The second amount is $6.125.00 for Workmen's Compen- sation re-insurance binder coverage for one year's fee. These two items will appear on the next warrant register. NO. 74-72 ADOPTED Mayor Hamilton said he had received a telegram from State Assemblyman Joseph Montoya regarding the CRA issue and he read it to the audience copy in official files). 00- Mr. Jerry Kitchel, 3308 North Athot Street, said he was speaking on behalf of the People for Pro- gress". He said the people of Baldwin Park wanted progress and affirmative action. He said the pro- perty owners in the project area had expressed their willingness to cooperate with the City in this CRA development. He said the developers had expressed a sincere interest in this project. He felt Council must act now. He said Mr. Jack Loether, owner and publisher of the Treasure Chest, Gtendora Press and the Azusa Herald had done a commendable job in researching the CRA issue and he wanted to thank him on behalf of the People for Progress". 00- Pubtisher Jack Loether, Treasure Chest Newspaper, com- mented that the meeting he had attended at the Morgan Park auditorium was the most exciting meeting he had ever attended. He said his news- papers were dedicated to print the truth. He had intended to prove the Council wrong and that the opposition to CRA was right, but as he had investigated the issue he found that CRA is the best for Baldwin Park. TELEGRAM ASSY. JACK LOETHER FAVOR OF CRA 00- Mr. Cart Sharpe, 5018 Wimmer Avenue, said he was criticizing whoever wrote the article in the San Gabriel Valley Tribune dated July 3, 1974, Section B, Page 4, and he read a portion of the article, Holiday Can't Stow Council" copy in official files). He protested the article and said it was not good reporting and was making statements without just cause. He felt an apology should be made as CRA was not a dead issue". MR. He urged Council to take action on CRA without further delay. He stated they would support with all the resources they have as they are convinced that CRA is the answer. He felt that they should have some ground rules if people were going to ring doorbells asking people for a referendum to bring this to a vote, they should be made to present to those people something in writing. He said they were going to try to hold them accountable legally and morally for mis- statements and mispresentation of facts. He referred to Mr. Carpenter's remarks in a recent article in the San Gabriel Valley Tribune, Redevelopment Foe's Petition Hits Council". Copy in official files). He felt that the paper should question Mr. Carpenter and find out what people are being harrassed by what government policies and he presumed Mr. Carpen- ter was talking about the City Council. He should be asked to explain his statement regard- ing millions of dollars" being at stake. He said if it goes to a referendum, they will pro- bably get it, but he felt when it goes to the vote, we will win the vote. By explaining what is involved, you can win the vote. He asked the opposition to join them as it will take every ounce of effort to make a success of this and they need the help, but not to delay it with a referendum. 00- Mrs. Amos Slater, 4814 Stancroft Street, said she had gone over the agenda packet from the library and several items had been deleted. Item #5 under the City Manager that Exhibit A" and B" were not in the packet. City Attorney Ftandrick said that may be true in the copy Mrs. Slater reviewed, but there is an Exhibit A" and B" and they are complicated legal descriptions of the property involved and had been approved by the City Engineering Depart- ment and by him. Mrs. Slater said the Councilman's packet had a copy of the agreement with Southern Pacific pro- perty and was not in the packet she had reviewed at the library. She understood that everything would be in the packet for the library that was included in the other packets. Mayor Hamilton explained that sometimes there are changes or certain information comes in to City Hall after the agenda packet is printed and there could be a difference. He felt this would be explained when the City Manager pre- sented his items and he didn't appreciate any criticism until after the City Manager had presented his report. Continued) MR. He had called City Clerk Batkus and she informed him that sometimes items are late and not enough copies were made and he felt that was sufficient explanation at the time, but Mrs. Slater evidently wanted further information from the City Manager. City Manager Mocalis said that the Council's instructions were that the Staff would attempt to find a way to make sure that the public would have at their disposal copies of the agenda material precisely the same as the Council receives. This has been the practice and if something was missing, it was inadver- tent, as it was not intentional. 00- Mr. T. E. Carpenter, 4346 Jerry Avenue, said he was impressed with the statement by the City Manager during the budget meetings. Mr. Mocalis said We did not have to dip into our Revenue Sharing we are in good shape". In 1973-74 the City Manager received $26,256, the Assistant got $20,418, the Director of Industrial and Commercial Development got $18,048. Now the City Manager receives $29,436 providing he hasn't received addi- tional since then, the Assistant gets $23,880 and $19,896 for the Director of Industrial and Commercial Development. These are the men who are supposed to keep us out of the woods". West Covina is practically broke", but they have CRA. He said everything he had put in the paper, he had meant. He said he had not put any money into advertising and he didn't intend to. When they put the CRA in, it is in for the City of Baldwin Park. You can put as many projects in as you see fit. You have to have hearings, but they are wasted. The last vote the people have is on a referendum; it's the law. He said the men mentioned above had done a good job in keeping us out of spending our revenue sharing tax money. 00- Mrs. Joy Robinson, 4708 Walnut Street, said she was opposed to CRA. She said Mayor Hamilton had stated at the last meeting that they would not go into this program unless they had a firm commitment. She asked that they make sure they are going into the right thing and not be pushed by the people in favor of CRA. 00- MR. T. E. CARPENTER AGAINST CRA MRS. Director of Public Works Perry said they were in the process of Slurry Sealing quite a few streets in town and the streets had to be closed during this procedure. He said they were askinq oeoole to Dark off of the street for that day as designated. They can't allow traffic on it for one day. Mrs. Asquith said her notice had indicated 2 days and Mr. Perry said perhaps she could either park off the street the night before or leave early in the morning and he would call her Monday morning to let her know if it would be Monday or Tuesday. 00- Mr. Edward Wilson, 5021 North Gayhurst Street, said he didn't believe in cities or government dabbling in business as they have too much power and your liberty is gone. He would like to see the City spend the money for an election so that the people wilt know about CRA. 00- Mr. James Garrow, 1011 Baldwin Park Boulevard, said we have always had people selling Southern California short. He said when they voted for the 3 big bridges in Los Angeles, they thought they would never pay for them, but they were paid for in 4 or 5 years. If this City is ever going to progress, we have the golden opportunity" with this project, we aren't throwing anyone out of their homes and no one is against selling their property. We have to compete with the other cities and compete on a CRA basis. 00- Dee Sharpe, 5018 Wimmer Street, said she was for CRA 100%. She said she does a11 of her buying outside of Baldwin Park. If CRA comes in for the progress of Baldwin Park, we can shop in our own City and our taxes wi11 go down. 00- City Clerk Batkus presented a claim from Martin Kellemeyn, 13088 Armar Road. He has accepted an executive position with a management consultant firm in Orange County. He expressed the privilege of working with Mr. Ed Perry and said he had done an outstanding job for our conmunity and wished him luck in his future endeavors. 00- City Manager Mocalis said it is the policy of the City to accept bids on unit cost basis for work done on street improvements. They had received two bids for approximately 19 items on June 18, 1974. The low bidder was Tussy Construction, Inc.» Baldwin Park and it was recommended the contract be awarded to them. AWARD OF CONTRACT FOR UNIT COST STREET IMPROVE- MENTS TO TUSSY CONSTRUCTION, INC. APPROVED. M/S/C: GREGORY/WALDO. 00- City Manager Mocalis presented Gas Tax Project 139, an extension of Ramona Boulevard from Francisquito Avenue to the Westerly City Limits and a portion of this Project is inside of the City of Irwindate. An agreement with Irwindate has been prepared to provide for maintenance and the City Attorney has approved the agreement as to form and it was recommended that the Mayor and the City Clerk be authorized to execute the agree- ment on behalf of the City. JOINT POWERS AGREEMENT BETWEEN CITY OF BALDWIN PARK AND CITY OF IRWINDALE FOR RAMONA BOULEVARD FROM FRANCISQUITO AVENUE TO THE WESTERLY CITY LIMITS GAS TAX PROJECT 139) STREET IMPROVEMENTS APPROVED AND MAYOR AND CITY CLERK AUTHORIZED TO EXECUTE THE AGREEMENT. M/S/J;: KING/GREGORY. 00- City Manager Mocalis said that Webster's Disposal Company had asked for an increase for single families from $2.28 to $2.50, plus an additional $.05 to be discussed. He had previously recom- mended the increase be granted. The Director of Public Works prepared a survey and found that the average of 17 cities was $2.47. He now recommended that the increase be from $2.28 to $2.45 and if they want the additional $.05 ser- vice, the rate would be $2.50. The multiple units would be from $1.30 to $1.50. He said MR. This presented a problem because the items had to be stored for a year before it could be dis- posed of. Webster's is now willing, for the extra $.05 per month, to provide this service throughout the year instead of once a year. He recommended that the approval be given to increase the rates from $2.28 to $2.50 for single dwellings and from $1.30 to $1.50 for multiple dwellings which would include the additional pick-up service. Mayor Hamilton asked if they had to call Webster's when they had the larger items or do they just put it out with the regular trash and Mr. Mocatis said they just put it out. City Manager read a list of items they could put out for removal such as water heaters, furnaces, bed springs and mattresses, dressers, stoves, air conditioners, televisions and radios, patio and yard furniture and any other household items. Councilman Waldo asked if they would no longer have the once a year clean-up and City Manager Mocatis said they would no longer need it, but they could stilt encourage people for a dean up of the City. Mayor Hamilton asked Mr. Otting of Webster's Disoosal if they would need any special pick-ups and Mr. Otting said that any of the mentioned items put out for removal would be picked up the same day it was put out. He said he could see no point in having the once-a-year clean-up and they would provide the service throughout the year. He said the cities of LaVerne, San Dimas and El Monte have the complete service and are very happy with it. City Attorney Flandrick said to accommodate the rate increase, it would be necessary to adopt an Urgency Ordinance and then a resolution. M/S/C: GREGORY/KING. 00- City Manager Mocalis said during the budgetary discussions, a review was given of a self insur- ance study for the City. This would mean that the City would carry this program rather than through the State Compensation program. We had received several proposals and the best proposal was from R. L. Kautz, Inc. indicating that for $.23 per $100 of payroll per annum, they would administer this program. He recommended the authorization of the agreement for a five year period. Councilman McCaron asked what the purpose of five years was and City Manager Mocalis said it was for the City's protection. In other words, they wilt not ask for an increase in rates for at least five years. If the City is not satisfied and would want to terminate the agreement, we would have to give notice in writing sixty 60) days prior to July 1 of the year we desire to terminate. RES. AGREEMENT APPROVED City Manager Mocalis said in 1966, the City Council had considered the development of Ramona Boulevard and appraisals were made of the property to be acquired from the railroad. In 1969, an appraisal was made by an independent appraiser and it was determined that the fair market value was $500,000. In 1967 the railroad had agreed to sell the property to the City when it was needed. The agreement provides that for Exhibit A") the property owned by the rail- road, the City would pay $417,365 and for an easement outside of the right-of-way Exhibit B"), the City would pay an additional amount of $82,635 making a total of $500,000. He said the necessary funds have been budgeted. He requested the Council to approve the agree- ment until we know when the railroad wi11 have the dealings with the PUC and ICC completed and will come back for authorization of execu- tion of the agreement. The Planning Commission held public hearings and then decided that the present provisions of the Code were appropriate and that enforcement be continued. He recommended that the City dispose od the southerly 19 feet of the property through nego- tiations with the property owner at 4861 La Rica. The sale would be conditional on the new owner installing a chain link fence along the northerly line of the 19 foot strip to match the existing one on the west. Councilman McCaron asked if the 25 feet included the 6 feet and Mr. Perry said that was correct; they wilt be selling 19 feet. Battaglia and Long copy in official files) regard- ing improvement of Borel Street, North of Olive Street. He gave three alternatives for the Council to consider as a solution to the problem. He recom- mended that the construction costs be shared by the property owners along the west side under an assess- ment district where owners would pay for the usual curb and gutter costs totaling approximately $2,000. No drive approaches could be constructed along the west side without obtaining additional right-of-way). City costs would total $9,500. Councilman McCaron asked if they would have room for sidewalks and Mr. Perry said they would not have sidewalks on the west side and would eliminate park- ing on one side. Councilman McCaron asked if there were any assess- ments pending in that area and Mr. Perry said there was no assessment district there now. Director of Public Works Perry said he recommended that they continue to work with the property owners on the east side so they would exchange the dedica- tions for the curbs and gutters. When the 3 property owners agree, he would come back with an assessment district on the west side for the curbs and gutters, then do the whole street. Councilman McCaron asked if funds were available for this and Mr. Perry said the money would come out of the normal curb and gutter construction fund. Councilman McCaron stated they had been given some progress reports. He would prefer further informa- tion from Mr. Sexton before acting on the Ordinance. If further information can be had to tie this down we could continue, but appears we have to have the Ordinance before there is any further discussion about the actual expenditure and what the developer hopes to put on the property. Mr. James Sexton, Director of Commercial and Indus- trial Development, said they have had discussions with the developer and they are ready to proceed if the City is ready to proceed. On the advise of the attorney, there has to be an authority created, CRA established before we can enter in any firmer agree- ments with the developer. He said they had several conference with the developer in regard to a further commitment. It is customary to negotiate all of the details involved in this type of development. It involves commitments not only by the developer, but by the City and these commitments are translated into a lot of legal documents. Negotiations can be very precise and technical. We do not have a redevelop- ment plan or authority as yet in order to undertake these matters according to State law. The developers know this and the City Attorney knows this and has advised that an agreement would be premature. Mr. Sexton read a tetter from the developer, Mr. Ray Jones, President of E. R. Jones Enterprises, express- ing continued interest in the proposed project. Copy in official files). Mr. Sexton also read an excerpt of the letter from Sheraton Inn to Mr. Jones stating their approval of the site, but that CRA acquisition of the property was necessary before the project could move. Copy in official files). Mr. Sexton said they have gone as far as they can go until an agency is created. He has other letters from Highlander Inns budget motel) and K-Mart Discount Store, both have expressed that they prefer to hold furhter negotiations until Council action is taken. PrU)C 13 Mr. Sexton said that amount was a standard amount which is assumed in negotiations of this type. The amount of the deposit would represent \0% of the purchase price. There is a reluctance to put it up in the absence of a redevelopment plan and feasibility studies to be made and the absence of the technical data that has to be collected. The figure is still an item for negotiation and dependent upon future agreements with the developer, the figure may vary. We aren't interested in keeping a developer's deposit, but rather are interested in getting a development built. Councilman Waldo said his understanding was that we can't go any further in an agreement until they hold second reading on the ordinance and form the agency. City Attorney Ftandrick said that was correct and it would be premature as they had not yet created the agency. Once the agency is created, the agency can proceed to negotiate with the developer, etc. Councilman King asked City Manager Mocatis if he felt secure in the intent of the developer and the project itself. City Manager Mocatis said he had provided a letter dated July 3, 1974 to the Council which outlined the work that Mr. Sexton had done. His understanding was that of what has been explained, that legally they cannot proceed any further than they have. His opinion is that the proposals which have been made are genuine and sincere. We are prohibited legally from accepting agreements, cash, deposits or oral commitments and can go no further until second reading. Councilman King said he would like to state some of his reasons for wanting Community Redevelopment, not just for redevelopment sake, but for this particular project. He has been on the Council for a number of years and a11 he has heard is people calling him and telling him there has been no development, no progress other than the streets look beauti- ful and the taxes are still high. the second highest in Los Angeles County. He said Mr. Carpenter had commended the Staff and he com- mends the Staff who have done a magnificent job with the funds they have in the budget. When you analyze the budget in a three year period, $70,000 in the black", $55,000 in the black" and $20,000 in the black". That is not very wholesome and is a scarry" situa- tion as there isn't much we can do about it with inflation of today. He said he couldn't see that an exploratory venture of this type is going to be detrimental to the City of Baldwin Park for the simple reason 1) we have a project area, 2) there is not a single person in the project area who does not want to se11, and 3) he firmly believes that we need this to pursue this to keep from subsidizing other areas that are already in existence. We are subsidizing all of the CRA's in existence because your taxes are raised to meet the lessening of revenue that was caused by the other CRA agencies. Some Councils don't listen to people and other Councils do listen. Each of us have tried to analyze if we are making the best decision. The question was asked at the last election if the need for CRA was justified and he felt the need was justified. We should take the initiative and take this step. Whatever the State does in the future with respect to legislation, may curtail some of the activities. They don't have any area that will hurt any person; it is clearly defined. Mayor Hamilton said he agreed with Councilman King. The property owners of this area are all in favor and agreement. He said he had received a tetter from 16 adjoining property owners who were in favor of it. He felt this was a chance for Baldwin Park to start a way of development and could open up the four miles of freeway we have. When the Agency is developed, it will be handled in a sound business manner. They have a capable staff to guide them and felt that this was a conservative Council and have even been accused of being penny-pinchers". The City has no bonded indebtedness and we do have an unappropriated surplus. We are in good shape this year, but he was worried about next year. The costs continue to rise, but the revenue doesn't come up with the increase of costs. They don't want to have to cut down on services. We have less employees per capita than any other city in California, yet our services are not too far down. We should be very proud of our people in City Halt and think they have done an excellent job. He agreed with Councilman King that this was a step they must take. Councilman Gregory stated there had been much discussion and many actions taken by individuals since the initiation of the Community Redevelop- ment Agency. He said he had talked to Mrs. Cattahan and she indicated that she would pay the $25 filing fee. Councilman Waldo said since Mrs. Catlahan's pro- blem had become known, he had been contacted by two individuals and a church group offering to pay the $25 and he thought this was commendable. 00- Councilman McCaron requested the Planning Depart- ment to prepare a report of how much revenue is involved, per year, in the different types of filing fees to see how much effect it has on the budget, and what the overall picture is. Councilman King asked if they didn't have such a study about a year ago. City Manager Mocalis said he didn't recall a study being made, but with the new municipal code coming up they would recommend that they collate all of the fees into one resolution, so that a citizen can find out what the City charges for the various fees. He said they could incorporate a study at the time they present the resolution. He said the new Municipal Code will be given to the Council for first reading at the second meeting in July. 00- Mrs. Amos Slater, 4814 Stancroft Street, asked if they hadn't waived the filing fee for a minor variance in the past and the City Attorney said the answer was no", that it was only done in a case of a Zone Change.
