Councilman Blewett felt the matter should be deferred for a while, considering the upcoming election in April, and also he felt consideration should be given to how charter cities would be affected under either the Watson Tax Initiative or the Jarvis Tax Initiative. COUNCILMAN BLEWETT MOVED THAT THE MATTER OF THE PROPOSED CITY CHARTER BE CONTINUED TO JUNE 21, 1972. Discussion followed regarding an appropriate date for continuance, depending upon passage of certain legislation, and advantages or disadvantages of charter cities under this proposed legislation. Councilman McCaron and Councilman Hamilton felt that holding the matter over for a shorter period, perhaps 90 days, would be advisable, and at that time it could bd continued again if necessary. Councilman Blewett felt that the matter should be continued beyond the date of the election in April. COUNCILMAN KING SECONDED THE MOTION. There were no objections. TO 6/21/72 00- It was the time and place for a continued public hearing on AZC-52, an amendment to the Baldwin Park Zoning Code, Sections 9428.9, 9551.3 and 9570.5 regulating household pets in the R-1. R-2 and R-3 Zones. Initiated by the Baldwin Park Planning Commission. Continued from 10/20/71 and 11/3/71) Proper publication and postings had been accomplished. There were no written protests. Planning Director Gordon reviewed his report on AZC-52, stating that on October 20, 1971 the Planning Commission recommended to the City Council a new ordinance which would allow pets in a11 the residential zones, R-1, R-2 and R-3; in single-family units there should be allowed three animals per lot, and if there is more than one residential unit per lot, there should be allowed one animal per unit; they also recommended that the wording of the Code be changed from mammals" to household pets", which would permit a wider variety of animals. One concern of the Commission was the negative problem of having too many animals; however, when this case was dis- cussed before the City Council there was a concern regarding people who wanted to keep more animals than permitted by the ordinance. Councilman McCaron asked about the procedure for filing for a minor variance, which Mr. Gordon explained, indicating there was a filing fee of $25. Mr. Gordon stated that Council had recently adopted the minor variance procedure, and it was presently incorporated within the Code. Councilman King asked whether the minor variance could be revoked, as could a conditional use permit, and Mr. Gordon stated it could. Proper postings and mailings had been accomplished. There were no written protests. Acting City Engineer Hale presented photographs of the property taken on October 19 and December 15, 1971. He stated that he understood the owner had indicated via telephone that he planned no action regarding this structure until he could find a tenant. TESTIMONY MAS GIVEN BY: Robert Heck. 740 W. Yale. Ontario, stated he was the owner of the property; he indicated that the information that he planned no action was erroneous, but that he was endeavoring to sell the property rather than rent it. as a suitable tenant could not be found. He stated that Jay Angelo. Realtor, was handling the property for him» and had also been his representative in attempting to keep the property boarded up. but as fast as it is boarded up. vandals tear it down, and they had entered the property, caused considerable damage, and had attempted to set the place on fire. He stated it was a continuous problem trying to keep the structure boarded up. In answer to Mayor Gregory's question. Mr. Heck stated he had received alt notifications regarding the substandard condition of the building, and had discussed the matter with the City Engineer, Mr. French, who had suggested the property be boarded up and see how things went. Jay Angelo. Realtor, 3123 Baldwin Park Boulevard, stated he wished to affirm what Mr. Heck had indicated; the building had been boarded up many times, and had been damaged repeatedly by vandals. He stated that Mr. Heck would remodel to bring the structure up to Code for a reliable tenant and an appropriate amount of rent. He stated the buildings are valuable buildings, but he did not know what Mr. Heck could do to protect his investment; they are trying to find a buyer or a lessee, but do not know what else they can do to eliminate the vandalism. Mayor Gregory pointed out that the structure-does not conform to the Code. and that if a renter were obtained he would have to rehabilitate. Mr. Heck stated he was not aware what the violations were regarding the Code, but that the structure. did meet the zoning requirements. He stated, however, that if the property were rented, he would bring the structure up to Code. Mr. Heck further commented that there is no insurance on vacant property, so the damage done had been a total loss to him, and he would prefer not to put any more money into the property until it is rented to someone who could give the property protection. Councilman King stated he felt the building was good and that it would not take much to upgrade it; perhaps Mr. Heck could re-board and clean up the area, and the police might be able to patrol a tittle more closely in that area, but he would not like to see a good building demolished because of vandalism. RESOLUTION NO. 71-279 CONFIRMING THE CITY ENGINEER'S REPORT REGARDING CERTAIN SPECIAL ASSESSMENTS 71-C-17) COUNCILMAN KING MOVED THAT RESOLUTION NO. 71-279 BE ADOPTED AND THAT FURTHER READING BE WAIVED. COUNCILMAN HAMILTON SECONDED. There were no objections. The motion carried and was so ordered. 00- Under Oral Communications, Mrs. Dorothy dark, 4308 N. Bresee Avenue, read a communication from The Concerned Citizens of Baldwin Park regarding the fee for reproduction of documents, and indicating it was their feeling that Councilman Blewett should have been charged $150 for the duplication of recall petitions, rather than the $75 he had been charged. Copy in official files) James A. Garrow, 1011 N. Baldwin Park Boulevard, cited several examples of organizations which would come to some City Halls and reproduce copies for 25<t a page. and where he had had copies reproduced for 50<t a page; he felt the recall action had taken a lot of time of personnel in the City Clerk's Office, and he felt any Councilman was entitled to protect himself against the wishes of certain people. He stated he felt the report made by the Police Department Should have, rather, been made by the Finance Director, as It indicated an exorbitant amount of time, and he felt Mrs. Duncan would have had a better idea, financially, what the cost should have been. He stated these were his personal feelings, but he felt they bore out the feelings of the Baldwin Park Improvement Association. Otis Clark, 4308 N. Bresee Avenue, stated he had been to the Police Department and paid $2 per copy to have documents reproduced, and Mr, Blewett was no different from any other citizen. He stated that if Mr. Blewett were allowed to pay less than others, then everyone who had ever had documents reproduced should be entitled to a refund. T. E. Carpenter, 4346 Jerry, stated he had a copy of the report regarding reproduction fees, but most of the audience had no idea what was being discussed, because they had not seen the report. He stated he had requested that the report be resumed for the audience, but since it had not, he briefly summarized it. He explained that the recall petitions had been reproduced on the Xerox machine, which is housed in the Police Department; it is a machine capable of reducing the print to allow more information on one sheet. He stated that if the City were to charge $1.00, plus 25( for each additional copy, he did not feet this was being considerate of the public, inasmuch as they could have copies reproduced at the library for 50^ or at Fitzpatrick's Drug Store for 10(. He stated he had done time and motion study, and reiterated that the report was a very good one, Councilman King pointed out that Councilman Blewett had indicated that he was unaware, as were the other members of Council, of the cost for reproducing documents. He stated that the report was after the fact. and Councilman Blewett did not indicate any desire for a refund, nor did he want his costs lowered, and that he, himself felt no refund could be made to Councilman Blewett. because that would mean refunds must be made to anyone who had ever had a document reproduced, which would be virtually Impossible. The question was how much benefit are the people getting for their money; are they being charged too much? There- fore, the staff made the study and came up with a report; it was not directly concerned with Councilman Blewett at all. as far as a refund, or getting out of paying the costs, and he felt it was wrong for anyone to make such a statement, Emmit Waldo. 4170 Sharons Way. stated the question was not whether we charged too much or too little, but why Councilman Blewett did not pay what any other citizen would pay if he went to the Police Department and requested a copy of something. Councilman King suggested the facts be clarified as to how the amount charged Councilman Blewett was determined. He stated he Councilman King) had called Mrs. Balkus inquiring what the cost was to reproduce a copy and she stated she thought it was 10(; however, after checking further. Finance Director Duncan had informed her that 50( had been charged in other instances, such as reproduction of a building permit that is required by F.H.A. Mrs. Balkus stated that the Xerox machine was capable of reducing the print so that two petitions would fit on one sheet, and the price charged Councilman Blewett was 50( per sheet, which had been the price charged others in the upstairs departments. Councilman King emphasized that Councilman Blewett had been unaware of the manner in which the price had been decided unfit he was informed that it would be 50( per sheet. Mr, Waldo stated that the reproduction of the petitions could have been done on the machine upstairs, but instead was done on the machine in the Police Department, which normally charges $1.00 per copy. and his point was they did not want Councilman Blewett to have any privileges that any other citizen would not have. Councilman Blewett quoted a portion of the report which indicated the amount of time spent by various persons in the reproduction of the documents, and the related costs based on each person's salary. He stated that the labor costs should not be included in the cost of doing anything for a citizen, because labor is a fixed cost; the people in City Hall are there to serve the public, and Councilmen are part of the public and should also be served. Councilman Blewett felt the Concerned Citizens Group was unduly preoccupied with what appeared to be a complaint aimed at him personally; he had nothing to do with the setting of the cost, nor was he involved in any way other than requesting that the City Clerk have the documents reproduced and paying the cost quoted to him. Mrs. Balkus confirmed that Councilman Blewett had requested the copies; she had quoted him a tentative price of 10< per copy, figuring the paper cost. etc., but had later ascertained that the other departments had been charging 50( for reproducing one sheet;,she then telephoned Councilman Blewett and informed him the cost would be 50< per copy, and he asked her to proceed, based on that figure. Mr. T. E. Carpenter commented that the study had been requested by the Council, and the report made by the Police Department; the Concerned Citizens had not been aware of, nor were they involved in any way until the report came out. Mr. Carpenter reiterated that he felt the audience should be given some sort of resume of items such as this so they would have an idea what was being discussed. Mayor Gregory commented that the material was always available at the City Clerk's Office for anyone interested. Councilman Blewett pointed out that the report took in only the cost of a single document; it did not take into account the economies in scale of producing more than one document. Mrs. Gloria Zook, 4817 La Rica, stated she had checked receipts in the Finance Department office and found that some people were charged 48(, some 43(, some $1.00, etc. for different things, and she felt it should be uniform throughout the City. She felt City service was being overlooked. Mr. James Q. Gibson, 13268 Francisquito, commented that government costs were usually more than for private industry. 00- City Clerk Balkus read a letter from Planning Commissioner Robert A. McCord, offering his resignation from the Commission, inasmuch as illness of his employer made it impossible for him to regularly attend the meetings. Copy in official files) Councilman King stated that he had conversed with Mr. McCord, who indicated that he did wish to serve on the Commission, but as indicated by his letter, circumstances at this time prevented his attendance at the meetings; however, if he were to be granted a 60-days' leave of absence, he should then be able to continue to serve as required. The motion carried and was so ordered. 00- City Manager Mocalis reviewed his report regarding the cost of duplication of documents, stating that the Committee appointed at the last Council meeting, consisting of Councilmen Blewett, Hamilton and the City Manager, had made a thorough study of the costs of duplication. The unanimous recommenda- tion of the Committee was: 1) An initial fee of $1.00 per single sheet; 2) A fee of 25( per sheet for subsequent sheets; 3) The foregoing rates apply to sheets no larger than W x 14". and an additional charge will be made for special handling; and 4) If the request is for more than 50 sheets, the price would be appropriately reduced to reflect actual time expended in duplication, He stated that in arriving at the foregoing recommendations the Committee took special cognizance of the fact that the City's prime responsibility is to provide services to citizens, but at the same time it was felt that whenever possible the cost of services should be borne by the user. It was the Committee's feeling that the foregoing recommended charges embody both considerations in a fair manner. In answer to Councilman McCaron's question. Mr. Mocalis clarified Item 4. stating that the 50 sheets could be 50 of the same sheet or 50 different sheets. Mr, Mocalis further stated that these costs were for those documents obtainable only at City Hail, not something a citizen might bring in from outside; he indicated also that these charges would be for all reproduction—upstairs and downstairs. Councilman Blewett stated that the City had never had a policy regarding duplication of documents, as do most other cities, and he concurred with the Committee's recommendations. COUNCILMAN BLEWETT MOVED THAT THE CITY COUNCIL APPROVE THE REPORT OF THE COMMITTEE AND INSTRUCT THE CITY MANAGER TO ADMINISTRATIVELY EFFECT THE RECOMMENDATIONS THEREIN. COUNCILMAN HAMILTON SECONDED. Councilman McCaron suggested a record be kept to determine what the City's costs were over a period of time. 00- City Manager Mocalis presented a Sub-Agreement, County of Los Angeles PEP Program, which was Phase 6 of the Emergency Employment Act of 1971. The program applies to jurisdictions having an unemployment rate of more than 4.5%; Baldwin Park's estimated rate presently is 7.9%. The agreement provides for one Clerk Typist, one Keypunch Operator and two Groundskeepers. The effective date of the agreement is retroactive to November 1. 1971. Continued) RESIG. Chief Adams stated that either a patrolman or a civilian employee from the federally funded program could be utilized; however, the federal funds would not, in any case, provide for the equipment; this is the City's responsibility. Councilman McCaron stated he was willing to cede to,the equipment, but he felt the personnel should come from the federal program. Councilman Hamilton stated it was his understanding that the officer would come from the federal funds, but the City would be required to purchase the equipment. City Clerk Balkus reiterated that this had been discussed as part of a Traffic Committee Report, and stated that the City Engineer at that time had recommended that it not be an individual from the federal program. Councilman Hamilton commented that it had also been discussed that probable revenue from citations might offset some of the cost of the employee. Discussion followed regarding continuing the matt6r of purchasing the equipment until the matter of personnel had been resolved. Councilman Blewett inquired whether there had been any information received as to availability of the vehicle, and whether there was any urgency. Chief Adams stated Cushman had 6 in stock, 4 of which were to be delivered to a customer, and the 2 remaining were available immediately; the dealer did not know when another shipment would be received from the factory. i It was the consensus of the Council that the matter be continued to allow the City Manager time to research it and report to the Council. 00- Acting City Engineer Hale presented reports of work completed under the Short Form 1911 Act on 71-S-24. on the southeast side of Maine Avenue between Rexwood Avenue and Foster Avenue, for sidewalk and drive approach; 71-S-32, on the west side of Azusa Canyon Road between Sandstone Street and Nubia Street, for curb and gutter; 71-S-33, on the west side of Azusa Canyon Road between Nubia Street and Olive Street, for curb and gutter; and 71-S-43, on the north side of Frazier Street between Foster Street and Grace Avenue, for curb and gutter. The motion carried and was so ordered. 00- Acting City Engineer Hale reviewed the Traffic Committee Report dated December 15, 1971, stating that the Committee recommended the following: 1) One way west to east traffic flow in the alley south of Ramona Boulevard between Francisquito Avenue and Corak Street, including installation and maintenance of directional signs and pavement markings; 2) No parking on the east and west sides of Merced Avenue from Ramona Boulevard approximately 200 feet southerly; and 3) that the Los Angeles County Road Department, Traffic and Lighting Division, be requested to re-time the pedestrian signal sequence at Merced Avenue and Ramona Boulevard and at Stewart Avenue and Ramona Boulevard. Mr. Hale presented photographs depicting what effect a one-way in this particular alley might have on a residence and the businesses abutting the alley. He stated he had talked with business owners in the area and one in particular, who has a lawnmower shop, was very much in favor of a one-way alley, because the alley has become quite a thoroughfare and there is danger to pedestrians, children on bicycles, etc. He stated alternatives had been considered, such as stop signs, but It was felt there would be an enforcement problem. He further stated that the Committee felt the alleys should be utilized as intended, which was primarily to serve the properties abutting them. Councilman Blewett pointed out that if this alley were made one way as recommended, the businessmen along Ramona Boulevard would Be almost totally denied business from westerly traffic. Mr. Hale stated that there were two businesses in the area, both being service stations; one would suffer no toss; however, egress from the Douglas Service Station into the alley would be prohibited. In answer to Councilman Blewett's question, Mr. Hale stated he had been unable to contact the owner of the Douglas station regarding this. Councilman Blewett felt all the property owners involved should be contacted before a decision was made. Discussion followed. Acting City Engineer Hale presented photographs of the proposed action, and the reasons for it. He stated that the reconstruction of Ramona Boulevard and related areas had not left sufficient parking area on either the east or west side of Merced Avenue without restricting hazardously vehicles turning left onto Merced Avenue, and those vehicles attempting to make a right turn onto Ramona Boulevard. Mr. Hale stated he had contacted the manager of the liquor store located on the corner of Ramona and Merced, and he indicated that there was a large parking lot for his facility and he was in total agreement with the recommended no parking area. Across the street from the liquor store is a mobile home park, and normally there would be no parking on the street in that area. City Attorney Flandrick read by title: RESOLUTION NO. 71-280 IMPOSING CERTAIN VEHICULAR TRAFFIC REGULATIONS The City Attorney indicated that Section 1 should be elimi- nated and Sections 2, 3 and 4 renumbered accordingly. Mr. Hale stated that residents of the City had requested an evaluation of the pedestrian timing of traffic devices located on Ramona Boulevard and Stewart Avenue and Merced Avenue. A review of the timing sequence at these intersections indicates a need to increase the present timing sequence. He stated it was the Committee's recommendation that the Los Angeles County Road Department. Traffic and Lighting Division, be requested to re-time the pedestrian signal sequence at these intersections. Acting City Engineer Hale stated a petition had been received from citizens in the area of Foster School requesting crosswalks, particularly at the corner of Vineland and Durness. He stated the Traffic Committee had evaluated the area and determined the average flow of traffic to be approximately 4,000 vehicles per day, and pedestrian traffic is primarily school children attending Foster School. To install crosswalks at Vineland and Durness would severely restrict vehicular traffic on Vineland Avenue; in addition, recent County Road Department studies have indicated that marked crosswalks at uncontrolled intersections and mid-block points were potential high-accident generators. Mr. Hate presented photographs of the area. Mr. Hale indicated that it was the recommendation of the Traffic Committee that sidewalks be constructed on the east side and west side of Vineland Avenue between Garvey Avenue and Merced Avenue. The motion carried and was so ordered. 00- City Manager Mocalis reviewed his report regarding the withdrawal of the City employees from Social Security and the PERS Agreement formula change. He stated that after pertinent ordinances had been adopted, the City would be on an unmodified 1/50th contract with PERS effective January 1, 1972. City Attorney Flandrick read by title: ORDINANCE NO. 622 AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY COUNCIL AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM COUNCILMAN MC CARON MOVED THAT FURTHER READING OF ORDINANCE NO. 622 BE WAIVED. The motion carried and was so ordered. 00- City Manager Mocalis reviewed his report regarding waiver of bid procedure for a three-wheeled vehicle for the parking enforcement officer. He stated that Council previously approved the officer and the equipment for the downtown area. The necessary equipment is a three-wheeled Cushman motor scooter. The Police Department received price quotations from several Cushman dealers; the low quotation was from Cushman Motor Sales, Inc., 8707 Sorensen Avenue. Santa Fe Springs. Section 2914(c) M.C. provides for waiver of the formal bid procedure, by a 4/5 vote of Council, if the format procedure would be impractical, useless or uneconomical, and since Cushman is the only manufacturer which can provide a vehicle that meets the needs of parking enforcement functions, the City Manager recommended that Council waive the formal bid procedure, and that the low quotation of $1.867 plus 5% sales tax from Cushman Motor Sales. Inc., Santa Fe Springs, for a Cushman police vehicle. Model #898404. be accepted. Councilman McCaron pointed out that when he made the motion to approve the hiring of an enforcement officer, he was under the impression it would be one of the positions paid for by federal funds, and not paid from our General Fund. He stated it was his intention to indicate such by his motion; however, the Minutes did not specifically indicate this. Councilman King stated it had been his understanding also that the City Clerk had indicated that the monies would come from the federally funded program. City Clerk Batkus stated that this position was not one requested under the PEP Program, but had been approved as a Traffic Committee request.
