Planning Director Gordon passed out maps of the area and gave a resume. He stated that there had been an oral pro- test at the February 7, 1973 meeting regarding vacant property 3 or 4 lots South of this area, requesting that Council hold this over as there were some industrial plans pending and that although the gentleman making this protest was aware of the hearing tonight, there has been no further communication from him. Mr. Gtenn McCracken, 14931 Cragmont Street, stated that he was very much in favor of this zone change. As there was no one else in the audience desiring to speak either in behalf of or in opposition to Z-365, Mayor Blewett declared the public hearing dosed. There were no written protests. 73-S-4 TESTIMONY WAS GIVEN BY: Mrs. Edith Dunn, 101 Palm Drive, Arcadia who stated she understood that in order to initiate these proceedings either 6Q% of the work had to be completed or 60% of the people involved had to request it, but was told that it could be done with a 4/5ths vote of the Council and Mayor Blewett informed her that this was so. She asked that the Council use Gas Tax Funds to pay for these improvements. As there was no one else in the audience desiring to speak either in behalf of or in opposition to 73-S-4, Mayor Blewett declared the public hearing closed. 73-S-5 TESTIMONY WAS GIVEN BY: Edward Fewer, 3763 Athol Street, stated that he was not opposed to the improvements but the way they were being handled. Mr. Perry made arrangements to set up an appoint- ment to work out any problems regarding his property. 73-S-6 No testimony 73-S-7 No testimony 73-S-8 No testimony 73-S-9 TESTIMONY WAS GIVEN BY: Mrs. Joyce C. Carson, 12507 Sprout, Norwalk, stated that she was speaking for various property owners, including her mother who owns the property at 3204 Big Dalton Avenue, and that these people have not completed paying for the sewer bonds and that the sewer bonds have 3 more years to run, and therefore they cannot afford to pay this cost at this time. Mr. Perodeau, 14257 E. Garvey, stated he felt the curbing should go in on Garvey instead of Big Dalton as last week the water came into his apartment from Garvey. Stan Houser, 3230 Big Dalton Avenue, asked what is wrong with the driveway approach the City has already installed and was told when the street was dedicated there would be absolutely no cost to the property owner. Mr. Perry explain- ed that the asphalt driveways were being replaced with con- crete. That there had been no charge for the asphalt drive- way. That he would check this property as the records do not indicate a driveway approach. T. E. Carpenter, 4346 Jerry Avenue, questioned why the City required tearing out the asphalt driveways and replacing them with concrete; that there is nothing wrong with asphalt, that it has already been done, and is not fair to the tax- payer. Councilman McCaron explained that an asphalt driveway cannot be used as part of a sidewalk. There should be no curb and gutter work done for dedication except on primary streets and Big Dalton is not a primary street. Mrs. Margaret Gibbs, 3567 Big Dalton Avenue, stated that an asphalt driveway was put in on her property last May. Charles Howard, 3108 Big Dalton Avenue, stated that curbs and gutters had not yet been installed at this location and in rainy weather the water extends from where the curbs and gutters should be to 5 feet into the street, which causes great discomfort to the children walking to school. That there are two alternatives, i.e., the City is trying to get all the streets paved and curbs and gutters in and to improve the water flow; this is the first object- ive. If the drive approach is eliminated at this time the work wilt have to be done sooner or later, as it becomes part of the sidewalk, so it is one choice or the other. The asphalt that was installed at the time was only a temporary measure and will have to be replaced as it was very thin and not a permanent approach. Mr. Perry stated that it was not fair that the City bear the cost of the improvements as it already pays 60% and the property owner 40%. Mayor Blewett asked that 73-S-9 be held over to the next meeting. 73-S-10 No testimony 73-S-11 No testimony 73-S-12 TESTIMONY WAS GIVEN BY: Mark W. Lee. 3222 Mangum Street, residence, Costa Mesa,) stated that 2 years ago the taxes in this area doubted. He stated that he could afford this expense but that there are many people in this area who are on pensions who also had the tax increase and cannot afford it. He questioned the high cost of the work and Mr. Perry ex- plained that the City added a cost of up to $50.00 per residence for administrative charges. Mr. Lee also ob- jected to the high cost of the sewer installation which was only recently completed. Mayor Blewett advised Mr. Lee that bids were solicited on all this work and that the City chose the lowest bidder. 73-S-13 TESTIMONY WAS GIVEN BY: John Thurber, 3136 Mangum Street asked for a cost break- down and Mr. Perry replied that if paid off before the cost hearing the total on his parcel would be $249.00, and could be paid either at completion of the work or added to the tax bill for the following year for an additional charge of $50.00 for administrative work. Mr. Perry explained that this administrative charge is ploughed back into these pro- jects. Mrs. Betty Toiler, 3248 Mangum Street, stated she understood that Gas Tax money was to be used to pay a portion of this cost and Mr. Perry explained that the City sets aside a certain amount each year to pay the city's portion of the cost. Mrs. Toiler questioned the difference in cost of the City vs. a private contractor and Mayor Blewett said the work by the city may turn out to be a very good bargain in the event there were any special problems, such as trees, etc. which the city would take care of. Mrs. Hattie Cochrane, 3247 Mangum Street, stated that she lives on Social Security and could not possibly raise that amount of money within 60 days, as her income is $87.00 a month. Mr. Perry and Mayor Blewett informed Mrs. Cochrane that up to 90% of her tax bill would be forgiven if she would file for it and they would send her a brochure regarding the tax reduction and asked that she share it with her neighbors. Mayor Blewett declared the public hearing closed. Councilman Hamilton felt that if the driveway was in good condition it should be left in. Councilman King stated the City should move ahead cautiously and if the asphalt driveway is to grade and the person shows a hardship replace it at a later date. Mayor Blewett preferred to have something more than just a spur of the moment thing, that in, the long run the City and the people would be far better off to have the cement approaches in, as somewhere along the tine that cost is going to have to be borne and the cost will be less now than later on. The motion carried and was so ordered. 00- It was the time and place fixed for a public hearing on AGP-25. an intent to revise the existing Community Design Element to include additions and deletions of future streets within the City. Initiated by the Planning Commission. Proper publication, postings and mailings had been accomp- lished. There were no written protests. Planning Director Gordon presented a resume and maps, stating that this was adopted along with the General Plan in 1960. Since that time many changes have taken place in the City and as a result the Planning Conmission has undertaken the project of revising and updating the future street map, one of the first steps in the revision of the General Plan. He recommended the following: 1. The City Council adopt this report and the future street map. 2. That the City establish a policy of encouraging implementation of future streets. 3. That Specific Plans be adopted establishing actual alignments for problem areas. These plans should be initiated only after the property owners show an interest in developing. 4. That when there is only one remaining vacant lot that could provide an out- let for a future street, the Staff shall be required to compile a report examining the feasibility of the purchase, by the City, of that lot. 5. That the Commission and Coun- cil examine the possibility of setting up a fund to buy lots needed to provide outlets for future streets. Mayor Blewett stated that he would like to make it clear that this Is a plan that can be implemented if the people within the area want it. TESTIMONY WAS GIVEN BY: Michael Dargus, 12360 East Francisquito. stated that at the last Planning Commission meeting a petition was presented to delete the proposed street, namely Egil Avenue, which was denied and he was now appealing to this body for the following reasons. Not economically feasible, it is land- locked, land would have to be bought; also the street would be approximately 1200 feet long, ending in a cut-de-sac. The Fire Department recommends 500 to 600 feet maximum. The street will be costly and only benefit 4 or 5 families. There are presently easements for all the lot splits. In answer to Councilman Hamilton, Mr. Dargus replied that he has owned property in the area since 1945 and it is fully developed and the proposed street would be very damaging to his property. Mrs. Check, 13187 Emery, stated they had put their street in, the only ones who have, but if the street is put through something will have to be done with the drainage problem as water stands above the curb when it rains. Mrs. Irene Randall, 4837 Fortin Street, stated that a street running East with no drainage should be checked by the Engineering Department. Mr. Gordon explained that if and when the people in that area wanted to develop the problem of drainage would be worked out with both the Engineering and Planning Departments. That this would also apply to the location of the street. Mrs. Margaret Gibbs, 3567 Big Dalton, asked if the proposed street is a cul-de-sac, who would pay for the improvements. Mr. Gordon replied that the developer would be responsible for those costs, and that Mrs. Gibbs should see him in his office for specific questions as he would have to refer to maps and files. Councilman McCaron stated that in the areas between Athol, Mangum and Frazier only one cul-de-sac was shown and he asked if there was anything to preclude a street going in these areas. Also there should be a policy for problem areas such as Egil Avenue. Mr. Gordon stated he would check this out and report at the next meeting and that deep lot provisions would apply on Egit Avenue. Councilman McCaron felt that there should be no further developments until the City adopts an overall plan. Mrs. Lenore Crandall, 4244 North Center Street, aked whether it would not be better to allow rentals on the larger lots, as the property is not used to good advantage anyway and there is a demand for rentals. Also, at Los Angeles and Palm possibly the city could put in a street and this would eliminate weeds. Mayor Blewett replied that this is exactly what the hearing is all about and some of the people do not want this. Councilman King stated that on Egil Avenue, or where there is no possibility of a street going in, that if additional homes are built on the larger lots they should remain under one owner because other cities who have allowed this have run into problems with easements for access to those rear houses. Councilman McCaron stated there should be some provision made for those homes that were built with the intention that a street would be put in to serve them, that it appeared Eqil Avenue had gone too far to eliminate the street, the dedication has been made, etc. and there should be no further development allowed, that access should be provided. He requested a review of the lot splits. Councilman King requested a resume of the lot splits, the easements and dedications, the paved areas. If the street is deleted, possibly the people should be reimbursed for the paving. There is a question as to whether this is economically feasible. A meeting is tenativety 00- Under Written Communications, City Clerk Batkus presented a letter from Mrs. Arlene Patterson, 14050 Olive Street, objecting to the Flood Control Project on Olive Street between Baldwin Park Boulevard and Center Street. Letter in official files.) Director of Public Works Perry presented a report regarding this project. He stated that in 1962 the City retained Integrated Engineers, consulting engineers to prepare a master storm drain plan for the City. The report went into great detail, and included was a recommendation that a storm drain be constructed on Olive Street between River- grade Road and Baldwin Park Boulevard. When the County of Los Angeles Flood Control District initiated the 1970 bond issue project the City of Baldwin Park was contacted and the City recommended at that time that certain storm drains be included within our City allocation, one of which was Olive Street. This bond issue was passed by the voters and project 9705 was completed and a portion of 1750 unit A, which was done in conjunction with the freeway work that is going on now on the San Bernardino Freeway. Due to financial difficulties in these two projects, the Olive storm drain project did not have sufficient funds to be constructed in the normal bond issue funding. The District studied the needs of the entire County and decided that the Olive Street storm drain was quite high in their priorities and they were able to justify the expenditure of General Fund money for this project. Public meetings were held, and tetters sent out answering some questions of property owners. The School District is supporting this project. Mr. Perry stated there were three major questions brought up regarding this project: 1. The need for the project. Continued) MRS. It was also the Inconvenience; they do agree there is too much water going down Stewart Street as they use the street too but it should be put in on Stewart Street or at the source. Arrow Highway. Gloria Zook, 4817 La Rica, stated she lived right off Olive Street and a storm drain is badly needed. She has worked as a crossing guard for Walnut School and many times carried the children across the water it was so deep. Marian Bellamy, 14052 East Olive Street, agreed with Mrs. Patterson they do not want the street torn up again although they realize Stewart Street does need the storm drain, but why can't it come down Arrow Highway. Every time the street is torn up the driveways are blocked and for medical purposes she must have access to emergency vehicles. She has to find other living quarters, which is an expense and inconvenience. GLORIA ZOOK 4817 LA RICA MARIAN BELLAMY 14052 E. OLIVE ST Councilman King agreed that it was bad to have the street torn up again but the problem must be approached from all areas and from an engineering point of view the most dir- ect route must be used. Mayor Blewett asked what condition the street would be left in after the work was completed. Mr. Perry replied that a recently completed project in the Athol Street, Bess Avenue area is one of the finest repaying jobs he had seen. Mayor Blewett asked that if this project is implemented that the utility companies be advised in order to avoid having duplicate work. Mr. Perry commented that this is always done but sometimes even with a combined effort, due to budgets, scheduling, etc., an overlap cannot be avoided. In answer to Mrs. Bellamy Mr. Perry assured her that there will always be emergency access during construction. Regarding parking problems. Mayor Blewett said there were always such problems in any area and they would be taken care of. as the Flood Control people know their business and are very efficient. Councilman Hamilton agreed that this is an Inconvenience as his business suffered for 4 months during this type of project. Mrs. Patterson stated they were not asking this matter to be dropped, but only that alternative routes be looked Into. Mayor Blewett promised to look into every possible angle as the Council had no desire to inconvenience anyone. Mr. Ruth stated in summary this plan was envisioned in 1962 by a private firm hired by the City and all of the segments of this plan have led up to this Olive Street storm drain; therefore they cannot build storm drains elsewhere. Also. Olive Street does flood and he had pictures showing this condition during the recent storm. Mr. Perry summarized by saying all the people who had in- quired had been given extensive information, including a report from the Flood Control District and the placement of the storm drain on Olive Street had required thousands of hours of research resulting in a detailed study and analysis of the project. The work will be done in segments so that it will not Involve the whole street during the 3 months. An environmental impact report will be presented at the next meeting for review and approval. 00- City Clerk Balkus presented a letter from Leslie Martin stating that he had applied for a City License and a Build- ing Permit and was told by the Planning Director that he would have to have a Conditional Use Permit. He stated he found the rules and regulations very ambiguous, and that one of the requirements was not listed. He had appealed the decision of the Planning Director to the Planning Commission and they upheld the Planning Director's deci- sion. He was now appealing the decision of the Planning Commission to the Council. City Attorney Flandrick stated there is a section in the Code that provides that the Planning Commission has the authority to review a particular area and if they find there is an ambiguity in the Code they make a recommenda- tion to the Council by resolution and if the Council accepts that recommendation that is the interpretation that is to govern, but there is no appeal procedure as such, as regards these things. The Council can refer it back to the Commission but the Code does not authorize the Council on its own authority, without the Planning Commission's recommendation, to make a clarification of ambiguity as such, and the commission has found there is no ambiguity in a Conditional Use Permit for this type of use. Leslie Martin, 3225 Rita Street, Pasadena, stated he owned the M-1 lot at 5114 Etton Street, and that he was denied a business license for the reason that he must have a Conditional Use Permit. He cited the following sections of the Municipal Code: 9630. SAME. PERMITTED USES. No person shall use any properly located in the M-1 Zone for any purpose other than those hereinafter specifically set forth. 14a. Fabricating of steel, including snap riveting, pro- vided if such use is located within 300 feet of any R-Zone, a Conditional Use Permit shall be obtained. 9631. SAME. USES PERMITTED BY CONDITIONAL USE PERMIT. The following uses shall be permitted in the M-1 Zone, pro- vided that a Conditional Use Permit is first obtained as prescribed in Section 9472 et seq. hereof: 3a. Contractor or construction offices, shops and yards. Mr. Martin stated his property is M-1, bounded on the West by Etton, and on the South, East and North by M-1. He requested clarification of 9630 14a.) Mr. Gordon explained that the problem is that Mr. Martin just doesn't want to apply for a Conditional Use Permit. He passed around photographs of the property. He stated that the Council adopted Section 9631 3a) about a year and a half ago and the intent was to require all contract- ors yards to have a Conditional Use Permit in an M-1 Zone. The section referred to is a clerical error and should have been changed at that time and was not. The City is presently attempting to bring this Northeast area up to Code. Mr. Flandrick explained that there is a clerical error in the code. Mr. Martin stated he had agreed to put up walls. Mr. Gordon stated that the adjoining property on Gayhurst is scheduled to be rezoned R-1. Mr. Martin stated it is not R-1 now and may not be for a year or two and why should he have to put up a block wall now; however, he is willing to do so. Discussion followed that this problem should be referred to the Planning Commission for clarification. Mr. Flandrick explained that the Planning Commission had re- viewed this request for clarification of ambiguity. As set out in the Code, the Planning Commission, after review, makes findings and recommendations clarifying that ambigu- ity and Council action is limited to their recommendation. Under the Code as written an appeal is not automatic as in the case of a zone variance, etc. Discussion by Council that possibly this appeal should be in the Code. Mayor Blewett requested a report from the Planning Commiss- ion by the next meeting. Roller for property at 15204 Arrow Highway City Attorney Flandrick explained that there is a code section under zoning regulations with respect to Conditional Use Permits that prohibits the refund of any money paid by the applicant upon withdrawal of the application. The possi- Mr. Perry introduced Mr, Charles Ruth of the Los Angeles County Flood Control District, who presented a report on these 3 points. Mr. Ruth stated that j,ust after the 1970 bond issue passed the Advanced Planning Section took an inventory of all the storm drain needs remaining in the County, and at that time found that all the major systems had been completed, with the exception of urban or residential areas. They felt this project needed immediate attention. Mr. Ruth presented a number of slides and maps to explain the need for the entire project. Mr. Perry then presented slides taken in the last rain storm in various parts of the area under discussion. Mr. Ruth stated the Olive Street storm drain is not being constructed solely for the people on Olive Street but primarily for the people below Olive Street and even below Los Angeles Street, that without it there could be severe damage to these areas. He emphasized that there will be no special tax assessment to finance the storm drain. He stated there will be inconveniences but the construction will take no longer than 120 days and the protection of 100 years or more, the life of the storm drains, wilt be well worth the small inconvenience. TESTIMONY WAS GIVEN BY: Mrs. Arlene Patterson, 14050 Olive Street, agreed with the report that Stewart Street is the problem; that the water is coming down off Arrow Highway. She stated she was speaking for the majority of the people on Olive Street and during the last 10 years it has been torn up time and again for different projects and they all object to having it torn up again. Two years ago it was paved and is now a very nice street they are proud of. If there must be a drain, and she agreed something has to be done, she sugg- ested the drain be put along Arrow Highway or on Stewart Street. She presented a petition with 37 signatures pro- testing this project, explaining that many of the people who signed are elderly and could not get to the meeting tonight. Councilman McCaron asked Mrs. Patterson if the people have been led to believe this is going to cost them extra money and she replied that every time a cement truck goes down their street they are led to believe it is going to cost more money because after the street improvements were put in the property was reassessed and taxes were raised. Mayor Btewett assured her the reassessment of Baldwin Park had absolutely nothing to do with the new street; that it just happened to be the year all the area was reassessed Mrs. Patterson commented there were older people on the street who could not stand one more tax raise and the best way to avoid this is to keep any further improvements off their street. Councilman Hamilton assured Mrs. Patterson this would not cost one cent more in taxes and possibly the people had been misinformed about it. Continued) MR.
