Mr. Robert Weiss, Attorney, 225 North Barranca, West Covina, who is representing the mortgagor, asked that due to lack of proper notification they be granted an extension to November 15, 1972. COUNCILMAN GREGORY MOVED THAT PUBLIC HEARING 72-N-17 BE POSTPONED TO NOVEMBER 15, 1972. COUNCILMAN HAM- ILTON SECONDED. There were no objections. The inotion carried and was so ordered. 00- It was the time and place fixed for a public hearing on the Proposed City Charter, continued from 8/4/71, 8/18/71. 9/15/71, 12/15/71, 6/21/72, 9/20/72 and 10/4/72- Michael Dargus, 12360 E. Francisquito, stated he was opposed to a Charter City, that there was no advant- age tax wise and that a special election would be a waste of money. City Manager Mocatis stated that with a Charter City a utility tax could be utilized to tower the tax for the single family residence. Gloria Zook, 4817 La Rica, requested a review of the high points of the changes in the draft of the Charter. City Manager Mocalis stated th?t briefly the highlights of changes were: 1. That the 2-year residency qualification for public office be changed to 1 year. 2. Council by 4/5 ths vote could give a contract to the City Manager. 3. Ordinances could only be passed at General or Special meetings. 4. The offices of City Clerk and Treasurer be elect- ive. Councilman Hamilton stated under a Charter the City may levy their own utility tax; that aside from this change the Charter was very tittle different than General Law regulations. Mayor Btewett stated that free copies of the Charter will be available to the public in the City Clerk's office. After some discussion regarding the ability to sub" peona it was agreed to amend the Proposed City Charter as follows: Sec. 703A, page 15, Subpara- graph 7. There was a brief discussion of asphalt vs. concrete drive approaches, a difference in cost of $80.00 vs. $110.00 respectively and it was decided that concrete was more permanent and therefore more economical in the long run. COUNCILMAN MC CARON MOVED THAT THE REQUIREMENT FOR A DRIVE APPROACH FOR PARCEL #1. 72-S-34, BE ELIMINATED. COUNCILMAN KING SECONDED. There we no objections. SLIDES PRESENTED BY DIRECTOR OF PUBLIC WORKS RE PUBLIC NUISANCE CASES. Mr. George Craven, property owner, agreed to 1. correct all Code violations, where applicable. including electrical wiring. Remove or rehabilitate shed in rear yard. 2. Remove all outside storage including auto parts, conduct yard cleanup of trash and weeds. 3. RESOLUTION NO. 72-134 CONFIRMING THE CITY MANAGERS REPORT REGARDING CERTAIN SPECIAL ASSESSMENTS 72-W-41) COUNCILMAN KING MOVED THAT RESOLUTION NO. 72-134 BE ADOPTED AND THAT FURTHER READING BE WAIVED. COUNCIL- MAN GREGORY SECONDED. There were no objections. The motion carried and was so ordered. 00- It was the time and place fixed for a public hearing on ZV-270, 3106 Puente Avenue, to appeal a decision of the Planning Commission decision to partially approve a variance request for a sign for Standard Oil. Variance to vary with Section 9652.9a of the Baldwin Park Zoning Code for an additional freestanding identification sign 85 feet in height Code allows 45 feet) and a sign face area of approximately 360 sq. ft. Code allows 100 sq. ft.) Applicant: Standard Oil Company of California. Proper publication, postings and mailings had been accomplished. There were no written protests. Planning Director John Gordon submitted photographs taken by Standard Oil from various locations, using a boom truck to raise a mock sign. Mr. Stanley Tract, 580 Park Avenue. Pomona, Real Estate Representative for Standard Oil, requested that the Planning Commission grant the original application for an 85 foot sign. He stated Standard Oil planned to reconstruct the station but this did not result in an increase in business; therefore the higher, larger sign would bring customers from the freeway, thereby justifying the reconstruction. Mr. Tract submitted photographs taken as a joint project between Standard Oil and members of the Planning Staff. These photographs showed the station along with the proposed ndw sign at various heights, as they could be seen from the free- way. Mr. Tract stated that the possiblity of other businesses requesting similar signs was not feasible as none of them are freeway oriented as is a gas station. Mrs. Dorothy Mayes, 3453 N. Big Dalton, stated she was in favor of the variance to encourage business and that the sign should be as high as necessary to be seen from the freeway. Sam Sandoval, 4561 Monterey Avenue, stated he was against the variance as this area is one of the worst sign jungles in the vat ley and if it is granted other people will ask for a similar sign. Clydewood. stated the higher sign is not needed because it is dose enough to the freeway. James Q. G-ibson, 13268 Francisquito Avenue, opposed granting the variance because any service station or any other type of business could ask for the same on the same grounds and that If it is to be granted the City Code should be changed to comply. As there was no one in the audience desiring to speak either in behalf of or in opposition to ZV-270, Ma^yor Blewett declared the Public Hearing closed. Councilman King stated that he would disagree with even a 15 foot variance, as the city should adhere to the Ordinance. Councilman Hamilton agreed that the need for the variance was justified and a reasonable request. Councilman McCaron stated he believed the variance was justified as this location is farther from the freeway than some and that a sign of this height would not appear as large as one of lesser height. Councilman Gregory stated that this station had a unique problem in being positioned as it is and also because of the trees and that the variance was justified. Mayor Blewett stated that most people do not want the signs in their community but that unless there is adequate time to see the sign from the freeway one does not have time to turn off. COUNCILMAN HAMILTON MOVED THAT THE VARIANCE FOR AN 85 FOOT SIGN BE GRANTED ZV-270. COUNCILMAN MC CARON SECONDED. Roll Call. The motion carried by the following vote: AYES: COUNCILMEN HAMILTON, MC CARON, GREGORY AND MAYOR BLEWETT NOES: COUNCILMAN KING 00- Mrs. Amos Slater, 4814 N. Stancroft Street, requested that the City Council take out of order the matter of the Recreation and Parks Commission Ordinance as there were students in the audience and there is a 10:00 O'clock curfew and the students had homework. Mayor Blewett stated he had Intended to take up this matter next In the interest of the late hour. Linda Twitchetl, 15424 Ctydewood, felt that the person LINDA TWITCHELL appointed should be someone who comes to the Council Meetings. Sam Sandoval, 4561 Monterey Avenue, felt that the SAM SANDOVAL representative should be someone who is willing to be involved in various dubs and organizations and is interested and that graduates should not be excluded. Councilman King agreed. He also stated that unless they had an extremely low grade average they should serve during their senior year. Also after age 19 a student can no longer serve. Mayor Blewett stated that the Council had a proposed amendment, i.e.; the other two members shall have offices 4 and 5. They should be less than 19 years of age during the terms of their office. One should be a student at Baldwin Park High School and one at Sierra Vista High School, at the time of their res- pective appointments. No person shall be appointed unless the principal of his or her school certify eligibility for the office. The decision as to which method of selection used would be left to the school. TERMS OF OFFICE MAXIMUM AGE OF 19 YEARS Councilman Hamilton stated the appointee should be interested in Recreation and the community, as this is not a popularity contest. Mayor Blewett stated that there was no such appointment promised nor would there be. Mr. Bernard Martin, 3749 N. He said there are basically two methods of choosing a represen- tative; one, a Mayor's Youth Commission; and adding 2 peo'ple or a stated number of youths to a regular commission. City Attorney Flandrick read the amendment as follows: The last sentence of Section 2231 to read: the other two members shall hold offices 6 and 7 and 1). shall hp 16 years to 19 years of age during their terns of office; 2). One such member shall be a student at Baldwin Park High School and the other such member shall be a student at Sierra Vista High School at the time of their respective appointments. 3). No person shall be appointed to either office 4 or 5 unless the principal of his high school has certified to his eligibility for such appoint- ment, which certification shall only be made after an appropriate selection process has been observed involving as a part thereof the wishes of the student body of each high school as to the appropriate candidates. The Chamber would assume storage and the yearly installa- tion. The decorations wilt last about three to five years and when the garlands wear out the electrical will still be usable. Leasing for one year costs $3,600. The installation for additional sleeves will be about $450. The yearly cost for installation and removal by City forces would be about $400. This would not include the shopping center. He stated he had discussed this with the Director of Public Works. Councilman McCaron asked if this would require additional help. Mrs. Duncan stated that this estimated $73,500 revenue is part of our General Fund in this year's budget and would have to be considered next year, City Attorney Ftandrick suggested deferring final action on the use of these funds because if they are placed in a capital outlay fund they may not be expended for any other purpose without a vote of the people. It would be advisable to wait and see the amount fine? strings attached to the Federal Revenue Sharing Program. City Manager Mocatis suggested Council indicate by a motion that their intention is to set these funds aside until such time as we have a workable program on where w are getting the funds and for what purpose they may e used. Also, we have been instructed by the Council to locate a new city yard and are in the process now of comparing two possible sites and will probably come bock to the Council in a very few weeks with a recommend- 11 on for the purchase of property and the beginning of e removal of the existing city yard to a new location. James Garrow stated that he felt when this bill was ntroduced in the Legislature it was for the purpose of inding pollution and establishing a mini-bus system. The City should start with a ten cent bus system and the use of this money for another purpose is defeating the intention of the gas tax sales money, and busses would help the town and business. Councilman King added that the City has already allocated funds for the implementation of a system throughout the City, 2 busses once a week. The motion carried and was so ordered. 00- City Manager Mocatis presented an updated report on the San Gabriel Valley Speedway. He stated action began on May 24, 1972 with the Planning Commission Public Hearing and a series of meetings were held with the owner of the Speedway and with the Mayor and City Manager of Irwindate, and the conclusion of the report was as follows: Mr. Atkinson promised that he would employ the Redel Corpora- tion to conduct sound level pressure tests and he now seems to be unwilling to do so. Mr. Mocalis recommended that Council request that Mr. Atkinson have such a survey made by an expert firm and if he fails to do this the Irwindale City Council should again be asked to revoke or substantially modify his conditional use permit or variance. Councilman King stated that he felt at this point that the citizens of Baldwin Park had suffered long enough and the Council has taken this through all the processes and has shown good faith and that it is now up to the City Council to make the move on behalf of its constituents to instruct the City Attorney to take appropriate action and see that this noise is abated. Councilman Gregory agreed that this problem has been pro- longed and it is almost the end of the season and now wilt be quiet, but it wi11 begin again next year without fail, so prosecution should be instituted. Mayor Btewett agreed and proposed sending a letter to the Irwindale City Council so the proper procedure will be followed. The Council instructed that the City Manager appear before the Irwindale City Council October 19, 1972 for a decision on whether they would set the matter for revocation hear- ing or not. The City Attorney will then advise the District Attorney as to whether or not any action was taken. Mayor Blewett con- curred. 00 It was the time and place fixed for a public hearing on SP-26, an Intent of the Baldwin Park Planning Commission to adopt a Specific Plan for the Northeast section of Baldwin Park showing Zoning and Future Streets. Also included, a 3 year program of beauti- fication, curb, gutter and sidewalk construction and Code enforcement. Initiated by the Baldwin Park Planning Commission. roper publications, postings and mailings had been accomplished. There were no written protests. Planning Director Gordon reviewed his report. The purpose of this plan is to improve the appearance and property values in the Northeast Area by encour- aging the construction, remodeling and higher levels of maintenance. The reason the Planning Commission undertook the study was due to their concern over problems that exist in the Northeast Area, complaints received from Council, business people in the commun- ity, property owners and various citizens, for quite a number of years, on the status of this area. The first part of the study was to sunrorize problems existing in the area; the poor appearance of many properties. The second, the mixtures of industrial and residential throughout the area, especially where this mixture has a tendency to cause blight and dis- courage construction and remodeling. Third, the lack of curbs and gutters. Fourth, the lack of sidewalks on major streets, especially Olive, Nubia and Azusa Canyon Road. These have led to difficulty in selling, renting and getting loans; tow prestige on the part of the area and a drain on municipal revenue. He presented a map cf the area and recommended approval of the^roqram. Mrs. Amos Slater, 4814 North Stancroft, questioned the disposition of proposed future streets, especially a cut de sac at the school. Mayor Btewott said the natter would be checked into. Irene Randolph, 4837 N. Fortin Street stated the red tine on the map ran through the center of her lot. Mrs. Myrtle Asquith, 13838 East Judith, stated she was interested in the Senior Citizens' ability to pay for the cost of the improvements. She felt it would be less expensive to have a private contractor than have the City do the improvements. Councilman McCaron asked that some of the urgency of improvement of some of these streets be held over until next year as the sewers in this area wi11 be paid for this year, which would allow another year's grace.
