The invocation was given by Reverend Aureliano Flores, Church of the Redeemer. Roll call: Present: COUNCILMEN GREGORY. HAMILTON. The motion carried and was so ordered. 00- City Clerk Balkus administered the Oath of Office to Guy Herreman, Patrolman, following which Mayor Blewett presented the officer his badge and congratulated him. 00- City Manager Mocalis announced the results of the oral and written examinations for the Police Department for the position of Lieutenant, stating that Sgt. Adelbert L. Aldrich received the highest grades for both the written and oral tests. He congratulated the new Lt. Planning Director Gordon stated that Virginia Avenue was zone M-1 in 1963 and by 1983 a11 homes were to be removed. He stated that the Council recently approved allowing caretakers quarters as an auxiliary use with dog kennels in an M-1 zone and that some of the problems that should be looked into are the land 40 feet to the rear of the property zoned R-3. There is an existing home next door to this property. Kennels tend to increase noise and flies in the area. Mr. Gary Christopherson, attorney with O'Melveny & Myers, representing Michael Nemeth, stated the major reasons, as outlined in his letter to Council, for having a dog kennel on the property were that the property is zoned M-1 which allows the use of a dog kennel, the property immediately across the street from the subject prooerty is operated as a dog kennel; and the property several doors to the North is another dog kennel, which has been in operation for many years. All have operated without complaints. He stated that Mr. Gordon had mentioned that there is R-3 within 43 feet. That 43 feet includes a railroad track where a train stops periodically and there is a high noise level. Also, the freeway is nearby. No one from the apartment house in the R-3 zone has complained and there has never been an objection or complaint about the dog kennels to his knowledge. He stated that Mr. Nemeth is an experienced dog handler, one of the best in the area, and that he is doing a good job. He stated the property in question is 68 feet by 438 feet and the R-3 property is only at the very rear of this property and only borders 24 feet of it and beyond that the existing buildings are some 50 feet away. An M-1 zone has a number of uses which could be noisier or more objectionable such as welding, sheet metal, etc. and for that reason the objections are not a legitimate concern. At the Planning Commission meeting when Mr. Nemeth's application was denied, sound was not their concern; it seemed their goal was to channel other development and growth in the area and it seems unfair to discri- minate against Mr. Nemeth as when the time is right this property win be sold to developers regardless of what type of usage exists and there are many lots for sale in the area. For the present, dog kennels are not inconsistent with the existing uses, 3 of which are dog kennels and a11 of these non-conforming uses and businesses are allowed to remain until 1983. He requested that the Planning Commission decision be overruled and that Mike Nemeth's application be granted. Michael Nemeth stated the application had been made by Henry Marquez but that he would be the one who would be operating and owning the kennel. He submitted a group of photographs of his work to Council and stated they would speak for themselves of the type of work he does. He is a graduate of Baldwin Park High School and has a degree from Cal Poty in business management, however, he decided to sacrifice the money of a business career and applied for a license from the American Kennel Club for dog handling. That there are only 20 licenses of this type in Southern California. The American Kenn- el Club issues a renewal every year and if he does not obtain a kennel his license will be revoked. Cont.) He stated he finally arranged a loan with the bank for Mr. Marquez' property and thought everything was going to be a11 right until he attended the Planning Commission meeting and suffered the setback. He stated his customers came from the whole Los Angeles area and as far as Oakland. That 90% of his customers are working people and will not drive too far, so this is a good location. He requested a favorable vote, as this is important to him in furthering his career. Mr. Andy Nemeth, 1318 Virginia stated that his son is probably one of the top young dog handlers in America and that at a given time he can have as much as $10.000 in value worth of dogs in his care. Under the County the area was to have been M-1 but as it was not, the City had rezoned to M-1 and he applied for a conditional use permit and it was granted. The area is being assess- ed for improvements of benefit to someone else. Mr. Schneider is building a warehouse on the corner and his own street assessment was over $1,000 last year and he did appreciate the improvement. He stated they had no problems with their neighbors, that the area is convenient for his son, being near the Ontario Airport and the surrounding cities and that he felt the conditional use permit should be granted to control how the property is used by the petitioner. C. W. Burdick. of Orange County, stated he was Past President of the Wire Hair Terrier Association and also of the Sealyham Terrier Club. He stated that Mike has handled dogs for him for 20 years and is going to be something in the chosen profession before he is finished. When his dogs are at Mike's kennels they are well fed and cared for and he was sure that If granted this con- ditional use permit the same care would be exercised. There are modern kennels in Orange County with neighbors on a11 sides and they are kept odor free with no noise problem. This can be done if properly administered. Charles Hagennan, 1335 Virginia, stated he has a kennel in that area and has known Mike a long time and has seen him handle his dogs and become known and he has certainly done a wonderful job. He has his dogs in the area and works for MGM. That Harold Lloyd had a dog kennel at one time with 72 great Danes and it was a beautiful kennel That shows that dogs can be in an area that is probably quite restricted and still be an asset to the area. They have had no trouble or complaints about their dogs and he hoped Mike would get his wish for a conditional use permit Milos Evosevich, 1355 Virginia Avenue, stated he had lived at that location 41 years and is opposed to having dog kennels in the area; that they had $4.000 in repairing and improvements and they are starting to build buildings in the area. He stated that they had a neighbor who had about 10 dogs and they had an odor and flies and that he finally moved. This is M-1 and too valuable to allow kennels which could be out in the desert where land is cheaper. He stated that the kennels should be can- celled out. Cont.) ANDY NEMETH 1318 VIRGINIA AVE. C. W. He stated that a Rennet would cut right into a valuable section of land which he had hoped some company would develop and provide employment for Baldwin Park and that he would be able to sell his property. He stated he had no criti- cism of the kennels but he thought this request should not be given consideration as this is fine industrial property. He did not think kennels would better condi- tions for an industrial park. Hector Martinez, 1321 North Virginia Avenue, stated he had been a neighbor of Don Eck for 26 years, that they had been against the improvement district, however, they had gone along with it and it now looks very nice. The area is cleaner, old homes have been removed, and it is improving. He had said nothing about the present kennels but with another one he would be surrounded by kennels and also this would discourage development of light industry and it now looks as if there is some interest on account of the railroad. He did not think they would want another kennel. Councilman King asked Mr. Martinez if he had offered to sell his property to Mr. Nemeth and was it contingent upon the approval of the kennel. Mr. Martinez stated no, that Mike Nemeth came over and said that he was thinking about building a kennel and at that time his mother said that if he came over with $40,000 they would se11. Then Mr. Nemeth came back once and didn't say anything and then Mrs. Martinez, his mother, said he should never have told him that and if he did come back and offered the money he was to refuse it. He stated there was an odor from the kennels but they had never said any- thing as they did not want to bother anyone. He stated the Planning Commission had viewed the property and he suggested that if the Council checked, they would notice the odor. Jerry Courtemarsh, 1363 North Virginia Avenue, stated he was in agreement with the comments that had been made about the property; that over $300,000 went into the improvement district; that industry was moving in with the Schneider Building and also Nichots Lumber Co. and that another struc- ture was in process of being demolished. He stated he sympathized with Mike Nemeth but he did believe a kennel would not benefit either the area or Baldwin Park, A kennel will not create the Jobs that industry will and another kennel w111 discourage upkeep of properties. He stated kennels are not a credit to the community and do not need a railroad. When the street was developed they were told this was prime property for industry and he could not see that a kennel would benefit the city. James Q. Gibson, 13268 Francisquito, asked the City Attorney if it was true that a dog kennel is a permissable use for property in an M-1 zone. City Attorney Flandrick stated yes. with a conditional use permit. Mr. Gibson asked why then is it necessary even to apply for a conditional use permit if a dog kennel comes under M-1 zoning. Cont.) Mr. Flandrick stated it is not a permitted use as such. There are a list of uses which are permitted of right in this zone. Then there is a second list of uses, one of which is a dog kennel, which is allowed In the zone if a conditional use permit for it is approved. Mr. Gibson asked if this is allowed only under a condi- tional use permit why would this man be allowed or given reason to believe that he could operate a kennel and go out and spend $35,000 for a piece of property and then have to be at the mercy of the Planning Commission or the City Council. It seemed to him If he had looked Into this and a dog kennel is allowed, and he feels he Is going to be able to operate it, it is no time to change the rules. We should change the ordinance or allow the usage. Mr. Gibson stated he was not arguing In favor of dog kennels, that there are 3 dogs next door to him that are an annoyance at night but 1f this Is allowed in an M-1 zone he couldn't help but agree there are many, many more annoyances, such as riveting machines, and various odors, than a barking dog or a little bit of a smell In an M-1 zone. Mr. Mike Nemeth agreed that a kennel Is a permitted use and noise Is related to an M-1 zone. He stated that If efficiently run there would be no dogs barking at 2:00 A.M. He wants to make an Improvement that this commun- ity will like and have respect for. He emphasized that the property would not go down and he was willing to meet any requirements. Councilman King asked If Mr. Nemeth had read the condi- tions that could be Imposed If this were approved. A copy of the proposed requirements was given to Mr. Nemeth. Mr. Christopherson stated they would agree to abide by all conditions and he suggested that the phrase condi- tioned free from all complaints" be changed to reason- able standards." He commented that It seas that the crux of a conditional use permit Is to protect the public and that most people would agree that protection can be Instituted. The existing kennels have been there for many years. The objections seem to be economic. Mr. Nemeth has spent a lot on application fees and escrow costs. People seem to be concerned about their property values. There are many lots for sale In this area and no Industrial park Is being developed. Property Is selling for 40(asq. ft. and Mr. Nemeth Is paying $1.10 a sq. ft. Councilman King stated that the conditional use permit should stipulate conditions that can be lived with. Mr. Christopherson stated this would pose no problem for this area and Mr. Nemeth stated they would construct a 6 foot masonry wall and trees as a buffer. There Is only one residence on the one side and they are 200 feet from the R-3 zone property which would cut off the last 160 feet. When he can afford such a thing he was thinking of a block wait around the whole 160 feet. Cont.) MIKE NEWETH MR. Councilman McCaron stated it appears that the way the trend is going that the area would go to mostly dog kennels if this continues. That on the original applications for con- ditional use permits for kennels he was against them and he has not changed his mind as far as kennels are concerned. It appeared to him that homes on dog kennel premises should be classified as a home occupancy. Dog kennels are the same as horses and chickens and they have been eliminated. They were here first. The more kennels allowed in the area, the more expensive it is to regulate. There are complaints about the ones there now and this was what he had expected and it has helped the deterioration of the area. If it were not for the Public Nuisance Ordinance the area would be worse. The people cannot enjoy their homes because noise from dogs carry considerable distance. The area where the County Dog Pound is located is in a manufacturing zone and those dogs can be heard for a long way. Councilman King stated that everyone is opposed to dog kennels, however, we do have an ordinance permitting kennels with a conditional use permit as this use was considered compatible in the M-1 zone. If this use is not to be allowed it should be eliminated from the code. If the applicant can live up to the conditions imposed he would be in favor of the conditional use permit. Councilman Hamilton stated the city is trying to attract industry and kennels will be of no help. This is a good manufacturing area and this is a proposed new business. The existing kennels have been there for some time; however chicken ranches and dairies were allowed six years to phase out and the same ruling should have applied to kennels as they will not attract industrial development. He was not in favor of the conditional use permit. Councilman King stated that if the Council felt that a certain type of development should be In an area. then an area should be so designated. However, this is a legitimate application and if the applicant is willing to abide by conditions then the usage should be allowed as there is not a great deal of opposition. Councilman Hamilton stated property owners had opposed the usage as they think it will be bad for the area and their rights should be considered too. It is not a matter of denying a man his rights, but what is best for the majority of the property owners in the area that should be considered. Council should not impose some- thing on the other property owners if they do not desire it. Mayor Blewett asked the City Attorney if it would be constitutional for the Council to rule against a condi- tional use permit. City Attorney Flandrick stated the matter could be decided either way. The code provides standards to guide the council such as the site itself and whether it is ade- quate In size and shape; whether it has adequate access; and whether the use as proposed will have an adverse affect upon surrounding adjacent uses. The City does have an ordinance and the Council may legally deny the use; however, she did not think morally they should. Controls will handle cleanliness, odors and noise. The applicant wishes to make his place inviting. As there was no further testimony. Mayor Blewett declared the Public Hearing closed. There were no objections. Councilman McCaron questioned why the use had been denied in other cities. Councilman Gregory stated that possibly other cities had deleted this usage from their code. However, it is still in the City Code and if the usage is not desirable it should be deleted. Councilman King agreed with Councilman Gregory. COUNCILMAN GREGORY PUBLIC HEARING CLOSED Councilman McCaron stated that just because kennels were listed, providing a conditional use permit was approved, was no criteria, as there were also other conditional use permit uses that should be eliminated. The Council can either allow them or deny them, regardless of conditions. He stated that the City has no zoning for this use and that in zones throughout the City there are mixed uses without sufficient protective barriers. He thought that where animals are kept in any number they are bound to create a nuisance and he did not think that another kennel should be added. Councilman Gregory stated that stray dogs roaming the streets were a real concern and not kennels where the dogs were cared for. Councilman McCaron stated he failed to see the connection, that there was still a noise factor and dogs roaming the streets is another problem and there Is an ordinance against this. Councilman Gregory stated there had been no complaints about the kennels until this evening. COUNCILMAN KING MOVED THAT CONDITIONAL USE PERMIT 186 BE APPROVED AND THAT A RESOLUTION BE PREPARED MODIFYING THE CONDITIONS AS WELL AS A REVISED PLOT PLAN FOR PRESENTATION AT THE NEXT MEETING. COUNCILMAN GREGORY SECONDED. The motion failed by the following vote: AYES: COUNCILMEN KING AND GREGORY NOES: COUNCILMEN HAMILTON, MC CARON AND MAYOR BLEWETT Mr. Andy Nemeth stated that he understood that Mayor Blewett had already committed himself to vote aqalnst the conditional use permit, and that this was on the basis of friendship with the younger Mr. Eck and that this statement had been made to Mike Nemeth. Initiated by the Baldwin Park Planning Commission. Continued from December 20, 1972) Proper publication and postings had been accomplished. There were no written protests. Mr. Emmit Haldo, 4170 Sharons Way, President of thp Chamber of Commerce, stated that the Chamber had reviewed the proposed development standards and found no objections. However, the Chamber has set an architectural theme and they have spent a year trying to get businessmen and property owners to redecorate their storefronts. If these standards are approved they may cause negative thoughts from these people, as the Chamber is trying to convince them that it is a good idpa to improve the fronts of their property. If they receive notice from City Hall about trash receptacles, etc. some people may feel that City Halt is pushing them. He requested that Coun- cil consider this, as the Chamber is trying to help the City and if the people feel that they are being pushed they may have second thoughts on improving the storefronts. They do not have to modernize the fronts of their stores, so he sug- gested that the other requirements be held in abeyance for the time being. Councilman King stated that many store owners are upgrading their stores to attract and better serve the citizens; however, there are out of town owners who have made no improvements for years and they should be made-to realize that some action is due on their part to invest some of their profit in upgrading their investment property. Residential areas, have restrict- ions imposed upon them and the businessman should realize he also has an obligation to the community. He felt that the City needs a constructive, progressive and up-grading ordinance adooted and enforced as quickly as possible. Mr. Waldo agreed that this could be correct, however, he recom- mended that such requirements and enforcement be well considered at this point by the Council as the response has been favorable so far when the owner or occupant has been approached and asked to conform to the architectural theme. They do not realty know at this ooint how successful they wilt be in getting the store fronts redecorated and any small new requirement, with a tetter to that effect, could negate the personal contact work that has been done and- could result in an owner doing only what he has to do and no more. Councilman King commended Mr. Gordon on his fine, progressive and concise report, stating that this was what the City needs right now as there are certain areas that are in dire need of upgrading. Councilman Gregory asked if there was a time schedule for the improvement of storefronts. Mr. watdo stated they have the architectural theme and are forming committees to go out and talk to the prooerty owner and they witt know in a few months how they are progressing. Mr. Gordon explained that 90^ of the stores do not have a screening problem as they have window or swamp coolers. What will require screening are the roof coolers on large stores. As there was no further testimony. Mayor Blewett declared the public hearing closed. There were no objections. Councilman Hamilton stated that if too much improvement was required at the back of stores there could be a quest- ion as to whether they would improve the front. The enact- ment of an ordinance means an expenditure of money and he felt that screening should apply to new construction only. Trash enclosures should be required, and although It will be costly to the small business, it is needed. There will be problems in certain instances in erecting a 6 foot wall, as some of the buildings are on the property line and a variance will be necessary. The ordinance says screening of a11 mechanical devices." and this should be clarified. Mr. Gordon explained that it was not the intent of the ordinance to require screening of window air conditioners and swamp coolers, it would apply to galvanized sheeting which had not been designed by the manufacturer to be vis- ible from the street. He stated that if the intent of the ordinance was approved, then Council would instruct the City Attorney and staff to clarify and rewrite it. Mr. Flandrick explained that landscaping would only be as now required under existing ordinances. This requirement will not affect existing businesses. If Council wished to make it applicable for interior landscaping in parking areas, it would have to say so. Mayor Blewett asked if landscaping could be required on large parking lots for existing large businesses. He re- ferred to the deplorable condition of the Food Giant park- ing lot and that if they were required to upgrade their standards, possibly they would pave the parking lot at the same time. Councilman Hamilton commented on the lack of clean-up on large parking lots. Councilman McCaron stated there should be some estimate of the impact these standards will have on the property owners in the C zones, such as enforcement costs, and the feasibility of landscaping where a wall exists. They will be able to build in rear yard setbacks with certain limitations, so they wilt have more buildabte area. The whole purpose of the requirements is to prevent com- mercial property from depreciating the value of the resi- dential property next door. Councilman McCaron stated the proposed shopping center on Puente had not developed and the city is not getting devel- opers and he questioned whether the city regulations were the problem. Mr. Gordon stated that the reason for the lack of commer- cial development in Baldwin Park, in his opinion, was bad zoning and the locations of zoning, inadequate lot sizes and inadequate market and the poor appearance of some types of businesses. Lenders will not come into an area that has a bad appearance. Councilman McCaron stated we have not been successful in attracting development and these standards would put an additional burden on present owners and he could see no advantage to the City. Councilman King stated that the City standards were no more restrictive than those in other areas; that the set- backs were reasonable and the requirements would upgrade the City. Councilman Hamilton agreed but stated the Council must use good judgment and that a 20 foot setback is costly to a small business and he felt 10 feet would be adequate. In answer to Mayor Blewett, Mr. Gordon stated a sign was permitted in the 20 foot setback. Mayor Blewett commented that there had been problems devel- oping the sign ordinance and road signs had to be allowed if there was inadequate setbacks. Possibly the 20 foot setback will be better for the businessman as he can have adequate signage to advertise his business. Councilman Hamilton stated that a sign could be utilized in a 10 foot setback. Mr. Gordon explained that the code specifies that the sign size is proportionate to the size of the property and the proposed front yard setback is to apply only to new devel- opment and only when the development is adjacent to or directly across the street from R zones. The recommenda- tion is that a 10 foot standard be maintained throughout the City and this has been a requirement since 1964. This is located outside the City but they will require permission. The motion carried and was so ordered. 00- City Manager Mocalis presented two requests; one for approval of lease of cars for the Organized Crime Staff, and'for lease of a Facility Trailer for the Organized Crime Staff, The California Council on Criminal Justice has approved the first year grant of the three-year period. The City is authorized to start expending funds for the East Valley Intelligence System. This is under a Federal Grant. Included in the first year grant was an appropriation for leased vehicles and for leased office space. It is recommended that the Police Department be authorized to execute a lease for four automobiles and for a mobile trailer, according to the provisions approved in the grant. The leased vehicles wilt cost $150 per month plus 5% tax and the leased trailer will cost $402 per month plus tax. Discussion followed regarding lease costs. Mr. Mocalis stated that all of the employees paid by Federally funded programs are on a temporary basis and employment ceases upon termination of the fund. These employees receive the same benefits while employed, such as sick leave, vacation, etc., but they are tem- porary. Copy in official files.) 00- City Clerk Balkus presented a request for a Temporary Use Permit and Waiver of Fees for the Chamber of Commerce Parade January 27, 1973 and Carnival January 25 through 28, 1973. The proposed location for the Carnival was the Ramona Parking area by Morgan Park between Baldwin Park Boulevard and Robin. Regarding the Carnival location, Pete Parenteau, Manager of the Chamber of Commerce,stated they did have a tentative second location if necessary; however, the primary location would be the park. He had discussed the location and the only objection had been from the Police Department concern- ing people parking on Ramona and crossing the streets. He had not been aware that there was any other objection to the location, as the park is for the public and this is a public function. He enumerated various cities which use city parks for carnivals and stated that Norwalk and Arcadia hold their carnivals on the front lawn of the City Hall. The Chamber will put up a bond to cover any damages. He understood that the main objection of the Recreation and Park Commission was the lack of parking, due to the nearness of the Park Bowl. However, he had a letter from Mr. Alvin Horn, Jr., Proprietor of the Park Bown, stating there was adequate parking on their lot and that they did not need street parking. He stated he would like to know the objections to the location so that they can be resolved Lee Lucas, Director of Recreation and Parks Commission, stated the main concern was lack of parking for people using the park facility. BERNARD MARTIN, CHM. RECR. & PARKS COMM. Discussion followed regarding use of the ball diamond area. Councilman Gregory suggested that the City Manager and the Recreation Director establish a location and resolve the problems. COUNCILMAN MC CARON MOVED THAT THE TEMPORARY USE PERMIT FOR THE PARADE AND CARNIVAL BE APPROVED SUBJECT TO A REPORT FROM CITY MANAGER MOCALIS AS TO LOCATION AND THAT FEES BE WAIVED. The motion carried and was so ordered. 00- City Manager Mocatis presented a request for a rate in- crease from Websters Refuse Disposal Co. from $2.00 to S2.25 Der month for single family dwellings and $1.25 to $1.40 for multiple dwellings, increases of 11.12% and 10.71% respectively. It has been several years since an increase. However, the staff has not had an oppor- tunity to conduct a review of prevailing rates in the area and he recommended that the Public Works Department be asked to make such a study and come back to Council.
