It was the time and placed fixed for a public hearing on Z-374, application for a Zone Change from A-1 to M-1 on property located at 13245 Los Angeles Street, in the City of Baldwin Park. Vernon W. Monroe, appli- cant continued from 2/6/74 & 3/6/74). Proper publications, postings and mailings had been accomplished. There were no written protests. Mr. Mike Macke, a representative of Arciero & Sons, a Construction Company with the proposed development of the porperty, stated it was their intention to develop the property into an industrial park. He said because of the surrounding uses, it is ideally suited and situated for this type of development. He said they had made a study of the area and they felt because of the exposure to the balance of the San Gabriel Valley, there is a definite need for this and it would be a proper use for the property. He said in the past they had submitted a planned development for the entire parcel with some required variances and setbacks but requested at this time that those plans be withdrawn and they are making some additional studies and at some future date will present a precise plan and precise development plan for the property. He said in order for them to pro- ceed, they would need a change in the Zone to ensure the developer that the property can be developed in an M-1 fashion. He said they had reviewed the M-1 Ordinance of the City and felt certain that the proposed development would be compatible with the uses outlined in that zone. Councilman King asked if Mr. Macke had a plan or exhibit to present at this time and Mr. Macke said he didn't has there had been modifications and they would present a new set of plans later. Councilman Waldo asked that since the applicant has withdrawn, then does that make the Variance that the Planning Commission passed null and void and no longer exists. He commended the people on their patience and understanding. He said he hoped that the people could see that this had not been a political thing that it was held over, but truly the applicant's wishes. He thanked them for their cooperation. April 3, 1974 Page 4 Mr. Robert Sherman, 4509 Hornbrook Street, said he appreciated Mr. King's comments. He said he didn't represent the people, but he was speaking for them,that they were his neighbors. He said the City had a variance which they disagreed with, they had posted a $75 filing fee. He said now that the variance was null and void, he requested a refund of the $75. Mayor Hamilton said there were expenses for paper- work, etc. to the City because of this variance, and he didn't believe they could do this according to the Code. Mr. Sherman asked why they had requested a fee against something that did not exist. He said they had a variance request for a zone in a zone that didn't exist. City Attorney Flandrick said the Code does not provide for a refund of fees on Zone Variances, Condition Use Permits and Zone Change cases. The reason for this is that at the time the fees were set, it was determined that the cost involved in processing these matters warranted the payment of the fees. If the City were to refund the fee, it would be in violation of the Code. Mr. Sherman asked why a citizen or a group of citi- zens have to file a fee of monies just to be heard and they could let it go and still be heard. City Attorney Flandrick said if they had not filed an appeal, that Variance would have been filed, and they would not have been heard. City Manager Mocatis said when the $75 fee was set up several years ago, that was a tittle less than the actual cost to the City. He estimated that $102 had been spent on the publication, etc. for this hearing. Councilman McCaron said he thought they should change the ordinance and that the proper thing they should change in order not to have indescriminate appeals of any decisions made, they set a proper time under Oral Communications for citizens of Baldwin Park to appeal to the Council to put it up as an appeal and a hearing and let Council make the determination at that time whether to continue it or drop it. He felt that this would bring matters to the attention of Council where there are objections to the decisions made by the Planning Commission. It was set up not only for the cost, but to keep too many appeals being made and cost would be exorbitant to the City. continued) MR. He suggested that they start a pro- cedure to do away with this portion of the ordinance and consider refunding the money to the citizens. Councilman King said he thought Councilman McCaron has a good point and that in the beginning that was what they were attempting to do, to eliminate costs to the citizens. He said if they find something that aggravates them or may be a liability to their area, the Councilmen should be contacted as the Council has the right to bring these matters before Council. City Attorney Flandrick stated that there was a pro- vision in the Code now that allows Council to appeal to itself any variance or zone change. He said this suggestion could be accomplished within the existing ordinance. Councilman Waldo asked why the citizen was not told that he could appeal to the Council. Mayor Hamilton said in this case, the applicant asked for the variance because of land usage; therefore, the Planning Commission recommended the variance? then the neighboring people asked for an appeal according to the ordinance. Alt of the work went out, necessary postings, etc. for the hearing and the City was out the money. If it could be handled without the expense to the citizen, it would be great, but he didn't see how they could do so, and still follow the procedure. City Attorney Flandrick said when Council appeals to itself, the cost is paid by the City and not by the individual. Councilman McCaron said they stilt should refund the money, but to do it legally, they have to dispose of that portion of the ordinance. He said they should not have had this up in the first place, that was the reason they had the ordinance state that they could appeal to themselves any decision made by the Planning Commission. They still left the ten day period from the time of the Planning Commission meet- ing until the Council Meeting so they could appeal it. At times they do not have the Planning Commission min- utes to know what actions had been. He asked if it could be continued to the Council without more publi- cations and City Attorney Flandrick said it could be continued to the Planning Commission, but not to the Council. Mr. T. E. Carpenter, 4346 Jerry Avenue, said he thought MR. T. E. CARPENTER he was more knowledgeable than some of the other people, even the Council in this respect. He said they had a variance on an M-1 that did not exist. It was A-1 that had never become agricultural. They were given 10 days to furnish $75 to appeal something on a zone that did not exist. He said 10 days was not the correct time and thdt is an error as it is 15 days he had determined. He said that he felt their money should be qiven back. April 3, 1974 Page 6 Mr. Jerry Kitchen, 3308 N. Athot Street, said as Mr. Carpenter stated, there have been a good deal of errors involved,but we are also talking about $75 that went into making a successful appeal for the people. As Mr, Mocalis mentioned, there is $102 involved, $27 over the $75 paid, for administrative costs and paperwork. As per usual, we gef'hung up"on details and said they would be here until 11:00 p.m. because certain individuals in the audience like to beg" the issues. Mr. Robert Sherman, 4509 Hornbrook Street, said they could care less about the amount of money, and what they want is the rightful ness of the Council's decision and the planning set-up for new zones. He said they would go along with this as long as it did not hurt the people environmentally or any other way. He said the $75 was not the issue, that the people were asking an appeal on something that did not exist and why should they have put the money up when they could have been heard without putting a dime up. City Attorney Ftandrfck said it was common practice in this City as in other cities that where a zone change request is made and the particular use involved perhaps requires a conditional use permit or applicant seeks a zone variance, the matters are all set and heard contemporaneously rather than ask the individuals to come back three and four times to have these things considered. NO. 74-40 ADOPTED Mr. Charles Madott, President of the Optimist Club of Baldwin Park, said he wished to present appreciation certificates to some of the Council- men and expressed gratitude in behalf of the Optimist Club for their valuable time and effort as judges for the recent contest for the youth of Baldwin Park. Certificates were awarded to Mayor Hamilton and Councilmen Gregory and King. Councilman King it was a wonderful experience to participate in this function and see the anxiety and participation by the students and they did a wonderful job. Mayor Hamilton said it was difficult to make a decision on both the boys and the girls and felt they were alt winners and if this was an example of the youth of Baldwin Park, we don't have a thing to worry about. He said it was a pleasure to participate in this judging. Councilman Gregory said if the students had turned their speeches in, she would like to see a bound book of the speeches and a copy presented to the library for those interested and thought the youth were doing so many nice things through the Optimist organization. 00- Mrs. Helen Gibson, 13268 Francisquito Avenue, asked if there was going to be a motion to refund the $75 to the people. Carpenter, 4346 Jerry Avenue, said he had been through the records of Baldwin Park for several years; he especially noted the checks. He said the outgoing Mayor was stilt signing the checks as they have done in years past and Mrs. Cale had signed for the Finance Director and Mrs. Duncan as signed for Mrs. Gate. She said they have to purchase the slug" from Headman Company and it takes from three to four weeks for delivery, but it is on order. She said Mayor Hamilton had been advised of this and he con- curred that they should use the signature machine as it Is. She said the banks have not been notified of the change because of this reason. She said they had checks printed in a quantity of 10,000 to arrive at a reasonable figure for the City to secure them. She said the signatures are recognized and it is perfectly legal; everyone knows who the Mayor is and she didn't see the point of Mr. Carpenter's complaint. Mr. Carpenter said the City has approximately 100 checks to sign and there shouldn't be a question of who is Mayor or who is Finance Director on given dates. If it is a matter of reprinting checks, that is one thing, but if it is a matter of everyone signing, that is another thing, and is not that big a burden. He stated he felt the Council was amply paid and could sign the check twice a month. Council had requested more information on the bids submitted for the police department vehicles. The two main items were in regard to engine size and air conditioning of the three vehicles. Two of the vehicles were compact cars and one was a full-size sedan and air conditioning is specified for all three vehicles. He said one of the vehicles would be for the Chief of Police and the other two would be for detectives' use. He said a full report was in the packet. He said the previous recommendation was that the low bid from 5 Points Chrysler-Plymouth and Savage AMC in the amounts of $3,852.61 and $6,520.88 respectively be accepted and alt other bids be rejected. The Police Department had budgeted only $8,700.00 for these three vehicles and had an unbudgeted amount of $1,673.49. He said there was an anticipated savings in the Police Department of approximately $63,000.00 for the fiscal year and the recommendation was that the necessary funds of the net difference be transferred from the Police Account 531.10 to Capital Outlay Account 594.10 in the amount of $1,673.49. Krieger asking the City Council to review their existing policy of charging a 20% handling fee for refunding witness fee deposits. He explained that when a police officer of the City is called to appear as a witness, the State law requires that a fee deposit be made. In the case here, the officer did not have to appear in court as the case was settled and the person who made the witness fee deposit has requested a refund and we informed him-that there would be a $9.00 charge for handling of the transaction. Finance Director Duncan had also prepared a study of the procedure and after a precise analysis determined it cost the City approximately $10.00. Mr. Mocalis said he did not think this charge was unreasonable, and the staff recommendation was to maintain the exist- ing policy of charging 20%. He said in July, 1973 there was considerable discussion on Baldwin Park's participation in Area D, a Civil Defense organization composed of many cities in the San Gabriel Valley. Area D has a paid executive director and has a board consisting of Council people and an advisory board consisting of directors of civil defense. We have become actively Involved in Area D and our City is now one-third of the executive board and he believed it was appropriate for Council to authorize releas- ing of dues, to Area D for fiscal year 1973-74 $800 Account 3561). Perhaps it could be limited to those who are affected by the decision unless someone else making an appeal would have a substantial reason for appealing the decision made by the Planning Commission. Primarily, nearly all of the decisions affect those in the immediate vicinity of whatever parcel of property that is being dealt with. He said they might limit it to that. The County asked the City of Baldwin Park to select one senior citizen from our community to be honored as Older American". Mayor Hamilton said there were several names of senior citizens submitted and we were fortunate to have so many good senior citizens, those who worked diligently for their fellow citizens and that it was indeed a difficult choice to make. The final selection was a husband and wife team, Mr. & Mrs. Gabriel Robidart and he said it was a pleasure to submit their names for this appointment. Councilman Waldo commented that these people had been very active in this City for over 50 years and was glad we could take this opportunity to say thank you". AH Council aqreed it was a wonderful choice. 00- Councitman McCaron asked that the Council ask City Attorney Ftandrick to draw up an ordinance or a resolution to refund the $75 to the people who made the appeal on the Zone Variance 288. City Attorney Flandrick said he didn't know how this could be applied to just this case. The City Council may make a refund of the filing fee showing good cause where finding facts which warrant such a refund, but it couldn't bo confined to a single case. GABRIEL ROBIDART REFUND OF FILING FEE FOR ZONE VARIANCE Councilman McCaron said he would like to have Council instruct the Planning Director to study the ordinance and arrive at a recommenda- tion along the lines of not-" requiring an appeal fee on decisions that are final by the Planning Commission. If the citizen wishes to appeal it, he can voice his objections to the Council. It is difficult to determine as it would almost mean accepting everyone that is brought to the Council for appeal, otherwise they would be making immediate decisions and without a hearing. City Attorney Ftandrick said they should refer this to Mr. Gordon to make a study.
