might be feasible at this time, and there would stilt be a certain cash-in value for the hardware In 5 years. He stated he felt Council should indicate their acquiescence to the program, and when the new City Manager assumed his duties, he would make a determination of how it should be paid for; however, as he understood it, an order for the equipment would have to be placed about 6 months in advance, and Council should make a decision as soon as possible. Sgt. Aldrich stated delivery would be in the area of 9 months, but he felt it could be accomplished around July 1, 1972. Chief Adams stated what what was needed was Council's approval; the manner in which the equipment was acquired could be settled within the next several months, but the important thing is to be able to let the company know we want it. Councilman King stated he agreed with Councilman McCaron, in that when the new City Manager arrived he would take care of the details, but that in his own opinion, according to what had been presented to date, he did not feet the City could afford this, even though it was a good program. He felt there were other things which would take priority, such as a new police facility and a new city halt, and he did not feet he could give his approval at this time. Mayor Gregory commented that it was only a matter of some 15 dc^ys before the new City Manager would arrive, and asked whether there was any urgency. In that she felt he should have a chance to study It before a comnltment had been made. Chief Adams stated that because time was of the essence, when the appointment of the new City Manager had been announced, he had met with Mr. Mocatis to discuss this matter, and Mr. Mocalis was in agreement and suggested they go ahead on this because of the scheduled adjourned meeting on November 15, 1971 to discuss the matter. Sgt. Aldrich also pointed out that the city which wanted to contract for services to be provided by this equipment was desirous of an answer, and If the contract were to be effective January 1, 1971, It would take some time to set up a program. Sgt. Aldrlch replied that It would depend on how much the City wants to put on It; If the complete financial package, engineering, planning, etc. Is to be handled. It would be limited to two cities; however. If only law enforcement applications are taken, probably two cities In addition to Baldwin Park could be handled* Discussion followed regarding the cost to the City If federal grants were approved. Sgt. Aldrlch Indicated that with the Department of Transportation, the City would have no percentage to pay, unless personnel were assigned to some other task than traffic; the California Council on Criminal Justice would require ten percent of the total grant be paid by the City; he further stated that there was other funding available also. Sgt. Aldrlch conmented that, with the grants available, plus the ability to handle work for other cities, the City of Baldwin Park could realize a profit of between $250,000 and $300,000 over a period of 7 years from grants alone, plus the contracts with the other cities. Acting City Manager Balkus stated that, undoubtedly, this was a good program, and that she had not been aware until she learned at a Council meeting that a meeting had taken place with Mr. Mocalis to discuss this, but she felt that as a courtesy to him, he should have an opportunity to review the City's budget and records thoroughly before a decision is made. Inasmuch as he has the responsibility of making the final decision and recommendations to the Council. Mayor Gregory stated that although Council appeared to be In agreement that It was a good program, she was reluctant to have them render a decision with which the City Manager must contend without his actual presence, and felt it might be better to delay until his arrival. Chief Adams Indicated he understood and agreed with this; however, this program had begun last February, but because of the unforeseen circumstances occurring over the past several months, they were now facing a deadline. Councilman McCaron stated that the order for the equipment could be placed, and if there were any objections on the part of the new City Manager, the order could be cancelled. Sgt. Aldrlch stated that this was correct; the contract was not binding, but the order would guarantee the delivery date. Mayor Gregory suggested that the City Attorney review any contract before finalization. Councilman Hamilton stated he felt It was a good program, and there was a need for It; also, if the federal funding was received, we would save money for the City In the long run. He further stated that there was a cancellation clause in the contract In the event the City Manager did not approve of the program. He Indicated he was In favor of giving approval this evening. It had been requested that additional hardware be purchased to update the IBM System 3 currently in use in the IBM Department; however, there was a question as to whether purchasing would have any advantage over leasing the equipment.
