NO. 74-110 ADOPTED Mr. Ron Smith, 14189 Jeremie Street, said he was present to question the personnel hearing that was held on November 22, 1974. There was information brought into the ordeal he had in front of Sambo's. Only one part of the story was heard that was pre- sented to Mr. Mocalis. He said he was defending himself and his family and has people present who have volunteered to testify in his behalf. He asked why he was not invited to the November 22 hearing. City Manager Mocatis said Mr. Smith had given testimony at the Council meeting prior to the personnel hearing. The personnel rules and regu- lations provide that a person accused of wrong doing has the privilege of calling witnesses. Two citizens and a third police officer who was not involved in the incident were called. He heard the testimony and upon considering the evidence given to him, found the allegations against them were not worthy of the recommended disciplinary action and he dismissed the case. He said the personnel rules are explicit in what they provide for. It wasn't a hearing to deter- mine if Mr. Smith was right or wrong, but to determine if the police officers had acted impro- perly. At this time, it is not appropriate to receive public testimony. He suggested that if Mr. Smith believed that improprieties took place, the proper action would be to ask the District Attorney's office to investigate. Mayor Hamilton told Mr. Smith that the City Manager had answered his questions and there was nothing the City Council could do at this time. Mr. Smith said two weeks ago when he appeared before Council, he was told that he would receive a written decision about the officers who responded to his call on November 1, 1974. He asked if they had reached a decision. continued) MR. City Manager Mocalis said there was a decision made based upon the testimony he had received. It was found that the allegations were unfounded and no disciplinary action was called for. He said he would be glad to put it in writing for Mr. Smith. City Attorney Flandrick explained that Mr. Smith did have the right to go to the District Attorney's office in El Monte. They should call and make an appointment and te11 them what it was about. He would not take other people down there until he has the clearance from the District Attorney as he may want time to review the case and review the City's documents. He didn't think the people should leave feeling that there is no remedy as there certainly is. That is one of the functions of the District Attorney's office. 00- Mr. T. E. Carpenter, 4346 Jerry Avenue, said he was a spokesman for the League to Preserve Con- stitutional and Civil Rights and he wanted exactly 10 minutes' time. He said at the November 27, 1974 Planning Commission meeting, a public hear- ing was scheduled on Case No. Z-384. The Acting Planning Director, Mr. Hate, immediately said the petitioner had withdrawn his request. The peti- tioner was the Sixpence Inns and had to do with putting in the Hytander Hotel which is part of the three installations to go in the 19 acre project. He said he did not have time to discuss it because it was stopped. He wanted to speak at the time of Oral Communications and played a tape to signify what had taken place. He said there was 40 seconds from the time the chairman said Oral" and Mr. Hate spoke and he had no chance to speak as they dismissed the audience in 40 seconds. He said he would not interrupt Mr. Hale because when someone begins to speak, you do not interrupt them. He lost his chance to speak. He asked why the Hylander Six pulled out. Mr. Carpenter said the second item he wished to discuss was the T. V. Program on November 26, 1974 with Tom Fransden in which Mayor Hamilton and Nicki Donahue had participated. He referred to the remarks about the property owners of 4 miles on the freeway. He played a tape of a portion of the program). There was no action by Council on it. Councilman Waldo asked why Mr. Carpenter thinks that the Sixpence Motel had withdrawn from the project area. Mayor Hamilton said he couldn't answer that, but he could respond to Mr. Carpenter's question regarding the tape. He said he has answered that question 4 times and he didn't think it necessary to answer it again. He said he could have made an error in speak- ing, but Council and the people of the City understand what he said and what he meant and what he thinks is best for the City and that is a11 they are interested in Councilman Waldo said it was brought to his attention that somebody from the community has been calling the developers we are negotiating with. We have received feedback from the developers that they do not appreciate this. He made a plea to the audience and to the com- munity to please not call the developers. This includes the Council. We have a professional man to do the nego- tiating and we could lose these developments if they are harassed by the people in the conmunity. Mr. Carpenter said he wished to speak in rebuttal to this last remark. Councilman Gregory said if Mr. Carpenter was asking for rebuttal, was he involved in this even thoucih his name was not mentioned. Mr. Carpenter said no one's name was mentioned, but as a citizen of the comnunity he thought he was entitled to a rebuttal. When an accusation is made against the citizens, one of them has a right for rebuttal. Councilman Gregory asked Councilman Waldo if names were given of the phone calls and Councilman Waldo said he would rather not say. He did not want to discuss any- thing about the developers, but K"Mart was one of the developers who were contacted. Councilman Gregory asked if the people who called the developers gave their names; she didn't want him to give the names, but did they give their names. Councilman Waldo said he was just making a plea to the citizens to please not contact the developers. It is a delicate thing. These people do not have to settle 1n Baldwin Park. They are businessmen and they do not want to be harassed. Mr. Carpenter said he knew of no one that had contacted these people, but he said anybody in the City has the right after the Hylander Six had pulled out and there is no reason given. He said if he wanted to call the Hylander, K-Mart or the President of the United States, he would do it! Councilman Waldo asked Mr. James Sexton if the Hylander Six had pulled out. Director of Commercial and Industrial Development Sexton said he had no knowledge of any of the hotels they have been negotiating with pulling out. 00- MR. Copy in official files). An editorial from the Los Angeles Times was attached. Mayor Hamilton said he had read the letter and the editorial and said he was not well enough informed to make a decision. The cities adjoining the coast- line would be better versed on this issue. Councilman King said his comment would be the same as on San Onofre Atomic Plant, that they should leave this to other people as we don't have the knowledge they do or the need they have. He said if the tech- nology is there and the Government feels there is control and if we need the oil to survive, let them decide. Councilman McCaron said there have been times when the Times has published editorials and some of the information is not correct. They have an opinion of their own based on how the results should be on a subject. He suggested that they write to Interior Secretary Rogers C. B. Morton for further information, The Council should not plunge in and object to some- thing that is already going on without knowing what the problems are. Councilman King said he would agree. Mayor Hamilton instructed City Manager Mocalis to write a letter to Interior Secretary Rogers C. B. Morton. 00- City Clerk Balkus presented a request from Junior Girl Scout Troop 366 for a Temporary Use Permit to hold a Swap-A-Rama at Foster School Parking Lot on December 7, 1974 or on December 14, 1974 in case of rain). FEES WAIVED AND TEMPORARY USE PERMIT TO JUNIOR GIRL SCOUT TROOP 366 FOR SWAP-A-RAMA APPROVED. M/S/C: GREGORY/KING. 00- City Manager Mocatis said 3 bids were received for swimming pool decking at Morgan Park. The tow bid is approximately $407.00 over the budgeted figure, but the savings on the purchase of the tawnmower was more than enough to offset the difference in the budget. It was recommended that the contract be awarded to Surface Decking Company, Van Nuys, California, in accordance with the tow bid of $5,287.00. Councilman McCaron asked if this was replacing the decking currently on the pool and is the pool in need of further repairs. City Manager Mocatis said this replaced cracked decking; that 2 years ago the clorinating system was changed. He said there will be repairs required from time to time because the pool has been used for 40 years, but is still a good facility. These are funds which belong to the City and are held by the County until we request them. NO. 74-111 ADOPTED RESOLUTION NO* 74-112, REQUESTING AN ALLOCATION OF COUNTY AID TO CITIES FUNDS FOR THE ACQUISITION OF RIGHT OF WAY FOR THE IMPROVEMENT OF RAMONA BOULEVARD FROM VIRGINIA AVENUE TO FRANCISQUITO AVENUE City Manager Mocalis said the amount of the request was $135,903 and it was recommended that the resolution be adopted and a certified copy be submitted to the Los Angeles County Road Commissioner. M/S/C: KING/GREGORY. 00- City Manager Mocalis stated that it was possible for the City to make application to the Public Utilities Commission requesting 50X of the City's cost be reimbursed from the Commission's crossing protection fund for upgrading various railroad crossings in conjunction wtih the Ramona Boule- vard Project. The total cost was approximately $41,890, of which the City's share is $23,674.95. The amount requested is $11,837.48. It is recom- mended that the resolution be adopted. It was recommended that a warrant in the amount of $31,960.80 be paid to Maurice Fleishman and Associates. PHASE APPROVED 00- City Manager Mocalis said Acting Chief of Police Hebert had requested approval of a sole source purchase of three police radios from Mobile Radio, Inc. of Sante Fe Springs in amount of $3,383.52. $3,075.00 had been budgeted,but sufficient funds are available to take care of the $308.52 balance. He reconmended that the purchase be authorized pursuant to Section 2914(c) of the Municipal Code. PURSUANT TO SECTION 2914(c) OF MUNICIPAL CODE, THREE POLICE RADIOS PURCHASED FROM MOBILE RADIO, INC. M/S/C: KING/GREGORY. 00- City Manager Mocalis said the Federal Highway Administration has a Bill that would affect the citizen's rights to enjoy their property by requir- ing a 300' set-back on any street having vehicle traffic of 25,000 per day. It was recommended that the resolution requesting revisions to the Federal Standards on Noise Level Requirements be adopted. M/S/C: WALDO/KING. 00- City Manager Mocalis oresented the annual city financial report from the auditors to the Council. He said a net savings of approximately $140.000 of unspent funds was realized and this was remarkable in a year when there were unexpected increases in costs. He said this Health Council had been highly successful according to the various police departments, school districts and the sheriff's department. Dr. Ullah is to be commended for an outstanding operation. He reports to the City and in one month averaged about 1,500 visits to the five centers. Councilman Gregory said she has attended the meet- ings and Dr. Utiah expends so much energy. If he ever tires of the service for the citizens in this area, we should hire him for the City. He really has done a tremendous job. Councilman McCaron said the report lists the amount of grant funds and the amount is very tittle above what the City has been contributing. What happened to the rest of the people's contributions. City Manager Mocalis said Councilman McCaron was referring to Item 2. This pertains to a particular grant amounting to $255,000 which included $11,250 from local government funds of five cities, $18,000 from State and $225,000 from the Federal Government. This is just a portion of the funds given by the cities. The actual budget from the five cities was about $50,000. They have used donations as matching funds for several different grant applications. 00- City Manager Mocalis referred to the report made by the Director of Public Works describing recent difficulties with the electrical system in the City Ha11 Building. Over the years repairs have been made on an emergency basis and now they must be corrected or a serious disruption to police operations and other vital functions could result. Director of Public Works Lathrop recommended that an electrical survey be made and that he be author- ized to spend a maximum of $1,000 for the survey. Based upon the results of the survey, it will be necessary to request a budget amendment to make whatever repairs are necessary to remove the hazard. Councilman King said he agreed and it should be done as quickly as possible. Councilman Waldo said that this $1,000 is just for the survey and City Manager Mocatis said that was correct and they would report to Council just how much it wilt cost to take care of the repairs. Councilman King said this was so important that as soon as the survey is completed and funds are needed, the Council should be contacted so some action may be taken. He recommended that February 5, 1975 be set for public hearing to hear any comments or complaints by the property owners affected by the improvements. M/S/C: GREGORY/KING. 00- Director of Public Works Lathrop said the City had received a tetter from Mr. Howard Sutterfield, Baldwin Park Unified School District, requesting that the City provide a crossing guard at the Vineland Avenue and Channing Street pedestrian crosswalk to protect the grade school children going to and from school. The Traffic Committee had reviewed the request and conducted studies and determined the request was not justified. Copy of report in official files). Councilman McCaron asked if it would be possible to change the markings on the street for drivers to stow down because of the school. Director of Public Works Lathrop said there are State and National standards for advance warning signs on paving and providing signs on the edge of the roadway for school crossings. These have been complied with. The reason for standardiza- tion is that motorists will recognize these stan- dards in every city and state. Councilman King asked how many days were the traffic counts taken and Mr. Lathrop said traffic counts were taken on two mid-week days. Speed checks were taken on the street in the morning, noon and afternoon periods when children were going to or coming from school. These were made on two days also. Councilman King asked about funding for only the peak hours; had that been taken into consideration. Mr. Lathrop said the Chief of Police did investi- gate the cost of funding a crossing guard for the balance of the school year. Councilman King suggested more justification from Mr. Sutterfield and also to look into the feasibil- ity of just the peak hours and report back to Council. He asked that they defer any decision until next meeting. Mayor Hamilton said he had no objections, but the Traffic Committee had made a thorough study and did not recommend it, he didn't feel that there was any advantage unless a hazard was indicated. Councilman King said there were several areas that were not looked into; peak hours and perhaps Mr. Sutterfield had more to offer than was indicated in his letter. Mayor Hamilton said they would defer action on this report until the next meeting. 00- City Manager Mocalis stated that Chief of Police Dale Adams will graduate from the FBI Academy on December 5, 1974. He expressed his appreciation to Acting Chief of Police Hebert and the staff for a job well done during Chief Adam's absence. 00- Councitman Gregory referred to second reading on Ordinance No. 691 said they had just received the list of changes and she would like to have more time to review them. Mayor Hamilton asked City Attorney Flandrick if he could explain the changes and Mr. Flandrick said he didn't have his notes, but he could try. The Checker vehicle was proven to be a good, sound mechanical vehicle. It was decided at that time if these vehicles did not stand up, they would make a change. City Manager Mocalis said this was not imposed on the police department. The research division of the police department made a thorough analysis of the various types of equipment available and requested permission from the City Council to purchase these Checker vehicles to be used as a test only. Many things were to be considered while they were in use. Some things have not contributed to the morale of the department. It is nothing to be ashamed of. Mayor Hamilton said they would defer second reading on Ordinance No. 691 to the next meet- ing. 00- ORD. NO. 691 DEFER TO NEXT MTG. Councilman King asked to whom they would direct a letter in respect to committees and action on setting a policy on offenders, juveniles, etc. He referred to the juveniles attacking an officer on the school grounds who were released from cus- tody the following day. He said the community should start sending tetters to some committees to help get better legislature for court action. City Attorney Flandrick said the Board of Super- visors had requested that an interim committee study be made on the entire problem of juvenile delinquency as far as the courts are concerned. The Speaker has indicated that he will appoint a committee who wilt be functioning shortly as the legislature has just reconvened. He sug- gested that Mr. Mocalis be asked to stay in con- tact with the Speaker's office so when the com- mittee is formed, we would be on the mailing list. They wi11 be sending out requests for information which the police department will be answering as well as the Council being informed of the problems. Councilman King said he thought a tetter to the committee showing our appreciation for starting the committee would be in order. Mayor Hamilton said we all know that something should be done because the penalty is not com- mensurate with the crime. It is very discourag- ing to the police who are trying to do their job. 00- JUVENILE DELINQUENCY Mr. Carl Sharpe, 5018 Wimmer Avenue, said he thought the Checker Cabs being used as police cars are ridiculous as they belittle the City. Councilman King said these cars were requested by the Police Department. Mr. Sharpe said to have good rapport with the citizens and teenagers, the police have to have respect and they won't have it while driving Checker Cabs. MR.
