Invocation was given by Councilman Blewett. Ro11 Call: Present: COUNCILMAN BLEWETT, GREGORY, HAMILTON, MC CARON, AND MAYOR KING JANUARY 2, 1974 7:30 P.M. FLAG SALUTE INVOCATION ROLL CALL Also Present: CITY MANAGER MOCALIS, CITY ATTORNEY FLANDRICK, DIRECTOR OF PUBLIC WORKS PERRY, PLAN- NING DIRECTOR GORDON, POLICE CHIEF ADAMS, CITY TREASURER CALE, FINANCE DIRECTOR DUNCAN AND CITY CLERK BALKUS. 00- On behalf of the Chamber of Commerce, Mayor King stated that the January Community Service Award recipients are Mrs. Margaret Burnett and Mrs. Nathine Bond commending them on their outstanding community service. The awards wilt be presented at a later date. 00- Mayor King requested that the following amendments be made in the December 19, 1973 minutes: Page 6, Para- graph two, last sentence to read, We possibly need a good ordinance; and Page 8, add paragraph after first paragraph on Chamber of Commerce Agreement Mayor King felt that the preliminary audit report given to Council was sufficient to execute the agreement with the Chamber of Commerce". Councilman McCaron said there are times in the minutes where something is said and nothing precedes it to know what it is about. This has happened several times and in asking to cut the minutes down, perhaps we are cutting them too much as there is a lot left out. It is better to leave an entire thing out rather than make a statement by itself with no meaning. Mayor King said that his insertion was partially a recommendation to Council was why he wanted the insertion; otherwise he wouldn't have brought it up. Councilman McCaron stated that in the minutes regard- ing the Chamber of Commerce Agreement, the contract was agreed to, then the contract was changed where the City was to pay for the audit and this is not indicated in the minutes Page 8). Mayor King said this wasn't an audit to be conducted by an auditing firm; it was merely an audit by the Chamber Manager. Mr. McCaron asked what was meant by auditing material. The one change that was made in the contract and concurred by the Council was that the cost of the annual audit would be paid for by the City. He suggested that the following be added to the motion: The annual audit required by the City wilt be paid for by the City of Baldwin Park". Carpenter asked as a point of order why the audience had to take the oath, when the City Officials did not. Mayor King told him that he could be heard under the Oral Communications portion of the Agenda. 00- It was the time and place fixed for a public hear- ing on CP-195» appealing the decision of the Baldwin Park Planning Commission on an application for a Conditional Use Permit In accordance with Section 9631.3 of the Baldwin Park Zoning Code to establish a Dog Kennel on property located 1n M-1 Zone at 3914 Downing Avenue In the City of Baldwin Park. County of Los Angeles, State of California. Applicant: Mr. & Mrs. Byron Hendrlcks. Proper publications, postings and mailings were accomplished. There were no written protests. Planning Director Gordon stated that the appli- cants will have approximately 50 dogs on the property. They will be outside from 7:00 a.m. to 6:00 p.m. and will remain inside the balance of the time. Butters, 14501 Jeremie Avenue, said he owned property near the proposed dog kennel and there is already a problem with stray dogs and he believed a kennel would create a noise and odor problem and would tower the value of the surrounding property; therefore, he was against it. He lives one block from the property. Mrs. Pearl Ferrando, 14560 Central Avenue, said they owned four pieces of property in the area as well as living there. She said it would be a nuisance and they would be unable to rent their property. She had not attended the Planning Commission hearing as she was not aware of the hearing. Councilman Blewett asked Planning Director Gordon to review the process by which the application was made. Planning Director Gordon said an applicant for any Conditional Use Permit has to file with the City and pay a filing fee. There are three parts to the notification: A legal ad placed in the Baldwin Park Bulletin 10 days before the Hearing, all property owners noted on the assessor's roll within 300 feet of the pro- perty are notified by mail and the streets bordering the area are posted with the notices of the public hearing. This applies to the Planning Commission hearing and the Council hearing. Councilman Blewett said he had talked with some of the people and they had not received notification. Mr. Gordon said sometimes the assessor's roll is from six months to a year behind and that renters are not notified in cases where owners are not residing at the address. Councilman Gregory asked if there was another kennel within a mile of the area. Mr. Gordon stated the animal shelter was in the area. Mrs. Gregory asked what was the basis of appro- val on this case with no kennels in the area in view of the fact the Virginia Street applica- tion was denied. Mr. Gordon said that there had been one denied due to the fact that it was within 40 feet of the residential area. This property is 200 feet away from a residential zone. The Virginia area was being opened up for modern industrial development. MR. CLARK BUTTERS MRS. PEARL FERRANDO Mayor King suggested that the restrictive South El Monte Kennel Ordinance be reviewed. Mr. Gordon stated there were about 15 to 20 dogs on Gayhurst and CP-195 proposed about 50. The only complaint on Gayhurst was in discussion of the general area. Mr. Oscar A. Hooker, 14566-A Central Avenue, said he personally was against the dog kennel and did not believe it was the right zoning for dog kennels First, you have 50 dogs, any size, type or form, all barking. Secondly, he lives fairly dose to this area and the back end of the lots are behind houses and are too dose for a dog kennel and he doesn't believe it is the right location for one. Mr. Gordon said the lots would be combined and were at least 200 feet from any residential lot. Mrs. Perry, 3907 Virginia Avenue, said she felt this dog kennel would be a hindrance to their R-2 property and that kennels should be located in the outlying areas of Baldwin Park. Mr. Raymond Embury, 14575 Central Avenue, said we have so many dogs in the area now that we can't get a decent night's sleep and can hear the dogs barking from the dog pound. 200 feet is too dose to the residents. Mr. Ernest Ferrando, 14560 Central Avenue, said he had lived here for 32 years and has four pieces of property in tMs area and it would be a detriment to him. Mr. Robert Perry, 3907 Virginia Avenue, said he lived on the corner and any resident within 200 feet was only on one side of Virginia and 250 feet on the other side and that was why more people had not received notification. If more people knew about the hearing, they would have attending the Planning Commission meeting. Mayor King asked the City Manager to check on this. Mr. T. E. Carpenter, 4346 Jerry Street, said it was obvious that the people did not receive a notice and that there should be a report to the people. As there was no further testimony, Mayor King declared the public hearing closed. Councilman Gregory requested a list of the people who appeared this evening and she asked if they had appeared at the Planning Commission hearing. Councilman Gregory also stated she was not in favor of the kennel since people were not aware of the hearing. City Attorney Flandrick said this appeal should either be passed or denied. Councilman Hamilton said he requested the appea3 because some of the people were not aware of the Public Hearing and didn't know about it as they would have been at the Planning Commission meet- ing if they had known. The people across the street and in the surrounding area were concerned. The City Manager will check this. Mayor King said he concurred with Councilman Blewett that we are-too congested and times have changed in the past ten years and have very little place for dog kennels, chicken coops and raceways. Councilman McCaron said the owner of this property had applied for a permit to rehabilitate this struc- ture in 1961, but as it was R-1 in an R-3 zone, he would have to have a Conditional Use Permit and he decided it was too expensive. Now the house is a nuisance because of its present condition. There should be some way that people who wish to improve their homes could do so without a Conditional Use Permit. He requested that this problem be researched. After discussion. On what project is revenue sharing money used to bene- fit the people?" He requested a report on this at the next meeting. Mayor King said the City Manager would make a report. 00- Mr. T. E. Carpenter, 4346 Jerry Street, asked why people in the audience had to swear under oath to testify and the officials did not. City Attorney Flandrick said that the City Council acts as a trier of facts as a judge in a court room and they do not present evidence; the people who present evidence under Council rules are required to take the oath. Mayor King explained that there were many items on the Agenda and many people desired to testify and if they had to leave early, they should be allowed to have an opportunity to speak and that is why he asked Mr. Carpenter to wait until time for Oral Communications before speaking. Mr. Carpenter said we should have more than what Mr. Dargus asked for as the City has received hundreds of dollars in revenue sharing, tax funds, etc. He had heard budget hearings, but only what is projected and not what has transpired. When and how are the audits of the City Books and City finances made? City Manager Mocalis stated that the State Auditors come in at unannounced times and audit any depart- ment handling finances. At the end of the fiscal year, the City Auditor makes a certified audit and a copy is on file in the City Clerk's office. Mr. Carpenter stated that the City funds seem to be a dark secret and that he hadn't seen the revenue- sharing report which was due on September 1, 1973. Mr. Mocatis said that certified copies had been published twice in the Baldwin Park Bulletin and he had copies in his office. Mr. Carpenter requested that an audit be made before we have a new Council and present the budget to the people. Mr. Dargus stated he had heard many comments during the month of December. Mr. Carpenter said he had been trying to find out what is going on and what is happening to the money, such as the $250,000 being spent on the Baldwin Park Boulevard Median and $2,000 per month to maintain it. Reports are needed. Councilman Hamilton said there was an audit just completed for the fiscal year 1972-73. It is a certified audit and is available to anyone who would like a copy of it. He stated that an equal amount of revenue sharing money for the new City Hall and police facility had been budgeted for this purpose and was in the bank drawing interest. MR. DARGUS MR. CARPENTER 00- Mr. A. Stockton, 5042 Etton Street, said he was billed $192 for curb and gutters. He had con- tacted a contractor and paid him for the curb and gutters before he received the notice from the City. It is quite disturbing to receive a bill after he had already paid a contractor for the work. Director of Public Works asked Mr. Stockton for his telephone number and said he would call him and see that this was corrected. 00- Mr. Joseph Sehow, 14714 Los Angeles Street, remarked that the energy crisis has forced citi- zens to use other methods of transportation. He had been told by some merchants that there was an ordinance prohibiting bicycle racks on the sidewalks. He requested that this be changed o that citizens could ride bicycles and lock them in racks in front of the stores. Mayor King thanked Mr. Sehow and said this would be checked out. 00- Mr. Ralph Middteton, 13122 East Corak Street, said several weeks ago he had wanted to speak and was shot-down". This was hard to take. He believed the City Council was here to hear the people and their problems. The issue of the last meeting was regarding the Cham- ber of Commerce and was not a public hearing, but we heard a statement by the new President of the Chamber as to the Board's intentions for the new year. He said it seems the permission was granted but it was to be in a different spot than it is now, but in conjunction with the present installation. Mayor King said he heard Commander Ruggles of Hughes Aircraft Company, and he has been in Atomic Energy for approximately 20 years, who spoke on the San Onofre Nuclear Plant. It's his under- standing that there was a minor malfunction, not the plant itself that was closed down. Mr. A. Stockton, 4280 Eiton Street, said he was all for the nuclear energy expansion except that he would like to have it changed a little bit by putting the additional generating plant on the East side of the freeway away from the beach, They say it would be just as easy to do this. He stated that this used to be a beautiful beach and a nice place to take your family. Since the nuclear plant Is there, it has completely des- troyed the beach as you can't get within a half a mile of the beach. So before the Council recommends any more development, he asked that consideration be given to placing it off the beach. Mayor King asked the City Manager to check this out before the next Council meeting. Councilman Gregory asked that the report include the minutes of the Coastal Commission s to why they voted against the installation. 00- Mayor King asked the City Manager to publish an advertisement for Planning Commission applicants, 00- Mayor King said Mr. Garrow had spoken to him about the Roadside Rest Park at the South end of town in regards to a zone change.
