The motion carried and was so ordered. * 00- I 7:30 P.M. having arrived, it was the time and'place fixed for a public hearing on the formation of Under- ground Utility District Nos. 2 and 3 Electrical,and Telephone), continued from June 6, 1973. Director of Public Works Perry outlined the general area of the districts as follows: District No. 2— the area bounded by Ramona Boulevard, Maine Street, Pacific Avenue, and Loray Place. This includes the City Ha11 and the commercial area down Maine Street to Adoue Place and down Pacific Avenue to the rail- road; District No. 3--the area bounded by Baldwin Park Boulevard going north to the Library, south to the north property line of the bowling alley/ shopping center complex and west down La Rica Ave- nue to Ramona Boulevard. There were no written protests. Since June 6, 1973, Mr. Perry stated that he had had conversations with the owners of Watty's Bike Shop and Park Bowl. They have both agreed that if the date the property owners have to receive service is moved back from July t, 1974, to January 1, 1975, that they would be able to afford the cost of this conversion. He recommended that the districts be approved but that the hookup date be postponed six months. Mr. Perry also stated that a tetter has been received from the Edison Company clarifying several points with respect to use of the money that the Edison Com- pany has available for the installation of underground utilities. Several proposals are being studied, but no ruling has yet been made which would permit the in- clusion of customer wiring costs under the application of Rule 20. Also, no ruling has been made, either by the P.U.C. or participating utility company, which would cancel att or any portion of unexpended funds allotted to the cities. However, it is entirety con- ceivable because of rising costs, rates, etc., that such a decision could be forthcoming. Southern Cali- fornia Edison Company recommended, therefore, that the presently planned districts be formed as soon as possi- ble. July 18, 1973 Page 2 RES. Intent of the Baldwin Park City Council to consider adoption of a new Land Use and Circula- tion Element for the General Plan, initiated by the Baldwin Park Planning Commission, and continued from May 16, June 6, June 20. and July 5, 1973. The En- vironmental Impact Report on the amendment to the General Plan was to be considered at this time. Commercial and Industrial Areas were presented at the May 16. 1973, meeting. Residential Areas were discussed at the June 6, 1973, meetinq. Circula- tion and Transportation were considered at the June 20, 1973, meeting, and Zoning was discussed at the July 5, 1973, meeting. City Attorney Flandrick stated that there are some amendments proposed by the staff, and he recommended that both hearings be continued to August 15th so that a full Council can be present. Director of Public Works Perry answered that the City would bear the expense If the trees are in the public right-of-way. Testimony was given by: Regarding 73-S-72. Mrs. Irene Randolph, 4837 Fortin Street, asked if the City would require curb. gutter, and drive approach for 4841 Fortin Street. Mr. Perry answered that there would only be a drive approach at the parcel where the house is. Mrs. Randolph then asked if a street would be going through there. Mr. Gordon explained that the General Plan shows a possible future street there. Mrs. Randolph asked Mr. Perry to write a letter stat- ing that a drive approach would not have to be put in at 4841 Fortin Street. Mr. Perry stated that he would oblige Mrs. Randolph by writing a letter. Testimony was given by: Regarding 73-S-4, Mrs. Edith Dunn, 101 Palm Drive, Arcadia, stated that they have received no communi- cation whatsoever on their property at 13210 Ramona Boulevard. She stated that other cities are more concerned and communicate with the owners about their property. She does not want curbs, gutters, and drive approaches installed, as she had stated at a previous meeting. Director of Public Works Perry stated that Mrs. Dunn was notified before the first hearing and be- fore this hearing also. Mrs. Dunn stated that in some cities there is an assessment district formed, and if you don*t want to pay when the work is done you are given either five or ten years to pay. Mr. Perry explained that it is too late at this point to do this in this district. Mrs. Dunn stated that the legislative body could do this, and money coming back from tax funds could be used. She stated that the protesters were ignored at the first hearing. Mayor King asked Mrs. Dunn if she had checked into what other cities are doing. Mrs. Dunn answered that she had and that the cities are supposed to do this—spread the cost if the property owner misses the first payment. She asked if the City were allowed to put the complete charge on the tax bill. She also asked how the costs to the properties were determined. Mr. Perry commented that each year we get a bid, and the contract is awarded to the lowest respon- sible contractor. Mayor King added that it is felt that curbs and gutters are needed for the safety and health of the people involved. Mrs. Dunn stated that the way the work was done, she could have a flood and a small lake. Councilman Me Caron explained that we're putting in curbs, gutters, and drive approaches throughout the City. The payment can be placed on the coming year's taxes. Mrs. Dunr. is looking for financing. Mrs. Dunn state-" that th-is is the law that people be given five to ten years to pay. This will tone down the Impact of paying for It all at once. Director of Public Works Perry stated that people have five days after the last public hearing to pay. If it isn't paid, then it will be due as a lien in December of 1974 or April of 1975. Councilman Me Caron asked if it were too late to fi- nance this district over a five or ten-year period. City Attorney Flandrick stated that it is too late. If in the future it is done that way, there are some financing problems involved. Councilman Me Caron stated that we should look into the long-term financing. Mrs. Dunn asked how much of a fee is added if the bill is not paid within five days. Director of Public Works Perry answered that a $50 administrative charge would be added. Mrs. Dunn stated that at the first hearing one gen- tleman questioned the number of contractors bidding. She asked how many contractors turned in bids and how much the contractor who did the work was actu- ally paid compared to what the owners were charged. Director of Public Works Perry stated that the con- tractor charged $2.65 per foot, and the owners were charged $3.0D per foot. Mayor King commented that Mrs. Dunn would have to check with the City Clerk during the day to find out about the contractors and their bidding. Mrs. Dunn stated that she is unhappy about the curbs and gutters. They don't meet at the corner. Park- ing was removed. The City didn't ask the owners about drive approaches. Councilman Btewett asked Mr. Perry if the work were substandard. Director of Public Works Perry stated that a transi- tion was installed. Mrs. Dunn commented that Ramona Boulevard was put in recently. The City had invaded about fifteen feet onto her property. This was later removed. The street hasn't been done properly, and she's being charged $482. Mayor King asked Mr. Perry to recheck the property lines tomorrow. He stated that if there is an error, it will be corrected. Mrs. Dunn stated that she will try to see that the City gets the money in less than five days. She was glad that the City is going to look into help- ing people in the future by forming assessment dis- tricts. It costs substantially more money. Walnut Street was handled in this manner. It cost the peo- ple about $170 more for 66 feet of frontage. Testimony was given by: Mr. T. E. Carpenter, 4246 Jerry Avenue, stated that he has been at the Council meetings consistently and that the drafters of the work estimated the highest payment that the people could put out. Councilman Me Caron has stated that this should be given a little latitude. We are a poor City. Even if it costs extra, many people wouldn't have anything if they didn't buy that way. Someone should be designated to see that the people get the best deal. Councilman Hamilton stated that we should discuss this matter under Oral Communications. We have heard about this before. Mayor King stated that we have acted on this accord- ingly and properly. These people were fully aware. If they had a hardship, every effort has been made to work with the property owner. Testimony was given by: Regarding 73-S-6, Mr. Roger Coffey, representing his father, Jess W. Coffey, 13435 West Athol Street. asked how the Council decides what the payment date is on the curbs, gutters, and drive approaches. His father received a notice July 6th; the payment is due July 25th, on a payment of over $200. This is less than a thirty-day notice. His father is disabled and on Social Security. City Attorney Flandrick stated that there was a prior hearing months ago. Notice was given as set by state law. Testimony was given by: Mr. Jess W. Coffey. 13435 West Athol Street, stated that a letter was not sent to him. Also, the drive was paved, but the City tore it up past the property tine. Director of Public Works.Perry stated that the only reason it would have been torn up is if it weren't good enough. It probably didn't meet the grade. Mr. Jess W. Coffey commented that his drive was twice as thick, and it's at the same level. Mr. Roger Coffey asked why the extra $50 is added. Mr. Perry explained that if it is not paid within the five days, it becomes a tien on the property, and it's placed on the 1974-75 tax bill. The $50 is added on to help recover the cost of the paper work. Mr. Roger Coffey asked why more time couldn't be given before the $50 is added. You are rude, and he does not approve of this conduct. Mayor King explained that Mr. Carpenter is at each Council meeting, which is at it should be. If a per- son is repetitious night after night, though, some- thing should be done. He stated that he wasn't try- ing to be rude. We do try to help people. He stated that he hoped Mr. Coffey would attend more meetings, and he also hoped that he understood the situation. Mr. Roger Coffey thanked the Council for their time. Councilman Me Caron asked if state law required the five-day time limit before adding the administrative cost. City Attorney Flandrick answered that the City Council has the prerogative of adding the cost. Councilman Me Caron asked if any other procedure can be used. City Attorney Flandrick stated that it can be allo- cated over a ten-year period, but it does add a fi- nancial burden for the property owner and the City. Councilman Me Caron added that we've had complaints as to notification and time. Each property owner should be notified of charges and have ample time. Possibly it should be put on a ninety-day basis. City Attorney Flandrick stated that the staff would prepare a memo regarding this, indicating the basis on which the costs can be spread. This is a problem of financing as far as the City is concerned. Councilman Me Caron stated that this should be done 1n one package. Improvements haven't been made because of financial reasons. We need the street improvements so there win be proper drainage. The drainage system is almost complete. Coun- cilman Me Caron felt that the fire hydrant should be assessed to all the properties it benefits, and that street lights should also be spread. The same prin- ciple should apply to street development. Planning Director Gordon stated that the only way to spread the cost is to hold up the lot split and have Mr. Lesperance circulate a petition to do the whole block at the same time. Councilman Me Caron asked if there would be a street light on the future street. Mr. Lesperance answered that there would be. Director of Public Works Perry stated that there is a spread on the cost of the street light. In answer to Councilman Me Caron, Mr. Gordon stated that we do not have dedication for the entire street. Mr. Lesperance stated that he thought the costs were unfair. City Attorney Flandrick stated that the appeal is to the Planning Cormission's conditions—that the garage requirement be deleted, and if acceptable to the ap- plicant the case could be held over and the fire hy- drant and street light could be shared between the two developers. Councilman Me Caron stated that we need a report on this. We're not getting the right answer to the problem. They will put in a water line. charge others, then refund it to the applicant. Councilman Blewett suggested that the decision on whether we go on or act this evening be made by the applicant. Sometimes it costs more to wait. Councilman Me Caron stated that the recommendation is that he furnish all the funds for it. We should hold the matter up. It should be done progressively. City Attorney Ftandrick stated that if the recom- mendation is approved, Mr. Lesperance could still go to the Water Company and eventually be reimbursed. It's the district's, not the City's, decision. Mr. Lesperance stated that Council has no control over what the Water Company decides to do after the matter is presented to them. It would be great if that could be worked out. Maybe the staff could help. but you wouldn't have any control over what the Water Company says. Planning Director Gordon stated that we could meet with the Manager of the Water District. All we could do is work with them. For the past few years since he's been here, the Chamber has had a contract with the City to perform specific functions. Their major goal was to develop a pride in Bald- win Park, and by doing this build a new awareness and confidence in the Baldwin Park Chamber of Commerce. The Board felt that in order to entice new develop- ment and promote existing businesses a new positive image must be projected by the total community. They feel they have done this. Administering is one thing, and developing and organizing is another. Organization is now behind us. It is now time to build upon the foundation created and proceed with the phase II program. Mr. Parenteau then reviewed portions of last year's contract. Section 2) SERVICES. The parties hereto do agree that during the term of this Agreement CHAM- BER shall: a) Provide daily information services to the public through the maintenance of an office. This has been done. Also, the building has been re- roofed, rewired, and repainted. New door locks were installed on reconditioned doors. The sewers have been connected and a new phone system completed. They have received estimates on heating and air con- ditioning but are holding off, pending further im- provements. They have paid off their sewer assess- ment and the Ramona assessment for landscaping, foun- tains, lighting, and decorative sidewalk. b) Make available informative City literature. They have published and are distributing business directories, listing all businesses in town, members of the Chamber of Commerce or not; service clubs and organization directories listing over 120 vol- unteer organizations and their contacts; public information directories listing local, state, and federal officials and offices, all churches, and schools; community economic profiles with informa- tion which developers seek such as location, size, climate, transportation, utilities, labor markets, etc.; also census statistics, maps, and other ma- terials. In addition, they have started the monthly news- letter, News and Views." It lists current activi- ties and other information concerning Baldwin Park. Every organization in Baldwin Park is urged to use this toot to make their programs known to the peo- ple. c) Welcome new businesses and industries by arrang- ing openings, ribbon cuttings, and attendant pub- licity. Thanks to Chairman Jay Angeto this has also been done with some major additions this past year, such as, the new Crocker Bank building, the bowling alley. Golden State Bank ground breaking. For this they thanked the Chairmen Bob Palmer and Erma God- dard. 2) Anniversary Parade—Again, we had our most successful yet with over 4,500 people participating. Chairman Sherry Elmore started a tradition and added a little class by including new banners. 3) Citizen of the Year Banquet—This was ex- tremely successful thanks to Chairman Lynn Cole who introduced Baldwin Park to the real J. Robert Flan- drick. 4) Policeman of the Year—Chairmen Lynn Cole and Hersh Erwing helped them almost reach the 200 mark for the first time with 198 in attendance. 5) Los Angeles County Fair Exhibit—Thanks to Chairman Lee Lucas and his committee, we were able to win first prize for the third consecutive year. 6) Fourth of July Celebration—Sergeant Jim Flavin and Recreation and Parks came up with another dandy show and picnic. 7) Miss Baldwin Park Contest—Mis Ofetia Ceja is truly an ambassador first-class for Baldwin Park. e) Continue to improve the Merchants Division to stimulate sales within the community. Although they feel their accomplishments are many, they feel that more time must be devoted to mer- chants' promotions and aids. This past year they were able to hold a few small sales and get the downtown merchants to contribute toward the purchase of Christmas decorations. The Ramona Boulevard merchants and various service or- ganizations working together purchased thirty-two decorative trash receptacles at a cost of $1,785. Even more important, the downtown merchants and property owners, acting as a unit, chose a theme and pushed for the adoption of the Architectural Theme Ordinance. /^s an aid to the local merchants, the Chamber has been able to contract group medical insurance and have it available to a11 of its members, no matter how large or small. Discount Coupons," and Scholarship Cou- pons" have been discussed. This committee has re- quested information from other Chambers of Commerce in regard to Downtown Business Associations. They are also investigating A.B. 103. Although this is now the number-one priority, they still have staff time limitations, and this is a very time-consuming job. f) Continue to improve and implement a program to stimulate commercial and Industrial development. This must be coordinated with the Director of Com- mercial and Industrial Development to insure that the City's program and the Chamber's program supple- ment each other, thus utilizing the limited manpower to its fullest extent. They feel that the Chamber staff has built an ex- cellent rapport with the City staff. The Chamber Manager has worked with the Director of Commercial and Industrial Development on many projects. Again, due to limited staff, most of the Chamber's work is referred to Mr. Sexton. The Chamber staff has re- lied heavily on his department and aid. g) Arrange public meetings and promote public aware- ness on key issues. They held Meet Your Candidate" nights for the School Board election and an open forum on the Charter City question. h) Reactivate a Community Beautification Committee and develop a program. Although a Baldwin Park Beautiful Committee per se hasn't been formed, they do have a few committees working along this line. The Chamber, in coopera- tion with Webster's Disposal and the City, have re- inaugurated our Annual Clean-Up Campaign. The trash receptacles, architectural theme, and the repainting of the Chamber building should be mentioned again under this category. Also, they have the Graffiti Committee, which is composed of many segments of the community and chaired by Vince Moreno. On the sur- face, this committee may not appear to be that im- portant, but it suddenly becomes important when you see the reaction of developers to the City's graffiti. Basically, this explains the Chamber's area of work, in tine with the City contract. He stated that he could go into other areas, such as membership where they had a 40% increase. They are proud of their accomplishments of this past year and took eagerly forward to the phase II plan, which is more work in the priority areas—namely, Merchants' Promotions and Aids and Commercial and Industrial Development. He stated that the Council has received a Fiscal 1972- 73 Financial Report. These figures are extremely conservative estimates, as they had no record of staff time per project. However, for 1973-74 they have been able to adapt the City Program-Personnel Time Distribution sheets, and next year at this time they should have a pretty good ac- counting of staff time. Mr. Parenteau presented a report on the amount of staff and office time per project, including the to- tal expense, based on $85.45 per day. He didn't in- clude the many hours of volunteer time. He then presented the proposed budget for 1973-74 and read from a letter signed by Emmit Waldo, Presi- dent, and Bill Smith, Treasurer, which was attached to it. He stated that the budget runs pretty much in line with the 1972-73 budget as it actually fin- ished this fiscal year, with four exceptions. They are requesting an increase in the amount of revenue from $16,000 to $24,000. The reason for this request is because of the proposed increase in permanent wages. The Board feels that both the manager and secretary rate a salary adjustment, but also the establishment of a new staff position of office clerk is necessary. The work load of the Chamber has increased dramati- cally in the last few years, to the point today where there are thirty-eight committees and sub- committees working. If you devote only one hour of staff time per week to each of these, you have a full-time job. After discussing various ideas such as an assistant manager, an additional secre- tary, etc., it was decided that the most economical and efficient way to obtain results would be to hire a clerk typist for four hours a day to handle the daily routine, to upgrade the secretarial po- sition to that of office manager, to handle book- keeping, committees, reports, etc., thus enabling the manager to devote more of his time to the busi- nessmen and their problems, merchant promotions, and commercial and industrial development. The budget appears to be out of balance. The rea- son for this is that there is no budget account number to show the $5,000 in savings at Crocker Bank. These funds will be used to offset the bud- get increases for building repairs and office equipment. They plan to add a conference room and storage area to the back of the existing build- ing. They are presently renting storage space, and with the committee meetings being held in front, every time anybody comes into the Chamber, the meeting is disrupted. Also, by moving the Confer- ence table there will be additional work space for additional staff and equipment. Once this work is done. the plan is to install a Duat-Pak heating and air conditioning unit. They fef"! mat the Chamber has done a fine job in reversing its negative financial and image situa- tions the last couple of years. They also feet that the total community attitude has improved to that of positive action and pride in Baldwin Park. This is an Intangible but necessary element in the development of any community. With the City's continued support and cooperation, this snowball which has been molded and rolled to the peak can now be pushed over the top, develop- ing into an avalanche of progress and prosperity for Baldwin Park. Mr. Parenteau then discussed the proposed contract between the City and the Chamber of Commerce. It is basically the same as last year's contract, with a couple of major changes. 2) SERVICES. The parties hereto do agree that dur- ing the term of this Agreement CHAMBER, in order of priority shall:" The priorities were changed, moving f) up to c) and rewording it. c) Develop a program of merchants' promotions and aids to assist the existing businesses." The second major change, excluding the request for the additional money, is an added sentence under paragraph 5): CITY'S independent auditors shall have authority at any reasonable time as determined by CITY to audit CHAMBER'S accounts with respect to all funds received by CHAMBER under this Agreement and the expenditure of any or all of such funds." This was an oversight in the last few contracts. The Directors feel that any time public funds are involved, this should be in the contract. They do have an annual audit. This year they have really worked hard and covered a lot of ground. The staff has put in many hours. The attitude of the community toward the Chamber has completely changed. When he first came to the Chamber, he was actually asked to leave a person's building because he was associated with the Chamber of Commerce. That merchant has since reversed his feeling for the Chamber, and he's very active. The groundwork has been laid. We do need more work along the area of merchant promotions, and realize this, but we are limited as far as staff goes. That is the reason for the increase in the budget. He stated that they tried to figure out the volun- teer man-hours they coordinated this past year. Counting the people who were on committees, and fig- uring how much time the committees took, they came out with over 20,000 volunteer man-hours. Mayor King commended Mr. Parenteau for his fine esentation. He asked how long Mr. Parenteau has been with the Chamber of Commerce and his salary at the present time. Being Mayor, he Is certainly aware of the activi- ties of the individuals participating in the pur- suit of the City's goals. He has felt, though. that the priorities have not been in line. That's the reason for the get-together this evening and the reworking of the priorities. Mr. Parenteau commented that the Chamber has felt that holding up the allocation has been beneficial in opening up lines of communication. Mayor King stated that he is glad the priorities have been rearranged. We all agree that we can't be without a Chamber of Commerce and that the City now has the most active, progressive Board they have ever had. Mr. Parenteau stated that quite a few of the Board members were present and asked them to stand and receive the recognition they so deserve. Councilman Hamilton asked if there were a list of the thirty-eight committees. Mr. Parenteau referred to a chart and listed all the committees. Mayor King stated that he had mentioned to the City Manager the possibility of the Police Department taking over the Fourth of July Celebration. They seem to be doing a major portion of it, and because Mr. Parenteau seems to be spread so thin, there was not an agenda of events. Perhaps to lessen the burden on Mr. Parenteau, it might be better if this were taken over by the Police Department. Mr. Parenteau stated that this year this was one of the unforeseen incidents. When you deal with vol- unteer help and rely so much upon it, sometimes there are problems. The chairman had to back out due to personal problems. Jim Flavin came to the rescue very beautifully. Councilman Btewett asked that each Council member re- ceive a copy of Mr. Parenteau's remarks. He stated that all of this came out of a breakfast meeting to which the Council was invited. Two of the Council members were present, and several members of the Board were also there. He stated that he made some comments which were solicited by the Board. They wanted Council's opinion. He commented at the meeting as to what he felt were some of the misuses and abuses within the Chamber. Those have not been menticnec rh'.s evening, and they are not in the written material. He stated that he has reviewed every Issue of News and Views." This was not intentional, the writer was just pro- jecting his thoughts. The number of I's" has been reduced, and the President's picture 1s no longer appearing in the publication. In similar publica- tions put out by other cities, 90% of them have the President's picture located somewhere in them. Councilman Blewett stated that if the Chamber has been used to develop the political candidacy of one man, this was not fair to the taxpayers. Mr. Parenteau stated that the President's message is usually one or two columns in length. The articles are reviewed by the Board of Directors to see if they reflect the views of the Chamber. Councilman Blewett stated that News and Views" had always come out toward the first of the month. The month the Board of Directors took action, it didn't come out until after the election. He asked if the action of the Board had beer, subverted, Mr. Parenteau answered that the action of the Board had not been subverted but that the Chamber's posi- tion could have been put more dearly. The April edition was late it didn't come out until the 28th), so the May issue wasn't put out. Mayor King stated, as had Councilman Me Caron pre- viously, that no funds are to be dictated. However, the Chamber's priorities were not in line, and the Council is responsible for seeing to the people's money. Mr. Parenteau stated that the Chamber Board of Di- rectors agrees with Mayor King. Mayor King stated that this item should be consid- ered at the next meeting when we have a full Coun- cil present. Mr. Ralph Middleton, 13122 Corak Street, stated that he was against the Chamber of Commerce two years ago, but he feels that they should have their budget now, as they have progressed. They are giving service to the community, not to five Council members only. If the Council cuts them out, we'll have a deader town than we have now. The decision should be made on what the Chamber does for the citizens, and the citi- zens are very pleased with the Chamber now. Councilman Blewett agreed with Mr. Middleton. but the Council represents the people and is the guardian of their money. The Council members would be remiss if they dicn't say the Chamber is wrong on some points. The most disenchanted people are the businessmen. The'Chamber hasn't provided them services. City Manager Mocalis stated that that incident oc- curred over a period of several years and that It was caught by the present City administration. The City has been reimbursed by additional sweeping. Mr. Middleton commented that there are some business- men who haven't been friendly toward the Chamber. They were pushed into backing the Charter. The Cham- ber has done a better job in the last two years than since they started in the City. Mayor King stated that Mr. Middleton was not present at the last budget meeting when Councilman Hamilton spoke strongly for the Chamber budget. The only problem was with the priorities. Mr. Middleton stated that by state law the public is excluded from Council's executive sessions, and af- ter executive session, the budget was adopted in ad- journed regular session. City Manager Mocalis stated that Budget studies were held concurrently with meet and confer sessions from which the public is excluded. Councilman Hamilton stated that the Chamber of Com- merce is asking for $24,000. They have received $16,000 in the past. It is his sincere belief that they are short on the money needed to do an adequate job. Six months from now he would like to check the contract and increase the amount of money if there are results. They can't do the job on the money they're getting. If they run one sales promotion per month, it would bring in a revenue of $1,000 a month to the City. The Pomotion Manager would have to work full-time. He is proud of the Chamber, but it is weak because they need more money. Mrs. Nathine Bond, 4635 North Bogart Avenue, stated that she and Mrs. Burnett are co-chairmen and that News and Views" went to be printed at the time it should have, but the printer wa$ unable to get it out on time. She doesn't feel the businessmen have' been let down. The Chamber has changed its image. Councilman Btewett asked if the bill had been paid before News and Views" was printed. Mrs. Bond answered that she didn't know about that. Councilman Blewett commented that there has been a lot of dissatisfaction with the Chamber of Conmerce. He asked what the Chamber had done for her besides doing their printing at her place of business. Mrs. Bond answered that the Chamber is letting the people of the City know about the merchants and that we have a town of w^ich we can be proud. Mayor King stated that we will be coming back to this subject later. Mrs. Bond and Mr. Parenteau concurred that News and Views" should come back from the printer on the 19th day of the month. Mr. Emmit Waldo, 4170 Sharons Way, stated that per- haps the Chamber has slipped up someplace. Councilman Btewett stated that he is in an indus- trial building of fourteen shops located south of the freeway and no one from the Chamber of Conmerce has ever visited there. Mr. Waldo stated that the Chamber has thirty-nine committees and that he and Mr. Parenteau are ex of- ficio members of each of them. He also stated that he had checked with a few of the businessmen in Bald- win Park-"157 of them—and they all signed a state- ment urging Council's support of the Chamber and stating that they do not feel the Chamber has let them down. Mayor King asked Mr. Waldo to submit the petition. Mr. Waldo stated that he would at a later time. He also stated that the Chamber has had a lot of public- ity which has resulted fn the donation of paint, etc. Three years ago Mr. Parenteau was thrown out of a place of business, b,ut he is welcomed there now. You can't build a mountain overnight. We are now ready to. go; the rapport is beautiful. Councilman Blewett asked why this didn't come until after the Council approached the Chamber of Commerce. Mr. Waldo answered that the Chamber did not have any idea of the Council's feelings. Councilman Blewett stated that he knows a business- man to whom the petition was misrepresented. It was sent around before the article in the newspaper came out. The man wouldn't have siqned it if he had seen the article first. The program involved twenty-three cities in the United States. In eleven months the government will look at what we have done. The program is geared to encourage citizens to develop their volunteer talents. Mayor King stated that with her knowledge of the tal- ents of people in Baldwin Park, Mrs. Asquith should come to Mr. Mocalis or Mr. Hate and go over this with them. Mrs. Asquith stated that four of the service clubs were going to get together. She will check with the others to see their feeling on the matter. Mr. Mocalis commented that there are more than four. He hoped that he would be able to attend all the vol- unteer meetings in town. Mrs. Asquith invited Mr. Mocalis to the Service Coun- cil meeting. Mrs. A. J. Slater, 4814 North Stancroft Street, asked if the first priority of the Chamber of Commerce is to bring business into Baldwin Park. Mayor King answered that the first priority of the Chamber of Commerce is to further merchant promotions. Mrs. Slater stated that until two years ago she didn't know Baldwin Park had a Chamber of Commerce, and she's lived here since 1961. She also stated that she does not go into anything she does not believe in, and she is chairman of one committee now. Within the past two years a better feeling has developed. You have to get the business people going. Personalities should be left out of it. Mayor King added that you have to analyze the situa- tion year by year. What certain organizations do should be directed to the organization itself. He also stated that he agrees with the Chamber program in other areas, but the main area is promoting the businessman. Director of Public Works Perry stated that the City has worked out plans for street improvements for about half a dozen people. He is going to investi- gate the case which was brought up this evening. Mr. Carpenter stated that he was not necessarily talking about hardship cases. When there is a good drive approach there is no reason to install a new one. It was to be brought forward to the people that they were entitled to retain a good drive ap- proach if it existed. When you have 4,000 to 5,000 homes, think of how much money is involved. He hopes that the situation can be improved. City Manager Mocalis stated that we have had an evaluation of our public relations. We are re- stricted by cold" state laws, however, a differ- ent form of notice is being considered. Mr. Carpenter stated that he appreciates that. Mayor King added that Mr. Carpenter has called him several times at home and that he has never been rude to him. He asked Mr. Carpenter to verify that statement, Mr. Carpenter verified that It was true. Councilman Hamilton stated that in forming an assess- ment district, it would have to include the entire block, not one or two parcels. City Attorney Flandrick stated that Councilman Hamil- ton was correct, but that costs go up with interest when you form an assessment district. At the forma- tion of the district there are alternative procedures. Councilman Hamilton stated that it should be up to the majority of the property owners. It bothers him that this is a hardship. The property owners should be contacted. It could cost 30% more. City Attorney Flandrick stated that he will explore the details and alternatives and report back to the Council. 00- It was the time and place fixed for a public hearing on an appeal from the decision of the Planning Com- mission on Parcel Map 843. Testimony was given by: Mr. Clarence Lesperance, Progress Enterprises, Inc., 1502 West Covina Parkway, Suite 116, West Covina, stated that he bought a piece of property which was a nuisance and that the nuisance has since been cleaned up. The one requirement which he appealed was that of building a new garage for the old, ex- isting house or moving an old building. The house doesn't have a garage now. Twenty-eight out of fif- ty-three homes in the area do not comply with the garage requirement. He plans on improving the property. The restriction isn't being imposed on the other owners. Mayor King asked if this is a new development and if the house overlaps the property line. Mr. Lesperance answered that he is cutting off three lots, and it isn't the City's right to impose that restriction on the existing house. City Attorney Flandrick stated that the one-acre lot is being divided into four. If a house does not have a garage, it is a non-conforming use according to the zoning laws. Mayor King asked what the overlap was. Planning Director Gordon stated that the building w^ich overlaps used to be a garage but has been con- verted Into a kind of house-.
