There were no objections. 00- City Attorney Flandrick administered the oath to those in the audience desiring to be heard during the meeting. 00- Mr. James Garrow, 1011 N. Baldwin Park Boulevard, said he had lobbied in Sacramento for legislation and he was paid to do it and he felt it was petty to question a two day expense account. City representatives must have the to61s to work with to get the work done. Stay- ing at good hotels and entertaining is costly, but you're competing with other cities that do spend money and these people deserve the best tools to work with. 00- RES. However, as there was no criminal action taken by the police toward him in the altercation in front of Sambo's bar the District Attorney could take no action and said this should be turned over to the City Council. Mr. Flandrick stated he had suggested to Mr. Smith that if he was not satisfied with the City Manager's action that he go to the District Attorney's office. A function of that office is to investigate matters conducted by local agencies. Mr. Smith said the District Attorney had said to go back to the City Council and demand that they reopen the investigation. He requested that Council reopen the investigation of his case. Mayor Hamilton said that only the persons involved in the disciplinary proceedings at the hearing had the right of appeal; that the Council had no juris- di cti on. City Attorney Flandrick said so far as the disci- plinary proceeding is concerned this is correct. If the Council wishes to request the District Attorney's office to investigate they are free to do so. Councilman Gregory asked that Mr. Smith clarify what he was requesting. Mr. Smith said the District Attorney had told him to go back to the Council and ask them to reopen this case. Mr. Flandrick explained that Section 223 of the Personnel Rules and Regulations outlines the procedures for disciplinary hearings. Only the parties involved have the right to present evidence and witnesses or appeal the decision of the City Manager to the Personnel Board and thereafter to the City Council. There is no provision for anyone who claims to be a wronged indi- vidual or a witness to an event to be a party to these proceedings. The District Attorney's office is avail" able for consultation if Mr. Smith is alleging that either of the officers committed any crime against his person, such as battery. If Council wishes to formally ask the District Attorney to investigate the various allegations Mr. Smith has made with respect to the two officers it is free to do so. However, the Council is not in a position to reins titute disciplinary proceed- ings against the officers. Mr. Smith said he was alleging neglect of duty, failure to take a report, failing to respond to his call and failing to take any action. Councilman McCaron stated this item should be taken under advisement and investigated. Councilman Waldo asked Mr. Smith if he had filed a formal complaint against the two officers for neglect of duty and Mr. Smith said he filed a complaint against the officers and the bartender on November 1st, with Clifford French. City Manager Mocatis said the informal hearing was held before him in conformance with the Personnel Rules and Regulations and based upon the verbal testimony presented he made a decision that the allegations that the officers had failed to render aid to a citizen were not substantiated. Mr. Smith, according to his state- ments before Council, and the citizen testimony at the hearing, had a superficial scratch on his left cheek or the left side of his neck. His mother and father were with him and he did not require emergency treatment. An appeal was not filed within 10 days so the City Manager's decision was final. He has explained all of this several times to Mr. Smith. Mr. Smith thought this was one sided as he was not entitled to bring witnesses. Mr. Mocatis said the disciplinary hearing was not a case of Mr. Smith versus the officers. It was the City, in the person of the Chief of Police, versus the officers who presented their testimony and their witnesses. He, as the hearing officer, was not permitted to solicit witnesses for either side. Councilman Waldo asked if Mr. Smith had explained in detail what his complaint was and what had occurred in his November 1st complaint and Mr. Smith said he had. Councilman Waldo said side of the story was the Chief of Police. that his point was that Mr. Smith's presented at the hearing through Mr. Smith agreed as far as the Sambo's incident, but a third officer testified regarding a previous incident and he felt this may have swayed the City Manager's decision. Mayor Hamilton said this item would be taken under advisement and investigated. 00- Mrs. Gloria Zook, 4817 N. La Rica, commended the Police Department and cited two recent instances which were well handled. She had read the article in a throw away newspaoer and she wondered why so much was being made of this. It sounded to her and others tike someone has a vendetta against the department. She felt the depart- ment deserves credit for their work, not criticism. 00- Mrs. Janice H. Miller, 728 Goodson Drive, La Puente, referred to a November 22nd incident concerning her daughters and her son which occurred on Baldwin Park Boulevard in Baldwin Park, which she felt was not properly handled. This involved the City of Industry Sheriff's Department, Baldwin Park and the District Attorney. She would like further investigation. Continued) TAKEN UNDER ADVISEMENT TO BE INVESTIGATED MRS. Stancroft Street, said that speaking from personal experiences she had no complaint about the Police Department. She asked if the City Manager would have a report on the expense statements and Mayor Hamilton said the report would be given later in the meeting. Comments should be made now under Oral Communications. Mrs. Slater asked if Council had authorized Councilman Waldo to go to the Senate Committee Hearing in San Francisco on November 21st. Mayor Hamilton said this was not required on City business and Mrs. Slater wondered why authorization was necessary for Councilman King to go to Mexico. Mayor Hamilton said that normally the City does not authorize out of state travel. Mrs. Slater asked what sort of guidelines were used. City Manager Mocalis said there was very short notice of this CRA meeting before Senator Marks in San Francisco. He had contacted the Mayor as he felt it was imperative that Mr. Sexton represent the City as the recent election indicated the community's desire. Councilman Waldo was witling to represent the Council as the elected representative. It is a common policy that an elected official attend, to get information to brinq back to their colleagues. Councilman McCaron stated that money was budgeted for this purpose. Mrs. Slater suggested that a per diem expense system be initiated for the city, and she asked who authorized partial payment for Mr. Jim Woods' expenses. As the Mayor said this would be answered in the report, Mrs. Slater then referred back to Mr. Sexton's previous trip, costing $106.40, to Sacramento. Mr. Graham Ritchie had a letter from the City Council to represent the city and as Mr. Sexton did not speak he was not needed. She strongly objected to these kinds of expenses. She also questioned Mr. Raphiel going to San Bernardino on June 27th and on June 28th. when one trip would have been sufficient. City Manager Mocalis stated that when he was hired he was asked by the Council to bring extra income to the community and the avenues suggested were CRA and Grants You have to spend time and money to make money. We have received 15 or 16 Federal Grants, totaling over 1-1/2 million dollars, making more services available to the community. We have received funds through the efforts of Mr. Sexton and Mr. Raphiel and we have the responsibility to be careful how we use taxpayers money. He carefully reviews expenditures and although the statements referred to were approved when he was out of the city he has since checked them and will make a report to the Council this evening on Mr. Sexton's expenses. He had told him that if out of town trips were necessary the city would come up with the money. Mayor Hamilton felt this was money well spent and that these expenses have been minimal so far; that this man should have a free hand to promote business for our city and that thus far his efforts have been well worthwhile. We could hold down progress by limiting this man's efforts. Mrs. Slater said she realized that some expense is necessary for development but she felt that $478.21, of which $177.52 was for meals, for a night and a day, was excessive as she could take her family out every night for a week for less money. She felt that the city should have a per diem allowance. 00- Mr. Joe Cate, 4457 No. Maine, said the Police Depart- ment has done a marvelous job, but that he felt that Council should allocate them more men and have 2 officers in a patrol car so they can do the job. This would relieve the kind of pressure that has been placed on them. 00- Mr. Bernard Downs, 13059 Francisquito, said he agreed with Mr. Cate. He also felt the department should have more modern equipment. He cited problems he has had and said he was sti'11 waiting for the department to contact him. 00- JOE CALE RE POLICE DEPARTMENT MR. BERNARD DOWNS RE POLICE DEPARTMENT Mr. Jack L. Loether, Treasure Chest, 243 E. Foothill Blvd., Glendora, stated that what they were stressing in the newspaper was a citizen complaint and what they are realty fighting for is the right of access to police action reports as to what happened, who was arrested, why and when. He referred to AB1687 which he said was passed with an amendment which excludes members of the press from penalty for attempt- ing to obtain copies of the official state rap" sheet. They are asking to find out what is happening when a person is booked from the police blotter, which has nothing to do with the rap" sheet. The amendment also states that the newspaper has a right to find out what has happened. He stated that he had spoken to the Council men, that the Council men had listened to tapes and that each had a copy of the Attorney General's re- port and that if Council did not act or have a personnel session it would be an injustice to the citizens of the city and the United States of America. 00- Mr. T. E. Carpenter, 4346 Jerry Avenue, said he had researched Mr. Sexton's expenses from August into December and he felt this was a misuse of city funds and that the San Francisco hearing could have been handled in one day. He understood that the Mayor authorized the trip and that Councilman Waldo was going to pay Mr. Woods' expenses, however, it appears his expenses were paid. He had checked the San Francisco Hitton as to single and double occupancy costs. For sustenance the Federal Government and Civil Service Commission allows $25.00 per day, the Continued) MR. J. L. He thought the City Manager was remiss in approving these expenses and that there should be a procedure and that he should be prudent in reviewing expenses. He did not know why a person was there just to take pictures and he asked that the city allow no more than the county. He had heard on T.V. that any- one in need should contact the police department or the service council and the lady digging in the garbage can should have been sent there. A man in need of food had come to him and he had made the proper contacts to no avail and had given the man some money. He questioned why the phone number 443-4057 Department of Public Social Services) was not publicized. 00- Mr. Carl Sharpe, 5018 Wimmer Avenue, said $20.00 a day would be inadequate in San Francisco; that there should be a time limit on oral communications. Only CRA expense accounts have been questioned. The people have indicated they want the city to grow and council is elected to see that this is done and this badgering and the harrassment of tenants in the 19 acres should be stopped. At the hearing some people had pouted and left San Francisco the same day as their testimony time had been limited. He asked that Council take a firm stand and curtail the badgering. Councilman King stated he felt the Mayor had conducted the meeting quite well and that everyone should be given the right to speak regardless of who feels they shouldn't; that Council recognizes this fact and would continue to do so, otherwise they would be remiss in their duties. 00- Major Dan Zapatski, BRAVO, 4025 Maine Avenue, stated he thought Baldwin Park has a fantastic future, and nothing but economic growth potential. This was one of the reasons BRAVO National Headquarters was established here. Through involvement with the City and trying to bring economic and commercial ventures in he has met the Council, Mr. Mocalis and Mr. Sexton, a11 who are concerned and interested in Baldwin Park, and despite adverse publicity the City will progress. He is thankful for the Council and staff and will do his best to add to the effort. 00- City Manager Mocalis stated that regarding the matter of expenses, the state law states that elected officials will be reimbursed for expenses incurred on behalf of the city and that it would be inappropriate for him to report on the expenses of a Councilman. He stated that Mr. Sexton's expenses for November 20, 21 and 22, 1974 included $41.50 air fare; mileage, including a trip to his home to pickup equipment necessary for the Senate hearing, $13.00; parking November 20th, 21st and 22nd at Los Angeles Inter- national Airport, $6.50; taxi, $8.00; storage, as an air flight was not available, $3.25; food, tips and miscellaneous, $75.57; hotel, $67.90. These are listed on and attached to a standard form. All statements are audited by the Finance Director for accuracy and to be sure funds were budgeted. We have a yearly control, the pro- cedure used by most cities. A departmental deter- mination is made and included in the budget as to total expenses for the year. This is approved by Council. Sometimes, if it is of benefit to the community, an expenditure over the budget is made and justified. Through budgetary control we finished 1973-74 in the black and departments reflected an over all savings to the community. He had checked Mr. Sexton's expenses in detail and there was no question in his mind that the purpose of the trip was not only authorized but in the best interest of the City and we do not have a policy on the amount to spend for a particular meal. The City is required to present the case of our community before certain bodies which could be called lobbying, or stating the true facts before that body. This is done for our citizens; the majority of which supported CRA. He found nothing improper about Mr. Sexton's expenses and recommended that Council approve the warrant. Councilman King asked if it was proper that some expense for Mr. Woods was included in the claim. Mr. Mocalis said this only involved some meats and it is not inappropriate for the city to host members of the press, nor was it a misuse of public funds. Councilman King stated he voted with reservations. 00- Councilman Waldo stated that it was important that they go to San Francisco. The County is lobbying to revamp the CRA law and trying to find a way to tax cities that have CRA. Small cities have much to gain by this law and have to fight to keep it the way it is. We do not want taxes raised and we want the City to progress. He hoped that citizens appreciated what they tried to do in San Francisco in rallying other cities. More hearings will be held in Los Angeles, San Diego and Sacramento and he plans to attend whether he is reimbursed or not as he feels very strongly about this. He was elected in March, 1974 and aside from San Francisco, has driven to and attended many functions and with the exception of one dinner and 3 or 4 luncheons, he had not submitted an expense statement. When he went to San Francisco it was necessary to hire someone in his place of business. The money was not advanced and he felt a city employee should be reimbursed without question. Whether he, himself was reimbursed or not would not make or break him, but Council salary after deductions is $126.00 a month. After citizen complaints he checked and found that, without the trip to San Francisco, it had cost him over $600.00 to be a Councilman and that from now on if he drives a half block or has lunch on city business he will record it. They tried to do a good job and he was hurt by the complaints. He thought they did a good job and will try to do so again if it comes up. He asked for a decision on his expense statement. He has absorbed expenses but in the future he will keep a record and turn in his expenses. He felt Councilman Waldo had clarified his expenses. MOTION TO APPROVE $261.49 EXPENSES COUNCILMAN WALDO) Councilman Gregory said she thought that in view of all the discussion on the use of public funds, for other than a Councilman or a City official, that there should be some discussion with the Council and Councilman Waldo. She has attended various functions but has never taken anyone outside the city. She could appreciate taking someone in the newspaper business but there was no authorization and perhaps Councilman Waldo should consider this next time, if there is a next time. That authority could be given at a Council meeting and would avert future problems. She was not concerned with the expenditure as such, but more with the precedent being set and the public- ity. She stated that she was not questioning Council- man Waldo's expenses as a Councilman but that she thought if he would reconsider that part of the expenditure it would make it easier for the rest of the Council. In her more than 10 years on the Council she had always submitted a statement of what was fair and owed to her for her own participation but she felt this expenditure should be clarified before a vote was taken. Councilman Waldo stated that he felt that it was important that the community know what was happening; he had invited reporters from the Treasure Chest and the Tribune to go. Mr. Woods paid for his own trans- portation. He did have some meals with Councilman Waldo and Mr. Sexton and he shared a room with Council- man Waldo. Councilman King stated he had no objection to Councit- mas Waldo's expenses but that when partial expenses for another party, on a trip, are involved he thought the proper procedure for Council men would be to have the concurrence of their colleagues when spending city funds. Councilman McCaron stated that if Councilman Waldo felt he was justified in the expenditure, then he was entitled to the money he put out. He said guidelines should be set up for submission and approval of expenses. Mayor Hamilton called for a ROLL CALL ON THE MOTION. ROLL CALL. THERE WERE NO OBJECTIONS. Final approval has been received from ICC and it is now appropriate for the agreement to be executed. He explained that in conjunction with the agreement Lampman and Associates had submitted a proposal to try to work out an arrangement with the railroad that would involve some excess adjacent to Ramona Blvd. and a possible profit for the City. provided Council with a report The fee would be $100,000.00 with a codicil that the agreement can be terminated at anytime subject to the fact that once they have succeeded with the first two items the termination fee would be $50,000.00. PROPOSED AGREEMENT LAMPMAN & ASSOCIATES HELD OVER TO 1/15/75 00- City Manager Mocatis announced that he had accepted the position of City Manager for the City of San Juan Capistrano, starting February 17, 1975. He expressed appreciation for citizen help over the past 3 years and said it had been a privilege to work with everyone here. He felt the City had progressed through his efforts and a fine staff and thanked Council and the staff for their support. He felt he had been a positive force for good in Baldwin Park and had made many splendid friends. He said it has been interesting and exhilarating and he hoped Council would think their working relationship had been of mutual benefit to the community. Councilman King said some years ago he had opposed an early retirement bill for City Manager's, but he has since changed his mind as there are stresses and strains which Council sometimes adds to. He thanked Mr. Mocalis for his fine service and the money thousands of dollars he had saved the City. He appreciated that the grants received were so handled that they would not leave the City with an excessive amount of bills to pay. Mayor Hamilton commeded Mr. Mocalis for over 1-1/2 million dollars in qrants he has obtained and stressed the work and overtime involved. He stated Mr. Mocalis would be missed and hard to replace but he would be receiving more money, have less people to contend with and he hoped a good Council to work with. He appreciated Mr. Mocalis"s courtesies extended to him when he came to City Halt and thanked him. When street improvements were made the Edison Company moved poles to a point behind the new curb. The Edison Company had prior rights which they wish to preserve. The agreement also provides for reim- bursement to the Edison Company if in the future the City requests relocation of their facilities. There were no objections. 00- Councilman Gregory stated that at the previous meeting she had requested a joint meeting of all the Council with alt the School Board members to discuss youth problems. She had received a notice from Mr. Mocalis, of a meeting with Mr. Holland and two School Board members and two Council members King and Gregory) and the City Manager, in the City Manager's office on January 7, 1975 at 7:30 p.m. She asked that the meeting be held in the Council Chambers as she had invited some ladies and other people were interested. City Manager Mocalis stated that Mr. Holland felt it was best to start with committees from each board and then develop into meetings with both full boards. Discussion followed that this would be an open meeting in the Council Chambers. 00- Councilman Waldo stated that he and Councilman King had been appointed by Council to work with a Citizens Committee on a Sister City Program. He asked that the Sister City Program be placed on the next agenda as Valle de Bravo people will be here January 25th and there was nothing budgeted for the program. He suggested that in the meantime some of the Council get together and discuss this. Mrs. Gregory said this was the first Council report and it has been said the people were coming here, but Council does not have a listing of the people on the committee. Councilman Waldo said everyone had been very busy because of the holidays and meeting attendance was nil. Councilman King said Councilman Maldo had been ill at the time of the first meeting; that the Citizens are the ones to be involved in the Sister City Program; that neither the Council or the Chamber should intervene aside from injecting their point of view. Mrs. Cisneros is Chairman of the Committee and she has gotten together people with respect to fund raising by citizens and to house the students. The City should host the dignitaries and possibly by January 25th the committee wilt have the additional needed funds. Mr. Pete Desport, La Puente, who works closely with the Government of Mexico had indicated there would be approximately 23 people involved. He believed they had 2 nights housing arranged for the $tudents. 00- At Councilman Gregory's request, Mr. Mocalis introduced Judy Hammond, reporter for the San Gabriel Valley Tribune. He said she is very astute and he felt the community would be happy with her reporting. She was welcomed by the Council.
