Mr. Garrow stated the State 1s offering to sell the freeway wayside park. He stated that the City of Pasadena had a similar situation and had adopted an ordinance designating all park land as parks so any purchaser would know the land was zoned for parks. He stated that they had talked with Mr. Ayantan, the head of Division #7 which encompasses Southern California and his right-of-way man and explained to them that the half of the parcels that are on the West side of the park are presently zoned commercial and are 37 to 40 feet in depth. They explained to him that it would take a 10 foot setback on commercial property, and because it abuts on residential in the rear of the alley, it would necessitate a 20 foot setback on the rear, so it would only allow 10 foot buildings. The State has offered these for sale before and only Mr. Eiko and one other party had been present so there was no auction. A third and fourth time when they posted the property he went down and talked to Mr. Templeton and Mr. Ayanian and they just took the signs down when the nature of the property was explained to them. He stated that to the left of the drive-in moving picture screen, 180 feet, is zoned R-3. Years ago the wash was adjacent to this piece of property and Mr. Jasper Haley owned half the wash and he owned half. Mr. Haley had filled in his half with rubble, etc. Later on, at much expense, the wash was moved. He stated that, in his opinion, building on this fill would require short caisons and structural steel. He had explained this to the Highway Department but the Highway Department stated they had to advertise the property as they were committed by the Little Hoover Commission and had to dispose of surplus property. The asking price for the property is $58,300. He suggested that legislation be Introduced, taking this property off the surplus land rolls and show that the property is unbuildable. Then possibly the City could purchase it for $1. The ordinance would show that the City intends to keep this park in which about $25,000 is invested. City Manager Mocalis stated that this matter has come before the Recreation and Parks Commission and they have taken similar action, that is, that they recommended that the Council protest to the Division of Highways on the sale of this property and seek legislative action if necessary. Councilman McCaron stated that we have a tease on this property that was to be renewed periodically; that at the time the lease was made the State stated that they were going to use the property and that it would never be put up for sale but if anything ever happened the State would notify the City. Mr. Mocalis stated this was correct except that the State did notify the City on October 2, 1972 that the lease was expiring and they would tease to the City again under the new Porter Bill which is a $100 lease but 10 days later they stated that this property does not meet the criteria of the Porter Bill and offered it at its assessed valua- tion of $58,300, the City to have the first option. At that time the Recreation and Parks Commission teamed about it and made recommendations to stop the sale to private parties. Mr. Mocatis stated that the lease is expiring right now. Councilman Hamilton asked if the City has a right to change the zoning from R-3 and C-2 and Mr. Ftandrick stated the City does not have the right to rezone property owned by someone other than the City, that it would destroy the value of the property when it cannot be used for another purpose. Councilman Gregory stated that there is some past legislation in the City of Claremont making this type of property accessible to the city for beautification or for park land and that it might apply to this particular situation. Mayor Blewett stated he would like to see a follow-up on this matter. 00- City Clerk Balkus again administered the Oath to those in the audience desiring to be heard during the meeting. 00- Michael V. Dargus, 13260 East Francisquito, stated he would like the conditional use permit cancelled for the Southern Pacific Freight Depot as they had not complied with the permit. Mr. Mocalis explained that a memo from Mr. Gordon indicated that notice had been sent and that they have until November 16, 1972 to comply. He stated that the storage was minor and that he felt they would comply. Mayor Blewett asked what could be done if they do not comply and Mr. Gordon stated that an acceptable zoning violation procedure would be followed. 00- Mr. Dargus asked that the City Council pass a resolution stipulating that Revenue Sharing funds be allocated for capital improvements and be used for a new City Hall. He suggested that the money be invested in short term bonds. Mayor Btewett stated that if these funds were put aside for capital improvements perhaps some time in the future some drastic thing might happen in the City that would necessitate a tax increase and he questioned whether the people in this cormiunity would want that. He stated that a new City Hail is what everyone wants. Mr. Dargus stated he did not believe the people would mind a tax increase if they had a new City Hall. Councilman Hamilton stated that he had requested that this money and the gas tax money be ear-marked for a new City Hall subject to a report from the city attorney regarding any possible restrictions on the funds. City Attorney Flandn'ck stated that the Treasury Depart- ment has issued the limitations on the use of the funds, one allowable usage is capital improvements and the City is free to allocate for whatever they see fit within the limitations. Mayor Blewett stated that perhaps at some future time if the people wanted to make some changes in the Council they may want to use the money for something other than capital improvements, and he questioned the right of this City Council to tie the hands of any future Council to this extent. 00- Mr. Dargus asked if any action had taken place regarding name badges for police officers and Mr. Mocalis gave a resume of Chief of Police Adams report; that each officer's badge has his number on it and that an officer is obliged to give his number if asked. He stated that there are some reasons why a police officer does not want his name known, such as possible violence and threats to his family. Councilman King stated he would concur in not having name badges on uniforms. 00- Mrs. Amos J. Slater, 4814 North Stancroft Street stated she had recently attended a public hearing, November 10th, here at City Hall held by the Planning Director on a minor variance M. V. No. 13). She asked why the City had building codes and then allowed a developer to get up to a foot side yard variances on 16 parcels of property. She stated this would set a precedent for other developers. Councilman McCaron stated that prior to the 60 foot frontage a 3 foot setback was required for a fifty foot lot until it was changed to 60 feet with an increase in side yards; that the surrounding area has all 50 foot lots previously developed and these lots now are 57 feet, on an average, with 9 feet between the houses, and a few 8 feet, which would be equal to a 4 foot side yard setback. He stated he had never objected to a variance as to setback or width because the 60 foot lot did not fit well with the way Baldwin Park was set up originally. The lots were set up for small chicken ranches and if an entrance street were set up the 60 feet did not make sense economically. He stated that in this case a man has agreed to put up larger homes than the minimum required, 1350 to 1400 square feet, and that he had seen some houses put on 45 foot lots that fit very well. That the only problem that may arise was access to the rear but he assumed the garages would be placed in the front. He stated that special arrangements would have to be made for the storage of recreational vehicles, that this should not preclude anyone from building the desiqn they wish and that will sell. One recommended method would be the consent calendar," where all repetitious and non-controversial Items such as claims and demands, minutes, claims, temporary use permits, etc. could be listed on the agenda and acted on with one motion. If a discussion Is required on an item it can be removed from the consent calendar" and considered separately. Councilman McCaron requested an example of a proposed agenda as he felt there should be a regular procedure a& the people are accustomed to public hearings, etc. In a certain order. He stated that there was not too much wrong with the present procedure. Councilman King agreed; however he stated he did not feel that the new procedure would take anything away from the people. Councilman Gregory agreed, stating that the public hearings could be handled at a specific time and the Items as listed on the agenda could be streamlined so the action at meetings would move along more smoothly. Mr. Perry recommended that to make the policy uniform throughtout the city Resolution No. 65-130 should be revised to offer the property owner on any street who is willing to dedicate his land to the city for street purposes, the construction of curb, gutter, driveway approaches and paveout. He also stated that this would apply to existing streets only and not to any new streets.
