NO. 74-105 ADOPTED Mr. Michael Dargus, 13260 East Francisquito, said he was disappointed in the Council as they brought shame to the City when they condoned the use of the picture of the defenseless old woman at the trash container during the campaign. This was done without the permission of the manager of the business Mayor Hamilton said that the Council had nothing to do with that and knew nothing about it before it was published. Mr. Dargus said the Council had designated the People for Progress" to be a representative for a full article in the election sheet and it was up to the Council to stop it before it came out. This degraded the senior citizens of the City and created a discreditable name for the City. Continued) MR. He and his wife help with meals on wheels" and take care of 10 to 15 people every week. Mayor Hamilton said the Council had not approved the publication and he was out of town on vacation at that time. He said if they would watch Channel 9 on November 26 at 1:00 p.m. and November 27 at 9:30 a.m., they would know his answer to the question. Councilman King said he had been out of town and had nothing to do with the publication. The article was out 2 days before he knew anything about it. It was impossible to do anything about it after it was published. Councilman Gregory said they had no control of the publication being put in or taken out as they had nothing to do with the printing of it. Mr. Dargus said Mayor Hamilton had made a lot of statements regarding five million dollars in the next 10 years in taxes to the City from CRA. He said there is no credibility in that statement and that City and County taxes would go up as a result of CRA projects. Mayor Hamilton stated that the figures he had given were estimated figures obtained from the people who had prepared a survey in the develop- ment office and they were not far wrong. We are on the way to get development in the City and he didn't want anyone tearing it down. He had been sincere in the statements he made. Mr. Cart Sharpe, 5018 Wimmer Avenue, said the City Council did not te11 the People for Progress and couldn't dictate to them what to do. They had as much right as anyone else to write the proponent item on the ballot. They published the picture to show just the way it is. 00- Mr. T. E. Carpenter, 4346 Jerry Avenue, said he wanted it noted that there were no reporters in attendance at this meeting. He read a letter from the League to Preserve Constitutional and Civil Rights" regarding CRA, addressed to Mr. Dick Tracy, San Gabriel Vat ley Tribune, dated November 9. 1974 Copy in official files). 00- Mrs. Amos Slater, 4814 North Stancroft Street, referred to the resolution on the agenda con- cerning Valle de Bravo as a Sister City and asked what the cost would be to the City to designate and maintain a Sister City. The City makes the official resolution, it is up to the citizens to put on the programs which produce the funds and also to design and carry out the programs. It is up to the City Council to determine if there would be any funds taken from the City funds. Mrs. Slater said she had no objection to having better relations between the two countries, but she thought it would be better to use any money from the City to help the senior citizens or the youth of the community. If the City would have an over-abundance of funds, they could go into other programs. 00- Reporter from the Treasure Chest newspaper arrived at 8:00 p.m.) 00- City Manager Mocalis said a $25 application fee for a Minor Zone Variance from Mr. and Mrs. Herbert Morgan had been incorrectly accepted as the variance was prohibited by the Municipal Code. The recom- mendation was to refund the entire amount of $25. REFUND OF APPLICATION FEE IN AMOUNT OF $25 TO MR. AND MRS. HERBERT MORGAN APPROVED. M/S/C: KING/ GREGORY. 00- City Manager Mocalis said if Council desires to adopt the following resolution, they would have to take two additional steps: 1) a nominal amount of money should be funded by the general fund for necessary and incidental expenses for this program which are incurred by the City, and 2) Council should appoint a citizen's com- mittee to have the responsibility of developing the Sister City program, planning programs, pro- moting and publicizing the Sister City relation- ship and other duties as the Council determines. He read by title: RESOLUTION NO. 74-106, DESIGNATING THE CITY OF VALLE DE BRAVO AS THE SISTER CITY OF THE CITY OF BALDWIN PARK Councilman Waldo said in answer to Mrs. Slater's suggestion, that arrangements to help the needy senior citizens out of City funds are being in- vestigated. He said the Mayor of Valle de Bravo was interested in youth problems in Mexico and in our City. He and his people in Va11e de Bravo have dealt with drug problems and gang warfare and have been able to curtail some of them. He would like a meaningful project set up here that his boys can participate in. This way they can help each other. The benefits would far outweigh the nominal cost incurred by the City. In devel- oping a better relationship between the two countries, the drug traffic could be helped and our youth and their youth wilt be helped. Councilman McCaron said since this is all new to us, just what is required; do they have to have a fund established prior to a need or can they handle it as the need arises. City Manager Mocalis suggested that if Council adopts the resolution, then Council could put together a Council committee such as two council members and a staff member to determine exactly what the amount of money should be and to suggest to the Council the make-up of a citizen committee to actually plan the program. Councilman McCaron said they should have a com- mittee first and let them decide what the proce- dure should be and then they would know about what they are doing. Councilman Gregory said this has been covered fairly well and the resolution to start things going Is a reasonable recommendation. RESOLUTION NO. 74-106 ADOPTED AND FURTHER READING WAIVED. M/S/C: WALDO/KING. There were no objections. Mayor Hamilton appointed Council men Waldo and King and City Manager Mocalis as a committee to make a study and come back with a report and to work to appoint a citizen's committee. Mr. Carpenter asked where the $1,500 was noted in the budget and Mayor Hamilton said that would be discussed when the committee comes back with their findings. 00- City Manager Mocalis presented a Letter of Intent regarding the 911" Planning effort which requires cities and counties to adopt a 911" system where citizens dialing a telephone for emergency services would be directed to a central place which would go to the nearest appropriate file or police department. He said we had received a letter from Los Angeles County to join with them as other cities have done to do the preliminary regional planning. A report from our Acting Chief of Police recommends we indicate to the County by passing the Notice of Intent that we will authorize the County to do the tentative planning for us, Councilman McCaron asked if there would be a charge for this. All cities in the State are mandated by State Law that by January 31, 1975, there must be a 911" tentative plan sub- mitted to the State Legislature. There wi11 be costs incurred by a11 of the cities at a future date, but the action now would be to allow the County to do the tentative regional planning for us. Once the plan is developed, the cities wi11 decide if they want to go into the plan that wi11 cost money. If we don't join in, they won't include us in their dan for an emergency 911" telephone use which would include other cities but we would not be included in the plan of which General Telephone and Pacific Telephone and Telegraph are participants. It 1s to our advantage to join because we don't have the funds for a plan of our own. Councilman McCaron asked if this is compulsory, how can they leave us out and City Manager Mocalis said the County is under no legal obligation to do the planning for us. The State Law says that each city and each county must submit the tenta- tive plan and the County has said they are witting to make the tentative plan with the joint coopera- tion of a11 the cities in Los Angeles County and they want the Notice of Intent to indicate we are witling to have them assume the burden of making the tentative plan. Our people have been in meet- ings with General Telephone, Pacific Telephone and Telegraph and Los Angeles County and they have indicated that this is the most effective way, by the regional basis. Councilman Gregory said the League of California Cities has a committee who has been studying this for several years and they have come to this deci- sion. Mr. Mocatis said he apologized to the Council for not giving them previous notice, but he had only received it several days ago and the Police Depart- ment had to investigate it first. LETTER OF INTENT FOR 911" SYSTEM FOR LOS ANGELES COUNTY TO PREPARE TENTATIVE PLAN AUTHORIZED. M/S/C: GREGORY/KING. 00- Director of Public Works Lathrop presented reports of work on Short Form 1911 Act Case Nos. 74-S-6, Northeast side of Merced Avenue between Vineland Avenue and Big Datton Avenue CG&DA); 74-S-7, South west side of Merced Avenue between Jeanette Lane and Big Dalton Avenue CG&DA); 74-S-8, Southwest side of Hotly Avenue between Pacific Avenue and Southwesterly terminus CG&DA); 74-S-tt, Northwest side of Stichman Avenue between Durness Street and Southwesterly terminus C&G). He recommended approval of completion of the districts and to set a hearing for February 5, 1975 to hear any pro- tests or objections to the cost of construction. The present Zoning Code is in the process of being updated and the Conditional Use Permit procedure is being analyzed and evaluated. In view of the fact that they have a backlog of zoning enforce- ment cases and they are anticipating a change in the Planning Department personnel, it has been recommended that the City Council concur with the Planning Commission's request for 120 day moratorium on Conditional Use Permits as applied to contractor's yards, offices and storages. The moratorium wi11 not affect any new contractor yards coming into the City, but only those who are presently in operation. M/S/C: MC CARON/WALDO. 00- Councitman King said that an interesting meeting had been held on November 19th at Morqan Park with approx- imately 50 peoole in attendance. Judge Kenyon from the juvenile court, Patrick Roach, Probation Officer of San GaDriet Valley and Acting Chief of Police Hebert were also present. The purpose of the meeting was to discuss juvenile detiquency and they expect to have more meetings in the future. Mrs. Boles is the Chairman, Mrs. Carol Hanson, Secretary and Mrs. Lundsford took notes also; they were responsible for organizing the meet- ing. He said he was sorry that the newspaper reporters were not there to take notes. Councilman Gregory said she and Councilman Waldo attended the meeting and it was a testimonial evening and exciting. Mr. Frank Zarate was introduced who had organized a group and there was a group meeting at the Landis School and a11 of these people were interested in the wel- fare of their neighbors and young people of Baldwin Park. Acting Chief of Police Hebert asked them to get behind the Boy's Club as they needed assistance. She commended a11 of the people who had participated and were involved. Councilman Waldo said people at the meeting were expressing their problems and fears and wanting a solution. He said Mr. Zarate had organized his group about a year ago and had about 200 active people tryinq to accom- plish what is needed. He thought it would be a good idea for the same people to attend one of Mr. Zarate's meetings. continued) CONCURRED W/ P. C. One of the missing links" was that there was no representation from the schools. Mr. Jerry Holland was attending a meeting out of the City. She thought it would be well for the Council to set up a meeting with the Board of Education including the older boys to discuss this problem. Perhaps they could have Mr. Zarate and Mrs. Boles and a member of the parole division as spokesmen so they would know just what has to be done because the police problems are not just ours, but the schools also. Mayor Hamilton said this was something that everyone should be concerned about and he asked City Manager Mocalis to arrange a meeting and he would be glad to attend. Councilman King requested that they have a represent- ative from the police department at the meeting also. Acting Chief of Police Hebert stated that as a result of the meeting, they had already received some feelers" from the gang leaders of the City to see if they could get together to try to re- solve the problems. Councilman Waldo said Mr. Zarate was doing a fantastic job with the youth of our City. He had lost his son through a gang killing last year and has been helping the youth of the community ever since. 00- Acting Planning Director Hale said at the last meeting Council had referred Z-383 back to the Planning Commission and they have decided to reopen the case. 00- City Clerk Balkus presented a claim from Mr. Charles Ptake of Baldwin Park. M/S/C: GREGORY/KING. 00- City Clerk Balkus said each Council member had a copy of a resolution from the City of Azusa REQUESTING LEGISLATIVE ACTION WITH RESPECT TO THE RAPID TRANSIT DISTRICT. This was for their information and study. Upon direction of the Council a resolution incorporating this Councils desires can be prepared for presentation. Councilman King said the resolution has been on the Council Desk since October 30, 1974 for their consideration and he did not think it was worthy of consideration at that time. M/S/C: KING/HAMILTON. Councilman King said the State is already taking legislative action so there would be no need for Council to take any action. Councilman Waldo said he agreed with Councilman King. He did disagree about the fact that the first he had heard about the resolution was from a fellow councilman from the City of Azusa who asked him what our City Council had done about their resolution. He had asked around and no one else knew anything about it. His friend sent him a copy of it. He later found that a copy had been placed in the Mayor's office along with other correspondence. He said a copy of the resolution had been sent to every city and to the supervisors and elected representatives in Sacramento and if it was important enough to do that, why wasn't a copy made and put in each of the Councilman's folders? Councilman King said it was on the desk in the Mayor and Council office and he had read it when it came in. We have a member of the Board of Directors of the RTD on Council and he didn't feet it warranted Council's action because legislators wilt take action and secondly, this person who is a Director is a mem- ber of the City Council and should be considered very carefully, before it is brought to Council for a debate because we want agreement by Council. Each of us are working together for a common purpose and that was his concern. Councilman Waldo said he agreed with Councilman King, but he would have liked a copy of it in his information folder. Councilman King said a copy was on the desk for review and he had read it. Councilman Waldo said he had asked three council- men and they had not seen it because nobody goes through that old stack of old papers. Councilman King said it was not an old stack. Mayor Hamilton said they could not continue the discussion as the resolution had been tabled. Councilman Waldo said he did not object to it being tabled, but he did object not having the information if his folder. Councilman McCaron said if Councilman Waldo had an objection, it should be heard. It could be brought up as a separate item. Councilman McCaron said if the City of Azusa had a complaint against the RTD, they are picking on the wrong reasons. There are other things and other organizations involved that are just as much responsible and have acted improperly on the subject of proper transit development and the one organization should not be blamed. The two organizations are SCAG and the League of California Cities. Some of the items fold to the people in order for the issue to be passed, were not proper and not the truth. Councilman Waldo said he agreed that this should be tabled because of action being taken in other places, but the Council should have been informed and that is his qripe and he won't change his mind. If anything happens, he wants to know about it. Councilman King said possibly that was right, on any resolution he would agree because Councilman McCaron does not have his packet in the Mayor's office and doesn't look at the items on the desk, but he Councilman King) does as a matter of habit. Councilman Waldo said he doesn't have time to read it, but takes his material home to read. City Clerk Balkus said the items in the Council folders and on the Council desk is mail that is opened by the City Manager's office. She receives items of general interest. This piece of corres- pondence was addressed to her, as many items are, and she knows they are intended for Council. There are many items there and if a Councilman is truly interested in his job, he would look and see what is on the desk. She said there are items in the folders that are very important and that is why they are there, but there are other items on the desk for their consideration and in true interest they would look there. She said she was making an issue of this because she had been hearing about this very thing for the last 2 or 3 days. Mr. Carpenter said they started out and went through it in the meeting at the auditorium. There have been no announcements to the people of Baldwin Park until now and you say you are going to wind it up". He requested that an item be put in the newspaper so that the people will know that there will be meetings noted at a specific time. He said the people should be notified as they don't know the meetings are being held. Mayor Hamilton said the public hearings are announced and are on regular dates and if the people are interested, they should attend. Mr. Carpenter said they have a few people who know about it now Council is going to wind it up", according to the newspaper. Mayor Hamilton said there are many items printed in^the newspaper that are not accurate- Council was elected to do a job and they are trying to do it. He said he did not control the newspapers. Mr. Glen Robinson, 4708 Walnut Street, said he wanted to speak on the Code and Mayor Hamilton asked what section, and Mr. Robinson said on the whole situation. Councilman King said Mr. Robinson was out of order. If anyone in the audience has something constructive to delete or add to the Code as they go through the sections, they should do so at that time. Mr. Robinson said the people have a right to know and they have denied them that right. It is the responsibility of the Council, this could have been eliminated if this had been published. Always a continuation get it out in the open. City Attorney Flandrick said allegations had been made and they should be set at rest. At the very outset, a published notice in conformity with the State law was given that the City Council would conduct a public hearing to consider the adoption of this Code and the various other codes and ordi- mances referred to in the document itself. Copies were made available in the City Clerk's office and copies are available at the library. On each occasion when that public hearing was held and adjourned to a different date, that announcement was made at the previous hearing. It is true that public notice is not given as to each of the continued hearings. That is not required in the case of the adoption of a code by reference or any other matter without exception. This is not an uncommon situation. It may be unfortunate, but copies are available. It is true that a number of letters have been received from persons who are interested in the contents of the Code; Mr. Carpenter, Mrs. Zook and others. When a letter was presented, he publicly, at one of the hearings, commented to the Council as to the legal aspect and Mr. Mocalis commented on the policy matters Involved in the questions raised. To say it is a violation of State Law or a secret meeting, is absolutely incorrect. Mayor Hamilton said that Councilman Waldo had requested to leave at 9:15 p.m. Councilman Waldo said he had made what changes he would tike to see made known to Mayor Hamilton. He has read the Code thoroughly and agrees with it except for the changes he noted. He left the meeting. City Attorney Flandrick said after the last ad- journed meeting of the continued hearing, he had drafted a letter indicating the various items that Council had changed with reference to the Code. White they were not formally changed, they are- indicated in the letter that Mrs. Balkus has put in the packet. It is the proposal that as they go through the Code, the changes made will be put in the same form so that when the hearings are concluded, they will have all of the pro- posed amendments so they can be acted on formally at the same time. Mayor Hamilton asked Council if they wanted the Code read or go through and just discuss the items they have a question on. Councilman McCaron said they should just discuss the items they have questions on. Everything else has been property handled. If not, they would have to change the method of doing it. If it becomes a compulsory issue and someone wants to sit and read the Code, we can let him continue reading it and we can come back next week. If there is too much inter- ference, they should close the hearing and discuss it on their own. He would suggest that they have each Councilman present the items they have questions on and then allow the members of the audience to voice their questions. Councilman King said he agreed with Councilman McCaron. Mrs. Slater had a question on Section 2201 and Mayor MRS. SLATER Hamilton said they had already covered that section and it had been changed and asked that any question on sections before 3350 be held until they have finished the Code review. They have been reviewed by Director of Public Works Lathrop and Perry and there are no major changes. ORD. NO. 691 CONT) Section 3217 ALL NIGHT PARKING PROHIBITED Mr. Carpenter said he objected to the fee for alt night parking permits, to change it from $3.00 to $15.00, what effort is expended to raise the price. City Manager Mocatis said after the Code has had the second reading and is adopted, then a list of fees will be provided to the Council and there will be adequate opportunity for the citizens to inquire about the fees. The adop- tion of the Code in no way determines the amount of fees. He said alt of the fees will be printed in one document. Mr. Carpenter asked if the fee had been eliminated on the public nuisance appeal $50). City Attorney Flandrick said that would be another decision that Council would make after the Code is adopted. City Manager Mocatis said that is not a fee at the present time, but is the fee that would be discussed by Council. Mr. Carpenter said he reserved the right to discuss and protest it when the matter did come up. City Attorney Flandrick said the next section 3600 through 3613 cover various and sundry matters which are specifically made a misdemeanor by virtue of the Code; intoxication in a private place, gambling, loitering, etc. Section 3609 deals with noise and any person who engages in any activity which results in an unreasonable noise is guilty of a misdemeanor. This section is a stop-gap measure only. The Plan- ning Department and Planning Commission is studying a draft of the noise ordinance and the League of California Cities' ordinance and several other noise ordinances which have been adopted by adjacent cities The District Attorney's office has indicated its preference in terms in matters that they wilt have to prosecute criminally of Section 3609 as drafted. Mrs. Dahl, 4345 Hartan Avenue, said her question was in reference to Section 3217, A11 Night Parking. She asked why Bogart was an exception. City Manager Mocatis said State Law requires that there be a street in the City that can be used for this purpose. City Attorney Flandrick said there is a series of sections dealing with parking meters and it does not impose parking meters anywhere in the City. It is just a series of sections that were placed in the Code so if at some time in the future it is determined that parking meters would be appropriate, they could be placed by Council instructing staff to do so. Mrs. Dahl asked about Section 3300,"License Required." City Attorney Flandrick said the sections relat- ing to bicycle licensing were mandated by the State Law that were in effect last year when we drafted the Code. Some amendments will have to be made because as of January 5, there are some changes in the State Law. He wilt come back with those changes then. The State requirement is that all bicycles be licensed, that they be good for 4 years, a maximum fee of $2.00 of which the State received $.50 and will be effective January 8, 1975. Mrs. Amos Slater asked if trucks were allowed to park with a permit or do they park where they want to. City Manager Mocalis said if a truck is actually at rest on Bogart, it is allowed to park all night even though it is not a truck route. If the truck is moving on or leaving Bogart indicating that they are not making a delivery, they are cited. This is obviously a bad situation and steps are being taken to find a place where truckers can park and not disturb residential people and have a legitimate place to park. Currently they can park legally on Bogart over night. Mrs. Slater said almost any time day or night, you can see big double semi trucks parked on Baldwin Park Boulevard and Olive. She said the priority should be to get the trucks off the streets, then work toward the citizens vehicle all night parking. City Manager Mocalis said every time that we are contacted about a truck parked illegally, an officer is sent out and they are cited. It is different truckers each time. We have a situation where we have not provided a place for trucks to park over night. As far as the over-night restrictions, he suggested that Captain Hebert be contacted as he has been directed to be more stringent in enforci.ng this and more citations and warnings have been issued continued) MRS. They must confine their travel to the designated truck routes unless they have a delivery and that is the most direct route they can use. Mrs. Slater said that Nubia Street was not the most direct route. City Manager Mocalis said what Mrs. Slater is referring to is a problem of enforcement and doesn't have anything to do with the way the Code is written. He suggested that Mrs. Slater contact him and Captain Hebert during the day and they would try to get more enforce- ment. Councilman McCaron said there are such narrow streets in the manufacturing zones and trucks can't turn around and go back the way they entered, so sometimes they have to use the other side streets. Section 3400 ANIMAL CONTROL ORDINANCE Mrs. Slater said she has had a running battle with the animal control people for some years. They do not do what they have contracted to do in this city or any other city. Mayor Hamilton said this had nothing to do with the Code and asked Mrs. Slater to take this com- plaint to the staff to eliminate the problem. Councilman King said he agreed with Mrs. Slater and this should be brought before the Board of Supervisors. She said she objected to taking on a staff member at the Council level and she felt Mr. Waldo owed Mrs. Balkus an apology. Councilman Waldo said he did not say Mrs. Balkus did anything illegal or wrong, but they do have an information packet and he would like his infor- mation put in it. He apologized to Mrs. Balkus, who thanked him. 00- Councilman Gregory said that some time ago Council- man Waldo and the Council in their concern for Senior Citizens had directed the City Manager to research and see what we can do for them. As a member of our staff has been appointed to the County of Los Angeles Public Social Services Commission by Supervisor Schabarum, she and Councilman Gregory met with representatives of the Department of Social Services and the Department of Social Security to find out what avenues are available for Information and Referral. Today they received information dealing with the Information and Referral Center for a grant application due November 22nd, and another one re- garding the establishment of a transportation program is due on January 6, 1974. She asked City Manager Mocalis to research the documents and process the material and perhaps we could obtain some money to assist the Senior Citizen program. 00- The hearing on Ordinance No. 691 RECODIFYING AND RE-ENACTING THE PROVISIONS OF THE BALDWIN PARK MUNICIPAL CODE was resumed: Councilman McCaron suggested that Mayor Hamilton ask each Council member to give their items for discussion rather than go through the Code as it takes so much time. Mayor Hamilton said some of the people in the audience might have questions so they would have to cover it. Mr. Carpenter said he had been the only representa- tive of the City of Baldwin Park at the last meeting. He said the newspaper stated that they would adopt the Code. He said in order to have a public hearing on something being changed after 17 years, just to read a number and expect the people to know what it was about didn't mean anything. He suggested that the Code be read or it would be a farce. Mayor Hamilton said if they went through the Code tine by line, it would be adopted by the middle of 1975. He said it was prepared by the City Attorney with the help of the City Manager and staff and Council has gone through it. Most of the suggestions or changes have been made. He said there was no way they could inform a11 of the citizens of Baldwin Park and to go through the Code tine by line.
