Director of Public Works Perry said Mr. Mersh, owner of the property, had attended the last Council Meeting to protest the cost for improvements on the four parcels. Mr. Perry said that an assessment for one street frontage would amount to approximately $1,150 and the City's portion would be approximately $5,400. Councilman McCaron asked if that included the property on Barnes Avenue and Mr. Perry said these Improve- ments were already in. Councilman McCaron said they should charge him for the one frontage and the City pay the balance. As there was no testimony. Mayor Hamilton declared the public hearing closed. Councilman Gregory asked if Mr. Mersh had been con- tacted and Mr. Perry said they couldn't reach him by telephone, but they had mailed him a copy of his report. Councilman Gregory suggested that this be held until Mr. Mersh could be contacted as this is an unusual piece of property and does present some hardship. She would like Staff to write a letter to Mr, Mersh informing him of this action. NO. 74-59 ADOPTED 00- Oral Communications: Mr. Newt Seay, 14846 Arrow Highway, had presented a letter agreeing to sign a covenant and agreement to install sidewalks in lieu of installation at this time. Mayor Hamilton asked him to step out and discuss this with Director of Public Works Perry and City Attorney Flandrick. This is to be resolved at the next meeting. 00- Mayor Hamilton said he would bring the last Agenda item, CRA Ordinance, on at this time. He stated he wanted to make it perfectly clear that this was not a public hearing. The purpose of considering the first reading of the CRA Ordinance is to show good faith to the developers and to obtain a firm commit- ment from them. Due to the perplexity of the Puente and Merced CRA Project, there might be someone pre- sent who did not attend the meeting at Morgan Park on May 28, 1974 who would wish to speak. In addi- tion, anyone who had attended that meeting who had anything new to offer may speak. He asked them not to repeat any comments or questions as they wanted to be fair to all of the citizens of Baldwin Park. He wanted to be sure that they a11 had an opportunity to express their views on this issue. A maximum of 45 minutes was to be allowed for this discussion and each person would be allowed 3 minutes to speak. Mr. Michael Dargus, 13260 Francisquito» said he had asked a question at the May 28, 1974 meeting and it wasn't answered and asked again why the two acres on the Southwest side of Puente and Merced, across from the four acres, had been included in this pro- ject. Mr. James Sexton, Director of Industrial Development, said it was included so that the City may capture the tax increments that wilt be resulting from the new development of the budget motet on the land. Mr. Dargus then asked why they were doing this piece meal", jumping from one to two or three places down the street and why this method was being used. Other CRA's have a complete area. Mr. Sexton said if a redevelopment plan is adopted, it will be in more precise terms and will address itself to that question precisely. It's only a preliminary plan at this time. We haven't adopted a plan, we are presenting a first reading of a CRA Ordinance to give us authority to prepare that plan. Mr. Lorin Lovejoy, 12749 Torch Street, asked what the cost would be over and above the regular busi- ness of the City, such as lawyers, etc. Mr. Sexton said the preliminary estimate was we would require a floating of a bond issue for approximately three million dollars, which the City would receive at the onset of the project. Mr. Lovejoy asked how long the agency people would be paid, for how many years and how much. City Attorney Flandrick said according to the Ordinance, there would be no compensation to any member of the agency. Mr. Lovejoy asked if the $30,000 for lawyers was the total cost or only the first year and Mr. Sexton said the initial cost estimate was for $85,000. The 3 million dollar bond should be paid off within 11 years. This figure of $85,000 covers planning, economics, engineering, fiscal and legal expertise. Mayor Hamilton said this tonight is merely a reading to introduce this ordinance and before we can come up with concrete figures, the ordi- nance must be adopted at the second reading, then there is a 30 day waiting period. This can be good or bad, depending on how it is handled. If the agency handles it right, it can be a boon to the City. It is up to Council to see that it is handled right. If we are not satisfied that this is right, we will not go through with it. The ordinance is a tool and we want to be sure that this will be the best for the City. CRA MR. LOVEJOY Mrs. Amos Slater, 4814 North Stancroft, asked if they would hire a consultant firm to make a feasibility study and Mayor Hamilton said not until after the second reading. MRS. Mr. James Sexton said the cost for the hotel development, including K-Mart, which amounts to approximately 25 million dollars would take 10 to 12 people and certain salaries would be $30,000 per year. The $85,000 is the cost to prepare a redevelopment plan to see whether or not this project is feasible; in other words, these are the costs in the preparation of a redevelopment plan. Mayor Hamilton said that the $85,000 paid by the City win be paid back to the City after the bonds are sold. MRS. SLATER Mr. Duane Shaftstati, 4250 Filhurst, they were going to have CRA, why did it to the vote of the people as they before the election. asked if they not put had promised MR. D. SHAFTSTALL Mayor Hamilton said he had made the statement that anything this controversial should go to a vote of the people. At that time there was no project. Since that time, the law has been changed to give the property owner more protection. This is a unique situation as we have a project and all of the property owners within the project are in favor of this and the adjacent property owners are in favor of it. He felt due to the change in the law and due to this project only, is why he had changed his mind. If it would go to a vote of the people, it would cost the City a lot of money and also would probably lose the developer and K-Mart wanted an answer by July 1. Mr. Shaffstall said there is no such thing as just one project or spot" CRA. The City Council can't limit CRA to this particular project, and what recourse does the taxpayer have to stop any future projects. Mayor Hamilton asked Mr. Sexton to give the proce- dures for implementing a CRA. Mr. Sexton said CRA is a Community Redevelopment Agency. It has a principal which it represents and in this case the principal is the City. It acts wholly within the scope of the delegation of power and authority that is given it by the Council, its principal. A redevelopment project area has to be described and the power and author- ity that can be used are only in the areas desig- nated and described by legal boundaries. That is the scope of CRA's authority, a one project basis only. Continued) MR. He does support the Council's action on CRA. Revenue bonds are paid for by the revenue from the project. He helped elect the members of the City Council and hoped they would do their job. No one should be crucified for changing their mind once in awhile. MR. BLAIR HOLMAN Mr. Glen Robinson, 4708 Walnut Street, said he would like to hear Mr. Sutterfield speak on the school tax situation and he would like to hear Mr. Carman continue on the alternatives of CRA. MR. GLEN ROBINSON Mayor Hamilton said we have had appreciate Mr. Carman attending he felt we should hear from the Park. input from exoerts and the meeting, but citizens of Baldwin City Attorney Ftandrick said the Council has the right to regulate the time and the number of people that appear on an issue such as this. Mr. Carman, 1415 Palm Avenue, San Gabriel, said they should clarify some things. A11 the money going to the bonds instead of the schools and the schools have to go ahead under AB1267 and tax the people for the same amount. To say taxes won't be raised is a tie, as you are going to be taxed. You are giving more than free taxes in giving money ahead of time with subsidies. You have eminent domain which takes pri- vate property for public use. Further effort should be made to put into legislation a more adequate distribution of sales tax to the cities. He said he had papers from all CRA's to show how much money they were losing. He said he had a book of the facts they could review. Mayor Hamilton stated they had requested a copy of the report. Mr. Cart Sharp, 5018 Wimmer Avenue, asked if the City Manager would read the ratio regarding law enforcement officers in the City of Baldwin Park. City Manager Mocalis read a comparison of our City's police officers with other cities in the valley. The average number per thousand in the San Gabriel Valley is 1.39 officers and Baldwin Park has 1.16 and we are the third lowest or about 10 police officers short. MR. CARMAN MR. CARL SHARP Mr. A. F. Vergote, 3209 Puente Avenue, requested that Council accept the petition he had with signatures of property owners across the street from the pro- posed CRA project. They asked immediate approval of the project and the enactment of the necessary ordi- nance. enabling Baldwin Park to take its place among the progressive cities of the valley. Continued) MR. Under current conditions, we would be bankrupt in three years". He said we didn't want this situation in Baldwin Park, but we have the possibility of this if we don't have new revenue. He also read an article from the Tribune, Reality May Decide the Issue", the way Council must go if its City is to remain competitive in the bid for new business firms. MR. RUSSELL BLEWETT Mr. Jay Angeto, 3123 Baldwin Park Boulevard, said the San Gabriel Valley Realtor Board of Directors stated that they are in favor of this CRA project. MR. JAY ANGELO Elizabeth Cummins, 4139 Downing Avenue, asked if the bonds would be floated as a public issue and if so, this money will not come out of Baldwin Park and this could be considered as an investment in the community as well as the personal pocketbook. ELIZABETH CUMMINS Mr. Howard Sutterfield, 3779 Foster Street, said he had no desire to discuss school finance. The school budget in Baldwin Park calls for a tax increase rate of $1.32 and hopefully it wilt be reduced to $1.00 before the final budget. If he felt that CRA would be detrimental to the school district, he would be opposed to CRA. He is not opposed, but is in favor of CRA as he felt we must build a tax base. Assessed valuations will be frozen, but we will have something to look forward to after the bonds are paid off. He said he was speaking as an individual. Councilman King asked Mr. Sutterfield to explain again what he had told him over the telephone regarding school finance. Mr. Sutterfield said it is dangerous to get into over-simplification on any subject because you don't cover alt bases. He said school districts pay for their schools to the extent of their ability to pay. The constitution provides that every student be allowed $125 from the State and some cities such as Beverly Hills, supplement this. $2,000 per student out of their local taxes. Baldwin Park receives $809 per student on a $4.00 tax rate, 3/5 is from the State and 2/5 is from local taxes. The situation has changed to the extent that assessed valuation under CRA was frozen for local revenue and we applied the local tax rate to the same assessed valuation for that 11 year period. In computing State revenue, they are required to use the actual assessed valuation which is the added 10 to 15 million dollars that may develop on the CRA and they told the State this was unfair as they were penalizing school districts for CRA. They asked to use the same assessed valuation computation for state apportionment that is used in computing local revenue, which will give them more money from the State. We are double taxed to the extent of being taxed as local property owners and taxed as a result of CRA in Cali- fornia. Carpenter, 4346 Jerry Avenue, asked Mayor Hamilton to state what the changes were in the law that caused him to change his mind. Mayor Hamilton said he couldn't go into all of the laws but the important one was where the property owners were protected. If you owned a business which would be taken in a CRA project, you would be relocated and paid for the time you were out of business. If you are living in a home, they must find a comparable home, even if they have to go to $15,000 more. A renter Is also safeguarded and can receive up to $4,000. Another reason for his change of mind is that they now have a definite project, harmony among the property owners in the project, and have received a tetter signed by 16 people who are adjacent to the project who are in favor of the project. Therefore, he felt it was wise to change his mind. Another factor is the cost of government, the inflation and the tax base will be increased about 1.2%; the cost of government has gone up at least 20%. We are looking for something. If there is any other way to support our City in the tax base, he would like to hear it. Mr. Carpenter said that this still doesn't give the citizen protection who doesn't want to sell. Mayor Hamilton said they were not intending to go into residential areas as they are only talking about this one project and see how this goes. MR. T. E. CARPENTER Mr. Orville Moran, 301 South Fifth Street. Alhambra. said he had been a taxpayer for 16 years; they own the property where Penny's Restaurant is located. He said they have confidence in the City Council and know they wilt do the right thing and that they will have the nerve to face the people and te11 them how they feel. MR. ORVILLE MORAN Mr. Fred Moran, 933 Actron Road, San Marino, said he was one of the property owners in this project. He read a letter from the Puente-Merced Property Association of Baldwin Park. requesting the accept- ance of CRA. Copy in official files). MR. Councilman McCaron said after listening to testi- mony from the people in regard to CRA, it still appears that some people think that Council will go hog-wild" and start digging up projects. Economics enters the picture and to tak homes, the cost of the property and the protection of the property owner, because of the cost it would be impossible for the project to pay itself out and would be foolish for any Council to consider such a thing. Each project will come before the public, they will be notified about it. Any Council would not approve something that wouldn't pay itself out within a reasonable period of time. No decision will be made on this until they know exactly what the project is in its entirety, what the costs are and the time it takes to repay it. It takes time before the Ordinance will become effective and Council should be able to act when it is presented to them. He felt that this is an opportunity that they have been waiting for and have hired a man to try and bring some improve- ments into the City. We are in competition with other cities. The basic principal does not appeal to a lot of people, nor does it appeal to him, but if this is the way we have to go to improve our basis, then this is the way we should go. We can't wait and allow other cities to take what benefits we can derive simply because we don't approve of their method of doing business. He moved that the Ordinance 684 be introduced; Mayor Hamilton seconded the motion and asked for Council discussion. Councilman King said his feelings reoardina CRA had changed, mainly with respect to the law as the law had changed in the past few months. There are new laws which will be effective within the next few months and four or five bills being introduced and they wilt curtail some activities of CRA and make it more responsive to the needs of the people, if the people are afraid of the Council being the agency or any appointed group to be the agency. In this case we do have a project area with clearly defined boundaries and we are not going outside of these boundaries. We have an area that people do want to sell and we are not taking anyone's home. The City of Baldwin Park, I believe at this time, has many problems but I believe this is the solution. He said he hoped the community felt as he did, that the Council was elected to do a job and not elected to be Gods" to say this is the way we are going and no other way to go. He had listened and had learned and felt there was sufficient knowledge on the subject of CRA that is warrants consideration. As Councilman McCaron stated, we are tieing it down a little more closely. If the Agency is created as said by Council, certainly the recourse by people at this point is to remove any councilmen from office who feel that this is warranted. People were not listened to in other CRA's as was the case of Rosemead. Under the present conditions, we are subsidizing CRA's in other areas which is double tax in a sense. CRA is not the answer to all the problems, but there will be an economic disaster if we don't decide. Consequently all of the cities picked up the tab" for this loss. We aren't going to lose anything. If there wasn't firm commitments, firm contracts and a project area and if people hadn't been heard, he wouldn't go for this, but he thought every- thing possible had been done. Councilman Gregory said Councilmen were not above making mistakes, but they are citizens of this community and act individually and collectively on CRA as on other issues in good faith and in good judgment. Councilman Waldo said he had pieces of campaign literature before him. On 95% of the literature, he had denounced CRA. He read from one of the pamphlets: Issues and objectives CRA: He stated he was against CRA because it removes the individual's right to govern his own pro- perty." That still holds. With CRA. the City could condemn your property and purchase it for a price they feet is reasonable". He said that statement was not true any longer. We now have legislation protecting the property owner, guarantee of fair market price value and the benefits go beyond that. They sell your property to the developer, but at the expense of the property owner." He didn't feel that was valid any longer. I would do everything in my power to see that CRA is put on the ballot for the people to vote on." He said he would still like the people to vote on it; however, they must act one way or the other. If we don't, something will happen as in the past. Baldwin Park lost Sears & Roebuck, Montegomery Ward, J. C. Penney's, Robinson's, May Company and at one time Disneytand wanted to move into the area. At one time. the City of Baldwin Park could have included the City of Industry and the City of Irwindale. None of these issues were put before the voter to make a decision. The Council made the decision, but not the right one as we lost these things. He felt that Baldwin Park has one more chance. He didn't like the Idea of passing this without more input from the citizens, but he knew we had to move or we would lose and no one wants to lose something like K-Mart. The man said he estimated their gross sales would be from 8 to 10 million dollars a year and we can't afford to lose something tike that. The older people living in this town have lived in their homes for many years, love it and want to stay, but he said he lives here and his parents live here and he doesn't want anyone to take their homes either. If it comes to that, somebody is going to have to move, we have to do it. E. Carpenter, 4346 Jerry Avenue, said he thought they should give information to the people as to what their rights are to protest the ordinance. City Attorney Ftandrick said rather than do this orally, and if Council agrees, he would be happy to prepare a memo of the procedures involved in a refer- endum so there would be no mistakes and could have it by the next meeting as it wouldn't be applicable until second reading. Mr. Carpenter wanted to know if his understanding was correct that they had 30 days after the action on the ordinance in order to protest it and after the protest, the Council has to act in a certain way, providing 10% signatures are furnished on a petition. He asked what is the action of the Council when the proper signatures or petition City Attorney Ftandrick said a referendum petition is circulated and submitted with sufficient signatures and within the time permitted, 30 days. The ordinance is then suspended pending Council's action and their action at that point is either to repeal the ordinance or send it to the electorate. 00- MR. T. E. He said they had not had a rate increase since 1971 and other cities in the Valley had already granted a rate increase to them. Councilman Gregory asked what the changes were regarding the license procedures and if Senior Citizens were considered in respect to a dis- count, etc. Councilmen Waldo and King also stated they would like to have something done in behalf of the Senior Citizens. Councilman Gregory said she would tike this to be held over until the City Manager can talk with the Yellow Cab Company and she said the cabs hadn't been clean according to complaints of citizens. City Manger will contact the Yellow Cab Company and report back at the next meeting. 00- City Manager Mocalis said the City received a letter from the owner of the Baldwin Theater stating their intention to sell the theater and asked if the City would be interested in buying it. He said the architects employed by the City to plan the new police facility and city hall had recommended that the City acquire the property. He recommended that Council authorize retaining an outside appraiser to appraise the property and a recommendation be made then. Councilman Waldo said he had tried to contact the owner of the theater, Mr. S&ndborn for about two years and had just recently talked to him. Councilman McCaron asked how much money the City had invested in this property and Mr. Perry said he would find out. Councilman McCaron asked if it wouldn't be better to keep the 3 lots intact rather than to se11 to the owner on the south just because he was interested. This would create odd property tines. The 3 lots are substandard and this should be explained to the owners. Mr. Perry said a11 of the other owners had fences in and that is probably why they weren't interested. Councilman King asked if the property owners were able to buy it for a token fee, would they be interested and Mr. Perry said they wrote tetters to a11 of the property owners and did not receive any answers except for the one on the south side. Councilman Waldo said Mr. Heil had given hundreds of hours of labor to Baldwin Park in trying to revamp some of the old stores. We particularly are grateful to the CRA Study Committee for their efforts, the substance of which is contained in their report and recommendations last Tuesday at Morgan Park. In passing the first reading of this ordinance, we intend to show good faith to the devel- oper and achieve thereby a firm commitment from them. He said he had been contacted and asked who the CRA Agency members would be, whether it would be Council or citizens of Baldwin Park. In answer, he replied yntil a CRA Ordinance is adopted and fully meets all the requirements of the law, it is premature on our part to act on the structure or composition of the agency before the second reading of the ordi- nance is passed. However, we solicit the recommenda- tions of the CRA Study Committee and other interested groups. Ultimately, we hope to achieve the appro- priate arrangements for CRA that wilt obtain for us a hotel development and possibly a K-Mart and wilt benefit all of the people in Baldwin Park".
