Assistant Director of Public Works Sexton said there was someone living there and that certified letters had been mailed. There were no written protests. Mr. Vernon Bronson, 4917 Bleecker Street, owner of the property, asked for clarification of repair of roof as the rocks there had been thrown there by children. He had talked to Mr. Perry and to Mr. Cunningham and they had sent him the requirements for the fire wall. He wanted to comply with the specifications but asked for an extension of time. Councilman Hamilton asked if this building was built before the ordinance went into effect and Mr. Bronson stated it was built in 1941. Mr. Hamilton asked why we are requiring this updating unless it is too close to other structures. Mr. Sexton said it was conceivable that property owners on the South could build up to the property line and this is why there must be a fire wall. As there was no further testimony. Mayor King declared the public hearing dosed. City Attorney Ftandrick said Mr. Britt indicated the work was done by a private contractor. However, our records show the work was done. Mr. Britt could pay under protest. It was the time and place fixed for a public hearing on ZV-288. application for a zone variance to encroach on the side yard set back for development of an industrial business park at 13245 Los Angeles Street in the City of Baldwin Park. Appeal filed by Robert Sherman et a1. PUBLIC HEARING ZV-288 Proper publications, postings and mailings had been accomplished. Planning Director Gordon read a letter from Mr. Arciero, partner to Mr. Monroe the applicant, requesting the above three hearings be postponed to March 6, 1974 to allow him to properly evaluate the terms and conditions set out by the Planning Commission regarding the proposed industrial park development on Los Angeles Street. He stated he had also talked with Mr. Monroe and they want to re-evaluate the whole proposal and they they would not be able to be at the hearing at this time. PUBLIC HEARINGS ON EIR Z-374. Z-374. Big Dalton Avenue, said she wished to protest the postponement of the hearings. She asked that the people hear the Environmental Impact Report and they could still continue the hearing. Mr. Gordon said if the applicant decided to change his application, there may be many changes involved and he would suggest not having testimonies until that time. Mayor King asked the Council if they wanted to hear testimonies. Councilman Hamilton said there might be changes and applicant might want to change his application and it would not be fair to him as he is not pre- sent. No value in testimonies if no action could be taken. Mr. T. E. Carpenter, 4346 Jerry Avenue, asked if they would hear testimony on all three items. Mayor King said they would not hear all three items, only the Environmental Impact Report. Mr. Carpenter stated the people had paid $75.00 for the appeal and they should be heard. Mayor King said that it would be impossible to hear testimony on the zone variance as the appli- cant was not present. Mrs. Mayes said they should listen to the people in the audience who wished to speak; they could carry it over and they would also have another chance to speak at a later hearing on the subject. City Attorney Ftandrick said the Council would be in effect rescinding its action it they were going to conduct a public hearing on Item #6 only which is EIR Z-374. Mr. Flandrick said they had a motion that had been acted upon that a11 three items be continued. He suggested that one of the members of Council who voted in favor of the motion, move to reconsider the motion. He asked if they were going to listen to a11 three of them. Mayor King said they couldn't listen to all of them as no action could be taken, but thought they could listen to the people on the appeal who had come to the hearing. Mr. Robert Sherman, 4509 Hornbrook Avenue, asked if the people could ask questions. All three hearings would have to come in order and that is why they can't act on any one of them at this time. Planning Director Gordon said the variance was conditional on the zone change being approved. It is handled this way in cities to avoid red tape. Mr. Sherman said this was a back-door" approach and that a M-1 Zone did not exist. Councilman McCaron said it seems that the people present want information on the entire project and if they want to ask questions, there wouldn't be any harm in it, but we should wait until the application is before us and we are ready to take action before we hear any testimony on it. City Attorney Flandrick said if they were going to take any testimony on any of the matters they would have to reopen the public hearing. By formal action they had continued these hearings and would have to retract all or part of that motion and specify what win be heard. There are four separate Items; 1) EIR relating to the zone change, 2) Zone Change application, 3) Zone Variance application and 4) EIR in reference to the zone variance. There Is a good chance that the applicant will chance his plans. Councilman Hamilton said these people had paid $75.00 for a zone variance. This was before the zone was changed. If this zone 1s not changed, he suggested that the $75.00 be refunded to them. Councilman McCaron said that this $75.00 was one of the things he was opposed to. If a person wants to protect his property, he should not be charged to make an appeal. He thought this part of the ordi- nance should be rescinded. This should be referred to the Planning Commission for a preliminary study. Mrs. Dorothy Mayes said the Environmental Impact Report was on the Agenda and they should hear It. The application for the zone variance has passed the Planning Commission and whether the applicant was there or not. they should hear It. They could continue their decisions, but the people wanted to be heard. Mayor King said in view of the possible changes to be made by the applicant, it would be best to not hear any testimony until March 6, 1974. The other councilmen concurred that it would be a waste of time for any testimony, since they could not take action on it. Mr. Sherman said that he agreed that they should wait until March 6, 1974 when the applicant would be present and they would have alt 3rf the facts. Stancroft, asked if there were changes made by the applicant would it have to go back to the Planning Commission, therefore they wouldn't be able to testify at the next hearing. City Attorney Flandrick said he didn't know what changes would be made, if any, and it wouldn't be to the zone change, only to the variance. Then he would advise the Council and they could act on it or send it back to the Planning Commission. 00- It was the time and place fixed for a public hearing on Z-377, application for a zone change from C"M to R-1 on properties located at 4817 through 4951 Azusa Canyon Road, in the City of Baldwin Park. Initiated by the Baldwin Park Plannin Commission. Mr. Gordon read the items pertaining to the zone change and said the Planning Commission recommended approval. He stated he had received a letter from Mr. David Schinn, owner of the property at 4857 Azusa Canyon Road stating the majority of the property that would be effected is residential. In his opinion it would be undesirable for commercial use as the lots are too small. Mr. Howard St. Charles, 4903 Azusa Canyon Road, said his property was included in that parcel of land and he had tried to have this changed to R-1 for the past few years. He said he was in favor of the zone change. Mr. Fred Montero, 4525 Azusa Canyon Road, said he was against the zone change. He said in order to have a school, he had to blacktop the lot next to him and he could not build a house there. Across the street is Irwindale and they have heavy tn-ick traffic. He had spent a lot of money in the past 23 years. Councilman Gregory asked him if the blacktop was at the request of the school. Mr. Montero said the City Council would not give them a permit until it had the blacktop. This had been done for the school for retarded children which has since folded. Mr. Albert Ctegg, 4945 Azusa Canyon Road, said he objected to the zone change. It was not a good street for families and no place for children. There hasn't been much commercial in the past two years. No one wilt buy there if it is rezoned. There is heavy industry across the street; can't change that. Almost impossible to obtain any Government loans also. Councilman McCaron said this area was changed to commercial and industrial about 15 years ago. The reason at that time was that deterioration was setting in. Since then the streets have been paved and improvements have been made. The homes are better than they used to be. It would be an area thatjio one would want to live In. If nothing had been done 1ri'15 years, it Is time to try something else. Councilman Blewett said he was In agreement with Mr. McCaron. We are faced with the same situation 1n the Northeastern part of our City. Irwindale does not have this problem as their lots are bigger. We are always going to be faced with this problem along Azusa Canyon Road. Councilman Hamilton said that Is what we are hoping to accomplish by the zone change, to bring the property back to Its conforming use and this can't be done until it is in the pro- per zone. Mr. St. Charles said he had several other reasons why he wanted it to be zoned to residential. Hf, had had three offers to get rid of his home and couldn't do It because he couldn't get a loan on it. Speaking about Irwindale, how about leaning on Irwindale a little. Maybe they can clean up their property a little. Councilman Gregory said she thought a contact with Irwindale would be In order and that they would cooperate. He said if they gave packets to these two then other organ- izations would feet they had been discriminated against. Mrs. Johnson asked how many packets were prepared and to whom they were given. City Clerk Balkus listed the names: Mayor, City Council, Department Heads and Assistants, Reporters and one for the Spanish-American Senior Citizens for which they are paying $10.00. Mrs. Balkus said that it was not only the printing, but time involved in assemblying, compiling, etc. Mrs. Johnson said that a great deal of confusion is caused because of lack of communication and this gap could be bridged and prevent further problems if they had the information contained in the packets. Mayor King said if she could wait until the next meeting, he would ask the City Manager to research this. Mr. Mocalis said that he had received inquiries from a citizen as to why we couldn't have over- runs of the material for the packets. He said this could become a big problem as the people who came first would be satisfied and those who came late would have to pay for copies. Mrs. Balkus explained that those receiving an Agenda at the present time come in to the City Clerk's office and review items that they are interested in and secure needed copies. This is more economical for the City and the individual. Mr. McCaron suggested that a reading room be provided and citizens could review the packet here. Mrs. Gregory said this was a problem in many cities. Perhaps we could have one prepared in the City Clerk's office. A reading room could be used for discussion after they had reviewed the packet. Mrs. Johnson said they would have to have some means for them to have enough time to read all of the material. Mr. McCaron said they could check an Agenda out at night and return it in the morning as there is a large amount of material contained in the packets and they are expensive and time-consuming to prepare. Councilman McCaron said there should be some way they could eliminate this requirement that they adhere to what this calls for in the way of com- pliance. He asked if there wasn't some way they could cut this down or fix it so that the Planning Director could make these reports. The only thing that would possibly change would be the removal of trees or some other type of construction on a lot and this is covered by our ordinances. To make a person go through this for modification on their home and pay a fee of $100 for an Environmental Report is something they should re-study and see if they could cut it down. Mayor King said the City Attorney stated this was a requirement by State law. Mr. Ftandrick said he wouldn't argue this. He would tike to see them repeat the Act, but they could hold this over until the next meeting if they desired and go over the matter with Mr. Gordon. He said they would probably find that they didn't have much choice. The legislature adopted this Act and it requires these items. Councilman McCaron asked if we couldn't change our method of enforcing it. If they could enforce it by having Mr. Gordon make reports on each item that comes up. Mr. Ftandricksaid the problem was that the Act states whenever there is an activity; for example, Conditional Use Permit, Zone Variance, etc. that the Environmental Impact Report relating to that has to be approved by the Planning Commission and/or the City Council, whichever is the issuing agency and so you have to go through alt the paperwork. The result of this study showed that a considerable savings could be realized by the purchase of cars the size of the standard Volkswagon unless there is substantial reason to consider a different size. All trucks and police patrol cars would be purchased with the smallest motor practicable to perform its assigned task. Councilman Btewett said he was not in favor of foreign cars and preferred American made auto- mobiles. The City Manager said his instructions were to make a study on economics of operation and if they wanted a study of the American made auto- mobiles, he would be glad to ask the Police Department to do another report based on American manufactured cars. Councilman Hamilton said he also was in favor of automobiles manufactured in America and that a study should be made. He was in favor of pur- chasing them in our town if we could. Councilman Gregory said she wished to commend the Police Department on the very comprehensive study they prepared and it was appreciated. City Manager wi11 have a study made of American made compact cars. 00- City Manager Mocalis presented a request from the Chief of Police that Sgt. James Flavin be trans- ferred from Logistics Officer to a patrolman's position due to health reasons. Sgt. Flavin's position being vacated is primarily a mechanic's position and it is recommended that the position of mechanic be created in Salary Schedule No. 41.
