Residential Areas were discussed at the June 6, 1973, meeting, and Circulation and Trans- portation were considered at this time. Planning Director Gordon stated that after tonight's presentation and testimony, the hearing should be continued to July 5, 1973, when the staff wilt make a presentation on the rezoning necessary to make the zoning ordinance compatible with the General Plan as required by state law. There will also be a presenta- tion of an Environmental Impact Report as required by state law. Hopefully on July 18th the final report will be ready for adoption, with all the corrections and revisions recommended by the Council. He outlined the two major goals which the Planning Commission focused on: 1) to provide a street system which encourages good Quality business and residential development; and 2) to insure adequate transportation exists for a11 citizens. He went on to say that the Commission's major find- ings were: 1) that the major street system is in good shape; 2) that the City is funding a once-a- week local bus route; 3) that the Rapid Transit District has one bus route through the City; 4) that the Rapid Transit District is planning to build a Rapid Transit System in the San Gabriel Valley. Among the problems discussed was the diagonal street system which exists south of Ramona. The fact that our streets do not run in a north-south, east-west direction between Ramona and the San Bernardino Freeway does cause some problems. Second, the 1acl< of east-west circulation parallel to and along the San Bernardino Freeway has created problems with development in that area. Third, the lack of good adequate transportation has also been a problem. The Commission summarized the report with six rec- ommended policies for adoption as part of the General Plan. The first was to complete curb and gutter con- struction on a11 major streets. The second was to complete sidewalk construction on all major streets. The third was to finish the major streets by: 1) extending Merced between Live Oak and Nubia; 2) ex- tending Puente between Ramona and Los Angeles; and 3) extending the bridge over Amar, which is a rec- ommendation the staff is adding which was missed in the Planning Commission Hearings. The fourth recom- mendation is to work with the State Division of High- ways to improve access and circulation along the San Bernardino Freeway. The fifth would be to encourage the establishment of more bus routes and more service on existing routes within and through the City. The sixth and last recommendation would be to adopt a policy on what type of mass transit would be best for the City of Baldwin Park. Mayor King thanked Mr. Gordon for his presentation and asked if anyone 1n the audience wished to tes- tify at this time on AGP-26. Testimony. Somehow the Impression got across that she didn't feet Mr. Gordon should have anything to do with 1t. She feels that Mr. Gordon should head the Precise Plan Committee. There was no further testimony. Neidlein, 3668 Barnes Avenue, stated that he had received notice that it would cost him about $293 for curbs and gutters and that he had plenty of time to take care of the bill. When he called again, they said when they start put- ting them in, they'll send you a notice, and you have thirty days to pay. Then he got another notice in the mail that it had gone up to $340, and if it wasn't paid by the 27th, it goes up another $50. When he called about it, he was told there was a new contractor in Baldwin Park. Director of Public Works Perry explained that the pro- cedure has been that you have five days after this hearing to pay the cost of the improvements. If it is not paid, then it becomes a lien on your property, and an administrative charge of up to a maximum of $50 or 25% o^ the work is added. This has been the policy for quite a white. Mr. Neidlein said that they had been told the reason the fee had gone up was that there was a new contrac- tor in Baldwin Park. Director of Public Works Perry stated that it was pos- sible theirs was an old district, and the prices ori- ginally quoted were for the contractor of the last fiscal year. We received new bids January 1st and have since then been operating under those prices. He asked Mr. Neidlein when he was quoted the price of S?93. r. Neidlein answered that they got the price about four months before they put in the curbs, which may have been from the former contractor. Director of Public Works Perry stated that they re- ceived new quotations about January 10th. The motion carried and was so ordered. 00" It was the time and place fixed for a public hearing on 73-N-19, to determine whether certain premises and structures constitute a public nuisance at 4071 Center Street. Proper postings and mailings had been accomplished. There were no written protests. Director of Public Works Perry passed around photo- graphs of the property for Council's review and stated that the following conditions exist on the property: 1) substandard sheds, 2) trash and debris, 3) weeds, and 4) alleged zoning viola- tions regarding chickens, ducks, etc. Entry was refused, so the photographs were taken from outside the property. He stated that after careful review of the property, the staff determined that the property should be de- clared a public nuisance and recommended the follow- ing: 1) Rehabilitate or demolish alt substandard sheds; 2) Remove alt trash and debris. Including outside storage; 3) Remove all weeds; 4) Correct all zoning violations in regard to chickens. i Council reviewed the photographs. Proper postings and mailings had been accomplished. There were no written protests. Director of Public Works Perry stated that the fol- lowing conditions exist on the property: 1) sub- standard sheds, some partially burned, 2) heavy shrubs on the front and rear of property, 3) trash, debris, and outside storage, and 4) weeds. He stated that after careful review of the property, the staff determined that the property should be de- clared a public nuisance and recommended the follow- ing: 1) Rehabilitate all sheds or demolish. Demol- ish alt sheds over 50% destroyed by fire; 2) Remove a11 shrubs and undergrowth from front and rear yard except trees. All shrubs in the front yard set back are to be cut back to a height of not greater than three feet; 3) Remove a11 trash and debris; 4) Re- move a11 weeds. The property owner had been contacted and entrance was refused, therefore photographs were taken from the outside of the property. Council reviewed the photographs. Mayor King called for testimony on 73-N-20. As there was no testimony. City Attorney Flandrick stated that apparently there was not a representa- tive of the owner, Mrs. Stoskus, present, and in view of the fact that she has an attorney he rec- ommended that this case be held over to the next meeting. He stated that if it was acceptable to Council he would write a tetter to the attorney, advising him of the hearing if he wishes to make an appearance. Mrs. Myrtle Asquith. 13138 E. Judith Avenue, stated that this case referred to property where the lady's street assessment had gone to bond, and the city had sold the bond. The assessment was over $8,000, and the entire street had not been finished. She asked if the Chamber of Commerce had been contacted re- garding this nuisance as they had been helping peo- ple. Mayor King explained that notices were given to the property owner on a11 nuisance cases, and this case had been processed in the same manner with proper mailings to the property owner and posting of the property. There would be no reason to notify the Chamber of Commerce, however they have a right to help if they so choose. Mrs. Asquith suggested that this be pointed out to the Chamber of Commerce, r this tady needs help and has been harassed enough. He did not think this was a fair analogy about the Stoskus property, as 1) the street was formed by the majority of the people who lived on or had property bordering on the street; the city did not initiate the street; it was formed by the majority of the people on the street, and the majority does rule; and 2) Mrs. Stoskus has had several opportunities to sell the rear half of the property, but she will not talk to the developers who are buying land and would like to buy this land to build houses on it. He again stressed that it was the people who owned the land who wanted the street and not the City. Mrs. Asquith stated that when the costs were estab- lished some of the owners had protested, but the district had been formed anyway. Also, she ques- tioned the advantage of selling half of the prop- erty. City Attorney Flandrick pointed out that at the time of the protest hearing, there was a protest by Mrs. Stoskus and one or two others, but the protest was much less than 50% of the property owners in the area, and there were some nineteen or twenty properties involved. Mrs. Asquith asked if it were true that these peo- ple did not realize what was happening—that many of them had to sell their property to get out from under. Mr. Flandrick stated not to his knowledge." Every- one in the district received notices required pur- suant to the 1911 Act, and some of them were at the hearing—those in favor and those in opposition. rs. Asquith commented that if the property were sold there would only be enough to pay off the assessment, and the tady has lived there some years. Discussion followed as to the amount of the street assessment and the valuation of the property. Mr. Flandrick stated the assessment was approxi- mately $8,000. The valuation of the property, as he recalled the figures, is approximately $24,000 to $25,000 in a subdivided condition. Discussion followed that the bond had been paid off and retired. Mrs. Asquith stated the bond was $12,000 when paid off and that she felt this 72-year-old lady should have had some help as this was her home. She also stated that she had not been able to talk to Mrs. Stoskus. Mayor King and Councilman Blewett stated that there were two sides to every issue. Councilman Gregory concurred with the City Attor- ney's recommendation that the attorney, Mr. Weltner, be contacted so if he wished he could appear on be- half of Mrs. Stoskus, and that the case be continued. The motion car- ried and was so ordered. 00- It was the time and place fixed for a public hearing on Zone Change 368, Application for a Zone Change back to R-1 single family residential) from M-1 light manufacturing) on properties located at 5135 and 5132 North Gayhurst Avenue South to 5038 and 5033 North Gayhurst Avenue, in the City of Baldwin Park. Initiated by the Baldwin Park Planning Com- mission. Proper publications, mailings, and postings had been accomplished. There were no written protests. Planning Director Gordon referred to the map in the packets and stated that the northerly two-thirds of the block is M-1, the southerly one-third is R-1. About 90% of the street consists of single family homes on modest-sized lots. He then passed out copies of the Northeast Specific Plan SP-26) which was adopted by the Council several months ago and which recommended land use and zoning for this gen- eral area and included photographs and a colored map. This was a continuation of the implementation of Spe- cific Plan 26. All lots in the zone-change area on both sides of Gayhurst are developed with single family residences, except for 5060 Gayhurst, which is an asphalt paving yard, and 5135, which has a house in front and a small shop in the rear. The existing zoning is M-1. Most of the property was zoned M-1 in 1964. The Specific Plan recommends single family use in zoning for the area. The lots in question are on the average 8,100 square feet and are developed with single family homes. Since industrial land is selling for about $1.00 a square foot in this area, the lot plus the house would have to se11 for around $8,100 for it to be economically feasible to develop, which is far below market con- ditions at this time. Presently there is an abun- dance of small M-1 lots with houses in Baldwin Park for just this reason. The Staff and Commission rec- ommend the zone change from M-1 to R-1 for the fol- lowing reasons: 1. All existing houses would become conforming instead of nonconforming. 2. The zoning would agree with the rec- ommendations of Specific Plan 26. 3. The marketability and loan value of the lots would improve. 4. The possibilities of future blight in the area would be reduced. Planning Director Gordon went on to say that one pro- test was received at the Planning Commission hearing from Mr. Stemn on the property at 5132 Gayhurst, on the east side of the street. He is the holder of the first trust deed on the property, he's foreclosing now, and he expressed a desire to have the property stay M-1. His client would like very much for it to be R-1, so that It can be sold. He asked If the equipment which has been on the property since 1967 would have to be removed if the zone change is made. Planning Director Gordon answered that if business equipment is being stored on the property, that's business use of the property. The question, then, is whether or not it was legally introduced onto the property under the City zoning code. He guessed that it wasn't, so it's probably illegal now and would also be illegal under R-1 zoning. In either case it should be removed. The motion carried and was so ordered. 00- City Manager Mocalis presented Resolution No. 73-108, which amends the budgetary appropriations for fiscal year 1972-73. It's been the custom of the City of Baldwin Park that as changes are made during the year—changes authorized by the City Council—these are put together at the end of the budgetary year, and then one Resolution is passed which actually amends our City budget. He went through each of these changes: 1) On July 7, 1972, the Council au- thorized the purchase of property at 4836 Fortin Street. The value of this was $5,357, and the pur- pose was a future street opening; 2) On August 16, 1972, the Council authorized completion of public works planning renovation—total of $3,500; 3) On November 15, 1972, the Council authorized the pur- chase of data processing equipment totaling $147,189, which wi11 be reimbursed over a period of time from the EVIS Grant; 4) On November 15, 1972, the Council authorized the transfer of one employee from the Pub- lic Works Landscape Section to Public Buildings Main- tenance. in the sum of $7,843. so there was no change in the budget; 5) On January 8, 1973, the Council au- thorized the purchase of a trailer to be used by the EVIS people, a total of $12,323. Originally the grant had provided that we would rent space somewhere. At the suggestion of the Council we investigated the de- sirability of purchase, and it was determined that we would actually save money if we purchased this out- right. We.are being reimbursed at the rate of $402 a month for the rental of this trailer. At the end of the EVIS Program we win own it and have several thousand dollars in savings; 6) On April 15, 1973, the Council authorized and approved the position of Assistant City Manager--$1,844. The Council then authorized the renovation of room 100 for use of data processing and the moving of several offices, for a cost of $11,000. He explained that the total change in the budget was $159,213. Of that, almost $148,000 was the purchase of the data processing equipment for which we wilt be reimbursed. Another $5,357 was for property. We have now added that to the real estate holdings of the City. The total actual extra expen- diture was $6,667. The net change to the budget, ex- cluding the purchase of the IBM equipment and the pur- chase of that property was less than 0.3% of the total budget. Our City was the recipient of a grant which will eventually total over $1,000,000 to make Baldwin Park the central data pro- cessing center for twenty-two of the police depart- ments in the San Gabriel Valley. We have a continuing amount of equipment which has to be purchased under the terms of that grant. One of the needs we have is for an emergency standby generator in case of a power fail- ure when data information is going on our data process- ing system. We went out to bid on this item. We got two bids back--one from Esco. Equipment Service Company, of Long Beach in the amount of $5,897; the other from Swelnhart Electrical of Los Angeles in the amount of $5,960. He recomnended that the lower bid be accepted. COUNCILMAN BLEWETT MOVED THAT THE LOWER BID OF $5.897 FROM THE ESCO EQUIPMENT SERVICE COMPANY IN LONG BEACH FOR AN EMERGENCY STANDBY GENERATOR BE ACCEPTED. COUN- CILMAN HAMILTON SECONDED. The motion carried and was so ordered. 00- City Manager Mocatis went on to say that the EVIS Pro- gram provides for several vehicles for the use of In- telligence people who wi11 be hired under the Program. Originally the Program called for leasing these ve- hicles. As of June 30, 1973, we'll have a surplus of approximately $35,000 in the EVIS Program. If we do not use the money by June 30th, we have to return it to the LEAA. To carry out the Council policy of in- vestigating whether or not we could earn money.by pur- chasing rather than leasing, we have determined that we can purchase these vehicles and use the additional monies for additional equipment under the grant. We have received bids from Mackaig & Sons, El Monte Motor Company, and El Monte Dodge, Inc. Six vehicles were involved in the bids—one was a van, one was a four- door standard sedan, and there were four two-door hardtops. These vehicles will be used for undercover intelligence work. The low bid for the first Vehicle was from Mackajig & Sons in the amount of $4,935.80. The low bid on the one four-door hardtop was from Mackaig & Sons in the amount of $4,371.44. The low bid on the four two-door vehicles came from El Monte Motor Company, but it didn't meet the equipment speci- fications. If the additional equipment were added, the cost would be substantially above the next lowest bid which was again Mackaig & Sons. Their bid was $16,701.85. The recommendation from the Police De- partment was that we accept the bids from Mackaig & Sons» a total of $26.009.09. It was recommended that the Council accept the tow bid and authorize tMe pur- chase of this equipment. It wi11 be entirely paid for by the grant. For a number of years the City of Baldwin Park and the Baldwin Park School District have participated in a joint program which provides recreational fa- cilities after school and during the summertime. Essentially the school district provides an amount of money—normally half of the total. The normal amount has been $27,000. Normally the school district has given us $13,500 and the use of various play- grounds and buildings. Then the City has employed people, has actually run the program, and has con- tributed $13,500. Last year Senate Bill 90 was passed, and this bill gave our school district quite a bit of extra money, but it also did away with the permissive override on the community's special services. The school district was using this spe- cial override tax for a portion of their contribution in the joint program. They no longer have the legal authority to exercise that tax, so they are proposing to the City that they would phase out their partici- pation over a three-year period. There is a bill in the legislature now-- Assembly Bill 1267—which will restore this permis- sive override. He stated that It is the recommenda- tion from Mr. Lucas and himself that, rather than going through a four-year agreement with the school district, we would go into a one-year agreement, ac- cepting their offer of $10,125 for this fiscal year coming up, provided that if AB 1267 or similar legis- lation is approved by the legislature restoring that permissive tax, then the school district would up their contribution again to half of the total pro- gram, or $13,500. He recommended that the execution of this agreement be approved and that the Mayor be authorized to execute on behalf of the City. Mr. Syhre, for a number of years, made this piece of land available to the Bassett Little League as they had no facilities. Chief Syhre is an older gentleman now. He wished to get rid of all his property, so he offered this land to the City with the unofficial proviso that we would continue to let the Bassett Little League use it during Little League season. The Board of Directors of Bassett Lit- tle League would now like to purchase this land. He stated that itiis the feeling of Mr. Lucas and himself that this should be referred to the Recreation and Parks Commission for their consideration and recommenda- tion back to the City Council. The motion carried and was so ordered. 00- Director of Public Works Perry presented a request for the City to pay one-half of the repaying cost for Morgan Alley. Some years ago a verbal agree- ment was reached between the Director of Public Works and representatives from the Baldwin Park County Water District that the City would repave that portion of Morgan Alley adjacent to the dis- trict facilities, for the dedication that we re- ceived from the district. The estimated cost is $1,800. The cost for the entire alley between Maine and Bogart would be approximately $7,500. If this were done, it could be handled by one of the following: 1) general fund expenditure; 2) combination of City participation by general fund plus an assessment to adjacent property owners; or 3) the property owners pay the entire cost through an assessment district. He asked for some direction from the Council—if they just wish to pay for that portion of the alley in the rear of the Baldwin Park Water Company, or we can form a district in that alley. Then our cost method 2) would be approximately $2,500 rather than $1,800. Discussion followed, and it was the general feeling of Council that the City should maintain the alley as there was a great deal of traffic on it. Director of Public Works Perry commented that this was not an item in our proposed budget. He didn't know about it until the budget was prepared. If we reconstruct the whole alley, the cost would be $7,500. It cannot be financed from gasoline tax money. City Manager Mocalis recommended that final decision on this item be deferred until the end of the budget study. Council deferred action on this decision until bud- getary processing is completed to see what funds are available. 00- Director of Public Works Perry stated that the Engi- neering Division inadvertently made a mistake in the language of a legal description for a parcel of land which was dedicated for road 1n conjunction with Par- cel Map No. 817. To correct this discrepancy, he recommended that the Mayor and the City Clerk be au- thorized to sign a Quitclaim Deed which has been re- viewed by the City Attorney and Title Insurance and Trust Company, so that this matter can be rectified. Mayor King added that Mrs. Burnett transported chil- dren while Mr. Burnett cooked. He commended them and alt others who participated for their efforts. Councilman Gregory was very disappointed with the Tribune's coverage of the Graffiti Campaign. There was no story—just a picture. There should be more publicity and more momentum to the move- ment. Mayor King and Councilman Hamilton suggested use of the marquee and a notice in the newspaper to publi- cize the movement. Mr. Moreno stated that he had been contacted by the Los Angeles Times. They want to do a series of stories on the project and the community. They have also been contacted by Supervisor Schabarum. A field representative has set up an appointment with KNXT to do a TV summation of the project. Henry Alfaro of KABC has also contacted them, as well as a gentleman from a federal agency who has money for supergraphics. Some of the businessmen of the corrmunity have already donated walls to the Committee for murals. Mr. Moreno is going to meet with the federal agent on Monday eve- ning. They are hoping to get a grant of about $19,000 to attract artists who will come in and supervise. The money goes to pay the salaries of the artists. This is just a rough outline of a long-term idea, Mayor King conmented on newspaper articles. He thought they should reflect the views of a11 the kids, rather than just one segment.
