Invocation was given by Father Anthony Marin, St. John the Baptist Church. She stated that he had been with the City for four years; one year as an Explorer Scout, one year as a Cadet and two years as a Dispatcher. Mayor Hamilton pre- sented him his badge and congratulated him. Councilman Gregory._sa id that she had known the Emon family for many years and they have been active in our community. Proper postings and mailings had been accomplished. There were no written protests. Ms, Joyce C. Barney, 12507 Sproul Street, Norwalk, said she was representing her mother, Mildred B. Kelty, owner of the property at 3204-10 Big Dalton Avenue, Case No. 74-W-499. She said she had not received any notice that the work was to be done, but had received the bin for $93.75 for removing 8 yards of rubbish away from the property. She said there was not that much rubbish and the pro- perty doesn't look any better now than it did before. She would like Mr. Palmer to come back and look at it. Mr. Sexton explained that notices had been returned by the Post Office marked undeliverable". City Attorney Ftandrick suggested that they hold this item over until they can resolve it. Council concurred. As there was no further testimony. Mayor Hamilton declared the public hearing dosed. There were no objections. 00- Oral Communications: PUBLIC HEARING CONTINUED TO 9/18/74 Mr. T. Carpenter, 4346 Jerry Avenue, referred to a newspaper article which quoted the City Attorney as saying that the ordinance must appear on the ballot exactly as it was passed by Council and the only way a law can be changed is by amending the Charter. He said he was sure that the City Attorney knows we don't have a City Charter and the article is not correct. Free Press might be free, but it is not free to do the things it is doing. City Attorney Ftandrick said that it was not an accurate quotation and the reporter had explained to him that this was a computer error. Mr. Carpenter said the newspaper continually brings up the fact that the 19 acres is all there is in the CRA in our City and that is not true. He said the Mayor has the responsi- bility to the people of Baldwin Park to see that these issues are properly presented. He asked that this be clarified with the Press. Mayor Hamilton said he did not write the article, he didn't give the paper any infor- mation and the Council does not have control over the news media. He said he didn't agree with alt of the articles, but he felt this could be resolved by talking to the editor. The news media does a great service to the communities and the country, but there are some mistakes made. Councilman Gregory said Mr. Carpenter had stated his case, but it is not the duty of the Council to right each and every statement. They have no control over the newspapers and can't dictate to them. They can only hope that the reporting is correct. She suggested that Mr. Carpenter visit the editor and explain his position. She said when they have occasion to be with the editors, they discuss the kinds of reporting they admire, but could not dictate to them. Mr. Carpenter said he wanted the people of Baldwin Park to get the truth. 00- MR. T. E. Andrich, 14202 East Los Angeles Street, said he was against CRA unless it is voted on. Mayor Hamilton said it is going to the vote of the people and will be on the ballot and they would not have any discussion for or against CRA until after the election. E. Carpenter asked that the resolution be read. City Attorney Flandrick read in summary: The resolution, if adopted in the draft form presented to the Council, the operative portion would read: That this City Council, being the legislative body of the City of Baldwin Park, hereby authorizes Virgil V. Hamilton, Adelina Gregory, Leo King, Joseph McCaron and Emmit Waldo, members of said body, to file a written argument for the City measure to wit, the CRA proposition". Continued) RES. AUTH. Motion died for lack of a second. Councilman Waldo said he had no objections to the Council writing the argument 1n favor of CRA, but he thought some consideration shou^11 be given to the people who worked very h.'<rd in the opposition to the referen- dum. Perhaps they would want to give the argument. City Attorney Flandrick said the Elections Code indicates that Council may, but are not required, to designate some person or persons to write the argument. If Council fails to take any steps to authorize an individual or group, any person or group can file an argu- ment with the City Clerk. If there is more than one, the Code establishes a line of priority: The first priority is given to the Council, the next is several members of the Council, the next is the organization that sponsored the measure, thereafter an individual voter who sponsored the measure and then any association or individual. If Council takes no action, any person who desires to do so can file an argument before the dead- line of September 5th that the City Clerk has set. Councilman Waldo asked if Council could desig- nate an individual and City Attorney Flandrick said they could designate the Council, indivi- dual or association that sponsored the particular measure or they could do nothing. Any qualified voter can file an argument for or against the measure. Councilman Gregory said there appeared to be people in the community who would like to write the argument for or against the measure and she felt that Council should not take any action on the resolution. COUNCILMAN GREGORY MOVED THAT NO ACTION BE TAKEN ON THE RESOLUTION. Mayor Hamilton said he didn't care who wrote the argument as it will be up to the people to decide by their vote. He felt he has tried to be fair to both sides. He hoped everyone would try to be honest in their statements. Councilman Waldo suggested that they designate the Council and the People for Progress Association to write the argument. Mayor Hamilton said they could not do that as they would be involved as they were not taking action on the resolution at this time. COUNCILMAN MC CARON SECONDED THE MOTION THAT NO ACTION BE TAKEN ON THE RESOLUTION. There were no objections. In other words, just one argu- ment for each side will be filed. Councilman McCaron felt the members of the association should write the arguments and asked if there was another way of qualifying them like the best written argument and City Attorney Flandrick said no". Councilman Gregory said because of the many questions asked regarding the procedures for the arguments. City Attorney Flandrick would read from the Elections Code. She said by the action of the Council, they have thrown away their right to have exactly what they wish to have as an argument for or against on the ballot. The Council members have thought long and hard on just what should be in the argument and have held out for every word to be the truth. She hoped that whoever writes the argument will print the truth and in their name as she would not want it in her name unless she knew exactly what was written. If Council were to write the measure, she would want every word to be scruti- nized by the Council. Now, the people have the right to make the statement and she hoped they were aware of the facts, as they could print something that was not quite right and maybe not factual which could be a detriment to the election. City Attorney Flandrick read Section 5104 of the Elections Code. His remarks which were made earlier were substantiated by the reading of the Elections Code. Mr. Carl Sharpe, 5018 Wimmer Avenue presented an argument to the City Clerk and said the People for Progress" had filed the argument with the City Clerk. 00- Assistant City Manager Hale presented a Joint Use Agreement with the Southern California Edison Company. He said the completion of the recon- struction of Morgan Alley had required relocation of certain utility poles along the new easement lines and it was necessary to have this agreement He recommended that the Mayor and City Clerk be authorized to execute the agreement. Councilman McCaron asked what the cost would amount to and Mr. Hate said it was $1,883.47. F. Dickson Company for a 10% increase in their rates for street sweeping. The added cost to the City would amount to $3.129.00 per year. He said the Acting Director of Public works had submitted a report which indicated that the increase was justified. Councilman Gregory said they have always had some problems with the street sweeping and they have not had a study recently of the cost of doing our own street sweeping as against that of contracting the work done. She suggested holding this over and have a study made. Assistant City Manager Hate said this contract was a month-by-month contract. Finance Director Duncan said this was a budgeted item and normally the City enters into a one year contract. Until a new contract is signed, they issue purchase orders from month to month. Acting Director of Public Works said the contract calls for 30 days notice for cancellation by either party. Mayor Hamilton said they had discussed the matter of obtaining sweepers about a year ago and the cost would be approximately $70,000. They held it over because of a shortage of funds. They adopted the budget this year with a minimum amount left and he could see no way that the City could get their own sweepers this year. He recommended that they approve this increase. Councilman Waldo asked how often do they sweep the streets and Acting Director of Public Works Sexton said they sweep every other week. Councilman Waldo said the streets of Baldwin Park look bad as though they haven't been swept in over a month. He didn't mind signing the contract, but wanted assurance that the work would be done and done well. He has received many phone calls regarding the dirty" streets. Mayor Hamilton said it appeared that the only way they would be assured of clean streets is to have our own sweepers and until that is a possibility, they will have to police" it as much as possible. Councilman Gregory said she would like an indepth comprehensive study made to see if there would be a better way to handle this so they might discuss it at the next budget time. Continued) R. F. Sweepers now run about $31.000 each and even if we wanted to buy sweepers it would almost be impossible as there is a 9 month delivery date. STREET SWEEPING RATE INCREASE OF APPROXIMATELY 10% FOR R. F. DICKSON COMPANY APPROVED. M/S/C: MC CARON/GREGORY. 00- Assistant City Manager Hale said the Office of Criminal Justice Planning had granted a 90 day extension on the second year of EVIS, Contract A121173. There are no City funds involved and it was recommended that the Resolution authorizing the Chief of Police to sign the agreement be adopted. He read by title: RESOLUTION NO. 74-90, AUTHORIZING AN AMENDING APPLICATION FOR LAW ENFORCE- MENT GRANTS SECOND YEAR FUNDING ORGANIZED CRIME INTELLIGENCE UNIT, CONTRACT NUMBER A-1211-73) RESOLUTION NO. 74-90 ADOPTED AND FURTHER READING WAIVED. M/S/C: WALDO/GREGORY. 00- Assistant City Manager Hale said the next item of business concerned a resolution to approve the application for 1974 State Grant Funds for the Walnut Creek Nature Area Project. The Council approved the employment of Lawrence R. Moss & Associates, a consulting firm, to provide the master plan and the plan has been completed. The Director of Parks and Recrea- tion has reported that they have run into some technical and legal problems regarding lease agreements with various agencies involved in this particular nature area and it would be impossible to meet the September 15, 1974 deadline. He recommended that the resolution be deferred until these problems are resolved. Councilman McCaron said they would also need a report of what the expenses would be and if they would be able to do it. Assistant City Manager Hate said the consultant had been asked to determine how much the operation of a delta park and maintenance would be after it was completed and this information would be presented to the Council when the information is available. M/S/C: MC CARON/ GREGORY. 00- Assistant City Manager Hale said the Finance Director had asked that the Electrostatic Master Copier, Model 2000 purchased in 1970 be declared surplus and that the machine be sold to the highest responsible bidder. He recommended that Council approve the request. ELECTROSTATIC COPIER DECLARED SURPLUS AND BIDS TO BE RECEIVED FOR SALE OF EQUIPMENT. M/S/C: GREGORY/WALDO. 00- Assistant City Manager Hate said the architect has completed the preliminary design phase of the new City Hall plans which have been reviewed by the department heads. There are certain minor changes to be made and the architect has agreed to incorporate the changes in the construction document phase. The architect has submitted a revised cost estimate for construction in the amount of $2,664,000.00, an increase of approximately $52,000 over the previous estimate. Cost of construction is rising at about 1% per month. They asked that Council approve the preliminary design and development drawings and specifications and the new construction cost estimate and author- ize the architect to proceed with the construc- tion document phase and authorize payment in the amount of $43,241.89 to the architect. Councilman McCaron asked how much more had to be done before they could ask for the funds. He said he would like to see if it would pass the Bond issue before they spend anymore money. City Attorney Ftandrick said this is about the last step. If this motion is carried, the architect will prepare construction drawings and submit them to Council for approval. Mayor Hamilton asked if Council had studied the preliminary drawings and if they were satisfied. Councilman Waldo said they had studied the preliminary plans, but he felt they should have the final plans. She thought perhaps they could ask the architect not to proceed further until after the election. Mayor Hamilton said this would not be on the November ballot, that they would have a special election after the first of the year. Assistant City Manager Hale said the contract the City has with the architect indicates that the project construction cost during the design development phase may be used as the amount necessary to construct the City Hall, along with the contingencies which Is 15%. Actually, the figure of $2,663,400.00, plus 15% would be sufficient to cover the cost of construction. However, no one can predict what it will be six months from now. City Attorney Flandrick said if Council approves the payment as submitted, that will mean that first you will authorize the Finance Director to prepare a warrant for that amount for fees and the architect will proceed to the next step. The architect Is present and he could agree to this or if he does not agree, there is a 10 day cancellation clause in the agreement. Councilman McCaron asked what they have to have before they go to the vote of the people and City Attorney Flandrick said there was nothing required in terms of drawings, etc. Councilman McCaron asked if they go to the vote first or find out if the money Is obtainable first. City Attorney Flandrick said It was up to the Council. They would have to have a concrete proposal to submit such as this Is. the type of structure you intend to build, the estimated cost and that would be sufficient to go ahead with a Bond issue. Councilman McCaron asked why it was necessary to watt until after the first of the year for an election; how long does it take to get it on the ballot and City Attorney Flandrick said approximately 75 days and that would run near the Christmas holidays. Mr. Fleishman, architect, said at this stage they only have a preliminary estimate and to have actual costs, they would have to have final working drawings. They could complete the working drawings, which is the next phase, and then go out for bid to get the actual con- tract prices. If they finished the final work- ing drawings in 2 to 3 months and if there is a slight slump, they may be fortunate enough to get some low bids. He didn't think it would cost much to improve on what they have at this time. M/S/C: MC CARON/WALDO. Assistant City Manager Hale said that the architect had completed a model of the new City Hall and it was on display in the City Manager's office. He said they would try to have it in the entry of the City Hall for everyone to see within the next few days. City Attorney Ftandrick said that Council should Instruct the City Manager to prepare a report coordinating the financial consul- tant concerning the Bond issue and a schedule for the Bond election and all other matters relating to this. Mayor Hamilton asked the Finance Director if the money for the payments had been Included in the 1974-75 budget. Finance Director Duncan said a department number had been Issued. They have made one payment of $31,000 and they have additional bills coming up, but Council has not as yet appropriated or set up a budget for approval on these Items. They have the money in the revenue sharing surplus. She said they would need a budgeted amount to work with which would mean increasing the 1974-75 budget to about $150,000. She requested that they hold this over until the first meeting of October as she will be back from vacation and win have a11 of the documents prepared then. The reason he was anxious to get the working plans completed is that they will then know the exact cost rather than an estimate. At this point, the expenditure is about $74,000 and another $34,000 to make the job a complete set of work- ing drawings to get bids. This payment would be due in approximately 3 months. City Attorney Flandrick said Councilman McCaron's question was, Wilt the architect accept the pay- ment due this evening and not proceed further with work or expenditure of funds pending the Bond issue?". The architect is proposing a counter-proposal to pay the amount due now, approved the design phase and authorize the work for the completion of construction drawings at an additional cost of $34,000. Councilman McCaron said if they have an actual cost and put it out for bids, the bids won't hold for 90 days as 30 days is about the limit. Mr. Fleishman suggested they finish the drawings in 90 days and go out for bids which would come back about the end of January and they would know the exact cost if they went out for the Bond issue in February. He would like to con- tinue as he would have the same men working on the drawings. Councilman McCaron said if the plan failed, they stilt have plans that could be used in the future. These plans are useless unless they are completed. He thought they should finish them up as long as it wouldn't take more than the $34,000. Councilman Gregory said they have looked at the preliminary plans, but she wasn't sure that all of the department heads were happy with them. She thought they should have the signatures in writing that they concurred. Councilman McCaron stated the floor space is adequate and the second floor can be expanded. City Attorney Flandrick said the motion should be to approve the design development documents, authorize the payment of the invoice as submitted by the architect in accordance with the agreement and to approve the project construction budget and authorize the architect to proceed with the construction document phase under the contract at his estimated cost of approximately $34,000. Mayor Hamilton said the size had been cut about one-half from the original plans. He said they would still be able to operate in the present building while building the new City Hall which will save a lot of money. Councilman Gregory said there had not been a recommendation given regarding the service yard which will be a considerable cost to add to the amounts already stated and this should be put in the suggested budget.
