Councilman Gregory stated that there have been some very nice happenings within the ranks of the employees and that she would like to comment on one in particular. The Senior Engineering Aide is not only fairly new to the City about three years) but also new to the United States. He was born in Czechoslavakia and has experienced some very nice times and some very difficult times due to political reasons. He came to Baldwin Park and has shown what he can do for us. His efforts have been much appreciated and he has shown his appreciation by recently becoming a United States citizen. As a way of saying Welcome" to Milan Klega she asked that he lead the Pledge of Allegiance to the Flag of the United States. Milan Klega led the salute to the flag. The invocation was given by Rev. Regular Meeting of the Baldwin Park City Council RESOLUTION NO. 72-124 ALLOWING CLAIMS AND DEMANDS AGAINST THE CITY OF BALDWIN PARK COUNCILMAN HAMILTON MOVED THAT RESOLUTION NO. 72-124 BE ADOPTED AND THAT FURTHER READING BE WAIVED. COUNCILMAN GREGORY SECONDED. Roil Call. There were no objections. The motion carried and was so ordered. 00- City Clerk Batkus administered the Oath to those in the audience desiring to be heard during the meeting. 00- 7:30 p.m. having arrived, it was the time and place fixed for a public hearing on the Proposed City Charter. Acting City Manager Balkus stated she had been requested to make the following comment: The proposed Charter has been under study for a year. Council has had a study group which has thoroughly studied the proposed Charter. It is the feeling and recommendation of the staff that the Council should table the Charter until the staff up-dates and makes a recapitulation of the past actions. When the staff has finished their study, the staff wilt bring this item back on the Agenda." COUNCILMAN GREGORY MOVED THAT THE CHARTER ISSUE BE TABLED. Councilman Hamilton questioned whether the Charter would be tabled to a set time. COUNCILMAN HAMILTON SECONDED THE MOTION PROVIDED THAT THE CHARTER BE BROUGHT BACK ON THE AGENDA AT THE NEXT MEETING. Councilman McCaron asked what aspects of the Charter would be updated. Acting City Manager Balkus stated she did not know what specific areas were referred to, but that she assumed that the objective was to go back over the minutes and see what matters were discussed by Council and what changes were made, and make sure the changes were made, and the Charter given to the Council in an up-dated form. Councilman McCaron requested that the report be given at the next regular Council meeting so that there would not be any more delay than necessary. He stated that action should be taken, unless there is something drastically wrong with the charter or objections to the way it is written at the present time. He said it was time to put this subject before the People. Acting City Manager Balkus stated that a report would be ready for presentation at the next meeting. Roll call on the motion. RESOLUTION NO. 72-123 CONFIRMING CERTAIN REPORTS OF THE SUPERINTENDENT OF STREETS 71-S-69, 71-S-70, 71-S-71 AND 71-S-72) Director of Public Works Perry stated that Section 1 f) should read that no" protests were filed. COUNCILMAN HAMILTON MOVED THAT RESOLUTION NO. 72-123 BE ADOPTED AND FURTHER READING BE WAIVED. COUNCILMAN GREGORY SECONDED. There were no objections. The motion carried and was so ordered. 00- It was the time and place fixed for a public hearing on AGP-23 a proposed amendment to the Comprehensive General Plan in regards to the deletion of the extension of Olive Street between Rivergrade Road and Center Street. Initiated by the Baldwin Park Planning Commission. Proper publication, postings and mailings had been accomplished. There were no written protests. Assistant Planning Director Lenorovitz reviewed the report in the Agenda packet and indicated the area on the wall map. He stated that the Planning Commission recommended the removal of the street from the General Plan. As there was no one in the audience desiring to speak either in behalf of or in opposition to AGP-23, Mayor pro tern King declared the public hearing dosed. Mayor pro tem King stated that the boundry of Irwindale was involved at the corner of Center Street and he questioned if there was sufficient property in Baldwin Park at that corner to design the street curve without encroaching into Irwindale at that point. Mr. Lenorovitz stated that there appeared to be sufficient right-of-way within Baldwin Park. Councilman Gregory stated that the minutes indicated testimony in favor of the deletion. She recalled previous discussion regarding the opening of Olive Street to help develop properties in the area and she was surprised as she felt that access to Rivergrade Road would be helpful rather than a hinderance. He questioned whether Merced would go through to open up the area. Mr. Lenorovitz stated the minutes reflected that public testimony was given by the renter of the property in the area, an owner of property near the area, and an interested citizen. He felt that the lack of concern was due to the fact that there would be no land locked parcels. He stated he would have to research the files to adequately comment on the opening of Merced to Arrow Highway. Councilman McCaron stated that at first he objected to the deletion of Olive, however, as it is one usage and one concern at the present time there is no harm in closing the street, but if the property is ever redeveloped and broken up into parcels where there was a need for the access then it could automatically be required. The motion carried and was so ordered. 00- Under Oral Communications, Mrs. Myrtle Asquith, 13138 East Judith Street, stated she had a news item from the Los Angeles Times, Sunday, September 10, 1972, regarding an elderly lady's property in the city. She read the article which referred to methods used by all California cities in forming assessment districts. The article concerned Mrs. Bertha Stoskus, 4111 Walnut Street. Copy of news item in official files.) Mrs. Asquith stated she worked with Senior Citizens who are not affluent and that she thought this City Council and all City Councils should see that Senior Citizens should be allowed to live out their time on their own property. She understood that the City had foreclosed on this particular piece of property and she requested that Council give this problem and similar problems serious consideration as these people live on limited incomes and should not be penalized. City Attorney Flandrick stated that the City did not foreclose, that it was a private bond holder who had foreclosed on the property. Councilman McCaron stated that the article should be clarified as there were many erroneous statements. He requested that the City Attorney itemize and explain the various statements and present it to Mrs. Asquith and the City Council at the next meeting. Continued) RES. He stated it was sometimes difficult to make a decision where a project is of benefit to 10 people and one it would not benefit. The Council tries to be as fair and as lenient as possible. 00- Mr. Richard Wallingford. 14342 East Ramona Boulevard, requested that parallel parking be allowed on the street side of Ramona as parking is a problem, especially on Fridays. Director of Public Works Perry stated this problem has been under consideration for some time and that a few months ago a survey of the downtown area was made asking the business owners opinion as to whether they would or would not like additional parking. The majority indicated they did not wish the parallel parking along the street side of Ramona Boulevard. Councilman Hamilton stated that the original plan indicated the parallel parking and the ingress and egress created problems. Three merchants had requested the parallel parking and he felt it would be beneficial to the merchants. Mayor pro tern King requested that Mr. Perry study the area and meet with the people and report to Council. Mr. Perry stated that a complete survey of the entire area of Ramona Boulevard would be made and a report would be made to council as soon as possible. 00- Emmit Waldo, President of the Chamber of Commerce. stated that the City's entry at the Fair had won first prize for the third year in a row. The exhibit features the architectural theme and displays renderings of both new banks, two oil paintings of Baldwin Park in the past, and the Freedom Tree which will be dedicated to Sgt. Steve Hastings of Baldwin Park. Polling the people as they viewed the Fair, they stated that the Baldwin Park exhibit is by far the finest. The Council commended and thanked Mr. Lucas and a11 who worked on the exhibit. 00- City Clerk Batkus presented a request for waiver of fees for an entertainment background check. The request concerns a Teen Age Dance to be held on September 30, 1972 in the Morgan Park recreation building, submitted by Paul Tapia. A portion of the proceeds to go to Orthopedic Hospital, Los Angeles. She stated that the Ordinance had been prepared at the request of the Mayor, and had been reviewed by the Recreation and Parks Commission. The major points of change embodied in the proposed Ordinance are as follows: 1) The Commission is increased from five 5) members to seven 7) members. The two 2) additional positions are for youth members under nineteen years of age during their terms of office. 2) The terms of office are changed from four 4) year terms to two 2) year terms. 3) The duties of the Commission are more fully spelled out, providing better Council direction to the Commission. She referred to a memo from the Recreation and Parks Commission, stating that on September 11, 1972 the Commission had reviewed the proposed Ordinance and recommended adoption as proposed with the exception of 2236, Section d). It was their recommendation that Section d) be deleted and that Section e) be changed to Section d). There was also some discussion related to the method whereby the two new young members would be selected. There was concern but no recommendation over their being elected at school rather that appointed. The problem being, if they turn nineteen before the school held the next years election, the Commission would be short one member until the election. Councilman McCaron questioned the reasons why the Mayor had requested these changes, the two young members, seven rather than five members and the duties. He stated items 2236 b) and c) should also be deleted along with item d) as item a) would cover the duties sufficiently. Mayor pro tern King stated that c) clarified the duties. Discussion followed that the word advise" be used in place of the word assist". Councilman McCaron stated he did not agree with the term being changed from four years to two years, and for the youth members they should be appointed from the school and if necessary to have their viewpoint they can do so during their term as seniors. Their appointment should be a matter of school policy. Mayor pro tern King stated that the youth could be elected by the student body during their senior year. Councilman Gregory stated the schools could be advised of the intent of the Ordinance and that the schools could furnish a list of students from which Council could make their selection after interviewing the young people. She felt it was important to get the views of the young people of Baldwin Park as to their needs. She stated the Ordinance would up-date the present Ordinance. Emmit Waldo, 4170 Sharons Way, stated he was in favor of having a representative from each of the high schools on the Commission. He stated he also felt that they should be elected by the student body. The Student Body President from each high school could serve, then the students would have something to work for in electing a president to serve them. Councilman Hamilton stated he thought youth appointees to the Commission is good, however, in view of the discussion on the Ordinance it should be held over until the Mayor is present. Mayor pro tern King stated that Section 2235, regarding an excused absence, should read advise the Chairman of the Commission o^r_ the Secretary of the Commission". The motion carried and was so ordered. 00- Acting City Manager Batkus stated that the next item was an Amendment to the Right-of-Way Contract for the 605 Freeway. The subject contract reimburses the City of Baldwin Park in the amount of $333.12 for work performed by the City on State owned property adjacent to the 605 Freeway. The amendment had been approved as to form by the City Attorney. She recommended that the City Manager and the City Clerk be authorized to execute the contract. COUNCILMAN MC CARON MOVED THAT THE CITY MANAGER AND THE CITY CLERK BE AUTHORIZED TO EXECUTE THE AMENDMENT TO THE RIGHT-OF-WAY CONTRACT FOR THE 605 FREEWAY. COUNCILMAN GREGORY SECONDED. There were no objections. The motion carried and was so ordered. 00- Director of Public Works Perry presented reports of work completed under the Short Form 1911 Act on 71-S-73, South side of Salisbury Street between Barnes Avenue and Syracuse Avenue; 71-S-74, East side of Idaho Street between Illinois Street and Ramona Boulevard; 71-S-75. West side of Idaho Street between Illinois Street and Ramona Boulevard and 71-S-77, South side of Frazier Street between Kenmore Avenue and Merced Avenue. A11 Improvement Districts are for curb, gutter, sidewalk and drive approach. Mr. Perry recommended approval of the completion of these districts and that a hearing date be set for October 18, 1972. MAYOR PRO TEM KING MOVED THAT THE COMPLETION OF THE WORK ON 71-S-73. 71-S-74, 71-S-75 AND 71-S-77 BE APPROVED AND THE HEARING BE SET FOR OCTOBER 18, 1972. COUNCILMAN GREGORY SECONDED. The motion carried and was so ordered. 00- Director of Public Works Perry stated that in July, 1972, a public hearing was conducted on Short Form 72-S-15, on the Southwest side of Earl Avenue between Athol Street and Frazier Street, for curb, gutter and drive approach. The public hearing was closed but the work was not ordered and the property owner was given 60 days to make known his intentions for the property. The staff met with Mr. Richard Champion, property owner, and an agreement has been reached on the location of the drive approach. He recommended that Council order the work to be done.
