PLanning Director Gordon said the above four items under public hearings were continued from a month ago. He had received a request from the applicant for a continuance until April 3, 1974 as Mr. Vernon Monroe was no longer affiliated with this project. He said a representative was present at this meet- ing to explain the situation. Mr. Mike Mackey said the reason they were asking for a continuance was because Mr. Monroe who was a partner, had found it necessary to disassociate himself from this project and had given them short notice. In addition, they were trying to acquire some additional property which could cause a modi- fication in this site. He felt it should be pre- sented as it would be built and the additional time would give them an opportunity to negotiate for the additional property. Mayor King said that it would best not to take any testimony at this point. PUBLIC HEARINGS ON EIR Z-374, ZONE CHANGE ON Z-374, EIR ZV-288. He said he had put in an appeal on Zone Variance 288. Why don't they throw the whole thing out; let them put in a new proposal to the Planning Commission and give the $75 back to the people. Mayor King said as there were no objections by Council, it was so ordered. Mr. T. E. Carpenter, 4346 Jerry Avenue said the M-1 Zone did not exist and they made a variance on something that did not exist. No property holder who has a residence in this City has ever got a zero lot line zone variance. Why are we allowing a zero lot line on these people, permit- ting them to build a block wall on residential property and put in trees. He asked that they throw this out and refund the $75 to the people. 00- Director of Public Works Perry said that Case No. 74-N-4, 5059-61 Heintz Street and Case No. 74-N-6, 13366 Ramona Boulevard, had been dismissed as the owners had accomplished the necessary clean up. 00- It was the time and place fixed for a public hearing on 74-N-1, 3738 Baldwin Park Boulevard to determine whether nuisance exists, continued from 2/20/74. Proper postings and mailings had been accomplished. There were no written protests. Mr. Ralph Smith, 14219 Ohio Street, said he was the owner of the proerty. He said he protested this hearing, not that some of the conditions did not exist, but at the method and procedure of handling the notification. He felt that more could be accomplished by person to person con- tact, rather than mandatory hearing before a public body of officials without prior verbal communication. If this could happen to him, he wondered how many others in Baldwin Park had been embarrassed or harassed in a like situation. He said we are taking a Council hearing as first recourse rathern than a last recourse. He said early in December he had asked the Police Depart- ment to investigate a building on the back of property at 3738 Baldwin Park Boulevard. The tenants were given his name as filing a complaint, so they did not pay the rent and said they would not move until they felt like it. After he gained possession of the property, he carried six pick-up loads of trash to the dump and had the house painted. While the painter was there, the Fire Department arrived to check the wiring. Items 1, 2, 4 & 5 had been the doings of the tenants. Without prior communication from Mr. Perry or Mr. Gordon, he received a certified tetter on January 25 that there would be a hearing on February 20, 1974 and he asked for a continuance until March 6, 1974 Continued) MR. One telephone call would have clari- fied any of the deficiencies. He said two lenders were notified of the hearing and one was an elderly widow, therefore, he thought an apology and explana- tion was in order. He stated no telephone call was received from the Director of Public Works; no letter or telephone call was received requesting consent to inspect the property. Mr. Smith said if the Public Works Department had been in contact with him they would have known that one building was torn down three weeks ago and the other one was in the process of being torn down. He felt that before they bring citizens before the Council and take up their time and the time of the people, there should be communication with the owner and it would eliminate embarrassment. He hopes that this discussion will serve to increase the efficiency of the staff to deal with the people of the City. If this happened to him, it could happen to any of the people of the City. Mayor King said the City Attorney and the City Manager are making a study of this and possibly we need to re-evaluate this situation. We should take all precautionary measures and thanked Mr. Smith for some good suggestions. City Manager Mocalis said Mr. Smith's comments reflect the feelings of the City Attorney and himself and the new procedure will be to provide that the initial contact between the citizens and powers that be" will be to hold an informal hear- ing where they will discuss the problem freely and if not satisfied, they can bring it before Council. Councilman Hamilton asked Mr. Smith if he had con- tacted anyone at City Hall and he said he had spoken to Mr. Perry and Mr. Mocalis. Mr. T. E. Carpenter. 4346 Jerry Avenue, said for two years he had been before the Council to ask that they control this harassing. He had gone through the files on a11 public nuisances. The so-called procedure is inadequate. There is a piece of paper in the files that shows that they have attempted to contact the people. The pro- cedure should show exactly what steps are being taken. MR. T. E. CARPENTER As there was no further testimony. Mayor King declared the public hearing closed. Mr, Perry said that as a word of explanation, they have the responsibility to contact lenders, also that they had not entered the structures in this case. He said that there had been a meeting between Mr. Cunningham and Mr. Smith on January 31 to see what Mr. Smith planned to do to clean up the property. Councilman McCaron said that there were two cases to be heard and he would like to hear Case No. 74-N-5, 15302 Arrow Highway, before any action was taken on 74-N-1. Proper postings and mailings had been accomplished. There were no written protests. Mr. Perry said since the last Council meeting, Mr. Salcido came in and said he will be taking out a permit to do the repair work on the structure. within sixty days and this abates the case as far as the department is concerned. City Attorney Flandrick asked Mr. Perry if he was amending his staff report to read rehabilitate and secure the building instead of demolition. Mr. Perry stated that completely boarded up con- stitutes rehabilitation so that there would be no further damage; however if he did not do that, then the structure should be demolished. As there was no testimony. Mayor King declared the public hearing closed. Councilman McCaron asked if he had to disqualify himself from speaking, since he owned property within 300 feet of this property. City Attorney Flandrick said this was an adminis- trative proceeding and unrelated and if there was no reason other than ownership, then he was free to act upon it. Councilman McCaron said he thought that these two should be dropped as well as the other two cases. If such a thing happens that they don't rehabili- tate the building satisfactorily or if what we are asking is excessive, then we could reconsider what is being done and bring it up for a nuisance at that time and make a firm demand. Councilman Gregory asked if it was going to be a nuisance without being boarded up. Mr. Perry stated when these conditions exist by being left open, children go inside and destroy the structure and if it is boarded up, no one can go inside and destroy it further. Councilman Gregory asked if this building is safe as it is as she was concerned about the safety of our young people. Mr. McCaron said it seems to be boarded up properly. COUNCILMAN MC CARON MOVED THAT THESE CASES BE DROPPED. Motion died for lack of a second. He felt Mr. Smith was in concurrence with respect to the other two buildings. As there were no objections. Mayor King reopened the public hearing. Councilman Hamilton asked Mr. Smith if he was in the process of rehabilitating his property. Mr. Smith said it was 90% rehabilitated; he had repainted the house, fixed the patio, taken down illegal wiring which was put up by the tenants, removed the trash dumped over the fence by the tenants, demolished the one building and the other building was to come down within the next week or two. Councilman Hamilton asked Mr. Smith approximately how long this would take and Mr. Smith said about 30 days. REOPEN PUBLIC HEARING ON 74-N-1 As there was no further testimony. He had contacted the City and had been told that Mr. Perry would contact him. Mr. Perry said this was an asphalt drive approach and he would call Mr. Devore and see if they could work out the problem. He asked that the Council act promptly and ask the service stations to post the price of gaso- line and the hours they are open. City Manager Mocatis said he had received a tetter from the County of Los Angeles recom- mending that cities meet with owners of ser- vice stations to work out hours of operation. He said they had arranged a meeting for March 11, 1974 and they would do a11 that they could to have a solution to the problem. On page 3, $247 to Councilman Gregory for mileage seemed to be a little high. Finance Director Duncan said this expense was over a period of four months and that other items were included such as meetings attended, etc.; due to limited space, they can not itemize everything. Mr. Carpenter asked if Councilman Gregory received payment from R.T.D. for mileage and she said that she does. 00- Mayor King extended congratulations to Mr. Del Aldrich on his marriage to take place May 18. 00- City Clerk Balkus presented a request for Temporary Use Permit from Goodyear Service Store for a Parking Lot Sale March 21, 1974 through March 30, 1974. He felt that Council should be given notice of the nuisance so that they can look at the property and a written report be given to them as to conditions existing beforehand so they will know what they are voting on. Councilman Hamilton asked for clarification of the motion. Councilman McCaron said if the owner cannot be contacted under any circumstances and it is a known fact that he is the owner, then the Council should be notified before abatement proceedings are started, so Council will know what the inten- tion is and they can make the determination at that time whether the department should proceed or stop. Councilman Gregory asked if this contact would be made to the property owner. Mr. McCaron said it should be directed to whoever is responsible for the condition of the property, whether it is the owner or someone financing it, someone who is capable of giving the answer as to what can be done to the property. Mayor King said that as there were no objections, the motion was so ordered. 00- Mr. Perry said he had received a request from the owner of the property on the southeast corner of Bogart Avenue and Ramona Boulevard for the City to vacate some excess property. Mr. Perry said it was probably picked up at a tax sale and was to provide easy access to La Rica by school children. Mr. McCaron said he would tike Mr. Perry to find out how and when this property was acquired and asked for a Title Search" of the property. The City Council concurred. 00- Mr. Perry, as requested by Council at the last meeting, gave a report regarding Curb and Gutter Improvement Districts. He said they are now preparing a contract to complete 15 blocks and an additional 24 blocks in accordance with Reso- lution 72-149. After this work is accomplished, their plans are to construct sidewalk districts in cooperation with the local school and then consider assessment district proceedings to initiate reconstruction of alleys which are in a state of disrepair. Councilman McCaron asked how much money this would take. Mr. Perry stated approximately $150,00 to $175,000 to complete the 15 plus 24 blocks and that they were including this in the budget they are pre- paring for the next fiscal year. 00- Mr. Perry said their Department had received a request from the property owner at the northwest corner of the intersection of Bresee Avenue and Baldwin Park Boulevard to vacate that portion of Bresee Avenue no longer in use. He said that the City has no plans for utilization of the excess property and recommended that Council adopted a resolution to initiate street vacation proceedings.
