It was the time and place fixed for a public hearing on 73-N-35 to determine whether certain premises and structures constitute a public nuisance at 12736 Bess Avenue. Proper postings and mailings had been accomplished. There were no written protests. Mr. Perry stated the staff had determined the property a public nuisance and recommended the structure be rehabilitated in accordance with 1970 edition of Uni- form Building Code or demolished and to conduct a general lot clean up. Mr. Claude Wright, 11845 Ferris Road. El Monte requested an extension of 90 days to enable him to take care of the property. Proper postings and mailings had been accomplished. There were no written protests. Mr. Perry reviewed the report of conditions of the property and stated the staff declared the property a public nuisance and recommended 1) rehabilitate sheds or demolish and 2) conduct a general lot dean up. Mr. Alfred Agunaga, 11741 Monticello Drive, La Mirada, said he had finished the clean up and would tike an extension of 60 days to complete it. He asked if he had to get rid of the shed or could he paint it. Mr. Perry said he could meet with his staff and they would explain the exact steps to be taken. As there was no one else desiring to speak either 1n behalf or 1n opposition to 73-N-36, Mayor King declared the public hearing closed. He stated his office did handle some of our zoning violations on a contract basis. Mr. Busch was given a letter requesting that his assistant. Mark Welden, review the file on the San Gabriel Valley Speedway. Mayor King asked what could be done about the outdoor theatres adjacent to our residential areas and questioned why these people should be exposed to these obscene movies. Mr. Busch said they presently have pending action against Deep Throat", The Devil and Mrs. Jones", and Beyond the Green Door". If we don't win these cases, don't know what we can do. Mr. Busch stated that the theatres have the license and the privilege of exhibiting films. The question is whether or not the pictures and the people in them constitute obscenity. The only answer would be declar- ing th*m a public nuisance. Also, what about youngsters viewing from outside? This could be contributing". This has not been resolved by the courts. He explained that it is impossible to ask the City Attorney to draw up a city ordinance to prevent this as the State has preempted the field. Councilman Blewett said there are a lot of people in this community that are concerned about the Irwindale Raceway noise. Mayor King said it is well over the noise limit or what we consider to be an intolerable limit and residents are subjected to this noise. The noise Is so great, you can't have a conversation. Mr. Busch said here again, this could be a public nuisance basis. Councilman Blewett said we need a solution as it is ruining some of the finer areas in the City. Mr. Busch said something new they might be able to do something about; however, this has been existing for about six years. He would be happy to have his staff make another report. Councilman McCaron said the homes existed before the racetrack and there was a protest made before the racetrack came in. Mayor King commented that he had talked to the Mayor of Irwindale and he said he would not cur- tail or stop any business. Mr. Busch said you might have some class action to bring against the track by inverse condemnation proceedings by the residents. Planning Director Gordon reviewed his report con" tained in the packets, and distributed maps. Mrs. Catalano, 3049 N. Maine Avenue said she felt that this should definitely be R-1 and should be residential, to be able to add a room, etc. if they desired. She lives between Garvey and Francisquito and two years ago they said it would only be one year until they rezoned the area. Mr. Joe Cale, 4457 N. Maine Avenue said he would like to see it changed back to R-1. He has just purchased one of the finer homes and it is a well- built home. Mr. Shawn, 3090 N. Maine Avenue asked for clarifica- tion if this means that property already commercial would remain such and the rest would go back to R-1 or C-2. Mr. Gordon said that was the recommendation. Mr. Cliff O'Brain, 350 W. Fifth Street, San Bernardino asked for verification of the land uses in this area. Mayor King said this would have no bearing on the existing uses. Councilman McCaron stated he had no objection to changing from C-2A to R-1, but not to C-2. Experience has shown us that C-2A does not attract large develop- ments. If they have C-2A, let them continue. Councilman Blewett asked if there is anything to keep us from leaving C-2A as C-2A. City Attorney Flandrick stated the direction would be to grant the zone change in part and deny it in part which shows as the yellow part on the map be classified as R-1 and let the balance of the property remain as C-2A. Mr. Schultz, 11570 Halt wood Drive asked how many of the councitmen would like to build a house on Francis- quito and live in it as trucks go by daily. Mr. Gordon stated that the yet tow portion of the map C-2A) would go to R-1 and the red portion C-2A) would remain C-2A. City Attorney Flandrick stated that Council should refer this back to the Planning Commission for a report and return to the next Council meeting with an ordinance. E. Carpenter, 4346 Jerry Avenue stated that Mr. Busch will have one of his Deputies attend one of our Council meetings soon. He also asked the Council to evaluate the street lighting proposed in the agenda. The public is vitally concerned as to the energy crisis. Another item is the landscaping the median.strip with lights on North Baldwin Park Boulevard. The traffic is light and he does not feel that we need grass medians which will require two additional maintenance men. We do need the street repaired. There are other areas in the City that we can use this money for. The people who live there should be asked if they want it. 00- City Manager Mocatis said we have fewer employees per population than any other city in the San Gabriel Valley. The funds we are talking about accrue to the City through the sale of gasoline. A portion of that money goes into a State fund and some of the returns come to the City based on the population of the City and this money must be used for street improvements. 00- Mrs. Gloria Zook, 4817 La Rica commended the Council for asking Mr. Busch to comment and help regarding the drive-ins and the race track. She asked that they pursue this matter. Mayor King stated that they had mailed a letter to the Attorney General regarding environmental factors. City Attorney Ftandrick suggested that the City Manager write a letter to Mr, Busch tomorrow as to what was discussed tonight. 00- Mr. Emmitt Waldo, 4170 Sharon Way thanked Council for presenting the awards to the two young men. These two young men have been on every project they have had, therefore, they would like them to go to Dallas for the Alt American City awards. Mr, Parenteau had figured out that it would cost from $170 to $175 to send them. Cliff's parents said they would borrow the money to send Cliff, but Tony's mother has been i11 and not worked for over six months and cannot send him. He asked Council to see their way clear to send him. Discussion followed and Councilman Hamilton asked if four 500 watt bulbs would be better than two 1.000 watts. Mr. Perry said the cost would be higher as they would be purchasing more bulbs. Councilman McCaron stated he couldn't justify the savings. He requested an explanation from the Edison Company as to charges. Mr. Perry said he had checked with them and these were the figures they gave; however, he wilt get a report from the Edison Company. The staff recommended that the construction of Baldwin Park Boulevard from Ramona to Live Oak be done before the construction of Baldwin Park Boulevard South of Merced. He stated that having fu11 grass medians would involve more to maintain, therefore they recommended that the medians with rock insets be considered. The basic maintenance difference between the rock and the grass medians, would be one extra man for the rock and two additional men for the grass medians. He pointed ou the two concepts as illustrated by the renderings on the wall and explained that Cobblestone medians with trees were proposed for the intersections north of Los Angeles Street and that colored rock could be used. Councilman McCaron stated that installation is paid with gas tax money, but maintenance is from the general fund. He would like to see In dollars and cents how much money we are talking about, how much out of each fund. Mr. Perry stated that 2107 Funds can be used for construction and for street maintenance; 2106 is more restrictive and is for the select system of street construction and a portion can be used for maintenance on select streets. Councilman McCaron stated that perhaps there should be a different design, without grass, and stay with- in our means. Discussion followed regarding blending of grass medians with the present grass medians, the rock medians at Intersections and the maintenance of one concept versus the other.
