They leave the doors open and will not shut them and operate unfit midnight. Because of this, he does not get to sleep until after midnight when they close. It is a tow frequency sound which travels quite far and is annoying. He appealed to the Council to try to find a way to stop this; should be something in the law that they can't operate before 6:00 a.m. and after 10:00 p.m. with the doors open. He said also that barking dogs pre- sent another problem and we should have stronger ordinances to prohibit it and more enforcement. City Attorney Flandrick stated once the General Plan is adopted, there will be an ordinance to control this. Councilman Gregory said since there is a problem in Irwindate, perhaps they could work together on some solution. Mr. Flandrick said an ordiance of one city does not apply to another city. Councilman Blewett asked Mr. Brunson if there were other companies in the area which contributed to the noise. Mr. Brunson said the Universal Molding Plant on Azusa Canyon Road operated 24 hours a day and had been asked to shut their doors. Also another plant at 5920 Bleecker Street could not dose their doors because of the fumes. Pharmaseal, Foxdale AVenue, had been asked to close their doors and they said they shouldn't be open, but they still haven't closed them. Mr. John Andrich, 14402 East Los Angeles Street, requested that they cease discussion on this until everyone would have an opportunity to read all the facts. He did not feel that it had been properly handled and should have a public election to determine what should be done. City Clerk Balkus stated proper publications had been accomplished as required by Code. Councilman McCaron asked what was meant on Page 9 of Housing Element revise R-1 and R-2 regulations to improve and allow low-density development. Mr. Gordon stated the Plan would retain a single family character and yet allow the land to be used. These are general recommendations and public hear- ings are required to change the Zoning Code. Councilman McCaron said he thought this should be a separate item and that the Planning Commission should give it a more specific study. Councilman McCaron said he thought we should look at the legal aspect and this should have more study. Mayor King stated we want to make certain that every- one is aware of what is involved. If it takes more time, we will give it more time. Councilman Btewett asked how the 150 feet distance from the rock quarry was arrived at, A new quarry is proposed and there should be notification to any person in case it was sold to a third party. Planning Director Gordon stated that this is based on the depth of the quarry and that this was only a guideline. Mr. T. Carpenter, 4346 Jerry Street, said he was glad this hearing would be continued. One of the items that has been lacking is the input on the zoning. All of the testimony he has heard was opposed to any multi-family dwellings on Ramona. This calls for more discussion. It is very impor- tant to the people. Councilman McCaron said we should have some sort of a study as to the present violations of noise, dis- tance involved, etc. A lot of people will sit and put up with the noise. We should determine what we can do for future protection of the residents. There are some things some people can do to reduce the noise. Mayor King said the State sets the guidelines. Noise is something that destroys family living in some areas Those in industrial areas are not able to enjoy their living rooms and yards. Councilman Hamilton, referring to the housing element, asked if this is all standard under the State Govern- ment Code and will the entire State come under the plan? Planning Director Gordon said State requires cities and Counties to have these four elements in every General Plan. 06G7J November 21, 1973 Page 3 MR. T. During the past seven years he has operated as a Mom & Pop Corporation, but there is not enough traffic on Ramona Boulevard to support this operation. He has had some months that he had only grossed $600 a month. Has tried speciality lunches and businessmen's lunches and this wasn't sufficient. He tried to rent facilities on Maine Street large enough so they could serve beer as many of their customers had requested. In February of this year, the tenants next door vacated their beer and Mexican food house and he was able to acquire this space. He obtained the finances to remodel and hired a Mexican cook. His business doubled, but overhead tripled, but customers constantly asked for beer. He made application to the Alcoholic Beverage Control on July 23, 1973 for a license. Around October 1, the Baldwin Park Police Department informed him that he would have to have a Conditional Use Per- mit because of the delay. He went to the Plan- ning Director and received a tetter October 15 stating he would have to comply with the Code because his grandfather rights had been lost. Even though he was in ignorance of such a require- ment, he had applied well within the six months for a beer license. It is impossible for him, because of financial reasons, to acquire a Con- ditional Use Permit. The Conditional Use Permit is a very lengthy, complex, detailed set of requirements entailing several hundred dollars in addition to the permit fee. He can't go any farther as this is the slow season of the year. The Alcoholic Beverage Control Board has said that unless some action is taken, they will refuse the license because of inactivity. He requested that action be taken to notify the Alcoholic Beverage Control as he did apply for the license in the six months time limit requirement. Discussion followed and the staff wilt report back at the December 5, 1973 meeting as to the findings. Chief of Police Adams will phone the Alcoholic Beverage Control to extend the time limit until that date. 00- Mr. T. Carpenter, 4346 Jerry Street, said he was sympathetic with Mr. Fristoe, however he asked Council to consider this carefully and consider the people dose to such an establishment. He commented on the Director of Public Works report on landscape medians. He stated he was opposed to medians any place on Baldwin Park Boulevard above Ramona. The costs brought out on the three alternatives would have to have the addition of lights, water, etc. This area does not tend itself to such a decorative median. Put in good roads where they are needed, but don't add more expense now. He recom- mended that it be submitted to Council and the people to see where repairs could be done. When all the streets are in good order, then we can think about decoration. 00- Mr. J. Andrich, 14402 East Los Angeles Street, said that at the corner of Baldwin Park Boulevard is where the County Fire Engine swings out of its facility and if you put medians there, they wouldn't be able to get around it. Should have good solid paving and no medians. 00- Mayor King read a letter from Mrs. Margaret Burnett expressing her appreciation for the opportunity of attending the All American City Award Meeting in Dallas. Three proposals were received; 1) International Management Systems $58,283.00; 2) Arthur Young and Company, $60,500.00; 3) IBM Corporation, $60,500.00. Lt. Aldrich stated they recommended acceptance of the Arthur Young & Company proposal because of their years of experience and more project systems develop- ments. He stated the department felt the adoption of Proposal II or III with a slight reduction of existing level of service would require only one additional person. He said additional street lighting would be approxi- mately $66 per month. Mayor King said we should not implement lights at this time, due to the energy crisis. In answer to Councilman McCaron's question of making a decision on the alternatives at this time, Mr. Perry stated that a schedule had been sent to the County as to where the money would be used. Councilman McCaron commented that he favored ground cover with Cobblestones. Mayor King favored Proposal No. I grass. Councilman Hamilton said the people living in this area did not want the medians. Improve the streets and if at a later date they want medians, they could put them in. He asked if there would be a left-hand turn in the Park Bowl shopping area if they did install medians and Mr. Perry said yes. Mr. Hamilton felt that double lines were sufficient at this time as maintenance is a big factor with grass medians. Councilman McCaron stated that children have to cross the street and double lines were not suf- ficient. Should have something to protect pedes- trians. Councilman Gregory stated the Council had requested the money for the medians from Supervisor Schabarum and she questioned whether the money could be used elsewhere. Mr. Perry explained that the money is committed to the Baldwin Park Boulevard project. Councilman Btewett stated that the area North of Ramona should be equally represented as well as the area South. He was in favor of grass North of Ramona, rock from Los Angeles on would protect children at Landis School. Rock treatment on Baldwin Park Boulevard South of Merced would pro- tect the students at Sierra Vista by Foster and Baldwin Park Boulevard. Proposal III would be the answer. In answer to Councilman Hamilton, Mr. Perry stated that Proposal II would have 50% Cobblestone and 50% ground with trees. Discussion followed regarding the three proposals. Roll Call: Ayes: McCaron, Blewett, Gregory Noes: Hamilton, King 00- Director of Public Works Perry stated that two bulbs had been removed from lights on Ramona Boulevard between Maine and Bogart and he asked for comments regarding adequate tight. Councilman Gregory asked Chief of Police Adams if there had been more crimes since the reduction of light. Chief Adams stated there was adequate light on the street, but not in the back driveways, etc. The more light we have, the better for police protection. This is a bad season for crimes and statistics for this area would not be exact at this time. Mayor King felt the four bulbs could be cut to one. Councilman Btewett stated he thought that the energy crisis is second to the leadership crisis. It is sad to realize our country is taking steps backward. He hopes the reduced lighting on Ramona wilt be temporary. Councilman Gregory stated she had just returned from Washington, D.C. where they have dimmed memorial lights. Considering the safety factor, she favored the two light bulbs. Councilman Hamilton suggested that each merchant put a light on the rear of their buildings and leave the lights as they are on Ramona Boulevard. Mayor King asked for a study as to the placement of bulbs behind the buildings to eliminate the possibil- ity of burglary. Mr. Joe Cale, 4457 N. Maine Avenue, suggested if things became worse, then put two men in each police car. Mr. Emmitt Waldo, 4170 Sharons Way, suggested that all marquees and signs be turned off at 8:00 p.m. on a voluntary basis. Councilman Hamilton felt the shortage will be more critical during the summer with the use of air conditioners, etc. Mr. Ralph Middleton, 13122 East Corak Street, sug- gested that an appeal be made throughout the City to users to burn less tgihts on a voluntary basis. He favored the reduced lighting which will help in the energy crisis. Mrs. Dorothy Mayes, 3453 N. Big Datton Avenue, said we should put first things first and spend our money for police or streets. Carpenter, 4346 Jerry Street, said he believed there was a misunderstanding regarding the energy crisis. The steam plants use a lot of oil and the use of gas is another power source. The energy comes from many sources. In favor of cutting down more on lighting and publicize it throughout the City. City Manager Mocalis stated we had received two tele- grams from President Nixon suggesting that public buildings lower thermostats to 66 degrees and not use air conditioners until 74 degrees; that public vehicles drive no faster than 50 miles per hour. We have also cut down on the lights in our building. Mr. Parenteau stated that the lights had not been reduced in front of his office on Ramona Boulevard. Mr. Perry restated that they had only been reduced in the one block. DIRECTOR OF PUBLIC WORKS TO REMOVE TWO LIGHT BULBS FROM ALL LIGHTS ON RAMONA.
