Councilman McCaron asked if the owners had been contacted and Mr. Perry said Mr. & Mrs. Howard Sanders had received a certified letter on Decem- ber 26. Mr. McCaron said that all we seem to do is to mail certified letters. There is no personal contact with the owners themselves. He felt it is time we change our procedures. We should contact the owners and find out what they can do to correct the situation Mayor King said he agreed with Mr. McCaron that owners should be contacted if they live in town. If they live out of town, it is difficult to contact them and a registered tetter to them is about all we can do. The people living in town seem to fulfill their obligations. Mr. McCaron said we should try to find out what the people can afford to do. City should have a different approach and find out what the trouble is. Then we send a letter asking permission to inspect the pro- perty. If this is returned, then another notice is sent. Most of them are contacted-" After notices, the nuisance is abated. Mayor King said alt avenues should be pursued. Con- tact the owners and make certain we have tried every way to help. Mr. McCaron said there should be a report to indicate what work needs to be done and what the owner's atti- tude is toward it and give him an opportunity to take care of it. City Attorney Flandrick said there was nothing in the code to prohibit personal contact. He suggested that if Council wished to review the procedure, they ask the City Manager to make a report outlining steps taken, and they may or may not be satisfied and perhaps a change in the ordinance would be warranted. City Manager Mocalis said he would make a report on the policy as he understands it. Councilman Blewett asked Mr. Perry what the source of information was regarding the public nuisances, if they were neighbor complaints. He has had certain individuals ask him why something wasn't done and they demand that it be done promptly. Quite often the action is very slow. This had happened to alt of the Council members. Mr. McCaron asked if they had looked at the house in this case and stated it was not as bad as the report indicated. It was not much different than other homes in the area. The house was vacant and they should look into it and find the reason. Some houses were sold because of R-3 zone purposes and never developed. He said he had insufficient information on this so he could not make a decision. Mr. Blewett said there are two sides to the situation. If someone lives next to a nuisance, they want it handled. We are all neighbors and there are many cases like this in the City. Mr. McCaron said the picture is changing. We are not getting the same type of nuisances as before and they are not that bad anymore. Mr. Blewett said it was true that there are less cases than in the past. He felt that the first obligation of the Council was to protect and pre- serve the neighborhoods of the community. Mayor King said the staff will research this and report back next meeting. Mr. Salcido, 1583 Arrow Highway, Covina, said his mother owned the property in this case. The struc- ture had been wrecked by A-1 Power Sweeping Company. He has engaged an attorney and has a pending law suit. He also has obtained estimates on the clean-up and he would take care of it. Mayor King asked Mr. Salcido to try to come in to see Mr. Perry regarding the property. Mayor King asked Mr. Perry to try to contact the owners personalty and to take pictures of these cases before the next meeting. CONTINUE ITEMS 2. 3. 4, AND 5 TO MARCH 6, 1974. The rear lots are in County area. Initiated by the City of Baldwin Park. Planning Director Gordon stated that the annexation was necessary due to the lots being half in the City and half In the County. Mayor King asked City Clerk Balkus if all publica- tions and mailings had been made. Mrs. Balkus said they were and she had copies of the affidavits. Carpenter, 4346 Jerry Avenue, said that nearly two years ago he stated to the Council that they did not have a standard operating procedure, no regulations or guidelines for public nuisances. He pointed out that they were entering properties illegally and quoted California law. In the minutes it was stated that an ordinance would be written, which has not been done. It is heartening to hear a Councilman speak up as to what is happening. He recommended setting up standard operating proce- dures. MR. T. E. CARPENTER Mr. McCaron said we do have a nuisance ordinance. 00- Mrs. Amos Slater, 4814 North Stancroft, asked if someone has a comment on Item 2 under City Manager could they speak then. Mr. McCaron said he favored discussion under Oral Communications rather than encouraging discussion throughout the meeting. Council concurred. Mrs. Slater said if the reports were given before the Oral Communications, then they would be able to discuss it. Mayor King said they could listen to comments but not a debate. Continued) MRS. Councilman Blewett asked if there was a polling place to replace the Women's Club since it had been burned. The highest bidder on the Vibrapac Road Roller was Wallace Motor Sales in amount of $457.00 and highest bidder on Ford Dump Truck was A-1 Asphalt and Seat Coat Company in the amount of $607.00. He recommended that the two bids be accepted. They recommended that in addi- tion to the copy available in the City Clerk's office, that two additional copies be on file in the County Library. This would enable citi- zens to read them at the library or one copy would be available to be checked out for a 24 hour period. A charge of $10.00 per agenda packet should be continued for those desiring to buy a copy. Mrs. Gregory suggested that persons wanting to buy a copy should make their wishes known to the City Clerk one week prior to the meeting to assist in determining the number of copies to be made for the packets. Mr. Blewett asked if both copies could be checked out. He thought one copy should be in the library at alt times. Mrs. Balkus said that one copy would remain on file and one copy would be available for check- ing out. Mr. McCaron said if everyone returned them in a timely manner, one copy should be enough for check out purposes. Mr. Hamilton said he thought this was a very good recommendation and that if citizens who checked out the copy returned them in 24 hours, they would all have a chance to review the packets. He felt that running more copies would be costly. Mr. Carpenter suggested that Planning Commis- sion packets also be on file at the library. The City Council concurred. Mrs. Slater said that this may be a solution. She had heard of two people who either called or came to City Hall last week requesting an agenda packet and were refused; one of them was a Treasure Chest representative. Mrs. Balkus said the only additional request was from the Treasure Chest which was made late Friday and it was explained that it was too late as the agenda packets were completed. At the request of the Treasure Chest, agenda pac- kets had been prepared for the last four meet- ings and as they were not picked up, a packet had not been made up for this meeting. The person requesting a copy was not aware that there had been a previous request or that they had not been picked up. A copy will be made for them for future meetings. He recommended approval of completion of the districts and to set a hearing date of April 17. 1974, to hear any protests or objections to the cost of construc- tion. M/S/C: MC CARON/BLEWETT. 00- Councilman Blewett read a letter addressed to the School Boards and Mayors of surrounding cities in regard to erasing graffiti, asking interested persons to a joint action meeting to be held at Morgan Park on March 11, 1974 at 7:00 p.m. He read the 10 point program proposed as a basis for starting discussion. Mr. Blewett asked for the Council's help. He felt that if they could have alt the surrounding cities band together, they could erase this pro- blem. Mr. Hamilton said these items were good and he asked the City Attorney if an ordinance could be adopted whereby the judges refer offenders back to the City to serve on a work crew to pay for the damages and that parents be required to make restitution in some form to property owners. Mr. Flandrick said we have an ordinance in effect now that allows any person convicted of a crime to be directed to work on any public project, but you can't mandate the court and judges to do that. It would be at their discretion. Most juvenile courts have been reasonably cooperative in this respect. He suggested asking the Chief of Police to check with the judges. Mayor King asked Chief of Police Adams if the judges had been lenient. He asked if they could have the disposition of the cases by the judge involved. Chief Adams said the judges usually are lenient and generally we do not receive a disposition for about 3 to 6 months. He said they had set up within the next week or so, a meeting with the juvenile court and Citrus Court and it might be well if they had some ammunition to give them more power, such as a resolution from the City Council. City Attorney Flandrick said he thought that the Chief of Police would like a specific Council authorization for he, the City Manager and the Mayor to meet with the appropriate juvenile court officers, probation department, and muni- cipal judges to express the concern of the Council.
