Mayor Blewett presented the Resolution to William Gushing, President, and Robert Palmer, Immediate Past President of the Baldwin Park Optimist Club on behalf of the Council, stating that because of their outstanding and fine work for youth and the community he was declaring May 21-27, 1973 as Youth Appreciation Week" in order to demonstrate to the young people that they are appreciated. Continued from February 21, 1973.) Proper postings and mailings had been accomplished. There were no written protests. Director of Public Works Perry, after reviewing the case, recommended that parcels 1 and 2 be eliminated from the district as the asphalt drive approaches are adequate and will not require concrete. Discussion followed regarding dedication in return for installation of improvements and the use of Gas Tax money for some improvements in the City. TESTIMONY WAS GIVEN BY: Mrs. Joyce Carson, 12507 Sprout, Norwalk, who objected to some people receiving improvements in return for a dedication and others on the same street having to pay for theirs. Councilman McCaron explained that under State Law, the City 1s allowed to use Gas Tax matching funds on select streets, but this would not apply to property dedicated in the past as application must be made during the current year. Further discussion followed regarding ambiguities in dedi- cations for improvements. As there was no one else in the audience desiring to speak either in behalf of or in opposition to 73-S-9, Mayor Blewett declared the public hearing dosed. Further discussion followed by Council whether to hold all driveway approaches on the balance of the City's improvement program or to take each case on individual needs, as in the event of a hardship. COUNCILMAN MC CARON MOVED THAT THE DIRECTOR OF PUBLIC WORKS IS HEREBY ORDERED TO TAKE THE STEPS NECESSARY TO CAUSE THE CONSTRUCTION OF CERTAIN IMPROVEMENTS IN CASE NO. 73-S-9, WITH THE EXCEPTION OF THE DRIVE APPROACHES ON PARCELS 1 AND 2, PURSUANT TO SECTION 5870, ET SEQ. OF THE STREETS AND HIGHWAYS CODE. COUNCILMAN HAMILTON SECONDED. There were no objections. Mr. Perry explained he had sent Mrs. Hattie Cochrane, 3247 Mangum Street, a tax relief brochure from the State which in her particular case amounted to 96% of her property tax, over $300.00, and since he has not heard from her he assumed she was satisfied, as the $300.00 exemption more than offsets the costs of the improvements. Judith Avenue, replied to Mr. MRS. MYRTLE ASQUITH Perry that if a person on Social Security is receiving one 13138 E. JUDITH AVE penny of County aid the eligibility for tax relief is denied. Mayor Blewett asked Mrs. Asquith to get all information possible on this situation and contact him and he would see what could be done. Mrs. Dorothy Mayes, 3453 N. Big Dalton, requested a continu- ance of the hearing because of an extreme hardship case in this district, a woman op Social Security who could not possibly afford even the curbs and gutters, much less the drive approach. Discussion followed regarding the method of notifying the property owners of improvements, and the feasibility of deleting the drive approaches in this district. As there was no one else in the audience desiring to speak either in behalf of or in opposition to 73-S-12, Mayor Blewett declared the public hearing closed. He reiterated that the Community Design Element is not a precise plan, but a general guide. He recommended that the City Council adopt the report and future street map. Also that the City establish a policy of encouraging implementation of future streets. That specific plans be adopted establishing actural alignments for problem areas but only after property owners show an interest in developing. That when there is only one remaining vacant lot that could provide an outlet for a future street the staff be required to examine the feasibility of the purchase of that lot. That the Commission and Council examine the possibility of setting up a fund to buy lots needed to provide outlets for future streets. TESTIMONY WAS GIVEN BY: Michael Dargus, 12360 East Francisquito, objected to the proposed extension of Egil Street. He stated there would be only 7 properties that would have a legal lot split. Also, if the streot were continued, it would leave a 20 to 40 foot island. That 95% of the lots involved would not have a legal 20 foot front yard setback the Code requires. Council discussion followed and the concensus was that Egil Street be removed from AGP-25. COUNCILMAN KING MOVED THAT THE PLANNING COMMISSION'S RECOM- MENDATIONS FOR AGP-25, INTENT TO REVISE EXISTING COMMUNITY DESIGN ELEMENT. BE APPROVED. WITH THE EXCEPTION OF EGIL STREET, WHICH IS TO BE DELETED FROM THE GENERAL PLAN. COUNCILMAN GREGORY SECONDED. In answer to Councilman McCaron» City Attorney Flandrtck explain- ed that with the elimination of Egil Street as a future street, there would be no deep lot development by anybody in that area unless they came In with a specific plan. There would be no further lot splits on any lot. It would have the effect of creating an Interior lot without a zone variance because the regulations now require that you have frontage on a dedicated public street or on an existing private street. There were no objections. The motion carried and was so ordered. 00- It was the time and place fixed for a public hearing on 73-N-6, to determine whether certain premises and buildings and struc- tures constitute a public nuisance at 4332 Center Street. Proper postings and mailings had been accomplished. There were no written protests. Director of Public Works Perry presented slide photographs of the property and reviewed his report and stated the owner would re- move the debris this weekend. COUNCILMAN HAMILTON MOVED THAT THE CITY COUNCIL APPROVE THE RECOMMENDATION OF THE PLANNING COMMISSION ALLOWING TWO HOUSES ON DEEP LOTS IN THE AREA OF OLIVE STREET BETWEEN FORTIN STREET AND LANTE STREET SP-27) AS SHOWN ON EXHIBIT A" PLANNING COMM- ISSION RES. 73-3. COUNCILMAN KING SECONDED. There were no objections. The motion carried and was so ordered. 00- Under Oral Communications, Mr. T. E. Carpenter, 4346 Jerry Ave- nue, objected to the solution of the discrepancy in payment of over $8,000.00 to the street sweeping contractor, stating that the service was very poor and his street was not only not swept once a week but not even once a month. Mr. Mocalis explained that the City was unable to determine who was responsible for the overpayment and therefore an agreement had been reached whereby the City would receive service every week rather than every other week to make up the deficit. Mr. Flandrick commented that the City felt this would be a better arrangement than to institute a law suit, as the City could lose the suit or 1'*' it was won would cost more than utilizing the additional service. Mr. Perry stated that the service had not been too satisfactory and the City was studying other methods of street sweeping services. Mrs. Myrtle Asquith, 13138 East Judith Avenue, felt this over- payment should be used for the Mid-Valley Drug Project. Mayor Btewett explained that the Council has authorized the money for this if the Federal Grant is approved. 00- City Clerk Balkus presented a request for a Temporary Use Permit from the Church of the Redeemer for a Drug Prevention Ratty to be held March 17, 1973 at Morgan Park. He recommended that the low bid of $7,670.00 from Nadar, Inc., 16141 East Old Valley Boulevard, La Puente, be accepted. COUNCILMAN HAMILTON MOVED THAT THE BID OF NADAR, INC., 16141 EAST OLD VALLEY BOULEVARD, LA PUENTE, IN THE AMOUNT OF $7,670.00 BE ACCEPTED AND THAT THE MAYOR AND CITY CLERK BE AUTHORIZED TO EXECUTE THE CONTRACT. OC- Director of Public Works Perry presented a report requested at the last meeting regarding the policy of drive approach construction, i.e., 1. if existing asphalt adjacent to curb is in good condition, concrete not required, if deteriorated require concrete; 2. where curb and gutter is required con- struct concrete drive approach. If concrete drive approach waived, the City will install 6" wide asphalt strip back of curb to protect street. If hardship is shown drive approach can be waived. He recommended, if Council agreed, approval of this policy. Councilman McCaron asked if Council would be advised of any hardship cases and Mr. Perry assured him they would, through either a written protest or an oral presentation. COUNCILMAN GREGORY MOVED THAT THE DRIVE APPROACH CONSTRUCTION REPORT BE APPROVED AND THE CITY MANAGER BE INSTRUCTED TO ISSUE A DIRECTIVE AS AN ADMINISTRATIVE REGULATION. COUNCILMAN HAMILTON SECONDED. The motion carried and was so ordered. 00- Director of Public Works Perry presented an Environmental Impact Report from the Los Angeles County Flood Control Dist- rict on the Olive Street Storm Dra^'n. He stated that the only negative impact would be the inconvenience during the construction and recommended that the report be received and filed. Councilman McCaron pointed out that although the construction will take about 6 months to complete, about two-thirds of the area will not affect any residences. Mr. Easton, representative from the Los Angeles County Flood Control District, stated there would be no location disrupted for the full 6 months, that once a particular location is started, it must be finished in a specified time. That the street will be restored to equal or better conditions upon completion. In answer to Councilman Hamilton, Mr. Easton explained that when the contract was awarded there would be a completion date established 6 months after that time. That the comple- tion date would be extended only in the event of bad weather, strikes, or anything beyond their control; otherwise it will be finished on or before the completion date. That this Ordinance would correct a clerical error that should have been made in 1971, clarifying Conditional Use Permits in an M-1 zone. Councilman McCaron felt that standards could be set in the Code of what is expected of anyone coming into an M-1 zone and not require a Conditional Use Permit. Councilman King stated the only way to control usage in M-1 zones is with a Conditional Use Permit. Councilman McCaron stated that the tendency towards Condition- al Use Permits is getting out of hand, that requirements should be specifically stated in the Code so a person would know what he could or could not do without coming to Council for permission. The motion carried and was so ordered. 00- Under New Business, Councilman King asked that a letter be directed to the Superintendent of Schools and the School Board with respect to those properties the school district has off the tax rolls, to see what the intended usage is at this point, since we have quite a reduction in attendance in the schools over the past 3 years, to determine if this property could be put back on the tax rolls if there is no need to build. Councilman Hamilton agreed and stated that the State of California is recommending this action at the present time. 00- City Manager Mocalis presented a report on the Irwindale Raceway, stating that on March 11, 1973 and March 25, 1973 there will be special events at the Irwindale Raceway. As the Council directed previously, he and the City Attorney contacted the District Attorney in December, 1972 and were told the California Highway Patrol and the Los Angeles County Health Department could make necessary tests at sound pressure levels. The City Attorney has directed a letter to District Attorney Busch informing him of our wish to have this done.
