Page 4 In answer to Councilman Hamilton, Mr. Kraft stated the manufacturing was simply a matter of drilling holes in a board in the base of radios for wiring and that there would be no noise. In answer to Mayor Blewett, Mr. Kraft stated they would put in a 6 foot ornamental wall which wilt match the walls of the buildings. The planning department suggested they put in 10 feet of landscaping around the Southwest- side and also on the South side. City Attorney Flandrick asked if he had any objection to the express requirement beinq included in the recent reclassification requiring compliance with the plot plan? Mr. Kraft stated he did not. Councilman McCaron asked if Mr. Flandrick was asking for an environmental impact report. City Attorney Flandrick stated he was suggesting that the requirements be made a part of the environmental impact report and that no building permit would be issued except in compliance with that plot plan. Mr. Kraft stated there would be no problem. Slater, 4814 N, Stancroft Street, representing the Baldwin Park Improve- ment Association, asked for a report on the Irwindale Raceway noise pollution. Mr. Mocalis explained that when this problem first came before the City Council the City Attorney was asked what steps could be taken and it was explained that we had to exhaust our administrative alternatives first: 1. ask the operator to cease the noise or modify it; 2. ask the Irwindale City Council to modify or suspend the condi- tional use permit; 3. see if the District Attorney would issue a criminal complaint; 4. instigate a civil suit. He stated that these things do take time, that the oper- ator has met twice with representatives of the City of Irwindale, the City Council, the manager and the owner of the track and he was given ten weeks to try and make some improvements to lower the sound pressures. Mr. Mocalis said the main reason the City Council asked that the District Attorney be notified was the fact that they were not happy with the progress being made but the District Attorney advised that no complaint may be issued in the absence of a nuisance. Since the track season has ended no nuisance exists at this time. Mr. Flandrick stated the District Attorney's office sug- gested using County and State agencies to obtain noise level readings at the present time and again when the track is in operation to get a comparison. This would save a substantial sum of money as the tests are very expensive. He stated the District Attorney's office felt they would file regardless but that the tests would be very helpful not only in issuing a complaint but also in terms of evidence in a civil action. Mr. Vincent Moreno, 4854 Jerry Avenue, stated there were readings submitted to the City of Irwindale about six years ago when the track was started; that he had sub- mitted the readings to them and that they were the same identical readings the City of El Monte submitted to them. That they are on file with the City of Irwindale, along with 2500 signatures of protest. He questioned whether these old records could be subpoenaed. He also stated that at that time our City Council was very, very cooperative. Mr. Flandrick stated the District Attorney indicated they would go through the entire file in the City of Irwindale and we advised them that there were a substantial number of petitions on file and he was surp they would go through them. He stated once these sound readings are taken care of and the track starts, the District Attorney intends to circularize their investigative staff in the Baldwin Park area and obtain anywhere from 10 to 30 people who are bothered by the noise, can attest to it, and who are witling to appear as witnesses, and then at that time it was his impression they intended to file. 00- Under Written Communications City Clerk Balkus introduced a letter from Mr. Charles Berthel. 4615 North Bresee, list- ing ten items of concern to him and their possible solu- tions. Discussion followed. Comments in favor of the waiver were made by Raul Tapia, Robert Velasquez, Mrs. Gloria Zook, and Mr. Loren L. Macomber. Mr. Mocalis recommended that the bid from Sun Electric Corporation, 343 South First Street, Burbank, in the amount of $3,006.36 be accepted. The motion carried and was so ordered. In answer to the Council, Mr. Mocalis replied that at the present time there is quite a bit of engine work that we cannot diagnose in our own garage. The report indi- cated that on the labor alone, if we realized only 10% there would be a savings of $3,000.00 excepting police work and with police work about $3,600.00. This would not include other cost factors such as rolling stock out to other agencies, a savings on gas and mileage. This equipment will be used by the Police Department also when the new City Yard is established. Mr. Perry stated that part of the purchase of the equip- ment includes Sun Electric sending two men to train our men to operate the equipment. 00- City Manager Mocalis explained that on November 15, 1972. the City Council approved a warrant in the amount of $147.356.20 payable on November 16, 1972 to International Business Machines Corporation to pay for computer equip- ment ordered on January 5, 1972. A recapitulation of past actions relative to this purchase was given to the Council at the last meeting. The City is currently in one of its dry" periods, and this purchase has sharply reduced the reserves that are necess- ary to see us through these dry periods. In the previous report given to the Council, it was recom- mended by the Finance Director that the Council authorize a negotiable note to pay for the subject equipment. How- ever, there was not sufficient time to complete all the necessary documentation required by State law prior to the last meeting, so the alternate method of drawing a warrant from unappropriated reserves was recommended. It will be necessary to borrow against anticipated reve- nues in order to meet our obligations, and he recommend- ed that the Council pass the resolution which will authorize the issuance of a negotiable note in the amount of $150»000.00, at an interest rate of 3.25% per annum, from the Bank of America National Trust and Savings Associ- ation, with said negotiable note to be repaid on June 29, 1973. The purpose of this note will be to meet the immediate requirements of the City. He recommended that the resolution, approved as to form and legality by the City Attorney, be adopted. If successful the city would stand to gain over a half million dollars extra per year. Mr. Mocalis stated no, that we have an informal agreement with the firm of Rutan and Tucker, who specialize in Municipal Law from Orange County. They have agreed to take on this suit should we enter into a written agree- ment and what we would do would be to find out what level of support we can expect from other cities, work out a fair scheme of apportioning the cost of the law- suit which will be in the neighborhood of $20,000.00, or $30,000.00 if it goes to the State Supreme Court and at that time the cities would be told their share. Then the City Councils would take definitive action by reso- lution or by motion sayinq we wish to expend this amount of funds and it would be an agreement amongst the cities put together that we would go into court. Our city would serve the function of collating all the reference material from the various cities. We will solicit their support before we start the suit. DeAnza, Elwin, Foster, Geddes, Heath, Jones, Kenmore, Landis, Pleasant View, Tracy, Vineland and Walnut. The City v.n'11 contribute $16,750.00 from Recreation and Parks fund and employ and supervise necessary personnel needed. Agreement from July 1, 1972 to June 30, 1973. He recommended approval of the agreement which has been approved by the School Board. He explained that this is a continuing program a 11 year. Mrs. Duncan explained that the City has not received the funds from the School District as it is in a very dry period so the program has been carried as the City's contribution. This action wilt authorize the City to bill the School District. The City has been underwrit- ing our portion of the costs. Life Savings and Loan has also indi- cated that they will donate a bus stop bench so we now have a total of 3 committed. This item was presented to the Council on October 18, 1972, the costs involved are approximately 4,000.00 for a total of 37 artificial Christmas trees for a purchase price of approximately $3,000.00. The agreement is that the City would pay $1,000.00 towards the purchase and the Chamber of Commerce would pay the approximately $2,000.00 remainder. The City would initially install the sleeves and the trees at a cost of $975.00 and the City would then remove the trees and the Chamber would provide the storage and thereafter the Chamber would be responsible for the removal and storage of the Christmas trees. There are about 60 people who are active members of the Health Council and we have been taking minutes and mailing them and other sorts of mailings. The costs have been absorbed by the Health Council but they are very low on funds and this is a very worthwhile cause.
