Assistant City Engineer Hale stated the owner had come in on November 30, 1971 and requested that this case be con- tinued; he was undecided whether to rehabilitate or demolish the structures. Mr. Hale stated the owner was in the process of deaninq up the premises, and presented photographs to that effect. Mr. Hale recommended that 71-N-61 be continued to December 15, 1971. Proper postings and mailings had been accomplished. There were no written protests. TESTIMONY WAS GIVEN BY: Mrs. Tomasetio, Maine Avenue, stated they had received a letter indicating the substandard shed should be demolished and she wondered whether this would apply also to the house. She stated the house had been sold twice; the first time the buyer had a death in the family and the property had to go through probate; now there is another buyer, and he agreed to take alt the responsibility of remodeling, etc. if the property were sold for less. Assistant City Engineer Hate reviewed the staff recommendations for abatement of the nuisance, which included demolition of garage, shed and fireplace, and rehabilitation of the single- family residence. Initiated by the Planning Conmission. Proper publication, postings and mailings had been accomplished. There were no written protests. Planning Director Gordon reviewed his report regarding Z-348, concluding that this was part of the City's program to rezone miszoned areas so that the use and the zone are the same. Councilman McCaron questioned under what procedure multiple residences had been constructed in the R-1 zone. Mr. Gordon stated that at the time the condominium had been built, this type construction was a permitted use in the R-1 zone under either a special use permit or a conditional use permit, and construction had been accomplished under the proper pro- cedure in effect at that time. The motion carried and was so ordered. 00- Mrs. Bonnie Leverich, of the Baldwin Park Truck Terminal, stated she had received a notice of necessity of filing for a conditional use permit- She was going to request that this be reconsidered, in that the property had been used in the same manner since 1967; however, she had been informed that she was not necessarily required to file at this time- Mrs. Leverich stated that they operated a truck service station, although if automobiles did enter the premises, they were obliged to service them. She felt that many of the conditional uses that were being forced upon the people in various cities were unfair, if the business had been operating for some time. and that the family spirit" was being taken away from people. She stated that the children growing up would not have the opportunity to start out from scratch and work toward a goal, because the requirements of government were closing In on them to where they did not have a chance to compete with big business. She stated that along Ramona Boulevard, small businesses had been encouraged to hold on to what they had, and the City had improved the area so they could keep their businesses and pass them on to their children. She stated that Council should not force requirements on them that they could not pay for, or the small businesses would be lost to major developers or industry. Mrs. Leverich stated that, under the present circumstances, she did not feel it necessary to address Council further, in that she would not be required to file for a conditional use permit at this time; however, she requested that she be permitted to appear in the future if circumstances warranted. As background, Mr. Gordon identified Mrs. Leverich's property, stating it was at Datewood and Maine, and was a service station catering mainly to trucks. He stated that several years ago, in order to have some control over possible blighted appearance of service stations, an ordinance was enacted requiring all stations within 200 feet of a residential zone to obtain conditional use permits; since that time all new gas stations have obtained permits, and all existing stations were required to file for a permit within 5 years. Mr. Gordon stated that Mr. Leverich had indicated to him that he planned to expand his truck yard, and that he would file for the service station conditional use permit at the same time he filed for the one relating to expansion of the truck yard; however, to date, he has not done so. Mr. Gordon stated he had talked to Mr. Leverich today, and Mr. Leverich indicated he would be in to file for the permits on Monday. Discussion followed regarding whether a conditional use permit would be required if only trucks were serviced. C'ity Attorney Ftandrick stated it would be the Leverichs* decision whether they wished to service only trucks, or to also serve automobiles, in which case they would have to apply for a conditional use permit. Mayor Gregory suggested that Mr. and Mrs. Leverich come in to discuss with Mr. Gordon the best way to approach their problem. 00- Bi11 Jablonski, 3756 Downing Street, asked what was the legal age for running for Council, since passaqe of the amendment allowing the vote to 18-year olds. City Attorney Ftandnck stated that the age as set forth in the State Constitution was 21 years, and had not been changed as yet, to his knowledge. Goulden, who is presently in Aberdeen, South Dakota. On September 15, Council granted 90 days for abatement of the nuisance; however, because of health reasons, he was requesting an additional 60 days. Assistant City Engineer Hale stated the staff had researched the matter and it appeared to be a legitimate situation. He stated the staff had no objection to allowing the additional 60 days. COUNCILMAN HAMILTON MOVED THAT THE CITY COUNCIL GRANT AN ADDITIONAL 60 DAYS FOR ABATEMENT OF PUBLIC NUISANCE CASE NO. 71-N-48. COUNCILMAN MC CARON SECONDED. There were no objections. The motion carried and was so ordered. 00- City Clerk Balkus presented a claim in the names of Joe and Adeline Bartolo. City Attorney Flandrick recommended that the claim be denied and referred to the insurance carrier. COUNCILMAN KING MOVED THAT THE CLAIM IN THE NAMES OF JOE AND ADELINE BARTOLO BE DENIED AND REFERRED TO THE INSURANCE CARRIER. COUNCILMAN HAMILTON SECONDED. There were no objections. The motion carried and was so ordered. 00- City Clerk Balkus stated that the Petition for Recall of Councilman Blewett was insufficient by 70 signatures. The proponents of the recall have been notified, and have another 30 days in which to circulate a petition to obtain the necessary signatures. She stated this was informational only, and no action was required. 00- City Manager Mocatis presented a report regarding the cost of reproducing documents. This matter had been continued from November 17, 1971 at the request of Councilman Blewett. Councilman Btewett commented that he felt the labor factor was a fixed cost that the City must bear, anrf if this were to be considered in the charge for reproducing documents, it might be necessary to consider it as far as other services were concerned. He stated that when people came to the City to have docu- ments reproduced, it was usually because they could not obtain the documents anywhere else, and he felt it highly unfair to have the cost at an exorbitant level. He stated that the cost of reproduction had been determined to be approximately $1.49, including the labor factor; he con- sidered this invalid, because the labor was here to provide services to the people of the conmum'ty who ask for it, and he felt this was a legitimate function of government. Councilman Blewett stated that he felt the Council, by motion or by resolution, should set a price on the cost of duplicating documents, and it should be a figure that would cover the cost of materials, but not the labor. He felt the cost should be cut down to provide a better and cheaper service for the people. Mayor Gregory suggested that since Mr. Mocalis was not here when the matter first came up, perhaps a committee of one or two of the Councilmen could confer with Mr. Mocalis to submit a recommendation as to the future policy regarding reproduction of documents. She suggested that Councilman Hamilton and Councilman Blewett meet with the City Manager, and they agreed. Councilman Hamilton questioned the number of requests for duplicating documents. Chief of Police Adams stated that during the month of September, there were 78 requests, and 77 during October, from his department alone. Councilman King commented that the County charged 3 cents per copy internally and 30 cents per copy plus 5 cents for each additional copy externally. He felt there was need for a study of the matter. Councilman McCaron felt that the charge for reproduction was similar to charges for inspections, permits, etc. in that they are all part of the revenue that the City derives from the services it gives to the public, and he felt it should remain as such. Councilman King stated he did not feel there charge; he felt it should be determined what would be, and that the charge was exorbitant time. should be no a fair charge at the present Mayor Gregory stated that the matter would be discussed at the next meeting, after Councilmen Rtewett and Hamilton had met with the City Manager. James Q. Gibson, 13268 E. Francisquito, stated he had read the 8-page report pertaining to reproduction of documents. He agreed with Councilman Blewett that labor was a fixed expense; he felt a charge should not be made for anything other than the actual cost of the material. He stated there were certain services that the City has to give to the public. 00- City Manager Mocalis reviewed the report regarding the Public Employees* Retirement System, stating that at the request of the Employees* Association in 1968, the Council requested the City Manager to initiate steps for phasing out Social Security. At that time a vote of the employees was taken, which indicated 118 in favor of dropping Social Security and zero against. Mr. Mocalis stated that another vote had been taken today, and out of a total 116 ballots cast, 107 were in favor of withdrawing from Social Security end 9 were opposed. Mr. Mocalis stated that, based upon the action of the employees, he recommended Council adopt the Resolution of Intention to withdraw from Social Security. Continued) CMN. He stated that of 51 ballots cast in the Police Association, 51 were in favor of withdrawal; of 65 ballots cast in the Employees Association, 56 were in favor of withdrawal; this amounts to 92.24% in favor of withdrawal from Social Security. Officer Ensminger urged Council to adopt the Resolution. Councilman King stated he had attended the meeting where the representative from Social Security was present, and at that time the representative had indicated that those who wished to remain in the program could do so as long as there was a classification. Officer Ensminger stated that at the meeting the following day, the representative from PERS had indicated this was not possible. The Association attorney had been contacted, and had informed Officer Ensminger that Council action would be.required to break down the classifications of employees who could remain in Social Security. Councilman King commented that Mr. Fiore, of Social Security, had given every indication that the people could stay in, and this would solve the problem of the minority who did not wish to withdraw. He stated he was interested to see that these people's wishes were taken care of, as well as those of the majority. He asked Finance Director Duncan whether any further information or action on this had been forthcoming since the meetings. Mrs. Duncan stated that she had been informed that once the agency withdrew from Social Security, there could be no return, and the City's membership would terminate December 31, 1971. It was her understanding that the agency, under another name, for instance, the Baldwin Park Street Maintenance Department, could petition the Social Security Board to be readmitted; however, this would require a different program for those employees under PERS. and this would have to be decided by PERS, as to whether they would permit part of the employees to be on a full PERS program and part on a modified program. Discussion followed regarding possible implementation of another program to allow those employees so desiring to remain in the Social Security program, Councilman Blewett felt the new retirement system was the best for the majority of the employees, as they apparently recognized by their vote; however, he indicated Council did not want to hurt any employee, and suggested a meeting might be held where one or two Counci'lmer, the City Manager and representatives of PERS and Social Security could discuss possible alternatives for the minority who wished to remain with Social Security- Councilman King commented he agreed with Councilman Blewett that the new program was probably the best; however, he felt that If the frity could possibly give the minority what they wanted, while stilt going along with the majority, it should be acted upon as soon as possible. rontinued) December 1. 1971 Page 8 OFFICER JOE ENSMINGER REP. Henry Volmert, of the Street Maintenance Department, stated he was one of the employees who wished to remain In Social Security, and he had never voted for withdrawal. He stated he understood the feelings of the police, specially, as well as the other employees, but he did not feel It was fair to take something away from some employees, and he felt he had a right to retire with dignity and security, the same as the other employees* He and the others who wished to remain with Social Security definitely felt they would be hurt by the withdrawal. / Mr. Volit^rt urged Council to investigate eyery possibility by which they might be able to remain in the Social Security program. Councilman Blewett questioned whether an employee who felt he had been hurt Insofar as his retirement pension would have recourse through the courts* City Attorney Handrick stated that, in his opinion, he would not, in that Council would be acting und^r State law in authorizing the transfer action. Councilman McCaron felt Council should proceed with the Resolution of Intention, and investigate the possibility of reinstatement for those eMployees who wished to reiMin, as suggested. The other night, his wife's car was hit while parked in front of their house, so he thought he would bring the matter before Council this evening. He stated this was not the only reason, however. There were many children walking in the area and a lot of vehicles. He felt it was Council's duty to do something about the hazardous condition which exists, and he offered to pay for stop signs if the City would install them. Mr. Middleton further stated there were many people in the area with the same complaint, and he appealed to Council to take action. Mayor Gregory stated she was aware of the alley in question and agreed it was not a good situation. She directed the Traffic Committee to make a study in the immediate future to determine a solution to correct the hazards that exist. 00- Councitman King comnented that Council had not been receiving the Planning Commission minutes within the 10-day appeal period. Mr. Gordon stated there had been an unusually large number of public hearings and the clerical staff were doing their best to catch up. He indicated that in the event of a controversial matter or an appeal, if the Minutes were not completed, unofficial excerpts relating to the particular matter would be placed in Council's packets. 00- Councilman King urged that each Council member read the KABC Radio Report regarding redistricting. He stated the report gave a lot of background and was very enlightening.
