Initiated by the Planning Commission. Continued from May 16, 1973). Commercial and Industrial Areas were presented at the May 16, 1973 meeting and Residential Areas were considered at this time. Planning Director Gordon stated that the hearing had been opened on May 16, 1973; that at the meeting this evening testimony should be taken and the hearing continued to June 20, 1973. He indicated on the watt map the Land Use proposals and the major street system of the City. Blue major commercial areas; striped industrial areas; orange multifamily use, R-3 or trailer parks; green parks, schools and open space. This depicts the land use over the next 20 years. In the Residential Area the Planning Commission recommends three major goats during the next 20 years; improve the appearance of the residential neighbor- hoods, continue to improve and upgrade the quality of these areas. Doing both of these will increase the pride of the people in the City. He discussed multifamily areas and apartment construction. There has been no conventional apartment construction in the City since 1964. On the subsidized type of apartment construction the Federal Government started a program to serve families in the $4,000.00 to $8.000.00 group. There are two of these apartments in the City, one on Torch Street, and another on Foster near the high school. These programs have been terminated by the Federal Government. The other types of subsidizing are referred to as public housing. These are for families with less than $4,000.00 per year. There are none in the City and there can be none without the approval of the Council. This program is also being terminated by the Federal Government. The subsidized rents for the Torch and Foster apartments will be about $155.00 for two bedrooms, whereas, the average City rent is $110.00. The City has about 236 acres of R-3 zoning; 1/3 is being used for multifamily; 1/3 single family; 1/3 is scattered or vacant. He did not believe that the undeveloped areas of R-3 wilt develop because of the change in apartment construction and the decrease in population growth. He pointed out the Railroad property from Stewart to Foster and along Ramona in the City of Irwindale to the 605 Freeway. Parts of this property are zoned C-2 and R-3 and about one half is zoned R-t. There are 15 acres in the property. Some years ago there was first reading on an Ordinance for R-3 on the property and there has been no change since then. The property is stilt tied up for transportation use and may be released this year by the ICC at which time the property wilt be marketable. There has been opposition to R-3 for the use of the property, however, the Planning Commission recommends muttifamity use. Ramona Blvd. between Lucky Market and the freeway has not improved for many years and it does not appear that it wilt develop until the Railroad property develops. It is not known what Irwindate plans for the future of the 15 acres in their city. The City has three toots to control the development of the property. Zoning, Environmental Impact Reports and Precise Plan Controls. This will guarantee good quality development for the area. The Planning Commission recommends that no development should be approved unless details are reviewed and marketing reports and other information are provided by the developers, so this will be good development for the City as this is an important piece of property. The Railroad is interested in a profitable development. The City is interested in development which win pay for the services required, that win not overload any public services, that will be an asset aesthetically to the whole area, and that is compatible and complimentary to all the existing and possible uses in the neighborhood. The Railroad understands that the City does not want any type of public or subsidized housing. Single Family construction slowed down about five or six years ago and started to come back about two years ago. The problem with single family units is the price range. No one is building a four bedroom home over $24,000.00, or three bedrooms over $21,000.00. At the same time the average price in Los Angeles County is $32,000.00. As the City image improves builders win erect better houses. There will not be much new home construction during the next twenty years. Most improvement will be maintenance and upgrading of existing homes and other types of neighborhood improvement projects. A good image for the community will attract more and better types of businesses. The three major things making up the image of the community are its physical appearance, the reputation and appearance of the schools and the reputation of the community as far as safety- These are the major requirements of home owners when buying in a new community. The population in 1970 was about 47,000 based on information from the County; the estimate for 1990 is 54,000 which is a modest increase. The policies recommended are construction of good quality multifamily units, removing some of the excess R-3 zoning, upgrading R-1 and R-2 developmental standards, making improving the image of the City as a number one priority item. An increased effort of code enforcement will help improve the image such as annual review of each street to eliminate weeds, junk cars, etc. Some cities have such a review every three months to prevent neighborhood deterioration. The City should also investigate Federal Grants available for improving neighborhoods street construction, tree planting, anything which win add to the quality of neighborhoods. Appearance wilt be improved by stronger emphasis on tree planting, curb and gutter construction and public land- scaping. Over the next 20 years there should be strong emphasis on citizen action in improving the community, such as cleanup, paint up and fix up campaigns, starting a Baldwin Park Beautiful Committee, neighborhood associations to get local people to provide leadership for improving their own neighborhoods. Also important is improving the revenue basis for the City as almost a11 the recommendations involve public programs which depend upon an adequate financial base. City Clerk Balkus again administered the oath for those wishing to testify. Mayor King asked for testimony, stating the Council encourages comments. Testimony. Mrs. Gloria Zook, 4814 N. La Rica, stated her question was in regard to R-3 property, not only the rail- road property, but muttifamily zones. She suggested that Council appoint a committee composed of Planning Commissioners, businessmen and possibly a resident that have an interest in the community. Mayor King requested that Mr. Gordon outline the present procedure. Mr. Gordon stated that all development is regulated by the standards in the zoning code. In addition there is the Precise Plan control under which the Planning Director may review plans and may make requirements over and above zoning code requirements. Mayor King asked how difficult it would be to have people come in for precise plan review. Mr. Gordon stated it would be very easy for apartment construction review, there have only been two within the past 6 years. Commercial and industrial construction review would require people who are willing to meet weekly during the day. Testimony. Mrs. Myrtle Asquith, 13138 E. Judith Avenue, MRS. MYRTLE ASQUITH asked for an answer regarding the committee, as she had 13138 E. JUDITH AVF understood there was to be a committee. Mr. Gordon explained that originally it had been discussed that the Planning Commission would act as a committee. Other alternatives were also discussed, however, it was decided that in order to expedite the process and not delay developers that there would be a one man review and the code stipulates the Planning Director. Mrs. Asquith stated that on the Railroad property she would prefer to see individual family dwellings. Mayor King stated that it appeared that the best use of the area would be R-1 rather than high density. He asked for comments from the council. Councilman Hamilton explained that the reason Council favored the one man review rather than a committee was to save time for a developer. If a precise plan review takes too much time a developer becomes discouraged and leaves town. He cited industrial properties as an example. He stated he had confidence in the Planning Director, although his understanding was that the Planning Director, City Engineer and City Manager consult on Precise Plan hearings. He stated he had no objection to a five man committee, however, he objected to a procedure which would hold up a developer. Mayor King asked that the City Manager check into the possibility of having a five man committee as long as this would not hinder a developer. Councilman McCaron asked the reason for the conimittee request. Mrs. Zook did not cite a specific incident, but stated that she did not feet that a city of this size should have one person saying whether a developer could come in or not. She understood that they can appeal upon payment of a fee. She stated cases before the Planning Commission and Council have been held over for many meetings and this discourages developers. She stated that by the next meeting she could have some specific incidents. Mayor King stated that it has been his experience on checking when developers had called him about precise plan review problems that the staff had made the correct decision. Mayor King asked for comments from the Council with respect to R-3 development along the railroad property. Councilman McCaron stated that any decision regarding the railroad property would be premature until such time as they apply to abandon the property. They are the owners and until such time as it is known what they have in mind a discussion was pointless. Mayor King stated that we must adopt a General Plan and adhere to it. He asked if the General Plan for this area was approved as R-3 and then later the citizens want the land use changed what would be the procedure. City Attorney Flandrick stated that the General Plan can be modified at any time after public hearings. Testimony. Mr. Ed Witson, 5023 N. Etton, stated he felt the hearings should be held street by street as whole neighborhoods are affected. He would like his area to be R-1 and that M-1 should be in another area. Mayor King suggested that Mr. Witson see Mr. Mocalis to further discuss individual problems in his area. Testimony. Mr. Michael Dargus, 13260 Francisquito, stated that in 1966 the City had an agreement with the railroad to zone the property R-3. He asked if the City was bound by this agreement to have R-3 zoning. City Attorney Flandrick stated the agreement did not refer to zoning. Mr. Dargus read a letter dated September 16, 1966, from the City Manager to Mr. Steiner. He stated this was a commitment regarding zoning. Mr. Flandrick stated that the agreement in the City Manager's Office has no reference to zoning. It refers to land acquisition. Mr. Dargus asked if the property had been cleared through escrow on the portion which the City purchased. Mr. Mocatis stated that escrow had not closed, that money has been put aside for this purpose, and that there is no agreement as to zoning. MR. ED WILSON 5023 N. ELTON MR. Approximately 3 months ago property owners and renters or lessors were notified of an informal meeting in the Council Chambers. At that meeting only two property owners from District No. 2) appeared. These were not real protests, but inquiries for information. A cost analysis estimate was included with the mailing as to what the property owners cost would be. This estimate was intentionally high. One property owner appeared at the informal hearing on District No. 3 and inquired as to the costs involved. Since that time one telephone call was received from the Pastor of the church at 4161 Baldwin Park Blvd. Mr. Perry and a representative from the Edison Company investigated and found that it would be possible to serve the church, leaving them in the district with respect to the front of the property, but serving the church with Edison and Telephone service from a pole located at the northerly tine of their property. This wi11 eliminate any cost to the church in this district. TESTIMONY WAS GIVEN BY: Mr. George Seidner, 20 W. Orangegrove, Arcadia, owner of 14322 and 14324 Ramona Blvd. property, stated he was informed that the City and the Edison Company were con- sidering putting in the vaults at no cost to the property owner, but there is a cost of connecting up and he did not receive notice of this cost. He did not know that owners had been notified as to the cost for hookup to the vault. As he is sti'11 paying for a $1,500.00 assessment for curb, gutter and sidewalk he did not feet this was an appropriate time for an additional assessment. He found that his hookup cost would be from $1,000.00 to $1,500.00. In answer to Mayor King, Mr. Perry stated that Mr. Seidner had been notified and his cost for the two addresses was estimated at $548.00, however, he felt that the actual cost would be less. This cost involves 50 feet of trench- ing, laying of conduit for Edison tines, connecting to the existing overhead facility, and conduit for the telephone facility. Mr. Seidner stated he was a general contractor and would like to know the distance to the vault and who made the estimate and was this a firm bid price. Mr. Perry stated this was not a firm bid, but quotations from two different electricians and 10% was added. The distance to the vault in the back alley on Mr. Seidner's property is about 50 feet. Mr. Seidner stated he did not feel that this was an adequate estimate of the cost. He stated he would not object to this additional cost in the future but he did at the present time In answer to Mayor King, Mr. Perry explained that if the districts were approved this evening the property owners wi11 have a year before thy have to hookup July 1, 1974. The owners will hire their own electrician. There is no assessment by the City for the work. He stated that he works 10 hours a day and that he felt the Council should personalty contact the businessmen and citizens to ascertain their wishes and problems. Mayor King assured Mr. Waltingford that the wishes of property owners are considered and are Council's first concern and that as of this time no decision has been made regarding this underground improvement district; that the purpose of the hearing was to ascertain the wishes of those involved. TESTIMONY WAS GIVEN BY: Mr. James R. Hollingstead, trustee of the First Christian Church at 4161 Baldwin Park Blvd., asked how their service would be provided if they were not within the district. HOLLINGSTEAD TRUSTEE FIRST CHRISTAIN CHURCH 4161 BALDWIN PARK BLVD Mr. Perry explained that there were two poles on the property, the most easterly pole will be removed and the property would be serviced from the most westerly pole for both electric and telephone and there would be no cost to this property. TESTIMONY WAS GIVEN BY: Mr. Bud Warren, 4191 Sharons Way, owner/operator of the Park Bowl, asked what their cost would be. He also asked if the cost of their interior hookup to the power units was considered. Mr. Perry stated their estimated cost would be $1,010.00. This was for a new pole tine in back of the Bowl, requiring 20 feet of trench, as there is a high load factor of 1000 amps the cost is high for the short distance. He stated that a modification within their panel would be required to hookup. Mr. Warren stated the estimate he had received for the panel modification runs between $1,500.00 and $2,000.00. He stated they had been in business about 9 months and had spent approximately $5,000.00 in modification improvements and that an additional cost at this time is a problem. Mr. Waltingford stated he had talked to an electrical contractor and his estimated cost for hookup was $1,000.00 and that is the reason he was protesting. As there was no further testimony for or against Under- ground Utility District Nos. 2 and 3, Mayor King declared the public hearing closed. Mayor King stated that possibly the district was a little premature following so closely the street improvement costs, the sign ordinance, the architectural theme, etc. Councilman Hamilton stated that the small businessman on Ramona has been hit pretty hard on Ramona, the street improvements were an expense, trash enclosures are costly and although this improvement would beautify the City It should be made in the future when the owners can better afford the improvement. In answer to Mr. Seidner, City Attorney Flandrick explained that the Edison Company will not put any facility anwhere unless there is a public right-of-way or they have a private easement in favor of the Edison Company. City Manager Mocalis suggested that Mr. Seidner see Mr. Perry and go over the maps showing the location of dedicated properties and easements. Councilman McCaron requested that a report be made showing the actual cost of the district for the funds being expended as far as the Edison Company is concerned and then give property owners an idea of the benefit in valuation to their individual properties. This wilt help the owners determine whether they wish to proceed sooner or not on acquiring the benefit to the property itself. He would also like to know what will happen to these funds, whether they can be delayed, whether the district can be put in as far as the agency is concerned and then the tie in held over for a certain grace period. He would like exact dates and then let the owners decide. Councilman Hamilton requested that the City contact a contractor for a bona fide estimate for property owners costs and continue the hearing for 30 days. If we go past July they wilt not be able to get bids out and do the job this year. however, if a decision is made by July 18, 1973 they can proceed. 00- On behalf of the Ladies of the Baldwin Park Chamber of Commerce, City Clerk Balkus announced the recipients of the June, 1973 Community Service Awards for outstanding service to the community without remuneration. On behalf of the Chamber of Commerce, Mayor King presented an award to Geoffrey Markell, and the Youth award to Phi Hip Howard, commending them for their outstanding service to the community. 00" Mr. Ralph Middteton, 13122 E. Corak, stated he was speaking for himself. He referred to recent items in the paper relating to a crime wave within the City. He has talked to officers in the department and he finds it is not inefficiency in the Police Department but it is a lack of man power to cover the City properly. We have a good department, however, he suggested that additional officers be considered in the coming budget to more adequately serve the City. Recruitment and training is a continuing problem. He asked Mr. Middleton if on consideration of the budget a choice had to be made between more officers or an increase in taxes which he would prefer. Mr. Middleton stated money had been set aside for City Hall, however» there is an obligation to the citizens and crime is increasing. He thought that the citizens would not object to possibly a two cent increase if they fully understood the need. He stressed that we do have the money and the need is now. Mayor King stated this would be checked into very thoroughly. 00- Mr. T. E. Carpenter, 4346 Jerry, stated some of the $400,000.00 should be used now for expansion of the police department. He stated that June 21, 1972 he came before Council regarding checking properties and homes considered as a nuisance. He referred to UBC, Code Section 201, right of entry and stated the owner should be notified before entry. He has researched records and cannot find that the owners have been notified. When he had commented in 1972, the City Attorney had stated that basidy Mr. Carpenter was correct in his analysis and that the code was in the process of being revised and the revisions would include the nuisance abatement ordinance as we11 as revisions to the UBC with regard to the entry of buildings. Mr. Carpenter stated the last revision on the nuisance abatement ordinance was made May 19, 1971 and that nothing has been done since. He questioned if the entry has complied with the UBC, and asked for comments from Council. Mr. Perry stated that on all cases this evening the owners had been notified; in fact every attempt is made to reach the owner many times by telephone. If permission is not granted the property is not entered and inspection is made from outside. City Manager Mocatis explained that the present code is lengthy and cumbersome and he, the City Attorney and staff have met many times and completed a complete revision of a11 the laws of the City and this will be before the Council in about 60 days. The ordinance regarding abatements is one of many sections which are being improved and updated. This has been a lengthy job in addition to the many other responsibilities. Mr. Carpenter stated that after a whole year there is no evidence in the files that these people have been contacted or that the code has been changed. Mayor King stated that Mr. Perry had contacted the people and there had been no complaints from the people other than Mr. Carpenter. He asked that the City Manager again check into this. Mrs. Amos J. Slater, 4814 N. Stancroft, stated she had heard Mr. Perry state that property owners were notified when possible, she asked for what reason he was unable to notify property owners. The code reads that a reasonable effort must be made and every attempt is made. He stated most of the inspections are made from the outside and only vacant houses are inspected. The procedure has been changed and they make a reasonable effort to contact the people. Mrs. Slater stated she could not understand why the owners cannot be contacted when this information is available from the assessors records for tax purposes. Mr. Perry explained that the City checks these same asessors records and many times there is no forwarding address. Due to various complaints, the Council back in February, requested the Chamber of Commerce along with interested citizens to pursue the problem of graffiti within the community. He was elected as chairman of the committee which is composed mainly of young people and their response and enthusiasm has been most satisfactory. They have reached about 85% of the people involved in the graffiti problem. There is a segment of the young population that is not involved in the effort to date, hopefully they will be enlisted in the program. This Saturday, June 9th, will be the kick off", at 8:30 a.m. He invited the Mayor and Council to join them at Rudy's Town and Country Market on Ramona Boulevard. He also invited the Chief of Police. As this is a national problem the chairman of the Chicano caucus in Sacramento, Assemblyman Richard Atatorre, has consented' to took at our program. He has expressed hopes that if it is successful, he will junk his graffiti legislation in the hopes of a soft sell rather than the hard sell. The legislation means that if they catch a minor under the age of 18) with an open aerated can of paint this can be a felony. There is also a possibility that Assemblyman Harvey Johnson will be present. County Supervisor Schabarum has been contacted. Community response has been tremendous in aiding in this endeavor. He complimented the businessmen in the community, specifically. In and Out Hamburgers, Angels and Standard Brands in El Monte, the Seven Up and Pepsi Cola Bottling Companies, Littlejohn, and many citizens have consented to cook and donate food. They anticipate 100 young people wilt be present Saturday morning. As they anticipate a slight traffic problem he requested that the City Council allow closure of the alley between Syracuse and Barnes, parallel with Ramona, from 8:30 a.m. to 1:00 p.m. If approved they wilt inform the people in the area as to what is going to transpire. He suggested that those attending dress in old clothes, bring a rag and a paint roller and join the kids in their efforts as they are more than meeting the community half way. This is an opportunity for that segment of the young population to, in a positive manner, project themselves into the community and to take pride in their undertaking and to stand up and say we can do something constructive" and we can get involved". He again requested that the Mayor and the Chief of Police be in attendance. Future projects are scheduled for June 30th, a paint in" on the intersections of Los Angeles and Merced Street. There will be two in June, one in July, one in August and then hopefully the young people feet that at that time they can start to project themselves into the community on the basis of some murals for which some of the property owners have graciously donated wall space. Mayor King commended Mr. Moreno on a fine job chairing the committee and motivating the young people. He also commended the young people for their efforts in the comnunity. A decent place for the young people will be considered next and the young people can also be instrumental in this. The Council welcomes their participation in all activities which wilt stimulate their interest in the community and help the Council to make it a better community. Councilman Hamilton commended the young people on their efforts and their pride in the City. Chief of Police Adams stated he would not be able to be present this Saturday as it was necessary to be out of the City, however, he will be present on June 30th with his own paint brush. Mr. Moreno stated they anticipated a very large T.V. coverage showing the image that the youth and police are working together in Baldwin Park and that the Council will also be working with them. Captain Hebert stated that Lt. Iskaderian will be on hand to represent the police department. On June 30, 1975, the State of California will implement a statewide bicycle code, similar to the vehicle code, and at that time our ordinance will be preempted. Bid requests were sent to ten major suppliers on March 23 and April 26, 1973. No bids were received at either bid opening. He expressed thanks to Mr. Middleton for arranging consultations with suppliers and stated that on May 21, 1973 Shell Oil Co. submitted a proposed price per gallon of gasoline of $0.274. The City paid $0.1877 per gallon for 1965-66 through 1969-70. The proposed price for 1973-74 is an increase of 70.36%. This is the identical price offered to other cities who received a proposal. He recommended that he be authorized to accept the Shell Oil Co.'s proposal Mrs. Duncan explained the intent of the proposal as follows: the quotation is $0.274, which excludes the Federal Tax of $0.04, and includes the State Tax which is not exempt. The motion carried and was so ordered. 00- Mr. Mocalis stated a telephone call had been received today from the City of Arcadia regarding AB1324 dealing with horse racing. The bill has been changed in committee to take away the rights of the city to ban horse racing on Sundays. They ask that a letter be drafted to the Racing Board and to the Chairman of the Ways and Means Committee indicating that this City is opposed to taking away the right of a city to determine which days they will allow horse racing in their local jurisdiction. He thought that those receiving the Community Service Awards indicate that this is an ideal community to develop this sort of a model. They are asking for suggested ways to allow volunteers to more efficiently use their talents and time to help fellow citizens to become involved and help themselves. This is an eleven month program. Where driveway approaches are not existing and are required under the district they will also be constructed in concrete. Their letter indicates they had attempted to gain permission for space from the four service clubs who erected the sign at Maine Avenue and Ramona Boulevard and were refused. Mayor King stated all organizations should have the same privilege. Councilman McCaron stated that the sign area should be available to all clubs, however, he did not believe there was an Optimist Club at the time the sign was built and installed. He felt that the other clubs would not object to including another club, but the additional club would have to pay the cost of changing the sign and unless the other clubs want to participate the cost would be the obligation of the Optimists. The bottom of the sign would have to be changed and each dub name made smaller. They are also requesting a temporary construction easement across the same piece of property. The assessors roll shows that the City does have ownership of the property. This easement will be an underground drainage system. He recommended that the Mayor and City Clerk be authorized to sign the easement on behalf of the City. He also recommend- ed approval of the plans and specifications. Councilman McCaron asked how the area between Center Street and Rivergrade Road would be handled. He also asked what effect the deletion of Olive Street would have on this particular item. Director of Public Works Perry stated that the district would procure easements from the owners where the proposed extension of Olive Street was formerly planned. They win also have to secure permission from the Department of Water and Power and Edison. He explained that the deletion of Olive Street would have very little effect on the project, however it will be necessary to make a modification in the design for catch basins with the deletion of the curb and gutter. The District will go out to bid on this project on June 8, 1973. He stated there was a possibility that if action was not taken on some districts within the very near future the allocation will be lost. He will investigate this and report back to the Council. Councilman McCaron requested a full report on the allocation and what the requirements are before Council takes further action. With the approval of the Council, Mayor King reopened the Public Hearing. There were no objections. TESTIMONY WAS GIVEN BY: Norman Northrup, Pastor of the First Christian Church, asked the size of the conduit to be used and also if there could be a deferred payment program worked out to help property.owners, possibly two or three years. Mr. Perry stated the size on conduit would depend upon the type of service and the amount of amperage and the distance. The owner would have one year to hookup, and possibly the City could finance and be paid back if this was the wish of Council. TESTIMONY WAS GIVEN BY: Mr. Glen Taylor, District Manager, Southern California Edison Company, 534 N. Barranca, Covina, stated delay would have a bearing on certain things with the PUC. Sometime back they were asked to have all the cities bring in some kind of an agreement in 1973 and spend the dollars allotted them. Baldwin Park has been working for some time to form some underground districts. The Edison Company had to write a release to the PUC that the City of Baldwin Park was ptanninq their districts to save the dollars that were going to Be taken away. These districts will cost the Edison Company about $230,000.00 and the Telephone Company about $40,000.00. Each year this has been delayed the cost has gone up about 10%. It is unknown what additional years of delay would cost as these are estimated figures. If the City has an intent to form underground districts and this is delayed now, it wouldn't be formed until 1975 as budgets are in for 1974. This could be delayed and put back in for action for 1975 and the dollars could be saved. Mayor King thanked Mr. Taytor. He asked if 1975 would be agreeable to the property owners. Mr. Seidner and Mr. Wallingford stated this would be more agreeable. Councilman Hamilton stated the increased costs for carrying this over a couple of years should be considered. Council discussion followed. Rev. Northrup asked that Council explore the possibility of a deferred payment plan, as allocating money would be a savings to owners if there is money available. City Manager Mocatis stated that State Law does not allow the use of public funds for work on private property. He explained that the vaults are on public property.
