The invocation was given by Rev. Paul Malone, Ascension Lutheran Church. Councilman King questioned the expenditures under Account 43 EVIS) and said it was a total of $1,844.00 which would be coming out of the General Fund. He asked if the City would be reimbursed for any of this amount. City Manager Mocalis said any item under 43 would be paid out of the EVIS funds and not out of the General Fund. Councilman Waldo asked for an explanation for Warrant No. 00379 expenditures, Finance Director Duncan explained that this amount covered the material purchased from a sign company which were blank so that the City could make their own signs such as street signs, stop signs, etc. Councilman Waldo asked if the $200 Warrant No. 412) was for the lawsuit of the League of California Cities City Manager Mocalis explained that all of the cities had been asked to donate $200 toward the lawsuit which concerns the provisions of the Fair Labor Stan- dard Act as to overtime conditions and they hope to attempt to show that cities are not engaged in inter- state commerce. This program meets with the State mandate to make alt zoning consistent with the General Plan. He submitted maps and photo- graphs for the Council's review. He said the present zoning was C-1 and has been since 1948. The Planning Commission recommended the rezon- ing from C-1, a Commercial Zone to R-3 which is a Multi-family Zone and this will make the area consistent with the General Plan. As there was no testimony, Mayor Hamilton declared the public hearing closed. Councilman McCaron asked if any of these pro- perties were involved in an extension of time for rezoning and Mr. Gordon said they were not. She read the last paragraph of the item and she asked where the information came from; was the $229J)00 in bank deposits to the Agency or to the City and how this project would put $710 a year personal income back into her family. The question 1s what Baldwin Park stands to lose 1f we lose this project. Councilman Waldo asked Mr. Sexton to give an explanation of these figures and how they had arrived at the amounts. Mr. James Sexton, Director of Commercial and Industrial Development, stated that the figures given to the newspapers by Mayor Hamilton were based on a report com- piled by the U. S. Chamber of Commerce. This was termined by approximately 100 new jobs the number of people coming Into the area because of the new develop- ment. Mrs. Slater asked that this explanation be printed in the newspapers and Mayor Hamilton said he couldn't promise this as he has no control over what goes into the papers, but the figures were from a reliable source. 00- Mr. Michael Dargus, 13260 Francisqulto, read a letter from Business Properties, Incorporated regarding CRA In Baldwin Park copy in official files). He said right after the election, they put the CRA in. Before the election, the CRA Committee was reactivated from 15 to 25 members. At the first meeting of the reactivated CRA Committee, the first motion was to vote for CRA as 11 are for It". He stated that there were conflicting statements made by Mayor Hamilton after the ordinance was passed, such as the revenue In the City. The only thing the City would realize from the development would be the sales tax and bed tax. The best we could hope for would be $20,000 in sates tax and we will spend this much in extra services for the area. He said the cost to the public would be from Ih to 2 million dollars. We won't realize any revenue for at least 20 years. Mr. Dargus asked City Attorney Flandrick if the CRA ordinance gave the Council absolute power to the maximum of 47 years. City Attorney Flandrick said it did not. When the ordinance goes into effect, you have created a CRA and can operate with accordance to the State law. Mr. Dargus stated the ordinance cannot be rescinded until the bonds are paid for; that future Councils could apply CRA anywhere in the City and that the people should be aware of the costs. He said they lost the development on Mr. Litttejohn's property and didn't want the same thing to happen again. 00- Mr. James Garrow, 1011 Baldwin Park Boulevard, said the fighting among themselves would get them no where. He said the CRA would put the whole picture together and then hand it to the developer. This is done alt over the State of California. He had been to the La Puente Hills Mail where they will have 368 stores and a mil- lion dollars in sales and property taxes, we need a development along the freeway and Baldwin Park will never have progress if the fighting continues. 00- Mr. Jay Angelo, 3123 Baldwin Park Boulevard, has been a realtor in Baldwin Park for 16 years. He said for 15 years he had tried to get private enterprise in the City. He said if any of the individuals who petitioned the citizens, could come up with a formula to bring private enter- prise in tike the project they had anticipated, he would give $1,000 to their favorite charity. He asked the people to get behind the progress for Baldwin Park. 00- Mrs. Gloria Zook, 4817 N. La Rica Avenue, said she did not have any part in the referendum petition, but wanted to know if the project was dead and why the developers are so insecure. She said she wants the project and if this had gone to a vote a few months ago, there would be no problem. She said she had been disappointed with the City Council. Mayor Hamilton said he had made the statement that they could very we11 lose the developer and his reason for that was other developers had left because of having to wait around for decisions. He did not object to it going to a vote of the people, but felt the months it would take would be detrimental. He said that the Council was trying to do the job they were hired to do and to improve Baldwin Park. The only way they can get a tax base to give the people the services they are entitled to is to get industry into the City. 00- MR. JAMES GARROW MR. JAY ANGELO MRS. E. Carpenter, 4346 Jerry Avenue, said the people who were opposed to CRA did not receive any coverage in the newspapers. The people of Baldwin Park don't like what you did as he had talked to over 1,000 people. There have been mis-statements in the paper and at the Council meetings. One statement said we have four miles of freeway. This is a message of what is in mind with CRA. This was mentioned in the paper on July 29, 1974. There are empty stores in our City and it is a blighted" City. He requested that they print exactly how the taxes operate, be fair and show alt of the sides of the issue. He speaks for the people who do not want their homes condemned and under eminent domain. They don't want their taxes going into CRA. There will be more comments from these people if Council continues the acts they are doing and he would hold Council accountable even to the point of removal if necessary. Mayor Hamilton said his statement in the paper was that this could very well be the beginning of development on the four miles of freeway in Baldwin Park. 00- Mr. Jack Loether, Publisher of the Treasure Chest Newspaper, congratulated the Council on their votes for CRA on two occasions. The opposition is also congratulated any time that they feet they are working for something that is the best for Baldwin Park. He said his newspapers are open to both sides. He had personally looked into CRA with a nega- tive took and came out with a positive view. He said he had tried many times to contact Mr. Carpenter and received no answer to his phone calls. He felt that most of the people In Baldwin Park are for progress. 00- Councitman King said the reason he did not want CRA in the beginning was because they did not have a defined area and there might be some people uprooted and he didn't believe in that. In this area they didn't have that problem. We are now subsidizing other CRA developments that are all around us. He said he was told by Mr. Sexton that it would be no longer than 11 years pay-off on the bonds. Not one person would be uprooted and they all wanted to sell and we can give them a tax break. When the revenue comes in from the reassessed evaluation, the County, the schools and the City get their percentage. Continued) MR. T. E. CARPENTER MR. RES. NO. 74-79 APPOINT MEMBER OF PERSONNEL BOARD ROBERT HONKEN) Mrs. Balkus said this Employee Association appointee was Mr. Robert G. Honken and his term would expire on April 1, 1976. NO. 74-79 ADOPTED 00- City Attorney Ftandrick said they had thought they would have an offer of settlement from Federal National Mortgage Company and they do not and asked this to be taken off the Agenda and brought back when they get an offer. There were no objections. 00- FEDERAL NATIONAL MORTGAGE TO BE HEARD AT LATER DATE City Manager Mocalis announced that the previous Fire Chief, Ron King, had been reassigned to another area and he had played an important part in the City family and he would be missed. He welcomed Fire Chief Roy Swank to the meeting. 00- City Manager Mocalis said the EVIS Program was divided into three phases and Arthur Young had bid competitively on Phase I and Phase II and was awarded Phase III. Now the State has said it would allow an extension of the 73-74 grant for 90 days to complete additional work in the amount of $9,000. The Police Department has indicated the firm of Arthur Young because they have completed the first two phases and would be the practical organization to com- plete this add-on work and he concurred that Arthur Young be declared the Sole Source pursuant to Section 2914(b) of the Municipal Code. He understood this would be expended from the General Fund. City Manager Mocalls said these were Grant Funds which were unexpended during the 1973-74 year and the State had Indicated 1t would allow us 90 more days to complete the uncompleted portion and have made the $9,000 available to us and Is not General Fund money. Councilman King said he would change his vote to yes". 00- City Manager Mocalls said during the 1974-75 budget hearings, a portion of our System 3 equipment was approved for sale and to pur- chase new equipment. This surplus equipment consists of a Central Processing Unit, a Console Typewriter and a Printer. He recom- mended that Council declare this equipment as surplus and to authorize the City Manager to accept bids and sell the equipment to the highest bidder. IBM EQUIPMENT DECLARED AS SURPLUS AND CITY MANAGER AUTHORIZED TO ACCEPT BIDS FOR SALE. M/S/C: KING/GREGORY. 00- City Manager Mocalls said the Chamber of Com- merce Agreement was Identical with the previous year's Agreement and the necessary funds for this agreement had been provided for 1n the approved 1974-75 budget. He recommended that the Mayor and City Clerk be authorized to exe- cute the subject Agreement. CHAMBER OF COMMERCE AGREEMENT APPROVED AND MAYOR AND CITY CLERK AUTHORIZED TO EXECUTE THE AGREEMENT EFFECTIVE FROM JULY 1, 1974 THROUGH JUNE 30, 1975. M/S/C: WALDO/KING. 00- City Manager Mocalls said at the June 5, 1974 Council Meeting, Council had asked that action be deferred on the Yellow Cab Company's request for rate Increases. This was to allow time to study the possibility of obtaining a discount In behalf of the Senior Citizens. The Yellow Cab Company made a pre$entation to the Senior Citizens on June 28. 1974 suggesting either Dial-a-Rlde or Share-a-Ride. Both of these would require extensive expenditures on the part of the City. City Manager Mocalls said he could not recommend that either of the plans to be implemented at this time. This increase would amount to approxi- mately 16( per mile. Councilman Waldo asked if the Cab Company would give the Senior Citizens any kind of a discount. City Manager Mocalis said he had talked to the representative of the Yellow Cab Company and they said it was not possible for them to extend a special rate at this time. Councilman Waldo said he was a little concerned that the Cab Company would not give a discount to Senior Citizens and yet they had suggested that the City subsidize their fares. Councilman Gregory said the Yellow Cab Company is getting into the Jitney bus business. Per- haps this could be researched for Baldwin Park as they are doing it in the County 6f Los Angeles. Councilman Waldo asked if they could pass the rate increase for a certain amount of months so in the meantime they could be talking to them about some other service. City Attorney Flandrick said they were fulfilling a rate-making function and whether they wished to grant a discount or free ride or some other system is unrelated to rates as such. If Council wished, they could cause a subsidy to be granted for the Senior Citizens for transportation, but not as far as the rates are concerned. Mayor Hamilton said the only relief the Senior Citizens would get, we would have to pay it as no transportation firm would give us a discount. The County wi11 maintain and provide the electrical energy for this equipment and the City and the County will split the cost. Councilman McCaron said in order to accom- plish some of the things regarding CRA, it would appear they would need to go the City Charter route. The City Charter allows the people to vote on any change on City Ordi- nances and under General Law, ordinances can be rescinded by a vote of the Council. In order to tie it down, it would be neces- sary for items placed in a City Charter that if any changes were to be made, the public would vote on the changes. He said the biggest objection to CRA seemed to be that the Council can condemn a home for redevelopment. The CRA law by the State is fairly complete. Along with this idea, It would also require a petition to the State to allow a Charter City to add a procedure for handling CRA within their Charter. That would be a proper solici- tation of the State. Some thought should be given to projects coming under CRA, the only property to be considered would be that which is not involved in R-1 Zones. If R-1 property was involved, it would have to be with the consent of the property owners If there was just one property owner who was not in favor of the project, then it would take a vote of the City to determine if the objections should be overruled. The people in these projects should govern and the City should not be able to override their wishes. He said this would apply to home owners living in their homes and not to rentals. Councilman McCaron said this would have to be set up as a Special Election as he didn't think all of this could be accomplished in a General Election in November. Continued) RES. He felt that the main objection at that time was the fact that taxes could be raised by the City Council. This item should also be by the vote of the people. Raising of taxes would only be for services to the people and they would be willing to pay for it if it became necessary for the increase to come from property taxes itself. If there are other sources of income that would take care of the wishes of the people, then there would not be a need for increase in property tax. If the people didn't want the services, they could reject it. He didn't know of any other objec- tions to the City Charter. Councilman McCaron said whatever objections there are to CRA, they should be settled so that everyone is satisfied and the items taken care of. He thought the only hard thing to overcome would be the objection that the taxes developed by a development would be incumbent for a period of years to pay off the develop- ment itself and whatever would be necessary to put the project through. He said a safety factor should be set up that no project should be considered 1f it took over a specified num- ber of years for repayment. If it wasn't of sufficient value to be paid back in a reason- able length of time, then the project should not be considered. The assessed valuation would have to increase a certain number of times before it could be considered. City Attorney Flandrick said that any redevelop- ment law Is applicable to Charter cities as well as General Law cities. What Mr. McCaron is referring to is requesting an amendment be made to the Community Redevelopment Law that would allow a Charter City to establish its own pro- cedural ordinance relating to the conduct of affairs of a CRA and thereafter if such a law was adopted, a Charter City and if Baldwin Park became a Charter City and taking part in it, would be to establish a procedure that would require a vote of the people in the area pro- posed for redevelopment if the area was classi- fied Zone R"1. If a certain percentage objected, the area could not be made the subject of a redevelopment plan. Councilman McCaron said in other words, he did not feel that the rest of the citizens of the City should have the right to overstep the rights of a few individuals if they don't want a development in their area. If there were any under ten, it would be up to the City to vote on it and over ten, that would be the determining factor and stbp any further pro- cess. He said they had tried for a Charter City and it was defeated about 4 to 1. He doubted if they could win an election for a Charter City. Another thing is that there should be some amendments on the present CRA law. He said he opposed the Bill that Assemblyman Montoya had intro- duced as some of the items would have killed community redevelopment entirely. He said he talked to his field man and told him he would support very strongly a CRA project and the people involved within the project. The property owners have a right to vote if they want it or did not want it. If you set up a project, the people should have the right to decide on it. Under the present condi- tions, the people seem to be pulling apart and he could see no way to get the people to work together. It is a case of waiting and see if they want it left a bedroom community" and don't want development, we will have to put up with it. Councilman McCaron said he felt that if all the objections were brought out and it was still a problem to solve it, then they should drop it and not pursue it any further. He said the City Charter had been treated too lightly in the past and the people were not told the benefits they would have with a City Charter. City Charters can limit the powers of a City Council and would con- tain procedures for operation. He said one of the basic things that creates the biggest turmoil is the threatening of a person's home. Councilman King said the points Councilman McCaron made about the City Charter were good. It was a poorly-written Charter and that is what basically defeated it. People had commented to him that they would not have been opposed if it had been drafted differently. As far as CRA was concerned, they had felt the area was good and merited consideration and action when they gave it. People were afraid and stilt are of the Council being the Agency for CRA or worse, the citizens being the Agency and being uncontrollable. If, perhaps they had taken more time with the Charter, it would have passed and the same with CRA, more time spent might have seen it passed. We seem to have a split community. He agreed with Councilman McCaron that safeguards must be provided or the people will be divided. We will have less services each year, unfit we get together and solve the problems and make certain that alt committee members are equal and not one-sided. If it takes one to two years to draft it, make sure the people are satisfied. Councilman McCaron said he would like to form a committee by the next meeting or reactivate the Charter Committee or per- haps a combination of both. He said they would also have to have the City Hall Bonds on the Ballot and they would need support for that. He said they have saved some money toward the new City Halt so that the people would only have to be asked for a minimum amount. The size of the new City Hall has been cut in half. The present City Hall is old and close to the condemna- tion stage and had a short-out which blew a switch-box recently and this is dangerous. If we should have a fire and the building burned down, the disruption would be more costly than the new housing of a City Hall. He would like to hear from the people if they have any suggestions or solutions to the problems. Councilman Waldo said going into the City Charter is a whole new ball game". We are talking about months and perhaps a year and a half to get it going right. In the mean- time we are losing everything we set out to do. Since we have lost our advantage and possibly the project, now it will go to a vote of the people and let them decide if they want it. If they don't want it, it will be on their heads". We had a 5 0 vote to make this thing go and he has no doubts that the people will vote in favor of it. The sad part of it is that we have probably lost the present developer. He said he would hate to be one of the few people who were the cause of the people of the community losing hundreds of dollars. Mayor Hamilton said they had two alternatives; rescind the ordinance or go to a vote of the people. He said it is discouraging when you work so hard to get something. They lost the Charter and he thought it would be the best thing for Baldwin Park and he had spent many months studying it. They put in almost three years studying CRA. He felt it was the only way they would get anything for Baldwin Park as we need better services and more of them. It could have meant millions of dol- lars in Baldwin Park. There is plenty of land that does not contain residents that is available. It takes a little steam" out of us when we are constantly batted down". From a11 indications they would be short and have to either raise taxes or cut services. He said they would like to improve recreations such as a boy's club and community center and they can't be done without money. The only way Baldwin Park will move is for the citizens to work together and if we don't, we are fighting a losing battle. Mr. Michael Dargus, 13260 Francisquito, said that the CRA law is the same under a General Law or Charter City and Mr. McCaron wants to go for a Charter City. The Charter City would have won if they had left out the paragraph and other taxes". Under the Charter City law, Council has the right to levy any type of a fax as long as it doesn't interfere with the State Tax. That Charter was a very poorly-written Charter. If CRA had been pro- perly presented, and explain to the people that they aren't going to get anything for nothing, they would go for it. In order to get anything, it will cost them and over a long period of time you will get it back. The People for Progress" are the worst offenders as they are applying Madison Avenue" tactics. Once CRA is on the books, 1t is for 47 years and the Council can desig- nate any area they want. Be honest with the people and give them the facts. Mayor Hamilton said he would like to clarify one item. There would be some expenditures, but when the Bonds are sold all of the money that the City has invested will come back from that project with interest. For an example if the land cost 3h million dollars and the developer said he would only pay 3 million dollars. Then it is determined if it is a good deal and that money comes back in the form of taxes 100 fold over a period of years. It would have to be a sound busi- ness deal or they wouldn't consider it for less money. If you can get a 24 million dollar development that will bring h million dollars a year to the City, how long would it take to get that money back and when the bonds are paid off, then all of the taxes go back to the County and to the schools. Our School District did not oppose CRA. We have tried very hard to present the facts and the people still don't understand it or they don't believe what we are saying. He said he had only made statements from docu- mented facts by people who are well versed in CRA and from other cities who are engaged in CRA. Continued) MR. Mr. James Sexton said the reference to the 1^s million dollars being a public cost can readily be explained. If you create a CRA, it is a public agency and as a public agency, it wilt incur the costs as an agent of its principal, the City. Those costs will be paid out of the project, not out of the City or the taxpayers in any other part of the City; only the taxpayers who are now the owners of the property where a hotel or K-Mart or whatever development is on it. They pay the new taxes to pay off the debt incurred by the Agency to undertake and make this successful. There is no City obligation in any way. When the report says that, it is what it means. There are no distortions, no lies, but the facts. Councilman Waldo said there had been some statements that if the development went in and was not successful, that the City tax- payers would have to pick up the tab". He asked that Mr. Sexton explain it. Mr. James Sexton stated that in case the development failed, for instance a hotel is built and goes bankrupt and not able to pay the taxes that are due, the risk for the payment for the debt owed is on the Bond- buyer and not the taxpayers of Baldwin Park. If there is a home that is lost for default of payment, is that risk his fellow tax- payers in the neighborhood, no. The risk is on the one who made the loan. The same principle applies to the CRA project. Mrs. Gloria Zook, 4817 La Rica Avenue, com- mended Councilman McCaron for at least try- ing to work something out. She said we do have a City divided. Her opposition to CRA was one point. Mayor Hamilton mentioned Assemblyman Montoya's Assembly Bill 4157. She went to the hearings because that Bill was important as alt of the objections to CRA rested with the paragraph dealing with the fact that referendum could be possible on each project area. There might be a bad project some day. A letter was sent to the committee from the City of Baldwin Park stating opposition to every portion of the Assembly Bill 4157. She would have liked to see the City of Baldwin Park send a letter stating they wanted the safeguards that Mr. Montoya wants for the people of Baldwin Park and the State of California and the referen- dum part put back in the Bill. The only safeguard the people have to the CRA is a referendum. Continued) MRS. That would be some safeguard. Mr. T. E. Carpenter, 4346 Jerry Avenue, said that was a good idea for people who are stuck with CRA and it is their last chance; they have no other chance to vote. This last referendum petition was not easy. He couldn't see that it would be any easier with Montoya's bill, but good luck to them. He has studied the law and if you want to change the law so you can have 11 property owners vote, this is unique. This can't be done. Mayor Hamilton said it can't be done because the law doesn't say so. He had spoken of a Bill that each property owner within a project area should have the right to vote a referendum whether or not they want it. They are the only ones who are affected. If the majority wants it, then it will go. Mr. Carpenter said the registered voters are the ones who decide issues like this. He read a quotation from the newspaper by City Attorney Flandrick; City Attorney Robert Flandrick advises that it would be unlawful to adopt an alternative ordinance specifying a 19 acre tract to be developed. If the referendum vote loses» the present redevelopment ordi- nance could be rescinded once that tract of development is done". Mr. Carpenter said he didn't find this in the law book. City Attorney Flandrick said he wasn't sure what the question was and he didn't write the article and it was totally inaccurate. Councilman McCaron said some of the remarks are completely out of line. If we can't get together, then the whole thing should be dropped. Mr. Ralph Middleton. 13122 E. Corak Street, said if there were some amendments made, there would be no doubt that a Charter City would pass. He suggested that they incor- porate councilmatic districts within the Charter City. This would mean that a mem- ber of Council would run within the district where he lives; only the voters of that dis- trict would vote for him. Mr. Middteton said one other item was that according to the new budget, there was no increase shown for police patrolmen. We are stilt short six patrolmen. Mayor Hamilton said they would like to add two more patrol cars, but it is expensive. If the citizens want to demand it and are willing to pay more taxes, the City taxes can be raised to the limit. We do need more revenue in the City. Councilman King asked how many patrolmen we are short. City Manager Mocalis said the police study showed that based on comparative figures of other cities, we are short about 10 patrolmen. Mr. Middleton said he was opposed to the Charter City before because of paragraphs that he didn't agree with. If we are going to float a 2 million dollar bond, why not float a 3 million dollar bond to cover the cost of the extra policemen. Mayor Hamilton stated that to bring our police force up by 10 more patrolmen, it would take approximately $200.000 per year. If we had an additional million dollars, it would not take long to use that up. If we did have a Charter City, this possibly would be a way to raise the revenue to take care of this cost. It has to come from taxes. We have to determine how to pay the bill without enough revenue. Mr. Middleton said with adjustments to the Charter City, it would give the opportunity to raise the taxes. We do not have the pro- tection we need and if it is clearly stated in the Charter exactly what the taxes are for, the people would not oppose it. Mayor Hamilton said that our Charter had been copied from the Temple City Charter and we lost on our Charter, but Temple City won which shows the difference in people. When you talk about raising the taxes, you have to be very careful. Mr. Middleton said we are talking about a new City Halt and we can't have the number of police patrolmen that we need. He felt the Council was neglecting their duty in not having enough policemen. Councilman Waldo stated that if a young man was considering police work, Baldwin Park would not be one of interest because of the facil- ity. He felt this could be incorporated in the amendments for a Charter City and he thought the people would pass it. He didn't feel that the people of the City were divided; the only division has been by the news media. City Manager Mocalis said these units have the base plates that fit the bottom of an IBM electric typewriter and they can remove the recording device from one typewriter to another. The IBM and Auto-Typist can not use either the SAVIN base plate or the control unit. Several sec- retaries have been trained in the use of the SAVIN; they can be moved from department to department. Councilman King said he liked the concept of competitive bidding when possible. He asked if they couldn't write the specifications in the proposals. City Manager Mocatis said this could be done and follow the bidding procedure and after the advertising, only one company would be able to supply the unit. That is why when there is only one apparent source that can meet the requirements of the City, they try to save the expense to the City and use the Sole Source feature in the Code.
