It has been a con- tinual nuisance and has not been maintained. Rock was left at the side of the street and children throw the rocks and damage the fence. He had been told that the City would put up a barricade, but it was not done. Councilman Blewett suggested that Mr. Perry have the conditions of this property checked and give a report back to the Council. City Manager Mocalis asked for the date of the hearing. Mr. Robinson said it was set for January 24, 1974. Mr. Mocalis said this was an informal hearing and citizens have a tow-key discussion on what has to be done and they attempt to make it as easy as possible for the citizen. He asked Mr. Robinson to call Mr. Perry tomorrow for more information. Mayor pro tern Hamilton asked Mr. Perry to check this out and if not a nuisance to drop the case. 00- Mr. T. E. Carpenter, 4346 Jerry Avenue, said he has come before the City Council many times and has heard complaints where people have been given erroneous notices and they say, Come into our office and we will take care of it". This is a public hearing and he thought the citizens were entitled to know about these things because they really amount to harassment. 00- City Clerk Balkus presented a Temporary Use Permit request from the Goodyear Service Store for a park- ing lot sale on January 21, through 27, 1974 from 9 a.m. to 9 p.m. They requested waiver of fees. GOODYEAR STORE APPROVED City Manager Mocalis said that at the last meeting Council requested information concerning City audits. He stated that our City is currently audited 8 ways by numerous agencies. Harmon & Company, an indepen- dent auditor employed by the City, audits at unan- nounced times on all of our funds, the State Control- ler's Office audits also at unannounced times on both revenue and expenditures. The State Compensation Insurance Fund performs a similar audit, the California State Department of Transportation does the same thing. The California Council of Criminal Justice audits our EVIS Grants and Los Angeles County Manpower Division audits our PEP Grants and the California State Division of Highways audit the gas projects. The Official City Audit performed by Mr. Harmon is a public document and is available to any citizen during business hours in the City Clerk's office. 00- Mr. Mocalis was also requested to furnish information regarding revenue sharing funds. He asked the Finance Director to prepare a report and it indicated that the City has made all of the required publications in the newspapers and there are no discrepancies between the figures used in the required publications and the figures shown in the Official City Audit and the City had accomplished everything required by law regarding general revenue sharing funds. 00- Mr. Mocalis presented a report regarding the Roadside Park on the South side of the San Bernard!no Freeway which the City has leased since 1969 from the Division of Highways for $25 per year. We had anticipated the purchase of this property for a token payment under the Porter Act and had been informed by the Division of Highways that we would be allowed to purchase it. They notified us a few months ago that the property no longer came under the Porter Act and if we wanted it, it could be purchased for $58.300.00. They also said they would have to cancel the lease. Mr. Lucas and he had met with State Officials and had been un- successful in changing their decision. He requested permission from Council to contact state-elected representatives to see if they could effect a change in the Division's attitude. CITY MANAGER AND MR. Councilman Gregory stated that at the present time the property is not zoned properly. Mr. Mocalis stated that under the present lease with the Division of Highways, the City was precluded from any use other than a recreational use. The tease expires the middle of February and we are restricted by the terms of the lease. The Division of Highways suggested that this property is usable for C-1 which is the zoning adjacent to it. Councilman Gregory said in view of this expenditure now on this piece of land, their meeting would not commit us, but it would merely be a negotiating on the basis of the land being in our jurisdiction and no commitment as to what it would be used for. Mayor pro tern Hamilton asked how many acres were involved and Mr. Mocalis said it was less than an acre. Councilman Btewett asked if this property is shown as a park under our General Plan and Mr. Mocalis said it was, but didn't know what the zoning map showed. Mr. Blewett said under the State law we are supposed to conform with our General Plan and perhaps this should be pointed out to the State. Councilman McCaron said he didn't think we could preclude the State being able to sell the property or to sell it to someone and deny them the proper use of the ground. He suggested that we research what the original deal was when we leased the ground as there had been some statements made at the time by the State that they would allow us to purchase it for a token amount or that it would be held for park purposes. He also thought they should include the other property in the river bottom and discuss both at the same time. He didn't feel that the State would want to create ill feelings and if we could show that the public had had benefit from it, the State would go along with it. Mr. Mocalis said he had talked with Haig Ayanian, the head engineer for District #7 and he is sympathetic with the situation, but does have written rules by which he must operate and he is aware that we will negotiate in good faith and they will cooperate with us and does hope we will be successful. 00- Mr. Mocalis said he had asked the Director of Commercial and Industrial Development, Mr. Sexton, to research the situation concerning our bus contract. His report indi- cated that the bus service had fallen well below what the City had anticipated and we have about 66 people per Thursday for two buses and our cost is extremely high per passenger. He recommended that Don Holmes and the transportation committee research alternative systems and provide us with more indepth information concerning potential patronage and anticipated costs and that the staff be instructed to research the possi- bility of State or Federal funding for a demonstration project. According to Council instruction, he had notified SCRTD that we would cancel our present contract effective January 18, 1974. Mr. Mocalis said they were aware that the service had not worked out due to the physical aspect of the bus and 3 to 4 blocks is too far for senior citizens to walk to catch a bus. They cannot provide us with mini buses. They did assure us that if we had our own system, they would assist us in maintenance or manage- ment of a transportation system. Mr. McCaron felt we should have a little more study on this and not be thinking about having the dial-a- ride system as that would be competing with taxi ser- vice. We should stay with public transportation as such and we should have more service for the City itself and having mini-buses was about the only way we can do it. There is a need and we want to meet the need. He suggested turning it over to the com- mittee and see what they can come up with. Mayor pro tern Hamilton stated that Mr. Don Holmes and his committee had made quite an extensive report on this and there are several different ways to go. He knew that East Los Angeles had a Federal Grant and we should pursue this. He asked Mr. Sexton to give his comments. Mr. Sexton stated that in East Los Angeles their daily average was around 300 and was going up. Their cost was about $200,000 for this service. They were doing this under a Model City's Program with Federal funding. Mr. McCaron said to compare the two: We have 66 a week and our budget was $5,000 for six months. The other is $200,000 a year for 300, so it doesn't seem that East Los Angeles was doing so well. Mayor pro tern Hamilton said even if we considered buying our own buses and operated them. there were several alternatives. He would like the committee to continue to study this and come up with a recom- mendation as we do need transportation for the people and we want to help them if we can. 00- Mr. Mocalis said the next report was concerning a new State law and indicated the State Legislature had passed an Urgency Statute which changed the Disability Retirement procedures for local safety employees, and the City Manager should be delegated the authority to determine disabilities. A resolution is necessary for this new procedure. M/S/C: BLEWETT/GREGORY. 00- Mr. Mocalis said that the Department of Water and Power had notified him that they have post- poned for four years the reconstruction of the DWP lines in the City of Baldwin Park. 00- Mr. Mocalis said he had been concerned regarding Section 9654.4 of the Zoning Code covering open storage and trash areas. He had received quite a few complaints and after investigating, found we had 37 property owners who had attended con- ferences with the District Attorney and with our staff. He felt that either we had a section of the Code not worded properly, is not a good law or the staff is applying the rule too stringently and not doing an effective job. He requested the Council to instruct the Planning Commission to take this particular section back before them for a public hearing and to request the staff to withhold any further enforcement of this section for 60 days. PLANNING COMMISSION TO CONSIDER SECTION 9654.4 OF ZONING CODE FOR PUBLIC HEARING AND STAFF TO WITHHOLD ENFORCEMENT FOR 60 DAYS. M/S/C: MC CARON/BLEWETT. 00- Mr. Dargus, 13260 East Francisquito Avenue, said two weeks ago he made a request regarding the amount of money that was being spent to refurbish and remodel City Hall and where the money was com- ing from, but this audit report does not state how much money was spent to refurbish City Hall in 1973. Mr. Mocalis said he had not received instructions on this, but with Mr. Perry's help, they could answer it. Any remodeling done in the City Halt was necessitated by a million dollar Federal Grant with which we purchased some additional Data Pro- cessing equipment and had some rather stringent security requirements for this equipment. We are the Central Data Bank for 22 jurisdictions in the San Gabriel Valley. The area previously used for this equipment was too small and had limited secur- ity. We relocated the EDP equipment to the North- east corner of this building and changed offices making use of the EDP area previously used. Part of this $6,500) was from Federal Grant and the balance of the funds was from the General Funds. Mr. Dargus said that was the $14,000 appropriated in the Spring of 1973 and he wondered where the rest of the money was coming from. Mr. Mocalis said he would be glad to give him a report in writing if he wanted it. 00- RES. NO. 74-7 ADOPTED D.W.P. E. Carpenter, 4346 Jerry Avenue, said he had asked for an audit for the revenue sharing. He said he had a copy of the report on revenue sharing and what it had been used for, according to the report, public safety, environmental protection, public transportation, health & recreation, social services for the poor needs, financial administration and library. He wanted to know at this meeting or at the next meeting how much money was allocated out of the $611,386 revenue sharing to the categories which come under Section I of the Act. Section II is capital expenditures and none of the money was used for that, although many, many times he had heard the City Manager state that it was used for building a civic center. It is in the minutes repeatedly. Now, he has gone on record that the money is being used in these 8 categories. He stated at the end of the report that the reports agree with the City audit and financial reports as published and the reports allocate all expenditures 100% to public safety, operating and maintenance. He asked the City Manager to explain at this meet- or the next meeting. Mr. Mocalis said that he had not made a statement in writing or oral. He said the report does not indicate we have spent anything on transportation or capital. Mr. Carpenter said it states that the money is allocated. Section I of Act of Congress. Mr. Mocalis said it states the above reports agree with the City Audit and the past reports as pub- lished, the reports allocate all expenditures 1003; to public safety, operating and maintenance and that is exactly where the money has gone. Mr. Carpenter said then every statement that has come before the Council is erroneous as far as building the civic center with that money. Mr. Mocalis said the Council was fairly careful in their instructions to the staff. They instructed them to use the money for public safety and to take a like amount of money raised from General Funds and other areas and set this aside in a surplus account, which has been done by Minute order of the Council. Mr. Carpenter asked if the Council has the authority to override the Act of Congress. Mr. Mocalis said they did not override an Act of Congress. He said he had read the statute of the public law and consulted the City Attorney and was sure what they had done was correct. He had talked to a representative in Washington, D. C. and he had concurred with their action. Mr. Carpenter said in other words it was buried in operating and maintenance where it isn't actually used and take a like amount which you don't have freely and pass it over into capital. One thing we should remember, that it would be a mistake to take revenue sharing funds and make them part of our budget and that is why it isn't done. Mr. Carpenter said that they were doing this as they sock" it in the bank, move it from the revenue shar- ing and call it operating and maintenance and move it over to the capital funds. Mr. McCaron said they move the general fund money into a separate account for the purpose they intend the money to be used and this is perfectly legal and the City Attorney will concur. City Attorney Flandrick said if he understood Mr. Carpenter's point, it is that they have deposited the funds into different bank accounts, but it still retains its character as revenue sharing funds. Mr. Carpenter said they indicate on all the reports to the United States Government that it is being used for operating and maintenance and the report says it is being used for the 8 items which come under Section I of the Act of Congress and they are not doing it. The very minute they receive it, they put it in the bank for capital expenditures. City Attorney Flandrick said that was better than keep- ing it under the mattress and was Mr. Carpenter com- plaining that they were depositing the money. Mr. Carpenter that there was a limitation on these funds and Mr. Mocalis was aware of this. The limita- tion runs out in two years on capital funds and the $129,000 from January through June 1972 expires if it is kept under capital expenditures. It is no one's money but the Federal Government and it expires in June 1974. Mr. Mocalis stated that this was incorrect as the Federal Law states that you have two years from the date of receipt of the check. We received it in January 1973 and have until January 1975. Various aspects were studied such as configuration, traffic volume, accident rates, existing signalization and congestion. There were three alternatives submitted: 1) Realignment of Dalewood Avenue and Vineland Avenue for standard- ized signalization. 2) Signalization of the off-set intersection for signalization of both intersections, and 3) relocation of Stop Bars, to move the stop bars back to the east side of Vineland Avenue. They recommended Alternate #3 and to keep the inter- sections under observation. If this does not prove effective, they could come back to Council. Mr. McCaron said that because of the danger at this intersection. Alternative #2 should be considered. Mr. Perry said that the State of California has a series of traffic warrants whereby they determine if certain conditions justify signalization. The conditions did not satisfy these warrants. Mr. McCaron asked City Attorney Flandrick if you had to justify a change in an intersection by actual deaths before it could be changed. Mr. Flandrick said it was a matter of discretion as far as traffic is concerned. He said the warrants Mr. Perry was referring to were put out by the State merely as guidelines. Mr. McCaron said this particular intersection had been a trouble spot for a long time and is an extremely dangerous one. He said we should convince the State to spend money for this and perhaps even provide the money ourselves out of the next budget to take care of it. Councilman Blewett said he agreed with Councilman McCaron that this intersection should take priority. Mr. Perry said it wasn't that the State has to allow us to do this, but rather we have the money set aside for other gas type projects. Mr. McCaron said we should readjust the priorities. They have three schools where children are crossing the street and every day there is a close call". Councilman Gregory asked that Mr. Flandrick review the resolution. She said that this had been widely supported by various councils. Mr. McCaron said he thought that we should find out if the airport in the Palmdale-Newhall area was going to be consumated before we decide. If this is a last resort, then we should support it. Mr. Flandrick said the purpose of the request was made at the end of December for hearings on the Environmental Impact Report on January 8 and 9 and perhaps It is not timely. He said he thought there would be further hearings on this. Councilman Gregory suggested they hold this in abeyance until further word comes through on it.
