Proper publication and postings had been accomplished. There were no written protests. City Manager Mocalis stated this proposed ordinance had emanated from discussions among the Council regarding street sweeping and possible more effective control of overnight parking on the City streets. He stated the ordinance provided for those people who had a bona fide need to park their vehicles overnight because of inadequate off-street parking facilities. The Police Department would investigate requests and if it was found that a need did exist, the person would be issued a permit to park on the street overnight, upon payment of a specified annual fee. Mr. Mocalis reviewed other provisions of the proposed ordinance, such as temporary permits for guests, etc. TESTIMONY WAS GIVEN BY: Lenora Woodside, 4537 Walnut Street, asked whether this ordinance was primarily for the cleaning of the streets. Mr. Mocalis replied that this was not the primary purpose of the ordinance; he reiterated that the ordinance emanated from discussions regarding street sweeping, but the sweeping was done in the daytime, on a regular schedule. Mrs. Uoodside commented that she had not noticed the sweeper on her street on any type of schedule, and when it did come, a poor job was done. Mr. Mocalis stated that Council had asked that an investigation be made, and the Public Works Department was making unannounced spot inspections at various locations to insure that the provisions of the contract were being carried out, and the results of the investigation will be reported to the Council. Discussion followed regarding the street sweeping problem, and the pros and cons of contracting the job out or the City purchasing sweepers and doing the job. Bill Jablonski, 3756 Downing, stated he felt the $24 permit fee was too high, considering the taxes, high rent, etc., and he would like to see it cut to about one third of that amount. City Manager Mocalis stated that there were two main purposes for an overnight parking ordinance to encourage people to have and use off-street parking facilities, and to alleviate the policing problem. When there are no cars parked on the streets during the hours when most burglaries occur, the patrol units can check the areas much more easily, and cover more territory. Peqarciinn the permit fee, Mr. Mocalis stated that the $24 was in line with what other cities were charging at the present time, and would net cover the costs involved. He felt it would create a hardship on a number of people, and particularly those who could least afford it, if they had to pay a fee to park on a public street. He felt this ordinance would not produce the desired results, and suggested that it be dropped and another avenue be pursued toward the solution of the street sweeping problem. Councilman King felt the fee was too high, and should be lowered to possibly $5, He agreed that overnight parking on the streets hindered the police operation; however, if a person had a parking permit, it should be mandatory that a decal be placed where it was readily visible to the police while patrolling, so they would know the car belonged there. Councilman Gregory felt that some type of control over parking was necessary, in that many of the complaints were pertaining to people storing" automobiles on the streets for long periods of time. She also felt it important that the policing problem be alleviated if possible, and that the decals on the cars would help along these lines. Councilman Hamilton asked whether night sweeping could be resumed if this ordinance were enacted. Mr. Mocalis stated it could be; the main reason it was discontinued was because of complaints from the citizens that the sweeper would awaken them during the night. Councilman Hamilton pointed out that many of the people parking cars on the street had adequate off-street parking, and there would probably be a very small percentage coming in for permits. He further commented that we paid a con- siderable amount for the sweeping contract, and he felt it would pay the City to purchase a sweeper as soon as financially feasible, and be assured of a good job being done. Councilman Hamilton stated he was in favor of the ordinance; however, he felt further consideration should be given to the fee. Councilman McCaron suggested that a time limit be put on parking, indicating the number of hours allowed, but not specific times. He felt soliciting the cooperation of the citizens would be more effective than enacting an ordinance of this type. He stated that the time limit would provide control over the cars that were stored" on the street, and anything that became a nuisance could be handled under the nuisance ordinance. Councilman Hamilton asked whether there was information as to how this type of ordinance had worked out in cities operating under such an ordinance. Mr. Mocalis stated he had no statistics, but understood that in those cities, the ordinance had proved beneficial from the standpoint of street sweeping and also an improved level of police protection. Mr. Waldo stated that he had lived in San Dimas, and that City had a similar ordinance, which was strictly enforced. He stated that if it became necessary to park in front of your house on any certain night, a phone ca11 to the police giving them the pertinent information regarding the car would suffice. He stated the police worked with the people, and he had never heard any complaints. There were no cars on the streets between 2:00 and 5:00 a.m., which resulted in the streets always being swept. James Q. Gibson, 13268 E. Francisquito, asked about the JAMES Q. GIBSON City's street sweeping schedule, which Mr. Perry explained. 13268 E. FRANCISQUITO Mr. Gibson stated that the procedure in the City of Los Angeles was to post the streets indicating no parking during specifi-- hours on a certain day of the week to provide for street sweeping. He stated the areas were patrolled and citations issued to anyone parking on the street during these hours. Mr. Gibson stated that he felt this procedure worked very well, and he had mentioned it for possible consideration as a procedure for Baldwin Park, rather than the ordinance. Mr. Gibson agreed with Councilman McCaron that a fee should not be charged to park on the street, and also commented that the fee would not insure that the streets would be swept, because there are those who would pay the fee as a penalty, and continue to park on the street. He felt that any kind of a fee for parking would be discriminatory. Mr. Perry explained that because street sweeping was con- tracted, it was difficult to maintain too much control over the contractor's schedule as it would relate to postino streets for a 2-hr. no parking restriction. Mr. Gibson felt that for the amount the contractor was paid, he should be able to supply the City with a definite schedule. Mr. Mocatis reiterated that the intent of the ordinance was not to completely improve the street sweeping within the City, but to try to alleviate the on-street parking for periods in excess of 24 hours, as we11 as alleviate the policing problem. The fee was suggested by the staff, based upon what other cities are charging. He stated the $24 fee would not cover the cost of making the investigation and enforcing the ordinance. He stated the ordinance would not discriminate against oeople who did not have off-street parking available. He felt that the street sweeping operation should be considered separately from the parking problems. Councilman King questioned the possible safety factor involved. Chief of Police Adams stated that from the police point of view, every car that could be removed from the street would be a tremendous aid to them in their patrol operations. Chief Adams replied that if the property could hold, within its limits, the vehicles without their protruding over the sidewalk area, this constituted ample parking. If there was an additional vehicle not provided for within these limits, a permit could be obtained. He pointed out, however, that if a permit were obtained, it would be for a specific vehicle and alternate vehicles could not be substituted under that permit. Mayor Blewett commented that each case would have to be considered individually. As there was no one else in the audience desiring to speak either in behalf of or in opposition to Ordinance No. 644, Mayor Blewett declared the public hearing closed. Mayor Btewett directed the City Manager to inform Parks Director Lucas that Mr. Silva would be in touch with him regarding use of the Auditorium, and Mr. Silva stated this would be agreeable. 00- Sam Sandoval, 4561 Monterey, President of the Baldwin Park Sports Boosters, stated that the parents of the children who participate in sports were concerned because only half of their field was usable because of damage caused by gophers. He stated it was rumored that the City had plans for either fixing the field, or was going to do something along these lines, and he asked what the City had planned to do. Councilman King stated that plans for an athletic field at Baldwin Park High School were being formulated between the City and the School District. The field will consist of two dia monds, badminton and basketball facilities, etc. He commented he understood there were plans for another field at Sierra Vista High School. Councilman King stated there was also a large area near the Santa Fe Dam where another field could possibly be constructed, in conjunction with the City of Irwindate, and also mentioned the proposed Wilderness Park. He suggested that Mr. Sandoval contact Mr. Lucas, who has maps and plans of the proposed sports areas, for more complete details. He commented that the City did not have a full-time license inspector. He reiterated that Mr. Sandoval*s complaint had been acted upon, and a report had been presented to the Council. Mr. Mocalis pointed out that a person could not be cited unless they were caught in the process of making illegal deliveries, and at the present time there was no staff available to do this. Francisquito, inquired what pro- gress had been made toward abating the nuisance caused by noise from the Irwindale Raceway. City Manager Mocalis reviewed previous Council action, indicating the possible alternatives available. He stated that the Mayors and City Managers of Baldwin Park and Irwindale had met twice, and the operator of the Raceway was present at the second meeting, The operator had agreed to perform various modifications to reduce the noise level emanating from the raceway, and the Irwindale Council has been unwilling to modify his conditional use permit unless he does not complete the work as agreed. Mr. Mocalis felt the operator must be allowed time to make the modifications; however, if the noise level is not substantially reduced, he stated our representatives would request the Irwindale City Council to modify or revoke the conditional use permit and, if not, would consider taking the matter to the District Attorney or entering into a civil suit. Mr. Gibson asked whether a time limit had been set. Mayor Blewett stated the operator had agreed to hire an independent firm, at his own expense, to make sound readings available to the City, and he felt the work would be com- pleted within eight weeks. Mr. Gibson stated that the members of the Improvement Association had been interested in the progress made on the matter and, in view of the action that has been taken, he felt the Association would await the outcome before pursuing the matter further. File & Associates for the annual audit of the accounts of the City. He stated that the only change from previous agreements was that the maximum contract cost had been raised from $3,000 to $4,000. He stated the firm had been employed by the City for several years, and the Finance Director was well pleased with their work. He recommended that the Council authorize the agreement. Discussion followed regarding the length of time the same auditor should be employed. Mayor Btewett stated that at League of California Cities conferences, it had been recommended that the same auditor not be used year after year, and he felt five years was a reasonable maximum. Mrs. Duncan stated that Mr. File's audit far exceeded the scope of work outlined in the agreement, and that other cities paid much more for the amount of work we were receiving. She further commented that his audits were readily accepted by State offices. Mayor Blewett agreed that Mr. File's company was excellent; however, he felt it was good policy to change auditors every so often. Mr. Perry explained that cities have the option of applying for and administering their own contracts for these projects, or accepting the County's offer to receive 50% of their allocation in Aid to Cities monies. He stated that Baldwin Park's apportionment in the form of Aid to Cities money would be $19,384. Mr. Perry recommended that the County be requested to allocate the City*s Urban Fund apportionment in the form of Aid to Cities money until such time as it becomes economically and administratively feasible for the City to administer such a program. Mr. Nuzzo, the present owner of the property, has now applied for a building permit; therefore, the matter has been brought before Council at this time. Mr. Nuzzo has agreed to honor the commitment made by Mr. E1ko to pay for one half the cost of reconstruction of the alley. Mr. Perry recommended that if the area is reconstructed it not be extended all the way to Dalewood, but only the section running parallel to Dalewood Street, as this would provide ingress and egress to the development to the south. Mr. Perry felt that sharing the cost of reconstruction of the alley on a 50-50 basis would be an equitable solution. Edwin Eiko, 13057 Bess Avenue, stated that at the time he appeared before Council on the zone change case, he had agreed to pay for half the cost of reconstruction. She recommended that the permit be approved and fees be waived. Discussion followed regarding sales being held independently, rather than 1n conjunction with the Chamber of Commerce's program. Mr. Waldo indicated they had experienced difficulty in obtaining the interest and cooperation of the merchants as far as city-wide sales; the shopping centers usually pay a certain amount of their monthly rent toward promotion, the large chain stores are independent, and the small stores could not afford it. COUNCILMAN HAMILTON MOVED THAT THE TEMPORARY USE PERMIT FOR THE GOODYEAR STORE BE APPROVED AND THAT FEES BE WAIVED. COUNCILMAN KING SECONDED. There were no objections. The motion carried and was so ordered. 00- City Clerk Balkus presented a request for a Temporary Use Permit from a Christian Youth Group for use of Morgan Park for a concert on July 23 from 3:00 to 6:00 p.m. She stated the Police Department had made a check of the organization, and Mr. Lucas knew members of the group; there was no direct opposition to the request. COUNCILMAN GREGORY MOVED THAT THE TEMPORARY USE PERMIT FOR THE CHRISTIAN YOUTH GROUP BE APPROVED AND THAT FEES BE WAIVED. COUNCILMAN HAMILTON SECONDED. There were no objections. The motion carried and was so ordered. 00- City Clerk Balkus presented a request for a Temporary Use Permit from the Chamber of Commerce for a sidewalk sale at Shop N Town from July 20-23, 1972. COUNCILMAN GREGORY MOVED THAT THE TEMPORARY USE PERMIT FOR A SIDEWALK SALE AT SHOP N TOWN BE APPROVED AND THAT FEES BE WAIVED. COUNCILMAN HAMILTON SECONDED. There were no objections. The motion carried and was so ordered. 00- City Manager Mocalis stated that on July 3, 1972 bids were opened for installation of traffic signals at the intersec- tions of Maine and Los Angeles and Maine and Olive. The cost of the improvements will be paid by federal TOPICS money and Gas Tax funds. Mr. Mocalis recommended that Sherwin Electric Service, 3347 San Femando Road, Los Angeles, be awarded the contract in accordance with their low bid of $50,954, subject to the approval of the Federal Highway Administration. In answer to Councilman McCaron, Mr. Perry stated that approximately 72% of the cost would be paid by TOPICS funds and the remainder from Gas Tax funds.
