Applicant: Foster & Kteiser Mr. John Gtyn). Proper publications, postings and mailings had been accomplished. There were no-written protests. Planning Director Gordon said Case A-4 was a request to extend the period of time on the removal of 2 billboards located directly across from City Halt. The City ordinance adopted in 1970 made billboards in certain areas nonconforming which included these 2 billboards. The Code allowed 3 years for the removal. The Code requires on appeal, the Council must determine if the 3 year abatement period is reasonable. Council can either deny the appeal or extend the abatement period to what is considered a reasonable period of time. /- Mr. John Glyn, a representative for Foster and Kteiser asked that Counc-11 extend the abatement period for another year or so, mainly because the signs are there and he didn't think they were causing a problem. He thought they were hiding some of the ugliness behind them. He said there had been no improvements around the signs in the last 3 years and if the area would be improved, with the possibility of a new City Hail, they would be glad to take the signs down at that time. JOHN GLYN Mr. Russell Btewett, 14352 Ramona boulevard, said he had a petition signed by 11 merchants on Ramona Boulevard who are in favor of the billboards remaining. He fell in this case the signs possibly could be left to recoup loses or the area develops and then remove at such time as the new City Hall is built. City Attorney Flandrick said to act on this, they should grant a period of an additional one year, subject to the right of the Council to extend for one year for good cause. Councilman Gregory said she did not feel that this request was unreasonable. The time of abatement would come when there is development in the area or when the rear entrances of the buildings that face Ramona are treated with beautification similar to the front entrances and the refuse containers are hidden from view. She was in favor of extending the same courtesy as they had to the Kunz Company. City Attorney Flandrick again explained what the motion would be; to grant a one year extension for abatement and that period could be extended by the Council for good cause. Councilman Waldo said he agreed with this. Councilman McCaron said he didn't know of any reason that they would demand that the signs be taken down any sooner than a year. He did not have any objections to one year, but not any longer than that. City Attorney Flandrick said it had to be'a definite period of time. Councilman McCaron said if a new City Hall was built, then they should have some land- scaping in that area. He agreed to one year. Councilman Gregory said the applicant had been before the Planning Commission and the Council at various times and have been agree- able and if there was a new City Hall, they would probably offer to abate the billboards. He had called the business license office and explained the situation and was told that he would not need a license. He received a letter last month telling him to come in and pay his license fee and was penalized from last July. He didn't mind paying the license fees, but didn't think he should be penalized when he was told he didn't have to have a license. Mayor Hamilton asked what type of business he was in. Mr. Morris said he works on refrigerators and electronic ovens for the Amana Corporation. He has a telephone in his home and when he receives a call from them, he goes out and does the repairs. Finance Director Duncan said she had talked with Mr. Morris and she was concerned about the fact that someone told him he did not need a business license. He is a self-employed person and was in business as of July, 1973. She said they have the State Board of Equali- zation records to support that and they have no recourse other than to charge him for a business license. The question he has before the Council is the penalty charge of 50% after being in business one month without a business license. She questioned whether Council could waive penalties. City Attorney Ftandrick said the Council did not have the right to waive the penalty accord- ing the the Code. He said they could amend the Code and eliminate the penalty requirement. Councilman McCaron asked what the amount of the penalty was and Mrs. Duncan said it was $8.75 for 1973 and $17.50 for 1974. Mr. Morris did not obtain his license prior to February 1, 1974. Mayor Hamilton said he was sorry, but they could not help him even if they desired to do so under the present Code; no way to waive the penalty. i Councilman McCaron said they need something as you can't have a hard and fast rule to cover every situation. Code should specify that the Council can alleviate some of the items that might arise. Councilman Waldo said it was too bad that Mr. Morris didn't have the person put it into writing. CLAIM MARGARET DAWSON CLAIM DENIED 00- City Manager Mocalis said Arthur Young and Associates, Consultants, had prepared Phase I and Phase II of the EVIS Program. They did bid competitively against other consultants for Phase I and II. Phase III is the comple- tion of the EVIS Program. He said Chief of Police Adams had recommended that Council consider Arthur Young as the only practical source to complete Phase III since they had done Phase I and II. The amount of $30,000 for this contract would be paid for out of Grant funds. Councilman King asked how critical the time period was with respect to this going to competitive bidding and also couldn't the requisition for this be drawn up pretty tight. City Manager Mocatis said it had been their experience that it takes approximately 2 months for the competitive bidding process and we are under a time schedule from the State and Federal governments to complete the EVIS Project. The proposal is a complex study. The EVIS Program is an innovative police package for the East Valley Informa- tion Service and makes use of computer know- ledge and hardware to take into account the more serious felonies which occur and to effect a region-wide approach to law enforce- ment. The 2 years with Arthur Young have been very satisfactory. Councilman King said he was concerned as he didn't like to get away from the competitive bidding aspect. He asked how critical the project security was. Aldrich said when they deal with these firms, they have to conduct a background investigation before they can put them on a project. The same request has been for- warded to the agency in Los Angeles who makes the final decision whether we can go sole source. Councilman King asked it the people in the other agencies were bonded in these areas o+ security and Lt. Aldrich they were not only bonded, but an extensive investigation is made, not only by our agency but by the Federal agency as well. Councilman Gregory said she was concerned about the bidding process. When there is competitive bidding and an established pro- posal, the Council has something to follow through on and are aware of the complete package. She knows that time does have a way of escaping, but sue felt there should be a better hold on the time so that the proper procedure can be followed more closely. City Manager Mocalis said the sole source bidding is not a requirement of our City Code, but is a requirement of the LEAA and CCJ. This is a 3 year project and is funded 12 months at a time and if we had the assurance of total funding for 3 +u11 years, they would have recommended the selection of the consultant for the full 3 years. Normally, you do not have a bidding process in hiring consultants, but look at the qualifications of the firm and determine which one best suits the needs. Councilman King stated that he liked the competitive bidding when possible, but realized in this case it was almost impos- sible. City Manager Mocalis said they could ask for proposals from other consultants if the Council so desired. Councilman Waldo asked if he was correct in his thinking that Arthur Young was familiar with the procedure and if another firm was to become involved, that would have to familiarize themselves with what we already have before they could get into Phase III. Lt. Aldrich said that was correct as Arthur Young did the conception design the first year, the detailed design and implementation the second year, and now they are to revise and expand what was done initially. He said it takes between 30 and 60 days to write an RFP where they would have to detail everything they have done to this point and when the proposals are received would have to review them and then present them to Council. Aldrich said it would be at least January 1, 1975; they would lose 5 months. Councilman King said since Arthur Young is already familiar with the program, he did not have any objection to them continuing. Lt. Atdrich said he wanted to make it clear to Council that this is only the first level of approval, have to go through the regional level, the State has to approve it and the Federal also has to approve it as they have the final say regarding Federal funds. San Antonio College which is identical to agreements in previous years. He recommended that the City Manager be auth- orized to execute the agreement. WORK STUDY AGREEMENT WITH MT. WORK STUDY AGREEMENT APPROVED City Manager Mocatis said he had learned of the availability of funds through the State Bond Act. The Recreation and Parks Commission had received proposals from consultants to do a master plan study for the area of the North side of Walnut Creek from Baldwin Park Boulevard to the Westerly City Limits, the Ledford School site and the DWP power right-of-way. The Commission has recommended that the City retain the firm of Lawrence R. Moss & Associates to provide this recreation plan tor a fee not to exceed $9,000. They recommended this amount be taken from the unappropriated surplus of the Recreation and Parks. He stated he was concerned about the continuing costs, the number of employees it may entail, the cost of supplies for the various facilities and the maintenance costs. He recommended if Council wants to proceed, they authorize Mr. Lucas, the City Attorney and Mr. Mocalis to explore amending the agree- ment to include the costs that would be of an on-going nature. Mayor Hamilton asked Recreation and Parks Direc- tor Lee Lucas to explain the concept of this application. Mr. Lucas said the proposed nature area extends from Baldwin Park Boulevard West to the East side of the San Gabriel River which includes the Delta Nature area at the inter- section of Walnut Creek in San Gabriel River, known as the Soft Bottom Creek'^ a part of the Flood Control District that has not been cemen- ted in. He said they would propose some type of off-road vehicle accommodations. Equestrian and hiking trails. They also could have con- cessions which would be revenue-producing; stables where horses are rented, mini-bike rentals and repairs. The future school site could be used for nature study. There could also be picnic tables, etc. This is one of the areas to provide recreation opportunities without going into high cost land acquisition. Mr. Lucas said in order to be eligible for the 1974-75 money, they would have to submit an application by September 15, 1974. They would have to have Council's approval of the Master Plan as they have to submit an EIR Report, plans of the general area before the State wilt indicate if the money $147,000) would be available to us. Mayor Hamilton said what they needed now was approval of the $9,000 for the Master Plan. Councilman Gregory asked if the Master Plan includes a11 of the pitfalls" that may arise and wi11 it show the way to stay on top of it financially. Mr. Lucas said they had indicated that they wanted to be made aware and kept up-to-date on the various funds that are available and ask for a projected maintenance cost and if it is feasible. Councilman Gregory said this would be a sort of pay as you go" kind of thing so they could be self-supporting. Councilman Gregory asked if any of this property was County-owned and Mr. Lucas said the majority of the land is County Flood Control; the Ledford School site is not part o+ the County Flood Con- trol. He said they had approximately 70 acres of open space. Councilman Gregory said they had annexed the freeway and wondered if it would be possible to annex that area and include the Flood Control land. City Attorney Flandrick said yes it would be, but they would have the right to protest. Councilman Gregory said if they pass on the agreement, then she would suggest that the Annexation Committee be called into action to research this. Mr. Lucas said the Master Plan would be the key" to annexation of that area because they have to show people what they intend to do. Councilman Waldo asked if there was access to this property from the 605 Freeway and Mr. Lucas said not from the freeway, but there is access from the residential area. Councilman McCaron suggested they move on the $9,000 agreement for the Master Plan and they could decide later if they wilt pursue it fur- ther. LAWRENCE R. MOSS & ASSOCIATES, INC. M/S/C: MC CARON/ WALDO. 00- City Manager Mocalis said the National League of Cities with the support of the League of California Cities is suing the Federal Gov- ernment over the Fair Labor Standards Act. Each city has been asked to contribute $200 to help pay the court costs involved. City Attorney Flandrick said the legislation was adopted by Congress and cited in the body of it was that it applied to local govern- mental agencies based on those being engaged in interstate commerce. The position of the National League of Cities is that is an incor- rect conclusion and based on erroneous facts that local governmental agencies would not be engaged in interstate commerce; therefore using commerce clauses. They now seek to expand it to local governmental agencies in all states. Councilman Gregory said she thought the $200 would be worthwhiIe. M/S/C: KING/GREGORY. $200 FEE TO NAT'L LEAGUE OF CITIES APPROVED 00- City Manager Mocalis said in December, 1969, the City entered in an agreement with Maurice Fleishman & Associates to produce schematics, working drawings and specifications for the proposed City Hall and Police Facility. The Council previously had determined that they wished to have the public services building located on the present site and we would occupy the present building until the new building was completed. Funds were not avail- able in 1969, but Council did act to set aside money from the revenue sharing. The architect has prepared a schematic plan and before they can go any further, the schematic plan must receive Council approval. He said Mr. Grimsgaard, architect, was present with the schematics for Council's review. Mr. Mocalis said he would first like to detail the action that Council should take if they decide to proceed: 1) The Architect has not received any pay for the past 5 years because the contract pro- vided that they must have approval of the schematic plan first, and 2) accept the preliminary construction budget estimate. He asked Mr. Grimsgaard to explain the neces- sity of providing a model of the proposed building as it is a complex one. The last item would be to authorize the necessary seismic investigations and boring samples of the soil on the site. Mayor Hamilton asked Mr. Grimsgaard to give the schematic presentation to the audience. They could have functional buildings such as steel and not have to design a special building. In the future, they could change the type of buildings. Councilman Gregory said she was concerned about the Public Works Yard, how the people have worked hard and have been treated as step children" as they have worked with a minimum of comforts and are really dedicated to the City of Baldwin Park. She felt some consideration should be given to them before they move on a motion. Mayor Hamilton said they certainly would con- sider this, but they also have to think of the expense. He said they should instruct the Staff to try and find the proper location, then they will get the buildings they need. Councilman Waldo asked if the City didn't own some property now that could be used and City Manager Mocalis said what they own is too small for this purpose. He said they will need a minimum of 3 acres. Councilman McCaron said there were two different items and he felt they should approve the pro- posed building design and have the Staff proceed to look for a location for the City Yard. Council concurred. City Attorney Flandrick clarified the motion: THE SCHEMATIC PLAN FOR THE PUBLIC SERVICE BUILDING APPROVED AS SUBMITTED; THE PRELIMINARY CONSTRUCTION BUDGET IN THE AMOUNT OF 2.6 MILLION DOLLARS AS RECOM- MENDED BY THE ARCHITECT APPROVED; THE MODEL AS PRO- POSED BY THE CITY MANAGER AUTHORIZED IN THE EXPENDI- TURE OF $4,125.00; SOILS TEST AS RECOWENDED BY THE ARCHITECT FOR AN APPROXIMATE COST OF $12,000 APPROVED, ARCHITECT'S PAYMENT AUTHORIZED. City Attorney Flandrick said the preliminary con- struction budget as is now approved, if the build- ing is constructed within a reasonable period of time, the project figure would hold. If the con- struction should be at some point in the future, obviously there wi11 be additional increases in cost based on labor and materials and that project construction budget costs will be increased corn" menserate with whatever the increases are. The architect is obligated to redesign that building if bids come in excess of 5% of his project con- struction budget estimate. He said they would probably complete the next phase within 45 days and would complete the working drawings by the end of October; every- thing would be completed before the November election. City Attorney Flandrick said the architect's estimate wi11 stand through the first of Nov- ember and Mr. Grimsgaard said it was today's estimate and they can't guess what it will be in November. Councilman McCaron suggested that the City Manager contact the firm of Stone & Youngberg to give us financial advice on the require- ments for a bond issue. M/S/C: GREGORY/KING. 00- City Manager Mocalis said the Council had previously authorized Councitmen King and Waldo to visit Vatle de Bravo, Mexico to investigate the possibility to establish a Sister City" relationship. They dis- covered there is a national association called Town Affiliation Association of United States, Inc". They have the res- ponsibility of developing sister city relationships. There is an annual dues assessment of $150 and they have requested that proper papers be sent to us. In the interim they wilt study the costs of other cities and what is involved. Councilman King requested that they make this study. Council concurred. Councilman Waldo said he had taken some pictures white visiting Va11e de Bravo and presented slides to the audience. 00- RES. It will be a concrete structure. He said the actual cost for this building would be $2,611,109.00 at this time, but could not say how long this amount would be as labor and materials are rising constantly. Mayor Hamilton said the proposed new City Halt wilt be in back of the present one and we will stilt occupy the present building during the construction of the new one, which will be a cost savings to us. He said the City Yard would be moved and we are now looking for a new location for that function. Councilman Waldo asked if the outside structure would have Spanish arches and Mr. Grimsgaard said there would be no arches, but it would be a warm-type building. Mayor Hamilton said the building had been designed so that there would be a minimum of maintenance cost. Councilman McCaron said this was the second configuration and they had cut down the square footage about one-half of what the first con- figuration was. This is a more compact build- ing, is functional and will take care of our future needs. Mr. Grimsgaard said they were paying very much attention to energy conservation and are making a study of solar energy to see if it could be used. City Manager Mocalis said the motion should be that Council approve the schematic plans as pro- vided in the agreement and establish a preliminary budget in the approximate amount of 2.6 million dollars, subject to increase costs that may come about in the interim for labor and construction and authorize the architect to go to Phase III of the building which is covered in the agreement and that is the design development phase calling for 35°^ of the basic fee. Councilman Gregory asked if this included the cost of moving the City Yard and Mr. Mocalis said it did not. City Manager Mocalis said the Director of Public Works has surveyed the City for a possible site and has found one piece of land just under $100, 000; the original estimate of developing the appropriation yard was in the area of $600,000. He said this would be a good time for Council to authorize them to actively seek a location and to work with the architect. This would be a separate agreement.
