COUNCILMAN BLEWETT SECONDED. There were no objections. The motion carried and was so ordered. 00- RESOLUTION NO. 72-14 ALLOWING CLAIMS AND DEMANDS AGAINST THE CITY OF BALDWIN PARK COUNCILMAN KING MOVED THAT RESOLUTION NO. 72-14 BE ADOPTED AND THAT FURTHER READING BE WAIVED. The motion carried and was so ordered. 00- City Clerk Balkus administered the oath to those in the audience desiring to be heard during the meeting. 00- 7:30 p.m. having arrived, it was the time and place for a continued public hearing on Short Form Case No. 71-S-76, on the south side of Frazier Street between Kenmore Avenue and Monterey Avenue, for curb and gutter. Cont. from 1/5/72) Proper postings and mailings had been accomplished. Written protests had been received from Mr. L. R. Buckmaster, 13624 Frazier. and Theota Aubel. 13720 Frazier. Acting City Engineer Hale stated this case had been continued to allow the staff time to determine the feasibility of adjusting parcel costs to reflect irregular shaped lots. He stated three alternatives could be considered: 1) to order construction as intended; 2) to delete the property in question from the district; or 3) to partially contribute to the cost of the construction.. City Manager Mocalis stated that the City's policy had not been to participate in the funding of improvement districts in residential areas, and he would recomnend eliminating the third alternative. He stated that since Mr. Buckmaster did indicate the cost of the construction would work a considerable hardship on him, he would recomnend excluding Mr. Buckmaster's property from the district. TESTIMONY WAS GIVEN BY: William Aubel, 459 S. Ford Boulevard. East Los Angeles, stated he was the owner of property at 13720 Frazier Street, which adjoins Mr. Buckmaster's property, and he wished to affirm his written protest, and also the testimony given by his wife at the meeting of January 5, 1972, on the grounds that the cost was too expensive. He stated that the total benefits they had received from this property during the past four years was $1,394, so they were not making any money from the property. In answer to Councilman McCaron's question. Acting City Engineer Hale stated that approximately 50% of the curb and gutter is already installed In this block. Councilman McCaron felt that If 50% was in, we should proceed with the district, as did Councilman King, recalling that Mr. Buckmaster had stated he was in favor of th6 improve- ments but was concerned about Immediate payment, but the payments spread over a two-year period probably would not be quite so much of a hardship. Councilman King also stated that the circulation element must be considered. Acting dity Engineer Hale indicated that the districts being Initiated are the only ones remaining to complete the entire stretch of Frazier Street. Councilman King felt that, from all indications, it would not be such an undue hardship for curb and gutter only, and would be in the best interests of the community; he felt construction should proceed. Councilman Blewett felt the matter should be deferred until it was determined whether or not 50% of the curb and gutter is already in. As there was no one else in the audience desiring to speak either in behalf of or in opposition to 71-S-76, Mayor Gregory declared the public hearing closed. Mayor Gregory directed the Acting City Engineer and the City Attorney to confer regarding the percentage of curb and gutter presently installed, and report to the Council. Councilman Hamilton suggested that Mr. Hale explain to the property owners how much the Improvements would cost them, spread over a period of time, etc. Councilman Blewett felt it should also be pointed out to them that any postponement would be temporary, and the cost of labor and material is consistently rising. 00- It was the time and place fixed for a continued public hearing on CP-171, application for a conditional use permit for an existing service station in accordance with Section 9651 of the Baldwin Park Zoning Code located at 13050 Ramona Boulevard. He stated that stop signs had been placed along the alley at the intersections with various streets, as directed by the Council. TESTIMONY WAS GIVEN BY: Robert Smirl, 1845 Via Palomares, San Dimas, representing Douglas Oil Company, referred to the revised plot plan and stated that two openings in the wall were indicated, plus the depressed area adjoining the openings, Councilman King stated that the plot plan indicates a 3-foot chain link fence with slats. The Planning Commission and the City Council had set standards of a 6-foot block wall, rather than just a view-obscuring fence, and if it were to be view-obscuring, it should be 6 feet in height. He felt we were deviating from the standards set, and were also deviating from the beautification of Ramona Boulevard. He felt the chain link fence would become an eyesore in the long run and would be, in his opinion, a deterrent to further development. Michael Dargus, 13260 E. Francisquito, suggested in-depth study by the Engineering Department of the alley under consideration, since it was sub-standard for a street, to be sure the plan would not become a traffic hazard. He stated that if it does become a traffic hazard, the City would become liable. Mr. Dargus quoted portions of a ruling/ by the State Supreme Court that the State must pay for all injuries caused by highway design which is proved unsafe, and ste.ted that this ruling applies to other public improve- ments built by cities, counties, school districts and other public agencies. He felt the alley was not wide enough, and perhaps consideration should be given to having the property owners dedicate additional footage to widen it in order to make it safer. In answer to Councilman Hamilton's question. Acting City Engineer Hale stated that the fence is to be placed right along the alley line. Councilman Hamilton felt it should be set back in order to alleviate any hazard. Mr. Smirl stated they would have no objection to setting the fence back if Council so desired. As there was no one else in the audience desiring to speak either in behalf of or in opposition to CP-171, Mayor Gregory declared the public hearing closed. Councilman Hamilton stated he would go along with the plan if the fence were set back from the alley. Discussion followed. Councilman King felt that if the chain link fence were required it should be 6 feet in height to conform to C" regulations. NO. 72-19 ADOPTED 00- It was the time and place fixed for a public hearing on SP-21, intent of the Baldwin Park Planning Commission to consider the adoption of a specific alignment or removal from the General Plan of the proposed street iri the area bounded by Monterey Avenue, Baldwin Park Boulevard and Rexwood Avenue. Initiated by the Baldwin Park Planning Commission. Proper publication, postings and mailings had been accomplished. There were no written protests. Planning Director Gordon stated that the General Plan adopted in 1960 proposed many future streets, the purpose of which was to allow the back of large lots to be split and developed, however, the General Plan proposal does not meet the desires of the property owners on Monterey and Rexwood, as most of them do not want the street. He stated that the Planning Commission, after holding a duly noticed public hearing, recommended the deletion of the future street from the General Plan. He further stated that if Council approves deletion of the street, return of cash deposits for lot splits and procedure for vacation of street easements should be considered. TESTIMONY WAS GIVEN BY: Thomas Knight, 13615 Rexwood, stated he had presented a petition to the Planning Commission at the public hearing containing approximately 20 signatures of property owners in favor of deleting the future street. Councilman King asked how this would affect those people who had built with the expectation of a street going in. Mr. Gordon replied that no one had built so that deletion of this future street would do them any harm. and most of the property owners did not want the street. Mr. Gordon stated that many of the property owners would then qualify under the deep lot ordinance and could out a second house on the back of their lot. He stated that at an informal meeting with the property owners held at the Kenmore School, most of them indicated they liked the large lots and did not wish tc develop them with another house, others have had swimming pools installed, etc. He stated that lot splits are likely on Monterey because these lots are much larger than those on Rexwood. Councilman King asked whether the property owners had been informed that if they did build on the rear lot it would be a covenant under one ownership. Planning Director Gordon stated they understood this* Discussion followed regarding the provisions of the deep lot ordinance. Councilman McCaron felt the street should not be deleted; however, a moratorium could be put on any development in this block if this was the desire of the present property owners, but ownership might change, and sometime in the future if there is a change in attitude toward the develop- ment of the balance of the block, this could be changed and we would not be at a disadvantage. He stated that with the increase in taxes, people did not want to pay taxes on excess land. Councilman Blewett did not agree; he stated that many of the people who live there have lived there for many years, and probably have no intention of moving; they had expressed their desires, and he felt Council should consider them favorably. Alfred Tebreault. 13591 Rexwood, stated he had lived there for 20 years, and he still has the same neighbors he had 20 years ago. They are not planning on moving, and they do not want the street. He was in favor of the Planning Commission's recommendation to delete the future street. Mrs. Frances Mendelsohn. 13716 Monterey, asked why the people on Monterey were being punished because the people on Rexwood did not want the street. She stated she has one acre of land, and asked whether there was some way of dividing the lots if the street were deleted. Councilman King explained that if the street were deleted, she could still build on her property, but it would have to remain under one ownership. Discussion followed regarding possible methods of develop- ment on Mrs. Mendelsohn*s property. Planning Director Gordon commented that the majority of the people from Monterey Avenue who attended the two meetings did not want the street. Councilman Hamilton felt that, although the residents do not want the street at this time, they may want it at some future time, as taxes get higher and they want to split their lots. Councilman King felt the street could be deleted so long as no home was built with the expectation of the future street, and with the understanding that if homes are built on these properties, they must be under one ownership and the proper easements must be provided to service the rear properties. Thomas Knight asked what the square footage requirements were for a residence in this area. Mr. Gordon replied 6,000 square feet were necessary to create a new lot. Mr. Knight stated he had 11,017 square feet, with one residence on it, so there was no way he could put two residences on his lot. Marilyn Welch, 13610 Monterey. stated there were lots on Monterey which already had two houses. She stated that the lot next door to her, owned by Mr. Dean Snider, had two houses on it which were rentals, and he had dedicated land to the City. Mrs. Welch stated she was speaking for herself, Mr. Snider, and Mrs. Christ!ansen. 13604 Monterey. She asked if it were determined that Mr. Snider should not have the second home on his lot, would it have to be removed. Planning Director Gordon indicated that neither of the proposals required the removal of anyone's home; all existing lots are recognized. Mrs. Powell, 13605 Rexwood, stated she lives in the rear house on the lot, and also owns 13603 Rexwood. She stated they have a swimming pool, and had dedicated a 20-foot easement at the request of the City. She stated that if the street were to go in, it would require 6-foot block walls, and she did not feet this would do anything for the beautification of Baldwin Park. It would also take away part of her pool decking. She stated she was very much against the street going in. She further stated they had lived there for 22 years, and did not plan to move. Councilman McCaron clarified his stand on the matter, stating he was against deletion of the street only in case there is future development which would be helter- skelter and without any plan for additional development in the area. He felt the wishes of the property owners should be recognized first, but if any development does occur in the area, it should be planned. Mrs. Mitchetl stated their property had a 30-foot easement. and she inquired how long it would take to have this easement removed from the records, in the event they desired to sell the property. City Attorney Flandrick replied that if the Council amended the General Flap and deleted the street, the vacation procedure would take approximately a month. Relating to the previous question as to whether these properties would qualify for the deep lot ordinance, Mr. Gordon quoted the four requirements for a deep lot: 1) at least 10,000 square feet in area; 2) an average depth of 170 feet or more; 3) located in an area for which a Specific Plan for street pattern has been approved; and 4) located in an area with an established street pattern. He stated if the Planning Commission's recommendation were approved, anyone who meets a11 four of these requirements would be able to put a second house at the rear of their property; they must siso be able to provide a 12-foot driveway to the back. Planning Director Gordon stated this had been requested by a citizen planning to build a 21-unit apartment building on Walnut. On December 15, 1971, the Acting City Engineer and the Planning Director met with eight of the eleven property owners; no one wanted the street. The School District was approached about bringing in the street along the north tine of the school, with a negative reaction. Mr. Gordon stated that the Planning Commission recommended deletion of the future street from the General Plan. The future street would benefit four lots at best, and the cost would far outweigh any benefits. TESTIMONY WAS GIVEN BY: Howard Pal en, 4324 Walnut Street, representing Walnut Apart- ments, Ltd.. presented to the City Clerk a petition containing eight names of property owners against the future street. He stated if this street were to go through, it would put his apartments out of business, by eliminating much of their parking area, leaving only thirteen carports for twenty-four units. Bresee, stated he had purchased a large parcel of R-3 land on Walnut Street about three years ago. but was not aware of the future street at that time. He had put a lot of money into developing his land, and then became aware that this future street would affect his property, and would injure him tremendously. Councilman Hamilton stated that after consideration, he was in agreement with Mayor Gregory's feeling and, therefore, had voted against the Ordinance. DISCUSSION 00- Councilman King requested that the City Manager investigate C.M. TO INVESTIGATE an item of major importance to the City. He stated that TURN IN A PUSHER" recently there had been a television show regarding a DRUG PROGRAM program developed in Florida called T.I.P Turn in a Pusher". He felt such a program here would be a tremendous asset if combined with other programs such as Impact Plus Two, Hotline and the Free Clinic. He stated the woman next door was against it, because it would take her property away from her. He stated he was also speaking for the owner of 4305 Merced, who was unable to be present, and she is also in favor of deleting the street, as she had no intentions of building. He indicated he had talked to quite a few people, and no one wanted the street put in. Mrs. Joseph Drendul. 4316 N. Walnut, stated she had gone to all the property owners on Merced to ask whether they were in favor of the street, and they were not. She stated the street would cause a noise problem also. Councilman McCaron stated it appeared R-3 was the develop- ment for this area and, therefore, there would be no reason for the future street. As there was no one else in the audience desiring to speak either in behalf of or in opposition to SP-22, Mayor Gregory declared 1;he public hearing closed. Councilman King agreed that the street would not serve any purpose; however, he was concerned about the ever- encroaching high-density multiple units into the residential areas, and he felt the Planning Commission should define the boundaries of the multiple units; he had not found an apartment building adjacent to or across from a residential area that was compatible. Initiated by the Baldwin Park Planning Commission. Proper publication, postings and mailings had been accomplished. There were no written protests. Planning Director Gordon stated that the General Plan for this area depicts heavy multiple residential as the future land use. There are two structures on the parcel, one having five units, and the other being a one-unit structure, The Planning Comnission recommended rezoning since there is an existing R-3 use of the parcel.
