Planning Director Gordon stated the recommendation of the Planning Commission was to rezone residential uses to R-1 and commercial uses to C-2. Council indicated the desire to rezone residence to R-1, but to leave commercial in the existing C-2A zoning. It was refer- red back to the Planning Commission to obtain a report on the proposed change from the original recommendation. They were concerned about the zoning of the development of the two vacant C-2A parcels. They thought C-2A would be more difficult to develop than C-2 because of the requirement of two uses in any new proposed development. Councilman McCaron stated that there is a misunderstand- ing in what is required for a development in C-2A. At the time the property was zoned to C-2A, the intent was to require a minimum of one acre of ground. It would take almost two lots to make one acre. It was never the intent to require two uses. To correct this, either proceed with conversion of the C-2A to R-1 or initiate proceedings to clarify the ordinance to indicate that the usage does not require two uses, but requires a mini- mum of one acre to qualify. This could mean a limitation to these parcels. When this area was originally zoned, they anticipated a large shopping center. Councilman Blewett said that C-2A requires one acre minimum. M/S/C: MC CARON/ HAMILTON. 00- It was the time and place fixed for a public hearing on Z-372, application for a Zone Change from R-1 and C-1 to C-2 on property located on the Southwesterly side of Francisquito Avenues from the San Bernardino Freeway to Vine!and Avenue in the City of Baldwin Park. Applicant: Mr. Harry Snyder. Publications, postings and mailings were accomplished There were no written protests. Mr. Harry Crowe, 1451 Vineland Avenue, Baldwin Park, stated that both of these properties were within 25 yards of his property and there was a dog-leg inter- section. He said he was in opposition to this zone change and there is a traffic hazard there and any development at this time would be tike the cart before the horse". They should straighten up this intersection as it is a mess! Traffic is backed up for one-half block or more and high rate of traffic accidents there. Mayor King said he would ask the Traffic Committee to investigate this area. Councilman Blewett said he has spoken to the Director of Public Works Perry regarding this problem. He said there are several alternatives to be taken; to change the course of the street or coordination of signals. City has to do something about it. M/S/C: GREGORY/HAMILTON. 00- Mr. Jesse Fristoe, 14428 Ramona Boulevard, referred to City Attorney Ftandrick's letter regarding a Conditional Use Permit, asking Council to relieve him of the strain imposed by a Conditional Use Per- mit. He stated" he had been doing business at this location for the past seven years and would appre- ciate their consideration in his behalf. He said he didn't know of an Italian or Mexican restaurant that didn't sell beer. Councilman McCaron asked-what the objection was and Police Captain Hebert said the Police Depart- ment had filed a protest with the ABC because of information they had on file. Mr. Fristoe desired Council to take action now as time is short and he needs to give information to the ABC and get the action started. Assistant Attorney Kress stated that Council would have to decide whether or not these facts required a Conditional Use Permit and whether or not this establishment had a non-conforming status, as to the grandfather" rights. City Manager Mocalis said the reason the Police Department had filed the protest us that without the Conditional Use Permit, they would not have any restrictions on the applicant. With a Condi- tional Use Permit, certain conditions could be attached which would cause the Police Department to withdraw their objections from the ABC. Planning Director Gordon said if Council decided that a Conditional Use Permit was in order, then Mr. Fristoe would have to file an application with the Planning Department and they would conduct a public hearing. Mr. Gordon stated that they cannot waive fees. City Manager Mocalis said that this could be held over and the Police Department and the ABC could come to an agreement, or Council could refer it back to the Planning Commission and they could initiate a public hearing. Councilman Btewett stated that it would be to Mr. Fristoe1s advantage if he could pay the $125 rather than having the Police Department and Planning Commission against him and one way to do this would be by the Conditional Use Permit. Mr. Fristoe said he was willing to cooperate in every way with the City, but just did not have the funds available at this time. The business has not progressed to the point where he is making money. Councilman Hamilton commented that he had been in Mr. Fristoe's establishment and he has spent a lot of money remodeling and has a neat, clean place- Mayor King asked Assistant Attorney Kress to give some thought to this and they would come back later in the meeting with a possible solu- tion. 00- City-Manager Mocalis stated that the agreement for Animal Control Services would have to be approved by resolution before December 31, 1973 and recommended that Council approve it. Mrs. Haltie Slater, 4814 North Stancroft, stated it had been suggested or recommended to Council to go into a mini-bus type service. With the energy crisis here, the service we now have is not the answer. In the study made by Don Holmes of the Chamber of Commerce Transportation Com- mittee, La Habra went to a mini-bus system for only $9,500. It is a dial-a-ride system, operates six days a week from 7:00 a.m. to 7:00 p.m. She asked Council to consider something like this. Mayor King said that Council members and others had already suggested that some other system be implemented. Councilman Btewett stated that the present ser- vice has not been what we expected as there are too many empty buses. He didn't especially like the dial-a-bus system as it was more costly than $9,500; more like $50,000. We have a taxicab company in our community and we could have them add more service and the City subsidize it for the handicapped and elderly citizens. This system could be working in a shorter period of time. Councilman Hamilton said he certainly was not in favor of the service we now have and suggested giving them a 30 day notice. Councilman Gregory stated she also is disappointed in the bus system as it is now as citizens had complained about walking a long distance to catch a bus and of the high steps, however, dial-a-ride is a subsidized system. Whatever type of trans- portation we decide on, it will have to be sub- sidized. She agreed we should terminate this system, but should continue service through the Christmas holidays. City Manager Mocalis suggested that Council give SCRTD 45 days written notice and at the end of approximately 30 days if they wish to continue it, they would still have time to renew the con- tract. Councilman McCaron asked if RTD was designing a smaller type bus. Councilman Gregory stated they are in a process of purchasing 300 more replacement buses, but they are still a large type. Councilman McCaron said we should have smaller buses and schedules be shortened so that there wasn't such a long waiting period in between buses. Councilman Blewett felt it was important to make a decision before the end of 45 days as the Council has made a commitment for some kind of transportation, which system we provide should be the one that will work and be the least expen- sive. Assistant Attorney Kress read an urgency ordinance as follows: ORDINANCE NO. 674, AN INTERIM ORDINANCE OF THE CITY OF BALDWIN PARK ADDING SEC- TION 9475.1 TO THE ZONING CODE OF SAID CITY URGENCY ORDINANCE). Councilman McCaron asked if they couldn't have some kind of an agreement rather than an ordinance as he did not agree to an ordinance to handle one item. Assistant Attorney Kress said Council would have to make a decision whether to uphold Mr. Fristoe's appeal or the Planning Commission's decision. There is nothing in the code at this time for either the Council or Planning Commission to waive or modify these fees in any circumstances. Mayor King said we are making an exception to help Mr. Fristoe and perhaps this 30 day ordinance would solve his problem and we would still have our Condi- tional Use Permit with conditions stipulated to give the Police Department and City control. In answer to Mayor King, Planning Director Gordon stated the necessary steps for a Conditional Use Permit were mainly to file application and the applicant spending several hours at the County Assessor's office obtaining names and addresses and making a sketch of his layout or having some- one make the sketch, and the cost would be about $25.
