Roll Call: Present: COUNCILMEN GREGORY, HAMILTON, KING AND MAYOR BLEWETT Absent: COUNCILMAN MC CARON ROLL CALL Also Present: Also Absent: CITY MANAGER MOCALIS, DIRECTOR OF PUBLIC WORKS PERRY, CITY TREASURER CALE AND CITY CLERK BALKUS CITY ATTORNEY FLANDRICK, PLANNING DIRECTOR GORDON, FINANCE DIRECTOR DUNCAN AND CHIEF OF POLICE ADAMS 00- City Clerk Balkus presented a request for a Temporary Use Permit from the Baldwin Park Chamber of Commerce for a sidewalk sale at Shop N' Town on August 31. September 1, 2, 3 and 4, 1972. She recommended approval and waiver of fees. COUNCILMAN GREGORY MOVED THAT THE TEMPORARY USE PERMIT FOR THE SHOP N' TOWN SIDEWALK SALE BE APPROVED AND THAT FEES BE WAIVED. COUNCILMAN HAMILTON SECONDED. There were no objections. The motion carried and was so ordered. 00- City Manager Mocalis stated that 3 bids for one 4 door sedan had been received and opened on August 25, 1972. The bid for the Ford Torino in the amount of $3,756.00 was not acceptable. The bid for a Plymouth Satellite was $3.462.54 and for the Malibu Chevelle $3.747.17. Mr. Mocatis stated that both were good bids. however, for the price differential of $217.00 he recommended purchase of the Chevelle as the City would benefit from a higher trade in value. The blue book showed less depreciation on a Dodge over a two year period. Mayor Blewett stated that cars were not traded every 2 years, that the majority of the city cars were Plymouth; that 2 types of cars would require an additional service contract and this could create more of a problem. Mr. Mocalis stated Mr. Perry did not feel that the difference between the two cars was that great but he felt the city would be money ahead on the Chevrolet. Mr. Perry explained that the Chevrolet depreciates less rapidly that the Plymouth up to 4 or 5 years, however, the difference would diminish in 8 to 10 years. The City does not maintain the Police cars and except for emergencies the Chevrolets would be maintained in the City shop. Councilman King wondered which was the most economical to maintain; he preferred standardization, however, if depreciation was less on the Chevrolet this should be considered as the bids were dose. However, he stated he would agree to the Chevrolet as long as the City does not maintain 2 service contracts. COUNCILMAN GREGORY MOVED THAT THE BID OF LEO HOFFMAN CHEVROLET, LA PUENTE. IN THE AMOUNT OF $3,747.17 BE ACCEPTED AS THE LOWEST ACCEPTABLE BID. COUNCILMAN KING SECONDED. There were no objections. McCaron Absent) The motion carried and was so ordered. 00- City Manager Mocalis stated the City had advertised for a Director of Commercial and Industrial Development and that the 4 top candidates had been interviewed orally on August 25th by Ed Powell. City Manager of Placentia, Dr. Alien Coleman, Englewood and Jerry Hathaway of the Whittier Chamber of Commerce. Their recommendation for the position was James Sexton. His background includes: Executive Director, Redevelopment Agency of the City of San Buenaventura; Director of Real Estate, Redevelopment Agency of the City of Redondo Beach and Department of Urban Renewal, Columbus, Ohio. Mr. Mocalis stated he felt Mr. Sexton could do a good job for Baldwin Park. He stated Mr. Sexton could report on September 18th or sooner and he requested that Council ratify his employment and authorize hiring him for the position. COUNCILMAN GREGORY MOVED THAT MR. MOCALIS BE AUTHORIZED TO HIRE MR. JAMES SEXTON AS DIRECTOR OF COMMERCIAL AND INDUSTRIAL DEVELOPMENT. COUNCILMAN HAMILTON SECONDED. There were no objections. The meeting was originally requested by Commission members. He stated there would be no structured format, but just an open discussion for all council and commission members. Mayor Blewett stated he had definite views as to what he felt; that treatment of people coming before the Council or the Commission should be expeditious and decisions should be made on information available and not put off. Planning Commission decisions should be made without thought of What would Council do?". Action should be on what is good for the growth and development of Baldwin Park; that Commercial areas should be preserved and developed; that back of deep lots should be developed to eliminate nuisance problems. Commissioner Yanez stated there had been inquiries as to what would happen to the proposed hospital property on North Maine. Mayor Blewett stated the first owner got caught in a change of State law. The land does not qualify for a hospital and would have to come before Comprehensive Health Planning. They are still trying and the City has written several letters requesting approval, as this would be good for the Comnunity. Commissioner Yanez asked what happened to the restaurant that was to go in adjacent to the service station at Ramona and 605 freeway. The developer had told the commission he would keep his word. Mayor Blewett stated that he personally had voted against the service station as the City Attorney had stated that the City could not stipulate conditions on a zone change. Councilman Gregory stated that the developer had said he would try to build as soon as possible. Mayor Blewett stated the developer, Mr. Perlin, is reputable, however, the dead land along the railroad right-of-wa^y does not help. Planning Director Gordon stated that the developer had tried to interest 2 restaurant chains but they were not interested. Possibly when the railroad land develops the restaurant will come into being. There is a lack of activity in the area. Councilman King stated his greatest concern is R-3 which is encroaching into R-l and some of this should be rolled back in areas where it is not compatible. He was also concerned with Housing Urban Development 236. This should be controlled and not let the city become over saturated. He stated C up can be controlled but excessive R-3 cannot. He cited areas approved near Sierra Vista High School and one near the freeway which he felt were good. Planning Director Gordon stated the one on Torch was a Variance. He did not know the status of the Walnut development. H.R.D. is going more to 20 to 40 unit development for people with $4,000.00 to $8,000.00 incomes. Councilman King stated apartments should feed Commercial areas but caution should be excercised in letting the R-3 encroach too far into R-1 areas. Mayor Blewett suggested that Baldwin Park concentrate more on conventional financing rather than H.U.D. development. He suggested that R-3 standards be reevaluated to determine whether the standards deter building. Surrounding cities have beautiful apartments and they are money makers from the point of sales tax, etc. He mentioned that school enrollment has dropped and possibly school areas should be looked at for recreation areas. Councilman King stated that if school enrollment continues to drop that some of the school property should go back on the tax rolls. Councilman Hamilton suggested that some C-1 zoning should be rolled back to its present use for instance. Pacific Avenue over to the Wash, past Vineland. This was zoned C-1 about 12 years ago and it is stilt residential. These are shallow lots. Commissioner Wittig stated the Master Plan is in dire need of revision. This is a tool that has been disregarded. The study of the Northeast section is a step in the right, direction, however, when properties are rolled back there is opposition from people who do not want property degraded financially. As to why this city cannot get private financing it is because the loan capabilities in the Community are not comparable with surrounding cities and this has to do with the land that is available; the size of lots. The code is restrictive, but good which insures good building. We do not want to lower our standards. Until financing is available neither we nor surrounding communities will see apartments. The apartments being built are where someone owns the land and has his own money for development. Mayor Blewett stated money is plentiful if it is the right area. Commissioner Wittig stated that the attitude of the Comnunity is a negative factor. Whenever something new is proposed there is criticism, but not constructive criticism. Many of these people are not informed and they do not consider what is best for the City as a whole rather than their own personal interest. He wished that people would be more understanding. There is a lack of consistency in the Community. Ordinances are disregarded. He referred to a 16 lot parcel. An ordinance adopted 6 years ago was adopted for the betterment of the Community and if it is not acceptable now then it should be changed so that it is suitable for the entire Community not for exceptions. He stated that 16 parcels is not an exception or a hardship and that the code should be changed. He does not think a Conditional Use Permit is the correct method to use as a developer wants to know exactly what he can do in black and white and for what purpose. Mayor Blewett stated that he noticed in reviewing the minutes of the last Planning Commission meeting there was a vote taken on an exception for 2 pieces of property 52" and 54" lots were granted. If you are not going to make exceptions you shouldn't make any exceptions. That was all the land that was there and this was a hardship. That he agreed there should be no exceptions. Mr. Wittig stated his main concern was consistency". Mayor Blewett questioned comparing lots created in the 1920's and 1930's with ones created in the 1970's. This made it hard to develop consistently. Conmissioner Wittig stated the code should then be rewritten for the 1970's. Mayor Blewett stated he would not object to a change in the code but he would like to see flexibility in the interpretation of the code. Some of the finest houses in the city are on 50 ft. lots. Commissioner Wittig stated that the code should be fair for all people without special exceptions. The code should fit the times so all would meet the same standards. He was not opposed to the 16 lots, but to the way the 16 lots were created. He understood there were always exceptions. He stated standards for different zoning was soon to be considered. He urged the Council to vote their convictions and then stick with them and if a case comes up where the Planning Comnission were to override the Councils convictions he would like to see the Council state, the reasons for the code and the purpose of adopting the code were, such and such" and then hold the case over for further discussion so everyone could voice their opinion and be satisfied. Councilman Hamilton stated he understood that what Commissioner Wittig was saying was, that if an area is alreacfy established with 50' lots, the man has no alternative and should be granted a variance to.build as the code calls for 60 feet. He cannot be deprived of the use and such exceptions have been granted. But, when you have a large vacant area to be developed with a group of houses then the land should be developed in accordance with our code standards. Some lots might be 70 or 80 feet. We have to grant variances on single 50 foot lots, but not on large new vacant development. Mayor Blewett stated a developer first askes what can I sell the house for and what am I paying for the land. Then they decide what kind of house to build. If you demand a $27,000.00 house in a $20,000.00 area, you won't get it. To make money on his investment on a larger lot the developer will build a cheaper house. Mayor Blewett stated, he personally, would like to see a better house on a smaller lot. Mr. Wittig agreed, but stated that when a variance comes before the Planning Commission they have to consider whether this was a hardship and a subdivision standard takes on a different outlook. To be fair to all people, change the code. Mr. Gordon stated that El Monte has 55 foot lots but the majority of the cities require 60 feet. People like large lots and in cities to the east they are going to 70 foot lots. Mayor Blewett felt it would discourage developers if they are required to build a $27,000.00 house in a $20,000.00 area. They won't do it. Mr. Wittig stated that there are zone changes coming up in the Northeast area and he suggested this be taken area by area, make a decision and stabilize the area and then the R-1 people will have an incentive to fix up their homes. The people who live on mixed use wi11 know that they will have to relocate and this wi11 clean up the area. He again stressed consistency". He stated we must create a better image for the City. Mayor Blewett stated you shouldn't be consistent to the point of being dogmatic. Councilman McCaron stated two different things were being argued; Market Value and Development. If neither one can be attained then the code should be changed. He felt that when the code was changed to 60 foot lots that no thought was given to the land available. To upgrade the City you need larger lots and homes. But if you can't se11 them then we should get in step with the times. The small commercial acres create frontage problems also the lot depths. Expediency is what is needed to develop the City so requirements will be the same and a builder will know what is required. Set standards for the development we want and for continued development. He cited the railroad property. The only choice they had was R-3. without having to buy the property. The wave of protests from surrounding property owners, who thought that apartments would go on Ramona Blvd. on property that belongs to them, made them back off from developing the property. Now they are suggesting the City buy the property and maintain it as a park. We can get federal aid to buy it but not for maintenance. If it becomes serious enough it wi11 have to be put to a vote of the people and if all facts are presented they won't accept it. Councilman King felt that reducing frontages so lots would se11 would be for the benefit of the developer. Baldwin Park took second best for years and if people buy a 50 foot lot and familys increase they find it necessary to expand then they are encroaching and need to apply for a variance. He would like to see the standards upheld on lot sizes. Although building may be in a little stump, what building does come in will enhance the area. Commissioner Wittig asked where Councilman King would make exceptions on lot sizes. Councilman King and Councilman Gregory stated that exceptions should only be made on hardship cases where an owner only has, say 104' lot. Councilman King said an exception should not be made for a large group of houses. Comnissioner Larson stated most people purchase a $25,000.00 home as that is what they can afford, although he has some $30,000.00 ones. People with the money do not want to buy in Baldwin Park which has an image of a working class city. He, personally, thinks Baldwin Park is best as he lives here. Houses in Baldwin Park are selling tike mad, but you have to consider the financial aspect as you have to build houses compatible with the area or they won't sell. Councilman King stated standards should not be lowered; that a variance should be for dire hardship only. Council does not receive the same testimony that the Commission does. This would prolong some cases but it would strengthen the Commissions ability to be more forceful. Cornnissioner Larson felt Council should make its' decision and send the case back to the Commission. Councilman Hamilton stated he felt that the evidence presented to the Council should be the same as is presented to the Commission. Mr. Gordon stated this would require a change in the code. As the hearing before Council is an entirely new hearing. When they are turned down before the Commission they realize they must prepare a better case and that's what they do. Councilman McCaron stated that on R-1 lots 600 feet across and 300 feet deep an interior street is possible. To get into the rear an entrance street is necessary which the city either has to pay for or the developer has to allow for. Where 60 foot lots are required there wilt be two comer lots 65 feet wide 4 lots). 50 foot lots would create 5 lots. Sidewalk would be 55 feet, 10 feet each lot. There would be 1 interior lot. The street to be developed requires paving, sewers, etc., which brings up the price of the lot. Mayor Blewett stated the cost is $2,000.00. Councilman McCaron stated the developer should not be asked to put in the interior street. The City should pay a portion of the cost. He stated that there are some nice new homes built on 45 foot lots on Frazier near the Freeway. More air space is desirable but economic conditions should be considered. Mayor Blewett stated he would like to see the Commission consider all the standards, in addition to lot standards, In all zones. Conditions have changed. Perhaps people would like zones changed. Commissioner McCord stated it was easier to rezone C-1 property than R-3. Discussion followed that strip zoning was the problem. Councilman McCaron stated that on North Maine, when the Master plan was adopted, an effort was made to rezone but there was considerable objection. Zoning should be consistent and not patchy, no mixed uses. You shouldn't rezone property that is not ready to be zoned. He stated in the North end of town development is taking place and gradually changing, but the only way to properly change all the area would be thru C.R.A. Commissioner Yanez asked if C.R.A. would be reactivated. Councilman McCaron stated that use of C.R.A. would require a definite program, outlining boundries of areas and a full explanation so everyone would know what to expect before anything is started. Commissioner Larson requested clarification of the parking ordinance. He also questioned not being able to park on the lawn. The new ordinance will allow parking on the street where off street parking is not available. A permit must be applied for. The fee has not yet been set. Authorized cars will carry a sticker on the left hand bumper. Councilman Gregory stated that in Los Angeles when this law was passed many people had cleaned out garages and rented them. She asked what is being done for senior citizens for adequate housing. They are on fixed incomes and are being taxed out of their homes. Many of these people have no transportation. Mr. Gordon stated there is a senior citizens property tax for home owners over 62 years of age. Thru the State Franchise Board they can get approximately 90% of their tax refunded. Commissioner Larson stated there was the 235 program for purchasing on fixed incomes 7 to 8 thousand dollars a year. Discussion followed regarding various types of housing programs for the elderly. Councilman Gregory suggested that the Planning Commission investigate the programs available. Mayor Blewett stated there is a 235 housing facility at Maine and Merced, however, this is not adequate for senior citizens. This city should support the 236 apartment program in the same ratio as other cities so each city assumes their share. Rentals are going up in Baldwin Park and senior citizens cannot afford them. He and Councilman Gregory suggested that the Planning Commission investigate the possibilities. Councilman McCaron stated the curb, gutter and sidewalk program should be checked. The city should help the elderly in making application for senior citizen assistance. He suggested that the remaining areas be taken as one big project as they are the difficult ones. Many people are being hurt severely. Every thing should be checked before proceeding with the remainder. Mr. Perry stated that In about a month he would have a report on curb and gutter and a possible suggested procedure to make the improvements more acceptable to the owners. Commissioner Moreno stated that in reference to the parking ordinance, this would require cleaning out garages, etc. and hauling to the dump and this would create a problem. The City of Los Angeles had become involved and removed all the trash and he would like to see Baldwin Park become involved with the rubbish disposal company and help remove the debris. Discussion followed regarding a Cleanup Week" wherein the City would assume part of the costs. Mayor Blewett asked if Councilman King and Councilman McCaron and Commissioners Eiko Moreno and Yanez would form a committee, working with the Chamber of Commerce, to work out a program for the immediate disposal of trash and the feasibility of a workable yearly pickup. Further discussion followed regarding adequate notification to the residents and that having a yearly pickup was not workable as some people abused the privilege. Commissioner Moreno stated many of them were on the streets. Mayor Blewett requested that Mr. Mocalis direct that the Police Department issue citations to trucks parked on the streets on weekends. City Manager Mocalis recommeded that no overnight parking citations be issued until after September 17th» when the new ordinance becomes effective. 00- Mayor Blewett explained that at the beginning of the meeting Councilman McCaron was not in attendance) the Council had approved the hiring of a new Director of Commercial and Industrial Development. He asked Mr. Mocalis to elaborate. City Manager Mocalis stated the City had advertised for a Director of Commercial and Industrial Development and that the 4 top candidates had been interviewed orally on August 25th by Ed Powell, City Manager of Placentia, Dr. Alien Coleman, Engtewood and Jerry Hathaway of the Whittier Chamber of Commerce. Their recommendation for the position was James Sexton. His background includes: Executive^ Director, Redevelopment Agency of the City of San Buenaventura; Director of Real Estate, Redevelopment Agency of the City of Redondo Beach and Department of Urban Renewal, Columbus, Ohio. Mr. Mocalis said Mr. Sexton was impressed by the challenge the City had to offer and felt it was a tremendous opportunity. He felt Mr. Sexton would do fine things for the City. 00- Commissioner Moreno commented on the fine cooperation of the people regarding the public hearing on M-l development in the Northeast part of the City. Councilman McCaron stated that if people understand how an ordinance is going to affect them now and in the future there might be more resistance. When the ordinance is enforced then there will be resistance. There should be more communication with the people. Commissioner Moreno complimented Mr. Gordon on the foundation he had laid by having block meetings in the area. When people found this would not affect them they did not care. Mr. Gordon stated more complaints are received regarding lack of code enforcement than anything else. Commissioner McCord asked what it would cost the City to send out a brochure to the people in the area stating what, when, where and how the change would affect them, also give the reasons for the change. Mayor Blewett requested that Mr. Mocalis along with Mr. Gordon make a recommendation as to how to better inform the people in a particular area. Mr. Gordon explained the staff was not sufficient to make more mailings as it is time consuming to look up names from the assessors rolls. Councilman McCaron asked if there was a definite goal after the study of the Northeast section or any other section is completed. Mr. Gordon stated the Planning Commission would be recommending a 3 year program for the Northeast area» some curb, gutter and sidewalk construction, code enforce- ment, zoning code. First there will be hearings on the plan and then individual hearings on increments to implement the plan. Councilman King stated that a study had been made of the area and a paper plan street circulation, zoning, etc. had been presented by the Planning Commission to the Council 4 years ago and it had been turned down. Councilman McCaron asked if the area is any more ready for change now than if was 4 years ago. Mr. Gordon stated he felt the people would be susceptible. Commissioner Eiko suggested that side yards should be studied such as zero on one side and 10 feet on the other side. Discussion followed re side yards, square footage, garage doors, parking. Commissioner Wittig stated that there is a provision in the code that alternate plot plans can be submitted. Mayor Blewett questioned whether our codes are realistic. City Manager Mocatis stated that throughout the valley Baldwin Park as a reputation of getting things accomplished. This City does more work than many cities in the valley and is moving ahead. Many cities ask for the nuisance abatement ordinance. Baldwin Park has surpassed El Monte in income and our rise is more rapid than other cities in the area. Also this is the 5th City in which he has worked and it has been his observation that the Council and Planning Commission has worked together exceedingly well. He stated a difference of opinion is natural and he asked them not to become discouraged as the two groups are working together well. Commissioner Wittig stated he felt the present commission had no criticism or arguments with the decisions of the Council, however, his personal concern is consistency. He knew there would be some drastic changes coming up and he hoped Council would look at them from the viewpoint that when a case is considered that they would say, I can back this up to the fullest extent and the exceptions to it are minor there wilt always be exceptions but the basic principle has to stay. If you feet that the Planning Commission passes something against your principles. because that was your conviction and you helped to put the ordinance in, then take it off the shelf, bring it before Council and vote on it and make a decision. However, he does not like to see something shelved. Stick with your opinion and voice it again and again. The emphasis of the meeting was not to make the Planning Commission think like the Council. The thinking of 12 spirits Is better than the thinking of 1 or 2. The Council wants the Planning Commission to do their thinking and if they don't like something he suggested they come to the Council and talk to them about It. Councilman Hamilton stated he had lived here practically all his adult life and had seen change in the last 15 years. This was county It was laid out so we did not have open land for easy development like some cities, any activity has opposition. We have improved and there has been criticism but these people don't come up with a constructive solution. We get too much criticism and not enough help. 00- AT 10:10 P.M.
