Mr. Fertiq said a Conditional Use Permit had been granted to Douglas Oil Company three years ago. Mr. Fertig said they presently operate a self- service gas station and sell assorted items such as soft drinks, chips, etc. They now wish to sell beer, wine and dairy products. The Planning Com- mission denied the Conditional Use Permit as they felt this would have an adverse effect on the adjacent property and that the area was over-sat- urated with beer and wine vendors. He presented photographs and Douglas Oil brochures to Council for their review. Mayor Hamilton asked for testimony in favor of CP-200. Ms. Barbara Prochnow, Marketing Services Analyst for Douglas Oil Company, 3160 Airway Avenue, Costa Mesa, California said the station has been operat- ing since 1971. They offer no service, mechanical work, lubes, tires or batteries. They offer the sate of gasoline and miscellaneous goods. The Douglas Beer and wine Program began over a year ago at the Redondo Beach store. They have 69 licensed stores throughout California, a11 under the regulations of the Alcoholic Beverage Control. They install a three-door refrigeration unit inside the sales office behind the cashier. When the customer pays for the gasoline, he may then with proper identification purchase beer and wine. They do not allow consumption of the beer and wine on the premises and can't sell beer and wine to minors, intoxicated persons or to customers while in their motor vehicles. They cannot se11 single cans but must se11 in six packs only. Regulations are posted and agreed to by the employees and t"iey have had no violation in 15 months' operation and no complaints. Ms. Prochnow said the Treasure Chest stated dairy setting gasoline may se11 beer and wine; however, gasoline station setting food items may not". That was the ruling from the City Council on a 3 to 1 vote fast week. She gave a direct quotation of Council- man Watdo, There is no difference between a station setting beer and wine and dairy that sells gasoline, setting beer and wine." She agreed with this. Many convenience food stores and drive-in dairies are setting gasoline throughout the country; even large stores such as Sears, Gemco, Fedco and White Front. Their store on Ramona sells gasoline almost entirety to local residents with prices weft below the majors. This is not a free-way off-ramp store and the con- sistently tow prices have created a financial crisis for the company. They are a small, independent oil company and have no other source of crude oil other than on the open market. They were paying 35 to 37<t per cjatton for crude oil and are now paying 45 to 47c" per gallon. They just raised their prices to 5t.2<t for regular, 6t higher than last year. To refine the crude oil, transport the gasoline to the store, sates tax, overhead and operating expenses, labor cost and make a profit, 6i won't stretch that far. Continued) MS. She said it had been said that drive-in dairies only sell gasoline as a sideline. If this is true, Douglas Oil Company is only selling gasoline as a s'ideline, but they don't have the other products to fall back on. Even though the dairy sells their gasoline for the same price as Douglas Oil, they have no labor cost or expenses which must come out of the gasoline profit as it already comes out of the dairy expense as the personnel is already there. She said they were attempting this store conversion in order to keep the store open and keep local people employed. The City derives revenue from this store. They are willing to spend $3,000 to keep this store open; $2,000 is for the refrigeration unit and changes inside the store. A little over $1,000 is to improve the outside appear- ance by repainting, etc. She said she knew there was opposition to their request, one was a petition with over 100 signatures stating they felt that there were enough liquor stores and markets in the area now. She presented a petition circulated April 30 and May 1, signed by 67 customers designating support for the off-sale of beer and wine products. She did not believe their sates would appreciatively increase the amount of beer and wine sold or consumed. They sell an average of 10 packs a day. The sale of beer and wine is important to their over-all operation and she asked Council approval of their request. Mayor Hamilton asked for testimony in opposition to CP-200. Mr. Ralph Middleton, 13122 Corak Street, said Ms. Prochnow brought out some of the points he was going to bring out. He had presented the petition as that is the only way the people can express their thoughts of opposition. He sug- qested that application Item #2 is untrue, better than 95% of traffic flows into the alley and not to Ramona. He said regarding the saturation, on the corner of Francisquito they have a market that sells beer and wine. East of that they have a bar and a filling station. On the corner of Ramona and Corak they have another grocery store, beer and wine, and a few doors down they have another bar and on the corner from there another beer joint. He said about 75% of the people signing the petition do purchase gas at that station and have a reason for protest. They are afraid this would become another skid-row". They have beer cans, broken bottles, debrisj that he has to dean up the alley every Saturday. Fven his fence is worn from the banging. The citizens who live there do protest this. Continued) MR. Clare Middleton, 13122 East Corak Street, said she had two tetters in opposition which she read from Harry Fisher, owner of Elwin Market and Mr. and Mrs. Cecil Campbell, 13127 East Corak Stree, Baldwin Park, California copies in official files). She said when the ABC representative talked to her, he stated that if Douglas was given their license through them, it would not mean they would definitely receive a license as it could stilt be denied by the City Council. Each protestor, if protesting at the time of application to the ABC, would have had to make out a special form and sign an affidavit so they decided to wait and protest to the City Council. They said they had ample space to handle traffic, but traffic exits on the back alley where they park and drink their purchases, pass out the bottles and cans and after mixing gasoline with alcohol, drive off to endanger the lives of the pedestrians. She presented a picture of the area). She said they have said the area wilt be guarded and at the time of purchase, this is so, but they would have to post a guard to watch on-the-premise drink- ing. She said the litter wi11 not be pleasing to the eye unless it doesn't matter if the cans and bottles are thrown on private property. She asked Council to deny this application. Mrs. Wharmby, 13128 East Corak Street, said they have enough liquor sates there and they have to pick up bottles and cans each morning and she doesn't want any more. Ms. Prochnow said they have a full-glass window so they can see the front and adjacent sides to te11 whether people are sitting in the parking lot, drinking in their cars. She said if Council has doubts as to whether there wi11 be problems with their store, to grant them an approved Con- ditional Use Permit for a period of one year, at which time it would be reviewed in regard to the impact to the City as to their handling of the operation. She was confident that they could control this program. Mrs. Hattie Slater, 4814 North Stancroft Street, spoke in opposition. She said if this Conditional Use Permit is granted, it will be setting a pre- cedent and we can expect every service station to ask for the same Conditional Use Permit in order to se11 beer and wine and asked if this is what our City wanted. They were the only oil company in Southern California with this type of program. Most oil companies are on dealer programs with full service stations. Self-service stores take a tremendous amount of investment and it is not easy to obtain an off- sale beer and wine license. Every applicant for this type of program would have to meet the same criteria as proposed by the Planning Com- mission and they would have full control on a Conditional Use Permit, As there was no further testimony. Mayor Hamilton declared the public hearing closed. Councilman King said he thought that the area was saturated; within a 364 ft. radius, there are three stores and one bar selling beer and wine. He felt that there are too many already. We need a check and balance. Councilman Waldo said a gas station selling beer and wine did not turn him on" and on the other hand, a dairy bar selling beer and wine and gasoline didn't turn him on" either. He said despite how much he disliked the idea, he didn't know how Council can pass on one type of operation and deny it to another type of operation and he didn't feel this was fair. Councilman McCaron said there had been a lot of comments regarding litter" in the area and there should be some way of controlling it. He said he didn't think there was anything in the code that said a service station can't sell beer and wine other than they have to have a Conditional Use Permit to govern the operation of the service station. This was established to prevent the old stations being abandoned and the nuisance law now takes care of that problem. He said the new code would relieve a lot of types of business operating under a Conditional Use Permit. It isn't a pretty sight to see closed service sta- tions and if the people feel the want additional revenue in order to cover their expenses, he didn't think Council should legislate against it. The idea of one business selling more than one item is not new but began with the general merchandise store. He said he felt that econo- mics would take care of this. However, the pro- blem of thowing cans, etc. should be taken under some other action and won't be any worse with another outlet for selling these items. As far as the parking in the alley, there should be no parking" signs to take care of it. Councilman Gregory said when Council is consider- ing a zoning redassification, they are not asked to consider the applicant's financial stability or whether they will make it or not. She did not condone the sale of beer and wine and did not believe they need this type of sale to make it". MS. He asked if they were presently selling milk. Ms Prochnow said no". He said he didn't blame them for wanting to make more money, but he couldn't see opening the service stations throughout the City to sell beer and wine. If this was approved, every service station would want to sell beer and wine and it is over-sat- urated with the sate of alcoholic beverages now. NO. 74-53 ADOPTED 00- It was the time and place fixed for a public hearing on A-3, Consideration of an appeal of an Order of Abatement for a non-conforming use an outdoor advertising structure) located at 12793 Garvey Avenue, in the City of Baldwin Park. Applicant: Kunz & Company formerly L. A. Outdoor Advertising). Assistant Planner Fertig explained that Council could either uphold the Planning Commissions decision to deny the appeal or they could extend the abatement period to a reasonable period of time. He presented two exhibits to Council showing the existing sign and what it presently looks like. Mr. William H. Kunz, 332 West Meda Avenue, Gtendora, said he was the principal in the business of Kunz and Company, formerly L. A. Outdoor Advertising. He said the subject sign for which they were appeal- ing the abatement order was erected in April, 1970. At that time it conformed to the ordinance which allowed outdoor advertising in a commercial zone. They had complied with the State outdoor require- ments for advertising at that time and also with the Federal outdoor advertising act and highway beautification act. When the permits were granted, they proceeded under the permit to make the struc- ture one that they could be proud of and the adver- tisers would be happy to advertise on and that the City would not have any problems with. This sign was constructed with a single pole minimizing the portion of the structure adjacent to the ground. He said there were two major categories in outdoor advertising; large firms dealing with national accounts handling alcoholic beverages, tobacco, airlines, automotive sales, etc. He said his firm dealt with the local business people. The initial cost of $12,000 covered the erection of the sign and an additional $4,000 for lighting. In addition, there is an annual maintenance cost of $2,800 and they pay a land rent, utility cost and taxes. He said they were basically appealing because they felt the sign fills the need that it originally did, that the sign is a form of communication to drivers on Interstate 10. He asked Council to consider the basic reasoning behind the use of this sign in its location. He said he had not been aware of the passing of the ordinance some three months following the erection of the sign. He asked Council to con- sider an extension of time or some reasonable adjustment to the abatement. Councilman Waldo stated Mr. Kunz applied for a permit in February, 1970 and the ordinance was adopted in November, 1970 and he asked Mr. Kunz if anyone had said anything to him about the possibility of this ordinance at the time he applied for his permit and Mr. Kunz said the only statement he remembered was that they would go to work soon and make it so that no more signs could be constructed. The only questions were regarding the type of structure and did it comply and would it interfere with other uses on the property. Councilman King said the ordinance was enacted in December, 1970 and Mr. Kunz1 permit was not finalized until tate 1971 which should have made them aware of the ordinance. He said he was not opposed to the continuance of the sign, but he thought someone should have told him about the ordinance being passed. Mr. Kunz said the erection of the sign was com- pleted in April and the first advertising was in May, 1970. The final inspection was postponed because of the electrical service to the sign. There was a question about the underground utility and the advice he received was not to trench for the electrical service until it was determined if they would have an overhead or underground hook-up. The decision was made to use the over- head hook-up providing that when the property was cleared and buildings removed, they would then underground the electrical service and they agreed to this. Councilman Gregory asked if Mr. Kunz was aware of the outdoor advertising district M-2 and he said he was now. Councilman Gregory asked Mr. Kunz if he was denied an extension of time, would he be wilting to apply to have the sign replaced in the district. He said he didn't know any place in that zoning where this sign would fit and the actual process of removal is ending up with scrap steel and it couldn't be reused as a unit in Baldwin Park. Mayor Hamilton asked what the amortization period was for the value of this sign and Mr. Kunz said they had almost 300 locations in the Western States and their cost of maintenance of the signs was against the value of the signs. Any particular location is a place of business and one of many and can't say they are through doing but ness in one and move on to the other. He said he couldn't say that it would be amortized in a certain number of years, but approximately a depreciation of ten years. Councilman King said that all laws were flexible and that this was a business and he felt that they shouldn't deprive a person of his business if at all possible. He thought the removal of the sign should be when the area is upgraded or when the area is rebuilt as the sign does not distract from the area at this time. Mr, T. E. Carpenter, 4346 Jerry Avenue, said he had attended the Planning Commission meeting and he felt that this sign was an asset to the people on the highway. He said he felt these signs did serve the public and fill a need. He did object to using these signs for political use. Mr. Michael Dargus, 13260 East Francisquito Avenue, said the Planning Commission with the help of the Chamber of Commerce and the Outdoor Advertising Companies spent the years of 1968, 69 and part of 1970 preparing an ordinance regarding outdoor advertising signs and the City Council approved it. He said he felt Mr. Kunz knew when he built this sign +"hat this ordinance was being prepared. He said Mr. Kunz had to sign a waiver with the State Highway that when they put a tree in, the sign would have to come down. He was under the impression that there should not be a sign within 500 feet of an interstate highway. Mr. Greg Kunz, 933 Engtewild Drive, Glendora, with the Kunz Company said the sign was not in violation of any Federal or State law and he could submit evidence of this if they desired. Continued) MR. He said the set-back from interstate highways is 660 feet and applies in an area where there is no commercial zoning within 1,000 feet. There is a three year period after the landscaping has been accepted and there is no compensation. They are familiar with the laws and do comply with them. As there was no further testimony. Mayor Hamilton declared the public hearing closed. Councilman McCaron said the area at the time the sign was installed along the 605 Freeway was not the landscaped area declared as such by the State Highway Commission. At the time there was a law that signs could not be within 500 feet of each other along the freeway. At the time the permit was issued, the ordinance had not been passed. The ordinance was adopted to close the balance of the area from any further signs being installed. He felt that they should be allowed to leave the sign unfit such time that the State declared it a landscape area. He said if some development should come in or the sign affected public safety, then that is a different matter. Councilman King said according to the City Attorney, the Council has to set an abatement period. We should leave the sign if it does not interfere. If the applicant is given an extension of time, And it-there is a development in that given time, then they are in trouble. He wondered then how they would abate if there was such a development. Councilman McCaron said in that case, have the appli- cant sign an agreement that in case it becomes a detriment to any development or if the State demands the sign removal, he would remove it. City Attorney Kress said perhaps something like that would be possible, but according to the ordinance, the time is three years. The ordinance can be changed, The Council can extend the abatement period. Mayor Hamilton said the question was are they going to uphold the ordinance. Councilman McCaron asked if the ordinance called for a specific abatement period and Mayor Hamilton said it did state three years. Councilman Waldo asked if Mr. Kunz could sign such an agreement and the City Attorney said that he thought something like that could be considered by using terms like a new development coming in, etc. Councilman Waldo asked if Mr. Kunz would be wilting to go along with this, and Mr. Kunz said he would have to know the terms and conditions regarding the final removal, but he would be happy to go over the terms of such an agreement, based on reasonable reasons for removal of the sign. Mayor Hamilton asked how long they would want to extend the abatement period. Councilman McCaron said they would have to establish this in the agreement, and the ultimate time limit would be by the State when it is declared a land- scape area and it would have to come out. Assistant Planner Fertig said this ordinance was written to cover every billboard in the City and it should not be changed because of one billboard. The code states the options, either deny it, or extend the abatement period to what is considered a reason- able time based on several things, one of which would be the amortization period of the sign. He said there was a three year abatement period for every billboard. He said they could declare an outdoor advertising district for that area, but the staff would prefer not to do that and felt that Council should extend the abatement period to a reasonable period of time. City Attorney Kress said that he agreed with Mr. Fertig. His comments about an agreement was in answer to the question of if an agreement could be made. Councilman McCaron said he thought they should reopen the hearing so that the applicant could come up with some answers and let them know what he needs for an abatement period or any alternate that would fit the purpose. Councilman King said he would like them to hold this over to the next meeting and have Mr. Flandn'ck research it thoroughly. There could possibly be an agreement, and if there is, they wouldn't be leaving it open to a three or four year abatement period. E. Carpenter said his information had come from the city clerk of LaHabra. It was true that the Chamber of Commerce had paid for the hundreds of slides, but he took them and he was the one to determine what they represented. One week after he had taken the pictures, there was repainting of graffiti much worse than before. The ownership of the slides is not the question, but the person who takes the pictures has a certain responsibility and as far as the dating being in November, if any- one is concerned, this happened yesterday. He said he made the same objection before the trip to Dallas and he felt that the presentation was not true and honest. Mrs. Gloria Zook, 4817 North La Rica, said she was uospt bv the remark that the Citv did not have a annd reputation. Mr. Mocatis said that we didn't agree with the information given to the AH American Cities and we think we get a lot of things accom- plished are are quite proud of the citizens of Baldwin Park. Mrs. Zook said the citizens have done more for their own town that a lot of cities. Mr. Mocatis said they were restricted to three items they could present and there were many other volunteer functions they could have given. He felt the approach was honest and he had no apology to give on the behalf of Baldwin Park. Mr. Jerry Kitchett, 3308 North Athot Street, said that the fact that Baldwin Park was able to compete in the All American Cities is certainty an outstanding factor He said Senator A1 Song has a bill before the State Senate which is trying to curtail the problems that graffiti has brought about. The Baldwin Park Unified School District is also concerned with the problem. When you can band a group of people together in a combined effort to bring about some type of correction to help the City, you are talking about an asset. He didn't think Mr. Carpenter should elaborate about the pictures he took as the pictures were taken for the Chamber of Commerce and not for Mr. Carpenter alone. Mayor Hamilton said that the City was nominated was an honor and many things have been accomplished and we have many wonderful people and projects in Baldwin Park and he resents someone getting up and condeming the City when so many people are trying to improve it. He directed a statement to Mr. Carpenter that he did not condone a personal attack on any one person sit- ting in the meeting. The programs were successful and 200 younsters had participated. As chairman of the Community Improvement Program, sponsored by the Sears, Roebuck and Company, the Women's Club won a $100 award on the graffiti project. She said it was true that it had not been 100% successful but they realty routd not exoect to on a project of that size and they have to go ahead and do better. She asked Councilman Watdo to explain about the pictures that were taken. Councilman Waldo said the Chamber of Commerce endeavored to take pictures of each project and incorporate a slide presentation to show to the different organizations in town to let them know what was happening. They did this with the graffiti program and the committee preparing the presentation for Dallas risked the Chamber of Commerce for the slides to use at that time. The pictures belong to the Chamber of Commerce. Mrs. Burnett said she was proud to be a resident of Baldwin Park and ii we have a few failures, let's do better next time; Councilman Waldo said so the program wasn't 100% successful in some people's eyes, but for him per- sonally, it was a wonderful experience. If they had not accomplished anything else other than get- ting the young people together, that was progress. 00- Councilman King said he had read an article in the Tribune on April 29, Watering Down the Law" and he wanted to commend the Tribune for making the people aware. The article stated that Mr. H. L. Richardson of ArcofJia had announced his resignation from the Senate Select Committee on the control of Marijuana and his reasons were that the committee is being used as a platform of watering down the Marijuana laws of California. The Tribune stated we fear such legislation as that proposed by Muscone1'. The legislation would make it a simple infraction for having a certain amount of pot" in your possession. He suggested that everyone present send a letter to H. L. Richardson and ask him to reconsider his stand with respect to resigning. He would like Council to send a letter to Muscone, carbon copy to the Tribune and to H. L. Richardson with respect to his lack of concern for the public. He would also like Council to send a tetter to the City Council of Los Angeles with respect to their test ordinance on pornography and if they win, then it would open the door for cities like ours to remove the pornographic material from the bookstands. He said another item was that of the State's prison mail ruling. The Supreme ourt has ruled that they can no longer open mail r^ the in-mates. He was told by a narcotic personnel officer that there could be a minute amount of Mari- juana or Cocaine in letters and if they weren't allowed to open the letters, how could they find out the contents. He felt that the courts are taking away alt of the rights. The police have no enforce- ments and are criticized for their actions and it is almost an anarchy. He asked if the City could now sponsor the team to go to Mexico for a game. They tentatively plan leaving on July 13 and spend 14 days there, play- ing six or seven games. There would be a total of 15 boys and 5 adults as chaperones, it would amount to about $50 each. They annot toe affil- iated with Baldwin Park High School because the C.I.F. would recognize them being out of juris- diction of the C.I.F. rules. Mayor Hamilton said this was a good suggestion, but the City had no budgeted money for this and wondered if there was another way the money could be raised. Councilman Waldo asked if it wa^ legal for the City to spend taxpayer's money for this type of program, and City Attorney Kress said no as it would be a gift of public funds. The reasons for this was that it was not d good estimate to begin with and there have been spiraling costs for the material going into the con- struction of the bridge which added to the difference. 00- City Manager Mocatis said the City was notified some time ago that the property teased by the City for some years on the South side of the San Bernard!no Freeway known as Roadside Park was going to be put up for sale by the State and Council directed the staff to try to retain the property and so they had contacted the District Director of Transportation for the State Division of Highways and the Highway Commission and they were successful in obtaining a new tease. He said there were some funds available through Southern California Association of Governments SCAG). The fund is the Local Transportation Fuyids. Our Director of Recreation and Parks would l.ike to fife a claim with SCAG for an allocation of these funds to be used for planning and developing a Pedecyle Station at the Bess and Frazier Avenue stop of the SCRTD. The allocation request is in the amount of $8,278.00. He would meet with the Division of Highways if the plan is approved and establish on whose land the improvements would be made and also meet with the SCRTD whose facilities we would be discussing. This facility would be a safe place where people who ride motorcycles or bicycles could lock their vehicle and board the bus to Los Angeles or go East. He recommended that the Director of Recrea- tion and Parks be authorized to file a SB821 claim for Local Transportation Funds for the purpose of bicycle and pedestrian facilities. Councilman McCaron asked if any City matching funds went into this and City Manager Mocalis said there were no matching funds as the money available in the Local Transportation Fund does not require matching. There were bid forms mailed to 23 companies and there were only three responses and they were no bid". After the bid closing, they con- tacted 13 agencies asking why they had not bid and to see if they would bid. Majestic Chryster-Plymouth said they did not have time to prepare a bid, but they would submit a bid. The bid received was for eight 8) Plymouth Satellites and the unit price was $3,699.78; total for all vehicles if $31,374.13. less trade-in of $2,400.00, leaving a balance of $28.974.13. Our Municipal Code provides that if we have attempted to secure bids and have been unsuccessful, that the City Council may be 4/5 vote dispense with further bidding and authorize the direct purchase. The Police Department recomnended that they accept this bid because of the maintenance cost on the present vehicles. Also, if they waited for the 1975 models, the cost would be approximately $300 more per vehicle. Mayor Hamilton asked how many cars the $2.400.00 trade- in covered and City Manager Mocalis said there were ten 10) vehicles being traded in and they are purchasing eight 8) and Council authorized two Checker vehicles to be purchased for test purposes. Councilman Gregory asked if these were the original Checker vehicles they studied, the one she had ridden in, the six cylinder car and Chief of Police Adams said Finance Director Duncan had already ordered those per Council approval. Councilman McCaron asked in regard to the $2,400.00 trade-in if they had tried to sell the cars outright to another source and what the comparison would be. Chief Adams said that other cities had and they had varying amounts from $500 to $1,100, but it cost them over $200 to bring them up to standard, plus the cost of advertising, etc. and they probably realized from $150 to $200 more per unit. We don't know how it would work, we might get our money back and maybe we won't. If they are taken to the dealer, they do all of the detail work and these cars would have to have quite a bit of work done on them before we could attempt to sell them. NO. 683 ADOPTED Mayor Hamilton said since the retirement of the Community Redevelopment Committee, there had been numerous requests from citizens and developers concerning interest in projects for Baldwin Park. Because of the interest expressed by property owners in project areas, the Council and he felt that the reactivation of the CRA was in order. In reactivating the committee, there was a lot of interest by people wishing to serve on the committee. He said that the comnittee had grown from 15 to 25 members and this will give more input and more people will be involved. He said Mr. Waldo is now a member of the City Council, Mr. Ralph Smith is a member of the Planning Com- mission and Mr. Paul Doyle has moved, so it was necessary to replace them. Mayor Hamilton said there is an opportunity for the City of Baldwin Park to help its citizens financially by increasing revenues. After thor- ough study and investigations by the CRA Commit- tee, the recommendation would be to move on a particular project and that recommendation would be considered by the Council for action. He said Council sincerely appreciates all of the efforts these committee members will spend on this pro- ject and he extended the expression of gratitude to the citizens of Baldwin Park for their help. He said every person on the list had been con- tacted and they had agreed to serve list is in official files). Mrs. Ha Hie Slater, 4814 North Stancroft Street, asked when the Council had the meeting that decided this reactivation of the CRA Committee. Mayor Hamilton said this had not been decided at a meeting, but Council members had been con- tacted and asked to do this and suggest appoin- tees. Mr. T. E. Carpenter asked how they selected this committee and how did the Council get together to do it. Mayor Hamilton explained that the committee had asked for a reconnaissance study. This has been done and then the committee was to be reactivated. He had contacted the Council individually and the committee was selected, Councilman King explained that Mayor Hamilton had called him for an indication of people he would like to serve on the committee and the Mayor reactivated this committee with the consent of the Council. Carpenter said originally the Council members had each selected three people and he asked if the same procedure had been followed. Councilman Waldo said he had asked the Mayor to appoint three individuals who he wanted on the committee and they are on it. He ha'd received a letter from the City Attorney which said he was not in conflict of interest providing he does not vote on monies being sent to the Chamber of Commerce. He said he does have a tetter of resignation written to the Chamber of Commerce. 00- Mr. T. E. Carpenter, 4346 Jerry Avenue, said he had read an article in Sunday's Times regarding graffiti. He said he took exception to remarks in the article made by the City Manager. The remark by Mr. Mocatis that graffiti in Baldwin Park is beginning to dis- appear" should be retracted. He felt that graffiti was 100 times worse now and he protested the use of slides of pictures he had taken representing some- thing that wasn't so. He said the article also states that the City would try for the award of All American City" again in 1974. Mr. Carpenter said he had talked to th- city clerk of LaHabra, the only other finalist in California and was told they were recognized for Dial-a-Ride, the Boys Club for Neurological Children and on a school project. He said he had photographed the City from one end to the other and graffiti has not been erased and he was going to notify the National League of Cities in New York of just what is happening. City Manager Mocalis stated in response to Mr. Carpenter's comments on graffiti, that the City Council appointed a citizen's committee to assist the staff in the presentation and this com- mittee included members of every service club in the City of Baldwin Park. Several citizens went to Dallas to help make the presentation. The article in the newspaper referred to remarks made in Dallas last November. At the time the remarks were made, the statement was accurate. Graffiti was being eliminated. The slides Mr. Carpenter referred to were not his. The slides were used through the courtesy of the Chamber of Commerce, were paid for and are the property of the Chamber of Commerce. The remark regarding Baldwin Park being a finalist is an accurate statement as there were 18 finalists out of approximately 500 appli- cants and only two were from the State of California, LaHabra and Baldwin Park. Mr. Mocalis said the AH American Cities only acknowledge citizen achievement and not the achieve- ment of the City and that is why we made the pre- sentation on what the citizens had accomplished. The City of LaHabra stressed the work done by the boys in the Boys Club. Almost every city who was represented had a Diat-a-Ride scheme and it was not new and hasn't worked out too well. He said he had contacted the Alt American City people and asked where we had fallen short in the presentation and they said they thought our presentation was well done, technically good; however, our City had the reputation of making it difficult to get things done and that was why Baldwin Park was turned down.
