Continued from April 4, 1973. Proper publication, postings and mailings had been accomp- lished. There were no written protests. City Attorney Flandrick stated Mr. Dennis Irving, the appli- cant and operator, appeared at the last meeting and a staff report and other evidence was presented indicating a failure, among other things, to comply with the conditions of approval on the Conditional Use Permit. At that time the case was held over to this meeting to allow the staff and the City Attorney to review the pending litigation between Mr. Irving and Mr. Wallingford and others with regard to the title to the property, which is the subject of the Conditional Use Permit. He contacted the attorneys for the parties and re- quested copies of the pleadings to ascertain the nature of the lawsuit and its effect, if any, on the proceedings. He contacted Mr. Dotan, Mr. Wallingford's attorney and Mr. Marcus, who is Mr. Irving's attorney. He had received no return phone calls from Mr. Marcus and about 10 minutes ago he received a tetter f.rom Mr. Marcus indicating that this matter was set for final argument in the Superior Court on May 4, 1973 at 1:30 p.m. This was confirmed by Mr. Dolan's letter which was received at 7:00 p.m.. May 2, 19731. Copies of a11 such letters would be made for distribution to the Council. Mr. Flandrick stated that Mr. Irving was in earlier this evening and had indicated that he was ill and had to leave and he was again making a request for a continuance. Mr. Ftandrick stated that insofar as this litigation was con- cerned, from his examination of the letter, he did not think it had any effect upon the proceeding. This hearing is for the purpose of considering whether the Conditional Use Permit should be revoked. The question of litigation between the parties as to ownership of the property was not particularly relevant to the proceeding. He pointed out that the fact that the case wilt be argued on Friday, May 4, 1973 does not mean that it wi11 be decided at that time; that it is up to the judge as he may take the mat- ter under submission for 30, 60 or 90 days at the maximum and even 1f he does decide it on Friday there are various motions that may well be made. There are findings of fact, conclu- sions of law, judgments, etc. that would extend that 30, 60 or 90 days and also, there is a 60-day appeal period if an appeal is taken, a11 of which may amount to 18 months to 2 years. This case has gone on for some years and it was within the Council's discretion as to whether to continue the matter or act on it after closing the hearing. Planning Director Gordon sunmarized the time period involved. The Conditional Use Permit was approved in November of 1969 and the requirement was that various physical Improvements such as sewers, water tines, fire hydrants, curb and gutter, sidewalks, street dedication, screening walls, landscaping. and parking facilities be provided. The commission when they approved this permit gave 2 years for compliance and this date was in November of 1971. At that time the prop- erty was Inspected and nothing had been done so about a month after that the Planning Commission started the revoca- tion proceedings. The proceedings have been going on since about January of 1972, about one year and 3 months. There have been continual requests for extensions, always with the promise that two weeks from now, three weeks from now, a month from now, things were going to happen. It is over 3 years now and nothing has been done and from this point of view it would be hard to justify an extension. Councilman Hamilton stated that it has been about 3 years and 7 months since this was Initiated and in view of the report from the attorney, this could go on for another 18 months. He stated he felt Council should act on this tonight. Councilman Blewett concurred with Councilman Hamilton, stating this should be acted upon as the litigation has no bearing on the case; the fact that the nuisance does exist; the fact that they have not complied, and he thought that was enough reason for Council to act. As there was no one in the audience desiring to speak either in behalf of or in opposition to CP-136R, Mayor King declared the public hearing closed. COUNCILMAN HAMILTON MOVED THAT THE CONTINUANCE BE DENIED AND THAT COUNCIL CONCUR WITH THE RECOMMENDATION OF THE PLANNING COMMISSION. COUNCILMAN BLEWETT SECONDED. Councilman McCaron asked if the motion was to revoke the Conditional Use Permit. Mr. Flandrick stated if the motion carried a resolution would be drafted formally revoking the Conditional Use Permit as issued, with stated reasons there- for. Mr. Perry explained that two of the property owners in the area objected to the freeway construction, which had a detri- mental effect on their business. He had talked to the State Chief Resident Engineer in charge of all construction in this district and he Indicated that in six weeks from April 27th, the intersection of Merced and Puente would be completely Continued) PUB. There was also discussion with regard to the frontage road and off and on ramp to the East of the intersection of Merced and Puente. The Resident Engineer stated that the work on this portion would be completed within 3 months. The time limit of this job would be September 27, 1974 but the construe- ion should not hamper the flow of traffic in the intersection and along the frontage road. The work on 73-S-38 is scheduled in July, 1973 which would be in excess of the 6 weeks required to complete the intersection by the State. Mayor King declared the public hearing opened on 73-S-38. Testimony was given by: Marie Earhart, 14365 East Garvey, stated her husband has been disabled since 1962 and they have frontage on Garvey and it would be a hardship to do the work at this time; therefore, they would appreciate an extension of time. Councilman Btewett stated that due to the economic hardship these people have suffered their request is not unreasonable and felt that Council should grant an extension. Councilman Hamilton stated he had just talked to one of the owners whose business had been so bad because of this that he almost closed his business and had to lay off over half of his employees and he was in agreement with Councilman Blewett. Councilman McCaron felt that the item should be dropped and brought up at a public hearing at some later date after the freeway work has been completed. Councilman Gregory felt this should be held over and anything else in this particular area also should be delayed. Proper postings and mailings had been accomplished. There were no written protests. Director of Public Works Perry presented slide photographs of the property and reviewed his report. Testimony was given by: Mrs. Margaret Burke, 13632 Monterey Avenue, owner of the property, stated that the trailer has been disconnected and was used only for storing camping equipment. Mrs. Burklg, 13642 Monterey Avenue, stated her lot borders the lot in question and regarding the back lot, she had informed Mrs. Burke over a year ago her grandson was back there smoking, so they do use it; in fact they were digging a tunnel under the garage. They have disconnected the electricity In the trailer but the boys had been sleeping in it. The house is a 2-bedroom home and there are 2 daughters and their 8 children in there. There are never but one or two trash containers put out for pickup. They had to put up a fence between the properties to keep the children out. Last Sunday they started to put up a reed fence attached to the wire fence to screen the trash and the eldest boy tried to jerk off the reed before it was completed. T. E. Carpenter, 4346 Jerry Avenue, stated he has become concerned over the last several years regarding public nuisances and had made a study; but his main reason for testifying was to announce the Cleanup Week in Baldwin Park this week so these people might use it to help with the cleanup work. RESOLUTION NO. 73-78 FINDING AND DETERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 73-N-16) Mr. Perry stated that under Section 2 a time limit of 30" days should be established and Council concurred. Discussion followed as to necessary cleanup time. COUNCILMAN HAMILTON MOVED THAT RESOLUTION NO. 73-78 BE ADOPTED AND THAT FURTHER READING BE WAIVED. COUNCILMAN BLEWETT SEC- ONDED. The motion carried and was so ordered. 00- It was the time and place fixed for a public hearing on SP-28, to study the block bounded on the North by Waltham Street, on the West by Syracuse Avenue, and on the East by Barnes Avenue, and on the South by Bess Avenue, to see whether the City should allow the construction of two houses on lots over 11,000 square feet. Initiated by the Planning Commission. Proper publication, postings and mailings had been accomp- lished. There were no written protests. Planning Director Gordon presented a resume and map of the area and recomnended approval of the plan. On behalf of Eje Latino, he extended an invita- tion to all the Council and staff and anyone in the audience to attend the celebration between 1:30 and 6:00 p.m. 00- Mr. Ed Parrott, 13502 Tracy Street, stated he had received a letter from the City objecting to having a horse on his property; that he had been a resident of Baldwin Park for 15 years and had always had an animal on his place. He felt the tetter not only affected him but also alt the people in Baldwin Park who own horses and he contacted as many as he could and they asked him to appear before the City Council to request a temporary permit to have horses until the City reaches the point where horses will automatically be phased out. Most of these people own large pieces of property, his being a commercial acre and it is nice to have a family sport such as horseback riding. Councilman Gregory said she had lived in Baldwin Park for some time and could well remember the days when her neighbors had horses, up until very recently, in fact. She questioned if there were that many horses to justify setting aside an ordinance. Mr. Gordon explained that it would only be a guess as to how many horses there are in the City, as they crop up from time to time; but there is, under the minOr variance procedure adopted last year, a special provision which allows keeping of special animals where circumstances would allow it, so presumably if a person were to apply for a variance and the lot size was adequate with the proper setbacks from neighbor- ing houses, the City could probably permit horses to be kept. One of the things we would look at is a place to ride, as one of the problems may be that they would be ridden out in the street. Mr. Flandrick suggested the matter be referred to Mr. Gordon as he was not at all certain it would be acceptable under terms of State law regarding minor variances. The Council directed Mr. Gordon to take the matter under advise- ment and suggested that Mr. Parrott contact Mr. Gordon. 00-. Mr. Ralph Middleton, 13122 East Corak Street, read a letter from State Senator Alfred E. Song, stating this tetter would shed some light on some of the half-answered questions in regard to the City Charter Election and taxation. Letter In official files.) Mr. Middteton distributed copies of the letter to the Council. 00- Mrs. Amos J. Slater, 4814 North Stancroft, stated it was her understanding that the City Attorney serves at the pleasure of the City Council and questioned on whose authority the City Manager ordered the billboard across the street in the name of the Informed Citizens Committee. Councilman Blewett replied he had donated the $72 to pay Foster & Kleiser for the sign. Mr. Mocatis replied that after an involved study the comm- ittee recommended this price, applying to 8^5 x 14 size or under only. 00- Gloria Zook, 4817 North La Rica, asked to see the receipt showing who paid for the printing of the booklet Let's Work Together in Chartering our Future," and how many copies were made. Mr. Mocalis stated that 1n response to an inquiry from Mr. Ralph Middleton, he had given the Council a memo explaining the reason for printing a pro-charter flyer. He had explain- ed to Mr. Middleton that not only had this been printed but also an anti-charter flyer from the Baldwin Park Improvement Association, entitled Calling all Voters of our City" had been Included. The charter was also reproduced and the charter ballot argu- ments, pro and con, and a letter from the City Attorney res- ponding to legal questions asked by the City Council. This material was available to all citizens. A great number of people made inquiries about the charter and were informed that copies were available in the City Halt. The Chamber of Commerce asked for copies and made the same materials available to citizens. He said Mr. Middleton still objected after this explanation and he felt the neighborhood informa- tion committee should pay for the copies they distributed at one of the forums, which they got from material at the City Hall. This committee was contacted and they agreed to pay for 75 copies and a bill in the amount of $5.74 was sent to the committee. 00- Mrs. rtle Asquith. 13138 East Judith, stated It appears whenever there is any politicking going on in Baldwin Park the City employees are always Involved. It is our taxpayers' money who pay theirs and the City Manager's salaries and most of these employees live out of town. At this point it appears that we have a rnlni-Watergate in progress in this town and she asked what does the Mayor intend to do about it. Mr. Mocalis replied that one of the most constant complaints is a lack of information. The State law does not require a City with a population of less than 50,000 to send out copies of the proposed charter. The Council determined, even though not required by law, that the charter be made available to all the people in this City. Secondly, regarding the employees of the City, four meetings were held with the employees and each one was given an ex- planation of the charter so that when citizens inquire about it they would be informed so as to be able to answer some of the questions regarding the history of the charter, why it had been held in abeyance. It was also made very, very clear to the employees they were not to sell pro or con on the charter and there was to be no pressure. 00- May 2. 1973 Page 7 MRS. E. Carpenter, 4346 Jerry Avenue, asked to have a point clarified regarding the penalties for violation of an ordin- ance. His copy of the Municipal Code calls out for 100 days under the general law and the charter calls for 6 months. Mr. Flandrick explained it is a matter of State law that a violation of any local ordinance is a misdemeanor which is punishable by a maximum of $500 fine and/or 6 months in the County jail. Mr. Carpenter asked that thi^ be looked into and stated we have a lot of ordinances that are redundant, such as horses, etc.; others pertaining to morals have gone out the window 50 years ago and they all should be overhauled. RE MUNI CODE RESOLUTION NO. 73-79 DESIGNATING THE CITY'S REPRESENTATIVES AND ALTERNATES TO CERTAIN MUNICIPAL COMMITTEES AND ORGANIZATIONS Councilman McCaron questioned appointees to the East San Gabriel Valley Planning Committee and Southern California Congress of Planning, stating the Planning Commission should be designated representatives and alternates. Mayor Kinq stated that the Planning Commission designates their representatives and the Council designates their representatives or alternates in case of absence. No other member of the City Council goes to these particular meetings; however, he wished they would because it cer- tainly would take a burden off two councilmen. Council- man Gregory and himself. He welcomed Councilman McCaron as a representative. Councilman McCaron declined, stating he felt the Planning Commission should be designated as City representatives as the membership of both organizations is composed of mainly planners and he did not think the by-laws indicate others. Councilman Gregory stated she had a lot to do with the writ- ing of the by-laws for the East San Gabriel Valley Planning Committee and she is a Past-President of the organization. Ever since she has been on Council, 9 years, there have always been both Councilmen and Planning Commissioners rep- resented, also engineers and planning directors. Mayor King, in response to Councilman McCaron"s request that the Planning Commission should be present, asked Mr. Gordon to so inform the Planning Commission. Councilman Blewett stated that Mayor King is the President- elect of the East San Gabriel Valley Planning Committee. Councilman McCaron stated that on the League of California Cities, historically it has always been the Mayor and Vice Mayor as the representative and alternate. Councilman Blewett explained there was an agreement for the change there and Councilman Hamilton asked him if he would take over the East San Gabriel Valley Regional Library Board and if it was all right with the Council he would like that. She attends the League of California Cities at all times and is on a good many of the committees and would like to continue that, but would rather be an alternate or representative if she is going to make all the meetings. Councilman Blewett asked Mayor King if he was planning on attending the Local Agency Formation Commission City Selection Committee meetings. Mayor King stated no, and asked Councilman Blewett if he wished to be on that committee. Councilman Blewett stated yes, as there are some areas of interest to the City and he has worked on annexations in the past. Mayor King requested that Councilman Blewett be designated as the representative for Local Agency Formation Commiss- ion City Selection Committee meetings. COUNCILMAN GREGORY MOVED THAT RESOLUTION NO. 73-79 BE ADOPTED AS AMENDED AND THAT FURTHER READING BE WAIVED. COUNCILMAN BLEWETT SECONDED. There were no objections. The motion carried and was so ordered. 00- City Clerk Batkus presented a claim from Mr. and Mrs. Richard Bair and recommended that the claim be denied and referred to the insurance carrier. COUNCILMAN GREGORY MOVED THAT THE CLAIM OF MR. AND MRS. RICHARD BAIR BE DENIED AND REFERRED TO THE INSURANCE CARRIER. COUNCILMAN BLEWETT SECONDED. There were no objections. The motion carried and was so ordered. 00- City Manager Mocalis presented a report from the Police Department requesting authorization for signing an agree- ment with the City of Los Angeles for Automated Want and Warrant System and explained that this is a very valuable method of acquiring monies due the City from outstanding warrants and could represent a substantial Increase in revenue. He recommended that the Mayor be authorized to sign the agreement. He stated this has been budgeted for 2 years but the City has not been able to get into the system. Baldwin Park has over 5,000 warrants outstanding, representing a dollar loss In excess of $380,000. \ COUNCILMAN GREGORY MOVED THAT THE MAYOR BE AUTHORIZED TO ENTER INTO AN AGREEMENT WITH THE CITY OF LOS ANGELES FOR AUTOMATED WANT AND WARRANT SYSTEM. He estimated that within less than a month the cost would be reimbursed and from then on the City would realize a profit. There are at present 5,000 unserved warrants. Chief Adams explained that all of the local warrants are served as they come in. That better than 50% of the war- rants coming in are out of city warrants" and these the system would benefit directly, as they could be queried. through the system. Mr. Mocalis explained if we were only able to serve 10% of the outstanding warrants in the initial year on the backlog alone, we would get back a return of $38,000. He expects in excess of $30,000 a year return to the City. We have $30,000 budgeted for the system at the present time. Chief Adams explained further that one of the reasons these warrants are not served is because the City is not in the system and therefore we are unable to check outstanding warrants when a man is picked up for questioning. He stated the City of Los Angeles is the only system available to cities. 00- City Manager Mocalis presented a request for a leave of absence for Pat Dawson, Finance Department, who is required to have back surgery. He reconmended a leave without pay of 90 days. COUNCILMAN HAMILTON MOVED THAT A REQUEST FOR LEAVE OF ABSENCE WITHOUT PAY FOR 90 DAYS BE GRANTED TO PAT DAWSON. COUNCILMAN BLEWETT SECONDED. The motion carr- ied and was so ordered. 00- Mr. Mocalis presented a request to authorize signing of a contract between Southern California Rapid Transit District and the City of Baldwin Park to establish a one-day per week bus service. He extended his thanks to the Chamber of Com- merce for alt their help in achieving this and stated that Don Holmes is on the committee. Two buses will be in service on Thursdays from 9:00 a.m. to 4:00 p.m. at 10<t per ride. The Chamber of Commerce will work with businessmen to coordinate sates so these customers will be able to take advantage of them on these days. The Senior Citizens activities are be- ing coordinated in Morgan Park to take place on Thursdays. Baldwin Park is the first City in the Southern California Rapid Transit District to have this kind of contract for 10^ a ride. If approved the system will be under way the latter part of May. The cost is as follows: The City will pay 71% of Southern California Rapid Transit District actual cost and receive credit for the fares. City cost per day: $168.48. Esti- mated cost for 6 months: $4,382.48 less the generated bus fares.
