Case No. 74-S-15, west side of Bresee Avenue between Olive Street and Dunia Street C&G). Proper postings and mailings had been accomplished. There were no written protests. As there was no testimony in behalf of or opposition to 74-S-15, Mayor Hamilton declared the public hearing dosed. Mr. Lathrop read by title: RESOLUTION NO. 75-16, CONFIRMING CERTAIN REPORTS OF THE SUPERINTENDENT OF STREETS 74-S-15) He stated that under Section 1 f) the word no" should be inserted. Stancroft, requested that agenda library packets be considered at this time and also that the tetter from Mrs. Helen Vaughan be read. City Clerk Balkus read in full the letter from Helen Vaughan, Librarian-in-Charge of the Los Angeles County Library in Baldwin Park, which stated in part, that the Library exists to serve its' community and they are pleased to make the packets available. More people are aware of their availability and requests have increased. It is not satisfactory to limit packets to library use and it would be of greater merit to have 3 or 4 for overnight circulation. As packets remain City property, it would not be in the library's domain to collect monies due or retrieve them. copy in official files) Mrs. Slater asked if there would be a report on this matter as directed by Council. Mayor Hamilton recommended that this item be held for consideration by the entire Council and Councilman Waldo said he would like to check into this further. Mrs. Slater suggested that more packets be made available depending upon the demand and that they be given to the library so they can regard them as they do other books and records. Mayor Hamilton asked that the Acting City Manager place this item on the next agenda and said the Council would have to use restraints as to the number as packets cost about $10.00 each and we have to took after the taxpayer's dollar. Jones and a Representative of the Sheriffs Department, and the use of more accurate maps. She said that the Concerned Citizens asked that when the noise level of the proposed motorcycle park was evaluated that this be done on Saturday or Sunday, the greatest attendance days, and that a resident of the area be selected as a representative for the test. Also, she asked if the test would be with 150 vehicles for approximately 4 hours. Councilman King asked that Mr. Hale convey this request to the Recreation Department. 00- Mr. Tom Carpenter, 4346 Jerry Avenue, said that since the agenda packet publicity, requests have increased. Mrs. Vaughan made a fine presentation and he agreed with Mrs. Slater's suggestion that packets be a part of library material. Regarding the oath administered at Council meetings, he requested that in the interest of truth that Council and staff also take the oath or that it be abolished. The Planning Commission abolished the oath about 2 years ago. He questioned that the Oath of Office, carried the same implication and was applicable at the meetings. City Attorney Flandrick explained that unless a person were sworn in at the meeting no other oath would apply. Mr. Carpenter said, then it was a one sided proposition when Council and staff could say anything without penalty of perjury and the audience must swear under oath that everything they say is true; that either everyone take the oath or that it be abolished. Councilman Waldo said that as elected officials are sworn in when they take office, much as a judge, is elected and sworn in, and those giving testimony or the jury is sworn in. He asked the City Attorney to compare the two. Mr. Flandrick said that evidence in any proceeding of a judicial nature as such is required by statute to be under oath. Council can require an oath or not as it sees fit. He cautioned Council that if Mr. Carpenter's recommendation were accepted, this should not be made applicable to a disciplinary action as such under civil service rules. Mayor Hamilton stated this would be discussed at the next meeting with a full Council. He stated he would have no qualms about taking the oath and as long as you tell the truth he did not see where it would be objectionable to anyone. 00- MRS. Mayor Hamilton said Mr. Henry would be consulted if necessary when the item came up. 00- Mr. Carl Sharpe, 5018 Wimmer Avenue, stated that regarding the packet checked out for 3 weeks, it was taken out on a Friday and after Wendesday night the packet would be given away. The packet was returned. Tuesday, February 18th, he had checked out a packet and had returned it this afternoon and it showed no other check out date. 00- Mrs. Bertha Regus, 5013 Cutter Street, said that in view of the noise from the Rivergrade Road Raceway she hoped the one proposed at 605 and the San Bemardino Freeways would not be approved and she felt that 80% of the people in the area were against it. Mayor Hamilton said he was not present at the last meeting but he had read tetters and petitions and the minutes of the meeting. Mayor pro tern Gregory had explained this would be presented to the Recreation and Park Commission and the Planning Commission before coming before Council, if it ever did. Council can listen but take no official action at this time. Councilman Waldo explained that most of the Council are attending the Recreation and Park Commission meetings and will attend the Planning Commission meetings so they are aware of the peoples wiihes. Councilman King asked for clarification that people do have a right to speak under Oral Communications but in this case Council could not respond at this point because this is now before the Recreation and Park Commission. REYNOLDS BUICK, INC RE ITEM 7 UNDER CITY MANAGER CARL SHARPE RE AGENDA PACKETS AT LIBRARY BERTHA REGUS MOTORCYCLE PARK Mr. Flandrick said if the question ever comes before Council there will be a series of hearings, an environmental impact hearing and that citizens can interject their views under Oral Communications unless Council feels it is inappropriate. Oral Communications is not an absolute, unqualifying right. The material presented has to be relevant and if there are to be public hearings later Council does not have to listen to things two or three times. 00- City Clerk Balkus read in full a letter from Frank Zarate, President of the Baldwin Park Parents and Youth Committee,!requesting that Council form and effect a delinquency prevention agency consisting of four employees. This would require emergency measures to allocate funds for the Outreach Program suggested by Gene Anderson, Los Angeles County Department of Community Services, at the last meeting. This was discussed with Mr. Hale and action is necessary to prevent shootings and loss of property. Procedures were discussed, etc., which will be necessary for a coordinated effort between about 12 city organizations in Baldwin Park interested in problems of troubled youth. It takes time for the County to put together a proposed approach that wilt be workable in Baldwin Park. The City has applied to the Comprehensive Employment Training Act people through the County for 4 Outreach people. If we get these people they will be assigned to the Recreation and Park Department to serve as a nucleus for this type of approach. There is much planning and coordinated effort necessary and nothing can be instituted until we are sure of the manpower, the volunteer effort and the necessary money. Councilman Waldo said the two County men were invited and had explained the program at the last meeting. They are experienced and understand the problem. They know how to communicate and that is what we are trying to do to prevent further problems. They said that if the City would contact Supervisor Schabarum, a program could be instituted. He understood that County money was available to hire people for one year, and he asked if any City money was available now for this purpose. Mr. Hate said he had made application and hopefully we would receive the County money, but we do not have any money available at the moment. There is money for C.E.T.A. personnel which is funded until December 30, 1975. Councilman Waldo asked that Mr. Hale be directed to contact Supervisor Schabarum and see if any money is available. Supervisor Schabarum knows about the problem in the communities around here and he is concerned. If there is a rumble at school these men with their credentials and know how are right in the middle of it and they know how to handle it. He said there was such a concerned and experienced man in the audience. He understands and can reach these young people. Mayor Hamilton requested that Mr. Hale pursue this and that Councitmen Waldo and King and Mr. Hate meet with the Youth Communications Committee to assist them and that Council be kept informed. Councilman King agreed that the problem is urgent and he thought that Mr. Hale should actively pursue this and that we should work as fast and decisively as possible while being cautious in the steps we are taking. Mayor Hamilton requested that Mr. Hale or a member of the staff attend the Community meetings. Mr. Hale stated that he is President of the Boys Club and that they have a vested interest in solving some of the problems of our troubled youth. Mrs. Gloria Zook, 4817 N. La Rica, thought we have to do something about our problems and she thanked Mr. Hale for helping with the band group; 150 young people who do not have problems with the project they have going. She asked if it could be ascertained how the Los Angeles Police Department broke up gangs some years ago and what had happened. Continued) MRS. GLORIA ZOOK 4817 N. They have an office on the second floor at 13887 E. Francisquito, and a telephone, number 338-9785, and he welcomed all ideas on how to solve the problem.. He would advise Council and Mr. Hale of their next meeting date. Councilman Waldo explained that Mr. Zarate had volunteered his time for a year trying to find jobs for young people. He again stressed the need for action. Mr. Carl Sharpe said he had left a Neighborhood Vigilance Committee Card at the Police Station as alt we need right now is for a radical to start some- thing. The Outreach Program is working. There have been daily shootings and a body and further occurrences should be prevented. Mr. Schabarum can help if we can get funds, possibly tax sharing revenue. Councilman King said the need was as urgent as the Mid- Valley Drug problem and should be a cooperative program between cities. Mr. T. E. Carpenter, 4346 Jerry, said he had observed and participated in what Council has done for several years; that he had photographed gangs that were writing graffiti) and spent hours with Councilman Waldo. A big publicity stunt was made of it graffiti), instead of keeping it quiet aad then it was dropped because the way he looked at it this was for All American City, which he had protested. Graffiti was not stopped and money and meetings are not the answer to the gang problem. He did not know the answer but believed the first thing was cooperation with the law enforcement agency. 00- With the concurrence of Council, items 1 and 2 under City Manager were deferred until after an executive session pertaining to employment was held. There were no objections. 00- Acting City Manager Hale explained that the Architect for City Hall had submitted plans and specifications to the Building Department for final check by March 3, 1975. After any corrections are made by the Architect the plans and specifications will be submitted to Council for final approval. The Architect's letter of February 11, 1975, recommends that electronic design expert Carl Yackey, Granada Hills, be retained to prepare special designs and specifications for audio visual communications and police communications. Mr. Yackey proposes $12.50 per hour, $2,500.00 maximum APPROVE PROPOSAL OF CARL YACKEY FOR ELECTRONIC DESIGN AND SPECIFICATIONS AT $12.50 PER HOUR, $2,500.00 MAXIMUM. APPROVE PROPOSAL FOR ELECTRONIC DESIGN FROM CARL YACKEY AT $12.50 PER HOUR $2.500.00 MAXIMUM Councilman Gregory said there had been many meetings to consider plans with the Architect, City Manager and personnel but she had not been included in some informational meetings. She suggested that in the future there be a Committee composed of a Councilman, City Manager, and a representative of the Police and miscellaneous personnel. Mayor Hamilton said preliminary plans have been approved and he could not see the importance of a separate committee involvement which would hold up progress. Information can be had from the City Manager's office prior to a meeting. As the plans are in the Building Department, Councilman Waldo asked if there was any reason why 2 Councilmen could not go over the plans. He has been waiting to get them from the Architect so he could go over them. Councilman King asked if there had been any significant change since he had seen the plans, 7h months ago, and Mr. Hale said there had been slight revisions. He recommended a building committee including staff with authority to make the necessary change orders involved in the construction sequences. These changes would not relate to money. Mayor Hamilton said cost change would require Council approval and delays would increase building costs. Council must show the electorate the need for a City Ha11 as this wilt require a 2/3 vote. Councilmen Gregory and Waldo volunteered to serve on the Committee. They wilt report to Council. COUNCILMEN GREGORY & WALDO TO SERVE ON BUILDING COMMITTEE 00- Acting City Manager Hale explained that Senate Bill 312 would amend the Public Employees Retirement System to exclude persons employed in a work experience program pursuant to the Federal Emergency Jobs and Assistance Act of 1974 from PERS with respect to such services. This would save the City approximately 10% of federal allocations which could be utilized for additional jobs. The requirements became effective January 1, 1975 and purchase of the truck was approved by Council September 25, 1974, based on specifications of August 23. 1974. Mr. Joseph D. Henry, Reynolds Buick, Inc., West Covina, explained that the City specifications were geared to 1974 models and they had proposed their bid on preliminary advance specifications of the 1975 models prior to the changing laws and specifications that were being written.
