CITY CLERK BALKUS 00- Mayor King presented a certificate of appreciation to Robert Dahlstedt in recognition of his serving on the Recreationand Park Commission as one of the first youth participants. He also presented a certificate of appre- ciation for successfully completing a training seminar conducted by the California Association of Park and Recreations Commissioners and Board Members. Other Commissioners also-received the same recognition. Robert Dahlstedt thanked Council for the opportunity to serve as a youth commissioner.- 00- On behalf of the Ladies of the Baldwin Park Chamber of Commerce, Mayor King announced the recipients of the September 1973 Community Service Awards for outstand- ing service to the community without remuneration and presented awards to Mr. Bernard Martin and Mrs. Myrtle Asquith, commending them for their outstanding service to the community. 00- GREGORY MOVED. He has contacted a contractor, has blueprints and applied for a loan to complete the necessary repairs. He requested ninety days Mr. Crespo is to discuss blueprints with Mr. Perry. Carried unanimously. 00- It was the time and place fixed fora public hearing on AZC-67. an Intent to amend the Zoning Code of the City of Baldwin Park by adding Section 9610 A 14) permitting the limited sale of used clothing in the C-2 Zone, initiated by the Baldwin Park Planning Commission. Proper postings and mailings had been accomplished. There were no written protests. Planning Director Gordon reviewed his report in the packet, stating that this change was proposed by J. C. Funky's. 14330 Ramona Boulevard. They sell mod clothing and used denims. Councilman Me Caron stated that the Planning Com- mission minutes do not indicate their thinking nor the reasons for their recommendation. Planning Director Gordon stated that the Planning Commission was concerned about the quality of busi- ness coming into Baldwin Park and the physical appear- ance. They were impressed with the type of operation of this business and felt that 40% used would not be detrimental. They sell mod clothing and are an agres- sive re-taller. The Planning Commission felt this was an attractive establishment desirable, not negative or degrading to downtown and that businesses similar to Funky'^ which is a chain store, should be allowed downtown and would bring more people downtown. He stated this is an unusual type of code amendment; however, the Planning Commission was hesitant to recom- mend Biconditional use permit. The code can be changed if problems arise. 6Q% new apparel is a safeguard. The 60% would be measured on maximum floor space setting area. City Attorney Flandrick stated that standards could not be indicated in an ordinance. Mrs. Zook suggested using the name Used Denims". T. E. Carpenter stated Funky"s is an asset to the city and that the concentration should be on used denims". City Attorney Flandrick stated this was not possible, the ordinance would have to cover all businesses the same, otherwise this would be passing special legisla- tion. As there was no further testimony. Mayor King declared the public hearing closed. Councilman McCaron stated he would prefer to use some other method of control rather than a code change; possibly set up standards of display. City Attorney Flandrick stated this would not be practi- cal as it would be difficult to police. Councilman Hamilton suggested a conditional use permit for this particular location setting out what is allowed the same as an ordinance. City Attorney Flandrick stated that the courts have passed on the validity of conditional use permits in cases that have come up and have indicated that the imposition of the conditional use permit requirement is valid only if the use itself is a unique use which is not capable of general regu- lation. This is not true, in his opinion, of a retail clothing operation. From the standpoint of zoning, other than esthetics, and the fact that it might become a public nuisance in the future, there is no difference between new and used clothing. The same operation is involved. The court would probably say that it is not a valid classifica- tion. Further discussion followed regarding health problems, junk stores and referring back to the Planning Commission for methods of resolving the usage. He reminded Councilman Btewett that literature about the council men's organization was to be forwarded to him. Mayor King stated that after review and condensing, minutes will be available. 00- Mr. T. E. Carpenter, 4346 Jerry Street, stated that he felt the General Plan needs more study and should be continued. 00- City Clerk Balkus stated that the office of the Regis- trar of Voters requested permission to use the City Yard as a check-in center for precinct workers for the election on November 6, 1973 from 6:00 P»M. to 12:00 midnight. GREGORY MOVED, BLEWETT SECONDED THAT PERMISSION BE GRANTED. Carried unanimously. 00- City Clerk Balkus presented a request for waiver of back- ground check fees for the Baldwin Park Breakfast Club Sing Concert to be held in the auditorium September 29, from 6:00 P.M. to 11:00 P.M. Approval was recommended provided that adequate supervision be provided for the parking lot and the interior of the auditorium. GREGORY MOVED, BLEMETT SECONDED THAT THE BACKGROUND CHECK FEES BE WAIVED. Carried unanimously. 00- City Manager, Mocatis stated two bids were received and opened on August 23, 1973 for interconnecting the traffic control signals on Ramona Boulevard between Francisquito and Puente Avenue. He recommended that the low bid of C. T. & F., Inc., Bell Gardens, California in the amount of $29,673. be accepted and that the Mayor and City Clerk be authorized to execute the contract. Revenue for this work will be from TOPICS and Gas Tax funds. BLEWETT MOVED, HAMILTON SECONDED TO ACCEPT THE BID AND AUTHORIZE EXECUTION OF THE CONTRACT. Carried unanimously. 00- City Manager Mocatis stated that one bid was received and opened on August 13, 1973 for the annual weed abatement contract. HAMILTON MOVED. BLEWETT SECONDED THAT RESOLUTION NO. 73-145 BE ADOPTED AND THAT FURTHER READING BE WAIVED. Carried unanimously. 00- City Manager Mocalis stated the City/Chamber of Commerce agreement hald been reviewed by the council committee composed of Councilmen Hamilton, Blewett and the City Manager, then made recommendations regarding priorities with the addition of new activi- ties. Priorities would be a program developing mer- chants promotions and assisting existing businesses. They recommend establishment of an Industrial Divi- sion within the Chamber; to develop a program to vigorously promote and encourage new memberships; develop a new Commercial and Industrial Beautifica- tion Committee. Also, City would have option to ask for an audit at Chamber expense and recommend not in the agreement) that after the audit the Council would review the agreement and consider changes. Mr. Pete Parenteau, Manager of Chamber of Commerce, stated that the Chamber Board of Directors had not seen the draft of the new agreement and requested a joint meeting of the entire Council and Board to dis~ cuss the contract. After discussion it was decided that the Council Committee would meet with the Board on September 11. 1973 at 7:00 P.M. 00- The Mayor and Council welcomed Scout Master Frank Bernardo and Boy Scout Troop 699, Etwin School, working for their citizenship and community merit badge projects. 00- City Manager Mocalis requested approval of drafting a resolution commending Larry Chimbole, past mayor, present Councilman of Palmdale, and President of the Los Angeles Division of the League of California Cities. He read the title of RESOLUTION NO. 73-151 COMMENDING LARRY CHIMBOLE FOR HIS MANY PUBLIC SERVICES The resolution will be presented at Mr. Chimbole's last meeting, this month. He presented pictures and reviewed his report on seven parcels between Virginia and Merced. A March, 1972 title report for Parcel No. 4 in front of bowling alley) indicates the city does not have fee title but does have easement rights, which would necessitate vaca- tion proceedings. Parcel No. 1 near County road yards) is being investigated for use as a planter area in connection with the East Ramona Boulevard project. He requested authorization to obtain title reports. The cost would be $2,000. BLEWETT MOVED, HAMILTON SECONDED TO AUTHORIZE THE APPRAISALS. City Manager Mocalis requested that the motion be withdrawn until after SCRTD studies and public hear- ings have been completed. WITH THE PERMISSION OF THE SECOND THE MOTION MAS WITHDRAWN. 00- Mr. Perry stated that the design for Ramona Boulevard between Badillo and the East city limits indicated that twenty-four parcels need to be acquired for uni- form eighty foot right-of-way. He requested authoriza- tion to secure appraisals on the parcels. HAMILTON MOVED.BLEWETT SECONDED TO AUTHORIZE THE APPRAISALS. Carried unanimously. 00- Planning Director Gordon gave a brief resume of his report on Rapid Transit, and indicated on the wall map the possible routes. The Planning Commission Resolution recommends that the City support the building of a fixed line through the valley to the Ontario airport; that station be built in Baldwin Park; that the line go in or along the San Bernardino Freeway; that the City work with RTD and work with valley cities to develop a uniform position on these items. Councilman Gregory announced that the next RTD public meet- ing will be in Rosemead on September 13. She recommended that everyone attend so problems will be known. Discussion followed as to the peoples wants and needs and whether they would use a, rapid transit system; that present system is inadequate; that the public is not well enough informed and that the City needs this service.
