There were no written protests. Ms. Chartene Jordan, a property owner on Monterey Street said she had no objection to curb and gutter price, but there is a lot of land without curb and gutters and others had to supply the money for curb and gutters. She was told that the work would be completed by October and it was not finished until February. She said the curbs and gutters were put in on her side of the street and have not touched the opposite side of the street. She said on Center Street where she lived, there is one lot still without curb and gutters. She asked why some had to pay to put in curb and gutters when others did not. Director of Public Works Perry said if Ms. Jordan would give him the address on Center, he would check it out. Mr. Perry said beginning in July of this year, they plan to finish all of the curbs and gutters in town and estimated that about 95% of the work had been completed where there is dedications. Mr. Jay Angeto, 3123 Baldwin Park Boulevard, said he had sold the property next to the church and it would dose escrow in about two or three weeks. He asked if there was a bill against that property for curb and gutters; he did not have the address of the property. He wanted to know if there was a bill so it could be paid before there was any penalty. Mr. Perry asked him to call and give him the correct address and he would be able to tell him if there was any amount outstanding. As there was no further testimony in behalf or opposition to 73-S-70, 78 and 79, Mayor Hamilton declared the public hearing closed. M/S/C: WALDO/KING. 00- City Manager Mocatis asked to hold the selection of proposal for data safe due to improper proce- dure and they would have to go out for bids on this item. 00- City Manager Mocalis said the Council had previously approved purchase of additional equipment to be used on traffic grant applications. This equipment is paid by grant funds. Before the approval was signed, IBM had increased the price by $108.03. He recommended approval of the price increase. PRICE INCREASE OF $108.03 FOR IBM EQUIPMENT APPROVED. M/S/C: MC CARON/WALDO. Councilman Waldo said he wanted to ask a question before they voted on this item. He asked how much longer the City would be receiving money on these grants. City Manager Mocatis said the largest grant was a three year grant if the City receives the next year's funding which they anticipate receiving. It will.end the fiscal year 1974-75. Councilman Waldo asked if our system would be complete and not have to purchase any other equipment. Mr. Mocalis said the City had some equipment before receiving any grant monies and it was possible through the grants for the City to upgrade the hardware and to employ people to write the necessary software programs. He said at the end of the three year period, the City would have sole ownership of the equipment which was almost entirely paid for by grant funds. Mr. Waldo said would this be a complete system without having to replace or spend a good deal of money as he remembered being told that once it was set up, the City could make money by selling information and services to other ci fc i es Mr. Mocdtis said the basis of the EVIS grant was for our City to provide a central data sys- tem for 22 jurisdictions. At the end of the three year period if the other cities decide they want to help pay to continue the system, then we would continue to provide the system and if they don't, we are left with the equip- ment which is entirety paid off and we will be in a much more superior position than we were in 1971. Mr. Mocatis said the only uncertainty at the present time is that we have not yet received final approval for the third year, but it appears we will receive the funding. He said on the new budget, there would be an entire separate sec- tion on grants with a three year projection so Council wi11 know what alternatives will be available to the City in case the other cities do not wish to participate in the program. Councilman King asked about additional funds or tickets that would help pay for this system or is it another system. City Manager Mocalis said that was the Automated Want and Warrant System which would mean the City would go on a computer system with Los Angeles City providing area-wide capability when a vio- later is stopped, the system would determine if that person has an outstanding warrant in other jurisdiction. That means other jurisdictions could also determine if someone has an outstand- ing warrant in Baldwin Park and we could then process the warrant and receive the funds back from court. Councilman McCaron said the Council had determined at the beginning that if funds were dropped, the City could back off without any adverse problems. If it goes the third year, we gain a complete system and if the operation of the system is too great by not having other cities participate, the City can use what portion it needs for its sole use and have a first-class system. He said there were certain items that are not purchased, but are rented or teased and those items are the ones to be improved and to buy them would cost more than to lease them and stilt keep up with the improvements. Mayor Hamilton said if the other cities did not participate and City had to go back on just its own usage we would be back to owning the system. Mr. Mocatis said a study would be made for the benefit of the Council and wilt indicate the effect on the City if they have a continuing system involving other jurisdictions compared to the system we will need, the number of people and amount of software involved if we have only our own. This study will be provided during the coming budget period. He said the low bid from Steiny and Company was $83,794.00 and recommended accepting the low bid. M/S/C: KING/WALDO. 00- City Manager Mocatis said there were four bids received on Gas Tax Project 142 for construc- tion of a storm drain and street overlay on Pacific Avenue. He said the low bid from Vernon Paving Company was $151,202.00 and recommended accepting the low bid. Councilman Waldo asked if there was a time limit on this project and Mr. Perry said there was a time limit on all the projects. The only way a contractor would receive an extension of time would be rain or totally unexpected problems and possibly engineer- ing problems. Mr. Perry said they always try to finish them as quickly as possible. He also said it was to the contractor's advantage to get the job done. Councilman McCaron asked where the drain would be and Mr. Perry said it was a good size drain and ties in with the flood con- trol drain at Vineland. Eventually it is designed to continue on Bogart and up R'amona to Auction City and will be near the center of the street. 00- City Manager Mocatis said the Gas Tax Project 140, reconstruction and widening of Ramona Boulevard from Badillo to the Easterly City Limits had gone out for bid. The Director of Public Works asked that this be held over because the low bid was over the engineer's estimate and wanted the opportunity to get together with the engineers and contractor and he wilt come back at the next council meeting with a recommendation. Our City's share of Federal Aid to Urban Systems money on per capita basis would be approximately $233,000.00. He said there had been some discussion regarding the proce- dure to use in establishing priorities for the Cities of Los Angeles County. The League of Cali- fornia Cities proposed that there be a joint com- mittee composed of nine representatives; three from Los Angeles County, three from the City of Los Angeles, one from the City of Long Beach and two from other cities in Los Angeles County. Councilman King said he had nothing against this, except that it was too bad that the three cities involved that the League would have allowed enough time for voting on whom they would wish to establish procedures, but time was the criteria. Mr. Mocalis said they would have to have the pro- posals in ready for bid by April 30, and Mr. Perry agreed they may be able to have projects available that would approximate the amount of money available to our City. Mr. Mocalis read by title: RESOLUTION NO. 74-45 ESTABLISHING AN ACCEPTABLE PROCEDURE FOR ALLOCATION OF 1973 HIGHWAY ACT FUNDS. Councilman McCaron asked if the League had indicated what procedure they favor, and City Manager Mocalis said this is one of the things the resolution would set up. He said there was a proposal from Los Angeles County if we would go along with it, those cities would be assured of half of their amount; the priority of allocation would be left to the Board of Supervisors. The League felt that this did not give proper representation to the cities and also wanted more time to develop the pro- cedures. This proposal sets the Board to work on the procedures and they will be developing the procedures for our use and will report back when the procedures are ready. Councilman McCaron said he hated to approve an action when they don't know what they are intending to do; population-wise, Los Angeles should not be entitled to three representatives. Mayor Hamilton said he and Councilman King were at the meeting and that was their feeling at that time that they weren't getting a fair shake", but due the shortage of time Mr. McCaron said it seems that time is always the factor to make a decision. The League leans toward the basis of 50-50 and not on the basis of population. Continued) RES. It further requires that Los Angeles County has the principle responsibil- ity. Councilman Waldo said we either support it or we forget it and he thought we should support it. Councilman McCaron said this is contrary to the basic principle that we are putting forth now in soliciting the aid of other cities to sue for the distribution of sales tax and he didn't feel they should agree to something directly in opposition. Mr. Mocalis said the Council does have the option of not passing the resolution and if they wish, can take no action. Councilman King said he would move for approval because it is establishing procedures to be approved by the respective cities and the County. The procedures wilt be approved later. Ayes King, Waldo, Hamilton Noes McCaron Absent Gregory 00- City Manager Mocalis presented a report from the Chief of Police indicating that Assembly Bill 1306 was signed into law on October 3, 1973. The Criminal Justice Board had levied a 0.2% fee to support the Board's activities. Based on our receipt of $380,673.00 in grants, the assessment is $761.35. He said this amount was not budgeted as the law was not in effect at the time the budget was prepared, but there are sufficient funds available to cover the assessment. He recommended that authorization be granted to pay the assessment out of the police contractual account 552.59. Councilman King asked if this was a one-time assessment and Mr. Mocalis said any time a city receives a grant in the future which goes before the Los Angeles Regional Criminal Justice Planning Board, they will add a 0.2% charge as it is a State law. M/S/C: KING/MCCARON. 00- City Manager Mocalis said on October 17, 1973, the City Council had authorized the reconstruc- tion of Morgan Alley from Maine Street East, provided that Gas Tax Funds could be used for the project. He said the Director of Public Works had received confirmation from the State Department of Transportation that Gas Tax Funds could be used if Council passed a resolu- tion declaring that public convenience and necessity demand the reconstruction of Morgan Alley. M/S/C: MC CARON/KING. 00- City Manager Mocalis reviewed the report on police vehicles which indicated maintenance cost down time) to repair Matadors averaged one week and the Furys only one day. He recom- mended that they replace the four 4) Furys as budgeted in the 1973-74 budget, and order an additional six 6) vehicles which will be delivered and paid for during the 1974-75 fiscal year and two 2) of these six 6) vehicles be purchased from the Checker Corp. Councilman Waldo asked if any of the Checker vehicles had been used by a police department; do they have enough power, etc. Mr. Mocalis said they will have a Checker vehicle at City Hall next week and if any members of Council would like to drive it, they may and that he had driven one before and it gave excellent performance. Councilman King said he had taken a ride in a taxi which was a Checker vehicle and it was something to remember. He said the taxi driver said it wouldn't wear out so they could replace it. City Manager Mocalis said what they have normally done is order the vehicles towards the end of the fiscal year. He said they usually have an average of 80,000 miles on the vehicle. Councilman King asked what the trade-in value on the Checkers and City Manager Mocalis said this was difficult to say as it would depend on the economic conditions and that is why it would be best to just order two 2) vehicles so they can see how they work out. Mayor Hamilton asked what the difference was in price between the Fury and the Checker and Mr. Mocalis said about $150 more for the Checker. Mr. Mocalis stated that there is a deadline on adopting this resolution and our own Recreation and Parks Commission not only recommends that this be adopted, but they will endorse the Act when it is time for the voters to be aware of the requirements of the Act. Mr. Lucas had felt that the committee had done the best job for the City of Baldwin Park that was possible. Councilman McCaron asked if they adopted the resolution, would they be supporting the Bond issue and Mr. Mocalis said it would only be the method of distribution. Mayor Hamilton said he had discussed this with Mr. Lucas and it was his understanding if the resolution wasn't adopted, the City might not receive anything. The reason for this request was that the Edison Company and the doctor's office said their addresses were on Pacific Avenue prior to its realignment several years ago. He said they had several solutions; 1) eliminate Loray Place and rename it Pacific Avenue between Maine Avenue and Sterling Way» 2) rename Loray Place to Sterling Way or 3) leave Loray Place and Robin Way as is and ask the businesses along there to utilize the Loray Place address. He said of the three, the first solution would be the most logical. Councilman Waldo said he had talked to the doctor and the doctor had mentioned that they have certain licenses to dispense narcotics which made it difficult to change their address with a lot of time and money involved and was really concerned about the street name because of this. Councilman McCaron said Pacific ran out to Ramona before and alt at once it disappeared. He said he thought it should be restored because it was a major street and it is easier to find Pacific than to try to find Loray Place or Robin Way. The Planning Commission recommended to the Council that there is not a significant change to warrant a modifi- cation or to go to another Conditional Use Permit. Permitted use with dairies to sell beer and wine is a part of the Conditional Use Permit for the dairies in the zones applicable to the dairy. Mayor Hamilton asked if other drive-in dairies were selling beer and wine in Baldwin Park and Mr. Perry said they were. Councilman McCaron asked if this would cover any use that is allowable in a zone to be used pro- viding a Conditional Use Permit is not necessary. City Attorney Flandrick said what the Planning Commission is recommending and if Council does approve it would merely be that the sale of beer and wine would be an accessory use to the princi- pal use of a drive-in dairy operation and would not require a modification. Councilman McCaron said.if a person is required to have a Conditional Use Permit for a certain usage and then wants to add an additional usage which does not require a Conditional Use Permit, he should be allowed to use it without having to come in and ask for an alteration to his permit. He said if you have a lot and a usage is per- mitted on the lot by a Conditional Use Permit where at the hearing they have determined the location of drive- ways, traffic flow, etc. and if the property owner then comes in and wants to put another use on that same lot that will intensify the traffic flow, there could be some problems. Councilman Waldo asked how disapproval of this item would affect the drive-in dairies which are now selling beer and wine and Mr. Flandrick said it would have no effect on existing dairies who have that use now, but it would prohibit it in the future unless the applicant came in and modified after a public hearing. Councilman Waldo said several weeks ago a case came before the Planning Commission where certain gas stations in town wanted to sell dairy products and beer and wine and he understood that it was turned down. He said he didn't understand why one could do it and others could not. Director of Public Works Perry said that a dairy is more in line with a food operation and a sale of beer and wine went along that line where a gas station is not a food operation, but the sale of gasoline. Mr. Robert Maness, 2517 South Popular Avenue, Santa Ana, California, Developer of the property, stated that the plans submitted to the Planning Department were specific. His other dairies sell beer and wine and Roger Jessup Dairy has the same operation. Beer and wine was not an after- thought; they have a pending hearing before the ABC. Mr. Jay Angelo, 3123 Baldwin-Park Boulevard, stated he felt this was harassment. The gentleman purchased the property one year ago and is doing a good business. The original application filed with the City abided by the rules and regulations. He went before the School Board on the beer and wine application. All of a sudden, a gas station wants to sell beer and wine and then he gets a letter saying he needs a Conditional Use Permit for sett- ing beer and wine. He has been operating the business for six months and if he can't dp business, he wilt have to leave. He asked that the man be given consideration. Mr, Joe Cafe, 3043 North Maine Avenue, said if we want to buy more in 74 in Baldwin Park", and they want to go this way in Baldwin Park, he agreed with what Jay Angelo said and he felt that they should spend some time and think about this and that they should go along with this man, that beer and wine should go along with food. Mr. T. E. Carpenter, 4346 Jerry Avenue, said he had been through the files on this and didn't see any consistency on denying one and opening up a blanket area for a11 dairies. The Conditional Use Permit that he read in the file called out dairy and self-service gasoline and he didn't see anything more in there. He said he knew that they had a good stock of food of all descriptions. It is a neat place, two pumps with four kinds of gasoline. The Conditional Use Permit did not call for food, but it is there. Now they have soft drinks, potato chips, etc. The only difference between them is that the application did not call for food. 149 people did not want a blanket authority to filling stations or to that particular area on Ramona to sell beer and wine. This ambiguity clarification in effect knocks out any of the citizen's rights to know when alcoholic beverages are going to be sold anywhere near their property. They would automatically not even have to come in other than to obtain their proper license from the ABC. There is very little difference between the titling station and the dairy except for the number of gas pumps. If we give them a Conditional Use Permit, they would be selling almost the same items. It is not fair to the people in the City to not have a protest when they sell beer and wine as they have done here; 149 people did not want it. To open it up so that any- one can sell it, calling themselves a dairy and self- service gasoline would automatically give the people a valid protest, without any notification to the citizens in that vicinity. He thought they should stop this until such time as the other people who have a right of appeal can have their say and the citizens have their say, as there are many people who feel as he does. Mr. Robert Maness, 2517 South Popular Avenue, said the MR. ROBERT MANESS 149 people Mr. Carpenter referred to do have a right to protest. In order to get a license, they have to apply to the ABC Board and then post an affidavit, a large sign for 30 days and anyone who wishes can go down and protest before the Board. He said he had 150 signatures of his customers who did wish them to sell beer and wine at their establishment. Councilman Waldo asked Mr. Maness if they had applied for this when they opened the store and why was it not granted. He said they had protests, but they can't do anything until this action is straightened out. Mr. Maness stated it has been almost a year since he put the plans before the Planning Department and had re- ceived no notification of this until April 9. He said if he had known he would have these problems, he would not have gone ahead with the project. He said he had gone before the school board and they withdrew their protest; and he went to the Police Department and worked out a program with them and is witting to work out a reasonable solution. Councilman King asked Chief of Police Adams if there was opposition from the citizens, could they have the sale revoked and Chief Adams said, yes as there is an auto- matic investigation at the time they apply for a license they do appear before the Appeals Board and if there is grounds for a protest, they do so. Councilman King said in view of what has transpired over the years, it appeared to him that they would be discrim- inating if they didn't approve, then they would have to go to a blanket Conditional Use Permit. Director of Public Works Perry said if Council approved this, then beer and wine sales with a dairy operation wilt be a part of the permitted use for that type of operation. Councilman Waldo asked if this is approved, would they be discriminating against gas stations that want to sell dairy products and beer and wine, and Mr. Perry said this action applies only to dairies. City Attorney Flandrick said to sum it up, if the Council approves the request, they would in effect be saying that the sale of beer and wine is a valid accessory use to the principle use of the drive-in dairy operation. Mr. Jerry Kitchen, 3308 N. Athol Street, said he didn't think the problems were the ambiguities, but the constant conflict of opposition. He said this was a reputable business and they shouldn't dis- courage it, but rather reach out and try to get new business into Baldwin Park as this is what our City needs. The opposition is not needed. He said he thought they should start to set precedents now by encouraging, not discouraging business so that when they come to Baldwin Park their only recourse is to leave. Mr. T. E. Carpenter, 4346 Jerry Avenue, said the question is, is a gas station selling dairy products the same as a dairy selling gasoline, and it is. There is no difference except that one has more pumps than the other. These other people want to do the same thing; they have about the same size building and that was turned down because the people wanted it turned down. Mr. Fertig wrote the company a letter on April 8 that they had to have a public hearing. The meeting was on April 9. There was no notice and it was not on the agenda. If it is never posted, no one will know about it. It will be posted by the ABC, but how many people will see it. There seemed to be a tendency toward too many rules and regulations to govern operations. He said the rules should be set up such as to either allow a sale of an item or you do not allow it. In respect to sale of beer and wine, it is controlled by a State agency and preempts any authority the City might have. He said some operations are not good in a certain zone and a Conditional Use Permit is required because of a disturbance in a particular neighborhood. Then there are certain items that can be sold anywhere as long as they are within the zoning that is required for them. Yet we are trying to determine what the major business is and what is the subsidiary sales. If a person wants to sell two items equally, there should be a determination if they are allowed to be sold in the area. Economics always governs whether a person will stay in business and what he will sell. In regard to additional traffic generated by the sale of certain items, this is the purpose of a business, to be success- ful. We want businesses that will succeed. He said they should reassess some of the things that are in the Code; so that anyone coming into Baldwin Park will know exactly what is required when they want to open a business. Mayor Hamilton said what they should do then is to spell it out more clearly in the Code. He said like the case they had regarding pennants. He said it was a question whether it was illegal or not, that his own observation was that he could see no wrong with pennants. He said he thought at certain times like grand openings, pennants were all eight as other towns such as West Covina uses them. They should definitely check these items in the Code. City Attorney Ftandrick said at the last budget session, Council authorized the re-evaluation and reaccomplishment under zoning ordinances and that is under way now and will be studied by the staff and the Council. They have a 12 year old zoning ordinance which has been amended many times and a lot of things have occurred which were not covered in the ordinance, and this will be changed in the near future. Councilman King said he didn't object to the selling of the beer and wine at the dairies as it could be regulated as the School Board could have objected, the Police Chief could have objected, etc. He said he did object to the drive-in dairy selling gasoline. M/S/C: MC CARON/WALDO. 00- Director of Public Works Perry presented the Traffic Committee Report consisting of the fol- lowing items: 1) Fountain Blue Trailer Park at 1765 Puente Avenue requested that the curb be painted red in front of their trailer park to facilitate better visibility for their residents in exiting the trailer park, which the Traffic Committee concurred, 2) Mr. Philip Smith, 3775 Athot Street requested a four-way stop at Eart Avenue and Athot Street as he was concerned regarding the speeding and danger of collisions at the intersection of Eart Avenue and Athol Street and 3) a petition from 18 families in the vicinity of Fithurst Avenue and Vatte Vista Avenue requesting stop signs at Fithurst Avenue and Vatle Vista Avenue. The Traffic Committee concurred and also recommended that stop signs be placed at Vaile Vista Avenue at Harlan Avenue and Valle Sista Avenue at Center Street. Mr. Perry read by title: RESOLUTION NO. 74-49. M/S/C: WALDO/MC CARON. 00- Director of Public Works Perry said he had received a tetter from Mr. Lonm'e Morn son of 4674 North Edra Avenue requesting a waiver of the sidewalk requirement as a condition of a building permit issuance. He recommended that instead of a waiver of the requirement, that they require the property owner to sign a cov- enant and agreement to install sidewalks at such time as sidewalk is constructed on the rest of the block. Councilman Waldo asked if Mr. Morrison had been notified in writing of this alternative and Mr. Perry said a letter had been sent to him. Mr. Lonm'e Morrison, 4674 North Edra Avenue, said he had been notified and that this decision had made him happy.
