Donoghue, 4638 North Landis Avenue hardship). 73-S-48 TESTIMONY WAS GIVEN BY: Mr. Thomas Maddie, owner of property at 4139 Alderson, stated that unless the curb was put in on all properties on both sides of the street he was not in favor of the improvement. He stated he was from Los Angeles and had picked up this property as an investment and wanted a firm commitment as to when the work would be completed. Director of Public Works Perry explained that the Rail" road owns some property in the area and with the exception of about some five feet which has not been dedicated the entire street will be improved. Construction is scheduled and all work will be completed in July. He explained that a letter had been received from Mr. Robert Clink, 4145 Alderson and that he recommended that the drive approach be eliminated on the property. 73-S-51 TESTIMONY WAS GIVEN BY: Mr. Richard Brownetl, 13358 Waco, stated concrete was too costly and he reguested a black top driveway. Mayor King suggested that Mr. Brownell meet with Mr. Perry and resolve the drive approach problem. 73-S-52 A letter of protest was received from Mrs. Donoghue and Mr. Perry recommended that the drive approach be deleted. 73-S-55 TESTIMONY WAS GIVEN BY: Marc Silva, 14887 East Clydewood, representing Ray and Donna Silva, stated that when his father had purchased the property 20 feet of the property had extended into the street. This 20 feet had been dedicated for street purposes by the previous owner and the area had been graded out for street widening. He asked if a Lot Split would still be required if the curb and gutter was installed. Also, he questioned whether the City would assume any of the responsibility as this property had remained on the tax rolls for a time after it was dedicated. Mr. Perry explained that a Lot Split would be necessary and that requirements would have to be met; that instal- lation of the street improvements under an improvement district would eliminate that requirement. He suggested that Mr. Silva telephone him and the property would be reviewed. 73-S-56 Mr. Perry stated that a hardship protest had been received from Mrs. Beebe and he recommended that the drive approach be eliminated. The motion carried and was so ordered. 00- It was the time and place fixed for a public hearing on AGP-26, intent of the Baldwin Park City Council to con- sider adoption of a new Land Use and Circulation Element for the General Plan. Initiated by the Baldwin Park Planning Commission. Proper publication, postings and mailings had been accomplished. There were no written protests. Planning Director Gordon reviewed his report on the proposed General Plan which is a long range policy guide for 20 years. The elements of the General Plan would be land use, circulation and transportation. He directed attention to the wall map indicating major streets and freeways and commercial and industrial land uses in the city and adjacent to the city. Residential land use will be discussed on June 6, 1973, and circu- lation, transportation and land use will be discussed on June 20, 1973. He outlined and summarized the General Plan Report. The first part of the General Plan will spelt out the development Goals of the city. Policies to be used to implement the goals of the General Plan and the Results. Cities using this approach generally come up with the best possible community and physical environment for the people. The City Council Implements the General Plan through the following major tools: Zone Changes, Capital Improvement Programs, Variances, Conditional Use Permits, and Specific Plans. The General Plan is not a fixed plan and will be updated yearly by the Planning Commission and the City Council. The last time the City adopted a General Plan was in 1959 and it has not been updated since. Land use and the character of the central San Gabriel Valley has changed dramatically. The plan should be continually updated for healthy physical development of the city. The three public hearings on the General Plan will cover a Land Use Transportation and Circulation study. To be adopted in 1973 are the three required state elements which are Housing, Seismic and Noise. The state requires a General Plan and that it have certain parts to it. Under a new State Law, effective July 1, 1973, zone changes and zoning in cities must be compatible with the General Plan. If not, citizens and other interested parties can file issue in court to force the city to comply with the General Plan. After a General Plan is adopted it is hoped we will have Specific Plans for four areas in the community that have special problems. We have already adopted a Specific Plan for northeast Baldwin Park. The area of the San Bernardino Freeway, Northwest Baldwin Park industrial) and downtown have special problems which need special solutions. The three major goals for the Industrial area are a revenue base for the community to furnish the services that are needed for the residential parts of the City, where taxes are not sufficient to pay for the public services needed. The highlights to be looked for in the development of the industrial areas will be Sates Tax and Property. Sales Tax Is important to the city and the property tax is most important to the school district. The industrial area will also create jobs for the community. The physical appearance of the industrial area should also be improved. Most of the industrial areas are on the outskirts of the city and effect the image of the city as a whole. Mr. Gordon pointed out the four industrial areas on the wall map. The Northeast area for which we established a Specific Plan about six months ago; the Northwest area which has excellent freeway access; the Ramona-BadiTIo area; and the area down to the south of the freeway. These areas have separate potentials. Assets for the Industrial areas are good railroads, low-priced land., good labor supply and freeways are excellent. Situated between Industry and Irwindale should help the city's Industrial program. Utility services are good in most of the Industrial areas. These assets should help us get quality development. The Policies recommended are that we Recruit industrial development which pays high taxes, the expansion of existing business and development of utilities in the areas where they are a problem so the developer will only have to pay for his share of the construction. Mr. Gordon also suggested encouragement of Job Placement and Job Training Centers within the community. This would not only encourage industrial development but would help the people in the community. The purpose of Commercial areas is either for Retailing or offices. The Goals suggested are Revenue to finance the public services the community needs; creation of jobs for the community; provide more goods and services available in the community; and improve the physical appearance of the Commercial areas. Commercial areas are on our major streets and have a strong influence on how people view Baldwin Park. He pointed out the Commercial areas. A problem in the city is overzoning. With unused commercial zoning the general tendency is for the property to become blighted, causing a bad physical appearance which is a major problem on our major streets. Excess commercial zoning weakens existing commercial centers and does not help but instead discourages business. The downtown area is the center for professional offices, government offices, utilities; comparison shopping for clothing and furniture; convenience buying for food and liquor; and a finance center. Hopefully, to develop the downtown we will have to try to develop specialty uses that will do well and thrive in the community. The Business Reconnaissance Study points out the problems with the excessive commercial zoning downtown and an excess of commercial buildings throughout the city which causes scattering of commercial uses and weakens the growth of the downtown area. A poor mixture of uses, appearance, inadequate selection of merchandise results in no major drawing in the downtown area. There are three types of retailing because they have different characteristics and they go in different areas and the city has definite possibilities for each type. The convenience and neighborhood small markets, liquor stores, barber shops, service stations, of which we have an excess if we get more of this type of business sales tax will not increase, it will just take business away from one store and give it to another. The downtown is what would be called a Community Center. Downtown West Covina and Puente and Amar are similar centers in the sense they compete with each other with similar types of stores. The result is they split the buying power in this area. The Regional Commercial, includes discount department stores, for which there is no potential in this city, and motor home sales and vehicle sales are areas where we do have a potential. Strip Commercial zoning, which is a problem does not thrive unless there is a high volume of traffic on the street. Almost none of our streets have enough traffic for healthy strip type zoning and as a result most areas with strip zoning are not doing well. The General Plan describes ground rules for granting zoning. It appears Rapid Transit will come up with plans for developing a fixed line in which the San Gabriel Valley win be included. Baldwin Park should decide which type of mass transit is best for the community so that when rapid transit does come the city will be in a position to take a stand. This will have a major effect on how the San Gabriel Valley develops in the next 20 years. The policy the Planning Commission is recommending is to continue to work on the appearance of commercial areas so the city can improve the commercial image. We should come up with a plan with the cooperation of the downtown merchants for the commercial business district and also for development near the San Bernard!no Freeway. We should be aware of the problem of oversaturation of low revenue businesses; identify dollars and recruit businesses that have a high potential for creation of jobs or revenue; eliminate our excessive C zoning and develop a policy for mass transit. Mr. Gordon showed graphs indicating retail sales for every year since 1956. Sales have increased but compared to the County wide average it is not as good as it could be. He stated industrial construction has been going up slowly but steadily since 1965 and this appears to be a good year. Maps of freeways indicated traffic in the area from which the bulk of business will be generated. Fire insurance ratings throughout the city for residential are the same with a 4 rating. The industrial areas change from 4.5 to 6 to 9. The higher the rating the higher the insurance rates. The reason rates are high is because of the distance from a fire station, hydrants or inadequate water lines. Mayor King thanked Mr. Gordon for his excellent report and asked for testimony on AGP-26. There was no testimony. Councilman Hamilton commended Mr. Gordon on the excellent report and resume which included many good recommendations and comments. Mr. Gordon stated extra copies of the report and the map were available to the public. This concerned a sewage problem which has been in the hands of the city since April 19, 1973. She learned of the problem on May 10th, and called Mr. Mocatis. She understood Mr. Hale worked on this. On April 11th the sewer was put in. On May 14th it was inspected and sealed. She appreciated this as it had solved a senior citizen's problem. She stated that there was a problem across the street which was turned into the city two months ago, the address is 13351 Waco. This concerns a house in which an elderly lady lived. The house is now vacant and in deplorable condition, and children are going into the house through broken windows. The building and tall grass are a fire hazard. She requested that something be done. She also asked that the spray of the wash in her area be checked as there were mosquitos. She stated that at 9:00 a.m., May 17, 1973, the Health Council would present their program, in the Morgan Park Community Building, to Los Angeles County for services in Baldwin Park. Councilman Hamilton asked what would be the average cost to the business or property owner and if Edison puts the facilities underground then each property owner has to run 1t from there to his building. Mr. Perry stated he did not have an average cost, however, most of the costs would be in the $200.00, $300.00 to $400.00 range. Each owner would have to connect and convert the existing overhead drop to the underground. He stated that Edison and General Telephone Company were providing most of the wiring. The responsibility of the property owner is to take down the mast arm, convert the meter box to an underground system and run a conduit out to intercept the Edison and the Telephone facilities. The owner also has to do the trenching of asphalt or concrete and the necessary patching. Councilman McCaron requested that on the financing that some of the money be withheld so that when streets are redone there is sufficient money held in abeyance to handle the cost of putting in the conduit. Mr. Perry stated he did not know if the utilities, without the formation of a district, would put in conduit in anticipation of a district being formed. However, he would check. Councilman McCaron suggested that the cost should be ascertained for the laying of this conduit. Then when a district is formed this would be sold back to the district. NO. 653 ADOPTED Councilman McCaron stated that on the appointments of League Representatives it was stated that during the time when Councilman Gregory was Mayor pro tern that she was not an alternate delegate to the League of California Cities. He researched this and found that she was an alternate and he wished to have this clarified. Councilman Gregory stated that she had meant that when she was attending the meetings as a committee person she was not an alternate. 00- Mayor King requested that prior to adjournment to an Executive Session that everyone stand for a moment of silent prayer in honor of Charles Morehead. Councilman Gregory suggested that a resolution expressing sympathy and tribute to Mr. Morehead be prepared and sent to Mrs. Morehead. There were no objections. 00- AT 9:08 P.M. They have an investment and upkeep is a problem, also utilities, and other users are some- times destructive. Mayor King stated he understood there was some mis- understanding as to the use and also the Leagues inquiry as to whether they would be able to continue the usage they had had in the past. He asked that Mr. McCutloch, Mr. Mocalis and Mr. Lucas meet at their convenience and discuss this issue. Mr. Mocatis and Mr. Lucas will then report their findings and hopefully this issue will be worked out to everyone's satisfaction. 00- Mr. T. E. Carpenter, 4346 Jerry Avenue, stated he had T. E. CARPENTER not heard anything about the speedway sound test results. 4346 JERRY AVENUE He also asked if the test sound pattern extends outside the city, to alt the areas affected. He wanted some assurance that the test area would encompass a large enough area to be effective. Mr. Mocalis stated that he and the City Attorney had met with the district attorneys' representatives and arrangements have been made for sound pressure tests to be made by a county government agency and also residents of the area have been contacted for statements from them concerning the noise. After the sound pressure tests have been completed this evidence will then be presented to the district attorney and if he believes there is sufficient evidence for a criminal complaint one will be issued, if he thinks there is not sufficient evidence for a complaint he would so advise the city. At that time the Council would decide whether they wish to have a civil action or drop the issue. He stated the sound experts would establish the areas for testing. City Attorney Flandrick stated the tests would cover the radius to any extent that they can show any sound deviation, so the tests would be effective. 00- C-ity Clerk Batkus read by title: RESOLUTION NO. 73-91 APPOINTING MEMBERS TO THE PERSONNEL BOARD OF THE CITY OF BALDWIN PARK RES. NO. /3-91 APPOINT MEMBERS TO PERSONNEL BOARD She explained that adoption of the ordinance would LYNN COLE & reappoint Lynn Cote and Marshall Hadley to the Board; MARSHALL HADLEY that at the last time she had spoken to them they were not adverse to continuing to serve on the Personnel Board.
