DIRECTOR OF PUBLIC WORKS TO TAKE THE STEPS NECESSARY TO CAUSE THE CONSTRUCTION OF CERTAIN STREET IMPROVEMENTS ON CASE NO. 74-S-15 PUR- SUANT TO SECTION 5870 ET SEQ OF THE STREETS AND HIGHWAYS CODE. M/S/C: KING/WALDO. 00- Oral Communications: CONSTRUCTION ORDERED CASE NO. 74-S-15 City Manager Mocalis said he had talked to Mr. Alex Birulin of the Yellow Cab Company and told him that Council would be consider- ing the new Municipal Code and the subject of taxi cabs would be included. He will be meeting with them to discuss the proposed section and he thought that the problem would be resolved to their satisfaction. Mr. Stalians will not be present to speak at this meeting. 00- Mrs. Gloria Zook, 4817 N. La Rica Avenue, said she had read an article in the Tribune entitled Legislators Anger Council" regarding retire- ment for legislators. She said evidently the City didn't know what it was talking about and the Assembly didn't know what they were talking about. She asked Council to wait until they do know more about it before taking any action. She said two letters during the past week had been sent to the Legislature and both of them had been wrong which embarrassed her. 00- City Clerk Balkus presented a Temporary Use Permit from the Goodyear Service Store for a Parking Lot Sate on August 25 to August 30, 1974. TEMPORARY USE PERMIT TO GOODYEAR SERVICE STORE FOR PARKING LOT SALE APPROVED AND FEES WAIVED. M/S/C: GREGORY/WALDO. 00- City Clerk Balkus said she had completed check- ing on the petitions of the referendum and sub- mitted a certified statement to the Council. She said she had compared all of the signatures regarding Ordinance No. 684. There were 2,292 signatures submitted, 45 not acceptable or not registered; 134 withdrawals submitted and 11 of them were not acceptable for various reasons. The total of signatures was 2,124 and the require- ment was 1,391, therefore the petition meets the requirements of the Election Code. City Attorney Flandrick read by title: RESOLUTION NO. 74-82, ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON NOVEMBER 5, 1974, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY AN ORDINANCE RELATING TO CREATING A COMMUNITY REDEVELOPMENT AGENCY FOR THE CITY OF BALDWIN PARK AND CONSOLIDATING SAID ELECTION WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON SAID DATE. City Attorney Flandrick read by title: RESOLUTION NO. 74-83, REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES TO CONSOLIDATE A SPECIAL MUNICIPAL ELECTION OF THE CITY OF BALDWIN PARK TO BE HELD ON NOVEMBER 5, 1974, WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON NOVEMBER 5, 1974, PURSUANT TO SECTION 23302 OF THE ELECTIONS CODE. City Attorney Flandrick said the third item would be the employment of the firm of Martin & Chapman to perform such election services for and on behalf of the City Clerk as she deems necessary. FIRM OF MARTIN & CHAPMAN TO PERFORM ELECTION SERVICES ON BEHALF OF THE CITY APPROVED. M/S/C: GREGORY/KING. 00- City Manager Mocatis said the next resolution fixes the amount of money that is necessary to be raised by taxation to fund the operations of the City for fiscal year 1974-75. One item in this resolution is the Street Lighting District. The amount of money that could have been raised under Senate Bill 90 was approximately $167,000 and actual cost of the District will be approximately $260,000 for the year. Almost alt of the other cities are in the same position because of the energy crisis, to either have to cut off between 30% to W lights within the City or to dig into reserves. The Legislature passed an Urgency bill which does exempt street lighting districts from the provisions of Senate Bill 90 and provides that local taxes may be raised due to the energy costs. He said he had not had one call from any citizen saying they would like to have their street light- ing reduced. The combined amount for General Fund and Recreation is $799,652.00. He recommended that Council adopt this resolu- tion. NO. 74-85 ADOPTED City Manager Mocalis said Council had previously approved a proposal from Arthur Young & Company for Phase II add-on of the EVIS project to be paid by Federal funds. The City Attorney has reviewed and approved the agreement and he recom- mended that the Mayor and City Clerk be authorized to execute the agreement. M/S/C: KING/WALDO. 00- City Manager Mocalis said he had received a CETA Title II Sub-Agreement from Los Angeles County. The initial agreement provides for seven positions and possibly more before the year ends on June 30, 1975. There is no cost to the City as the Federal Government pays for the salaries and fringe benefits through Los Angeles County. The City was able to absorb employees into the City Government through the P.E.P. Program. The reason for the pro- gram was to get people who were unemployed or under-employed into permanent jobs. This agreement is similar to the P.E.P. Program. He recommended that Council authorize the Mayor to execute the subject agreement. Councilman Gregory asked what was meant by Sub-Agreement". City Manager Mocalis said the major agreement is between the County of Los Angeles and the Federal Government. To be a Prime Sponsor", Federal law requires that you be a city with a population of 100,000; otherwise you are a sub-agent. A11 cities with less than 100,000 must therefore execute a sub-agree- ment under the major agreement that Los Angeles County has with the Federal Govern- ment; we deal directly with Los Angeles County. He said we do handle the paperwork for the school district. The County has given an entitlement to the City and to the School District and determined the amounts to each; the amount to the school was approxi- mately $34,000 and the City's amount was approximately $65,000. Councilman Gregory asked if there would be an agreement between the school district and the City and Mr. Mocalis said it was not required by the County or the Federal Govern- ment. Councilman Gregory asked if there would be a great deal of paperwork and Mr. Mocalis said the School District would originate their paperwork and forward it to us and we combine it with ours and forward them to the Los Angeles County. He said there wasn't a great deal of work under the P.E.P. Program and didn't think it would increase the workload. Councilman Gregory asked if these positions would be in the City Hall and Mr. Mocalis said they would be. Continued) WORD PROCESS. EQUIPT. He said a person must be a resident of Baldwin Park and unemployed for at least 30 days. CETA II SUBAGREEMENT WITH LOS ANGELES COUNTY APPROVED. M/S/C: WALDO/KING. 00- City Manager Mocalis said the next resolution was a requirement of the State Law, providing for the collection of fees from alt applicants for construction permits equivalent to 007 percent of the estimated construction costs. The fees are collected by the City and paid to the State, Division of Mines and Geology. He recommended that Council adopt this reso- lution. He read by title: RESOLUTION NO. 74-86 ADOPTED AND FURTHER READING WAIVED. M/S/C: GREGORY/KING. 00- City Manager Mocatis said the next resolution was similar in requirements and requires cities to maintain official copies of plans of buildings for which permits have been issued. It provides for a collection of fees to pay for the expenses Incurred in making the copies. He read by title: RESOLUTION NO. 74-87, RELATING TO OFFICIAL COPIES OF PLANS OF BUILDINGS FOR WHICH BUILDING PERMITS ARE ISSUED. Councilman Waldo asked if this included homes and remodeling or additions. City Manager Mocalis said this covered every building for which a permit is issued which requires building plans. The break-down of costs is 10( per sheet for 8^5 x 11 or smaller. If the sheet is larger, the charge would be 3Qi per sheet. Councilman Gregory asked if these charges were commensurate with other cities' charges and Mr. Mocalis said they were and they are within the law. He said he thought that Mr. Mocalis had called Sacramento to obtain more information on this matter, but as yet they have not received it. Council can not act unless they have this information. Councilman Gregory said she was surprised when she read the article in the newspaper and was not too happy with the article. This Council has expressed dissatisfaction many times on something new being brought up from a news article without a study being made first. She has not received anything regarding this matter as yet. They will need a11 of the information they can obtain in order to take any action. She suggested that they table" this resolution. City Manager Mocalis said he had telephoned the Los Angeles League of California Cities and they did not have any Information. He then contacted the Sacramento office of the League of California Cities. They were to ca11 back, but he has not heard from them as yet. The questions he asked were: How many years of service before a person can retire; what is the rate of retirement; what are the fringe benefits that the legis- lators will receive. When he receives this information, he will forward it on to the Council. Councilman Waldo said he had written a letter to the Secretary of State requesting a11 of this information. He certainly did not want to take any action on this until they have the required information. Mayor Hamilton said he would also like to have more information regarding this resolu- tion as all he knew about it was what he had read in the newspaper. He hopes that everyone will work together to keep it from being delayed further. If nothing can be resolved, then they should km" it.
