Proper postings and mailings had been accomplished. There were no written protests. Acting Director of Public Works Sexton said at the last meeting Mrs. Barney stated she had only received one of the four notices from the City. They had checked with the Post Office and it was determined that Mrs. Kelly had moved four or five years ago and the tenant had been forwarding her mail since that time. The Post Office had not received a notification requesting a change of address. The malting had been accomplished according to our Municipal Code and the Post Office had followed their standard procedure. Based on this Information, the Staff recommended confirmation of this assessment. Councilman Gregory said this has happened before where tetters have been returned. She felt that the policy should be that the property not be cleaned unfit att avenues have been exhausted In trying to reach the owner. There should be further Investigation before any action Is taken. Mayor Hamilton agreed that they should took Into the procedure and be sure that the property owner was notified before the City takes the abatement action. City Attorney Ftandrick said In addition to the malt Ing notices, they post the premises and Mrs. Barney said she had not seen any posted notice on the property. At the time this was processed, they were not following the Return Receipt Requested" type of mattings and that would determine whether or not the property owner did receive the notices. This could be tried. Mrs. Bender, 3905 Bresee Avenue, said that she could not pay the $1,253.00 assessment because she is on disability and the property is in probate court. She said the man across the street dedicated 10 feet of his property recently and he is getting his curbs and gut- ters in free. The frontage on this property was dedicated 13 years ago and she has to pay $1,253.00. She has an income of only $273.00 a month and there is no way possible for her to pay this amount. POSTINGS & MAILINGS NO WRITTEN PROTESTS MRS. BENDER Councilman King asked what the policy was 13 years ago in respect to dedication of streets and Mr. Sexton said he didn't know what it was 13 years ago, but Mrs. Bender was referring to the current Council policy adopted under Resolu- tion 72-149. Councilman King said he thought there were some inequities and that they should be straightened out so that all would be treated fairly and Councilman Waldo agreed and thought this case should be continued to the next meeting. Mayor Hamilton asked Acting Director of Public Works Sexton to investigate the matter of street dedication and report back to Council. Councilman McCaron said he thought there were some avenues of aid that they should look into, perhaps a fund carried by the County. Councilman King said he thought there was to be such a fund about 4 years ago for this purpose, but he had not heard any feedback about it. Councilman Gregory agreed that they should try to investigate some way to help to obtain public assistance for people who can not afford it because of disability, etc. Council concurred that this be continued to the next meeting to allow time for investigation. 00- It was the time and place fixed for a public hearing on Ordinance No. 691: RECODIFYING AND RE-ENACTING THE PRO- VISIONS OF THE BALDWIN PARK MUNICIPAL CODE continued from September 4, 1974) Publications and postings had been accomplished. Regular Meeting of the Baldwin Park City Council Mayor Hamilton asked City Manager Mocalis to go over some of the major changes in the Code. City Manager Mocalis stated that the present Municipal Code was a compilation of ordinances which have been passed by the City Council since 1956. It is redundant in some areas, contrary to State Law in some areas and in some cases references situations that no longer pertain to the City of Baldwin Park. He said Council had set aside funds to have the existing Code recodified about two years ago. There are 4 major areas of change in the new Code: 1) Area of appointments of certain employees; some would be appointed by the Council, some by the City Manager and some by the regular classified or Civil Service pro- cess. This method is essentially the same as they have used the past several years. Section 2201) 2) Appeal Process in existing Code there are approximately 15 different situations in which individuals can follow an Appeal process. Mr. T. E. Carpenter, 4346 Jerry Avenue, asked the City Manager to give the Section Number when he refers to these changes. City Manager Mocalis said on Item No. 1, the number is 2201 regarding Classified and Unclassi- fied employees. Classified employees are those under the Civil Service structure and they are subject to a different set of Rules and Regula- tions than the Unclassified employees. This was Section 2201 2) which have been changed to go under Section 2201 1). except for part-time employees, temporary employees and State or Federal Grant employees which will remain under City Manager appointment. Mr. Mocalis said Item No. 2 Appeals) was covered in different sections under the old Code and they have been combined in one section in the New Code, Section 2900 so that any one filing an appeal for any reason, may follow the standard appeal procedure. 3) Fees In the present Code, fees are set by ordinance and this has presented a problem as they have not been in one section of the Code. They are putting together a Fee Resolution and any fee charged by the City except Business Licenses will be in a resolution form. Under the existing Code, there has to be a first and second reading of an ordinance which takes 45 days to effect the change, plus the expense of publish- notice In the paper. Section 7600). In the new Code, these hearings will be held by the Administrative Office. If they are not happy with the decision, then they can appeal to the City Council. City Manager Mocalis said the City Attorney and the Staff have worked for over a year trying to find a logical way to approach the new Code. There will be items arise that they have not covered, but he thought they had done a good job on the new Code. City Attorney Ftandrick said that Chapter 2.5, Section 2150 concerning Community Redevelopment Agency should be deleted from the new Code. Mrs. Gloria Zook, 4817 North La Rica Avenue, asked if this would be the only hearing on the Code as she felt it should be considered in greater depth. She said it was true that the old Code was antiquated, but some sections were noticeably absent in the new Code; in fact, the section covering the conduct for a public hearing was deleted. City Attorney Flandrick said it was true that those sections were deleted and most of them were pointless as they are covered in the State Law, for example the method of ordinances adopted is covered by State Law. He said if the Code was adopted, it would not become effective for a period of 30 days and they have proposed that a resolution be presented to the Council that would have a conduct pro- cedure in accordance with State Law to require that there be such a document published and available to any applicant, etc. This would be done for the benefit of the person who appears before Council. The provisions in the Code now are not particularly helpful and they are 18 years of age, they cover matters not covered by State Law and they do not cover matters that are required to be covered by recent State Law. If this Code is adopted, there are a number of other resolutions and actions that would be asked of the Council in the same vein; setting the fees, personnel rules, etc. At the present time when a change is required, it takes a first and second reading of an ordinance, a 30 day delay and substantial expense of a publication. Mrs. Zook has made a good point and there wi11 be a document that an individual may have and be able to read and understand it. continued) MRS. City Attorney Flandrick said the questions should be submitted in writing no later than September 27, 1974 for him to be able to answer them at the next meeting. City Attorney Flandrick stated that there is a State Law requiring that if an amendment is made to an ordinance after it has been introduced, the amendment must be made five days prior to its adoption. There are two suggested amendments; 1) Section 2150, deletion of the section dealing with Community Redevelopment Agency and 2) the amendment of Section 2201 as proposed by the City Manager. He recommended that Council, by motion, amend the ordinance as introduced. He stated Council has taken action on the referendum petition and the measure has been put on the ballot for the coming election; the decision wilt be made then. Mrs. Amos Slater, 4814 North Stancroft Street, said she wanted to question the validity of the $1,299.77 expense account submitted by Mr. James Sexton covering the period from January through June, 1974. She was under the impression that this was supposed to be done on a monthly basis. She read a list of luncheon expenses from April through June, 1974. She did not think that these expenses should be paid by the City. Mr. Sexton has a nice office in which he could hold these meetings. She thought this should be investigated. City Manager Mocalis said Mr. Sexton had used his own money and therefore had carried the City for five or six months. He does under- stand now that expense reports are to be turned in each month. He said he had gone through the expense report and then gave it to the Finance Director to be audited and she found only one error in the amount of $1.00. Most of the people at these luncheons were either members of official city bodies, press members or landowners. Mr. Sexton's position was created by the Council to bring in development to Baldwin Park. His expenses are not excessive in trying to do his job. He did not feet there was any need to investigate as they are satisfied with the accuracy of the report and the appropriateness of the expenditures. Mrs. Slater said she did not agree with this practice. 00- Mr. Cart Sharpe, 5018 Wimmer Avenue, said Mr. Sexton was hired to sell" this City. Any sales- man has to romance the person he is trying to sell something to and that is why you take them to lunch. 00- Mr. T. E. Carpenter, 4346 Jerry Avenue, said he had heard Mayor Hamilton's edict twice, but he felt the Bill of Rights took precedent over the power of the Mayor. The first amendment of the Bill of Rights is the freedom of religion, speech, press, assembly, etc. He said on September 4, 1974, a gentlemen appeared before the City Council and didn't get a chance to speak. He said he had no Intention of violating anyone's right to speak, but they attempt to conduct City business at these meetings. Mr. Carpenter said he believed that this was in violation of the man's constitutional rights and he should have been heard. 00- Ms. Sherry Elmore, 3891 N. Maine Avenue, said she was happy to announce on behalf of the Chamber of Commerce that Baldwin Park's display at the County Fair had been awarded a blue rib- bon for 1st place. It can be seen any day in Building No. 4, but particularly on September 24. 1974 as that 1s Baldwin Park Day. Councilman Waldo said we also won $600.00 for the prize which will go toward preparing next year's display. Mayor Hamilton said the Chamber of Commerce was to be commended as this was the fifth year that they have won 1st prize. He thanked those who had given their time for this. 00- City Manager Mocalis said that Mr. John Gordon, Planning Director, had announced his intention of accepting a position with the City of Pasadena as Director of Community Development. He said this was an outstanding advancement for Mr. Gordon and the City Council had prepared a resolution. Mr. Mocalis read In full: RESOLUTION NO. 74-93. COMMENDING JOHN P. M/S/C: GREGORY/KING. 00- City Manager Mocalis said Council had authorized the staff to retain an appraiser to have the Baldwin Park Theater property appraised. The report from the appraiser, Himes and Himes, indicates that the market value of the property is $32,500. He recommended that Council author- ize the negotiation for the property with cer- tain escrow provisions because of the traffic study being made at this time. He will come back to Council to explain the escrow provisions, but would tike to hold off on the actual purchase until the engineering report is finished. CITY MANAGER AUTHORIZED TO NEGOTIATE FOR BALDWIN PARK THEATER PROPERTY; HOLD ESCROW UNTIL ENGINEER- ING STUDY IS COMPLETED AND REPORT BACK TO COUNCIL. M/S/C: KING/GREGORY. 00- City Manager Mocalis stated that the IBM data processing equipment had been put up for bids on September 6, 1974. One bid was received from Data Sales Company, Burnsville, Minnesota in the amount of $76,360.00. On September 12, a final negotiation resulted in an increase in the sell- ing price to $80,000.00. He recommended that the high bid from Data Sales Company be accepted and the sates contract consumated. BID ACCEPTED FROM DATA SALES COMPANY. BURNSVILLE, MINNESOTA IN AMOUNT OF $80,000.00 AND SALES CONTRACT AUTHORIZED. M/S/C: KING/GREGORY. 00- City Manager Mocalis said we are required by law to go out to bid on vehicles, etc. unless there is only one supplier. They had asked six dealers to bid on the Vehicle Fleet Packet and received only one bid back which was from Reynolds Buick, Inc. of West Covina. He also said he would like the Council to endorse a strongly-worded letter to the elected representatives in Sacra- mento with space at the bottom of the letter for citizens to sign. Councilman King said the Council were all very sympathetic and had researched this situation two years ago and were not able to find the solution, but perhaps now that everyone was more aware of the problems of the Senior Citi- zens, they might be able to determine a way If they researched the situation. M/S/C: MC CARON/WALDO. 00- City Manager Mocalis read by title a resolution asking for authority to apply for off-highway vehicle grant of approximately $131,000.00 which would make it possible to develop property in the area of the 605 and San Bernardino Freeway. He said Mr, John Hybarger was present to answer any questions. Councilman McCaron said they were just making application for the funds at this time and would have 1 to 3 years to consumate the spending, and was this correct and Mr. Hybarger said that was correct. Mr. Hybarger requested that Council members try to attend the forthcoming meeting of the Recrea- tion and Parks Commission as the architect wilt be there to present a proposal for the Delta Nature Park and they will be discussing this matter in detail. Mayor Hamilton said he hoped the Commission would take into consideration the cost of maintenance and use caution. Mr. Hybarger said they have indicated in the Gen- eral Master Plan the amount of maintenance and number of men required for the 3 separate areas. They plan to use private enterprise as much as possible. The only area the City will be totally responsible for is the Nature Center itself. Councilman King said without added revenue in the City, this would not be economically feasible for the City at this time. We can't be too cautious. Mr. Hybarger said they were seeking Governmental agencies for grant funding to help with the pro- ject. He said it would take approximately 2 years for the completion of the motorcycle area and the only area that would not be revenue producing will be the Nature area. Councilman McCaron said at this point, they are just keeping the door open for the funds in case we can use them. He felt that the report is incom- plete and requires considerable more information before they can take action on it.
