There were no written protests. Planning Director Kilgour reviewed the resume of the case and said the Planning Commission recommended approval of the zone change. Mr. T. E. Carpenter, 4346 Jerry, stated he opposed the zone change as they have taken two R-1 lots facing Nubia and faced them on Calmview and what he was violently opposed to was making them all zero lot lines and putting the plant smack on the lot tine. Unless people become interested they will find manufacturing within 30 or 40 feet of their bedrooms. As there was no further testimony either in behalf of or in opposition to Z-386, Mayor Hamilton declared the public hearing closed. Councilman King said that as this was consistent with the General Plan, he tended to go along with the Planning Commission's recommendation. Councilman McCaron questioned why the rear lot line, back of the houses, did not line up with the lot line to the West. Planning Director Kilgour explained that this was the M-1 boundary on Specific Plan No. 26 also the proposal is for 23,414 feet of M-1 area and any reduction would change the building plans. Councilman McCaron asked how much rear yard this would leave the present houses and what is the setback. Planning Director Kitgour said the line would be 20 feet from the houses; that the required setback from M-1 to R-1 is 20 feet; that the Planning Commission held a separate hearing on a variance to build on the property line with a 16 feet high block wall. This was approved subject to the zone change. Councilman McCaron asked if it had been brought before the Planning Commission as to why they want an irregular lot and how many feet was the tine offset from the West lot line. Mr. Kilgour said the Southerly boundary coincides with Specific Plan No. 26 as to the lot depth from Nubia. Councilman Waldo asked if there were homes on the two lots at the corner of Nubia and Calmview and wilt this development be close to those homes. Mr. Kilgour said there were two houses on the lots which the applicant owns and he proposes to split off the northerly 141 feet of the property and there would be 20 feet, from the back of the existing residences to the M-1 property and these would be legal conforming lots. In answer to Mayor Hamilton, Mr. Kilgour said the watt of the building on the property line wilt be 16 feet high. Discussion followed. Councilman Gregory said this area was discussed in conjunction with the General Plan and the homes facing Nubia would remain to complement the homes across the street. She would have preferred a more regular lot line as this could cause problems, how- ever, there is a buffer and this conforms to the General Plan. NO. 699 INTRODUCED It was the time and place fixed for a public hearing on an appeal from the decision of the Planning Commission on conditions of approval of Parcel Map No. 873. APPLICANT: Paul Battaglia; owner Mr. and Mrs. Raymond Miner. Proper mailing had been made. Planning Director Kilgour explained that Mr. Battaglia was asking for a waiver of two conditions of the Parcel Map. Condition No. 2 Build a two car garage to accommodate the existing residence on lot 4 and condition No. 4 The driveway for lot 4 shall be paved to the new garage. The intent is to develop three single family residences on Kenmore, after recording the Parcel Map, and leave the existing house at 4134 Walnut without any structural changes. He presented pictures of the property and of surrounding properties. He explained that the Planning Commission's intent was to upgrade the area as development is taking place and it is revitalizing itself. Mr. Paul Battaglia, 1816 Ranchero Street, West Covina, representing Battaglia and Associates, said the garage requirement would be an economic hardship as the value of the house, about $12,000.00, is not in proportion to the value of the improvement, $2,500.00. The owner wishes to lot split and sell the property but is handicapped by the expensive improvement requirement for a 50 year old house. Last July on Parcel Map 860 and 861 this requirement was waived as the requirement incurs deterioration of older homes on large lots. In view of code requirements he requested that the garage and drive- way requirements be waived. In answer to Councilman Waldo, Mr. Battaglia said the value of the 3 proposed homes would be $90,000.00 and that there is street improvement and that curbs, gutters and sidewalks are going in. He presented pictures of the surrounding area. Mrs. Donna Miner, 6918-D Middleton Street, Huntington Park, California, owner of the property, said it would be a hardship to put in the garage and driveway. They have not been able to sell the entire property nor can they take care of it. They would like to sell the back half and maintain the front part. If they cannot sell the back property they will not be able to make the improvements. Mr. T. E. Carpenter, 4346 Jerry, opposed the waiver of garage and driveway. He said the City should abide by the Ordinance as this would be degrading the City. Councilman Gregory asked if in having the home at 4134 Walnut as it is without a garage or driveway) would it not prove detrimental to the sale of new homes. The exhibit pictures indicate a run down yard. Mr. Battaglia said that as a result of the waiver of requirements in one case where new homes were built on the back of parcels, one old rental the owner lives out of the city), is being repainted and the yard cleaned up. The owner has been able to sell the house because of the lot split. He cited other instances. Councilman Gregory said the nuisance abatement ordinance would be enforceable if necessary. In answer to Councilman Waldo, Mr. Battaglia said the plan would require that the garage be 90 feet from the curb, or near the curb and people would have to walk 90 feet to the house. As there was no further testimony either in favor of or in opposition to the appeal on Parcel Map 873, Mayor Hamilton declared the public hearing closed. Discussion followed that in similar situations on legal non-conforming uses the ordinance had been complied with; the possibility of an agreement to comply with the conditions within a period of years and that the requirements could keep the property from developing. Wet day. 12813 Farnell Street, representing Concerned Citizens, stated they were 1) against the establishment of a motorcycle park west of the 605 freeway and south of the San Bernard!no freeway. This could create noise, dust, pollution and problems. 2) They were not against people who ride motorcycles and did not consider them undesirables, but opposed this activity In their backyard. 3) If a study is made for an environmental park they will assist. They would like to see a family park. Mayor Hamilton said that there were many letters and petitions opposing the motorcycle park, but letters have been received from people who were not aware of the proposed study discussion and from people in favor who had not expressed their opinion. He thought 1t was fair that everyone have an opportunity to speak, and he asked that all speakers be brief and avoid repetition. He said the development study area has been expanded from 19 acres to 140 acres which includes hundreds of homes from Big Dalton to Garvey; that Mayor Hamilton and Councilman Waldo's comments In the newspaper that K-Mart needs 19 acres Is not true as Mr. Potts in charge of real estate for the K-Mart people said a11 they need is about 9 acres, 54.000 sq. feet plus 500 600 parking spaces, and he had never heard of Baldwin Park until 3 or 4 weeks ago. The developer presented a letter and a plot plan including K-Mart and he had paid out of his own pocket for a newspaper item to get these facts to the people. 00- Jack Ray, 12706 E. Farnetl, spoke in opposition to proposed motorcycle park. 00- James D. Rich, 3103-A Big Dalton, Baldwin Park Parents and Youth Communications Committee, thanked the City Council for the use of facilities at Morgan Park on April 13th and for their quick action in screening Outreach Workers. He felt there was a need here for a motorcycle park. Mrs. Patricia Scheidler, 13163 Corak, said the people in the area were notified of the motorcycle park study but the rest of Baldwin Park was not. The Recreation and Park Department planned meetings to notify everyone. She felt this study should be com- pleted to see if there would be problems. She was in favor of a motorcycle park in the neighborhood so the kids would have a chance to ride their motor- cycles as many areas have been closed. Mrs. Darlene Squires, 4309 N. Cutler, was in favor of the motorcycle park and she understood that with proper silencers and spark arresters there is less noise than from the average automobile. Kenneth Collins, 4560 Hornbrook, spoke in favor of the motorcycle park and thought the study should go on to satisfy everyone. Mrs. Diane Colley, 4652 Walnut, favored the project and referred to Supervisor Schabarum's letter of February 6, 1975 which said unless other means of access to the area is developed and unless effective measures can be taken to alleviate noise and dust pollution he was opposed to the project. She felt there should be further study. Robert Pickett, 4150 Cutler, spoke in favor of the project. Joseph Moctezuma, 239 N. Barbara, Azusa, said that in view of the juvenile delinquency problem the kids should have a place to ride motorcycles. Mrs. Mary E. Warren, 4312 Bresee, asked that the motorcycle park study be made to see if it is feasible Her son works and spends his money on tools and motor- cycle parts. He and other boys work in their patio on motorcycles almost every night and they have no place to try them out. The Congressman had investigated and said Mr. Baca had also investigated and ordered a cleanup. She was advised to ask Council's help. Councilman King suggested that Miss Weaver write Supervisor Schabarum, whose address could be secured by contacting Mr. Hale. Councilman Gregory suggested that Mr. Hale follow up on this and that a letter from the Council be sent to Supervisor Schabarum. 00- Robert Hilsinger, 5057 N. Gayhurst, asked what could be done about the Siko family at 5032 Gayhurst. Their house is a fire hazard, also he was fearful that they would jump him and put him out of work again, so he could not make his house payments. They have broken his windows, one at 11:00 p.m. They threw rocks at him and his 3 year old boy and at the car when his wife pulled into the driveway. He brought this to the Police Department and they say there is nothing they can do. Six or seven families have moved out of the area because of this problem. Councilman King asked that Mr. Hale bring this to the Health Department's attention and he asked if the Police Department was close to solving the problem at this time. Lt. Aldrich said they are working on the problem but were not getting much cooperation from juvenile authorities. He recommended that current investigations be completed and see what can be done. Councilman King asked that Mr. Hale report the outcome of this to Council. 00- James Ray Myrick, 4726 Larry, spoke in favor of the motorcycle park which he felt would alleviate gang violence. Michael Hall, 4726 Larry Avenue, spoke in favor of a motorcycle park to alleviate youth problems. He referred to an Alhambra bike park at Mission and Granada. He said the principal at Alhambra High School said problem students were no longer on their list but were involved in motorcycling. Jack Ray. 12706 E. Fame 11. speaking against the the motorcycle park, said the Alhambra bike park is being removed as it was the subject of protests by residents. The proposed park would be for those over 16 years. Money spent would have to be matched by a quarter from Baldwin Park. He felt that conformance to nuisance laws would prohibit dirt cycling and that the discussion this evening had been maneuvered by the Commission. She wondered what precedent was being set for future hiring and questioned the necessity of going outside the City to hire Department Heads. If they are not qualified they should not be functioning in an acting capacity. City Attorney Flandrick said that the City can enter into a contract with an employee. 00- In answer to Mrs. Janet Milton, Mayor Hamilton said the Council had not proposed seeking anyone to sit with Council to consider alternatives to the motor- cycle park. 00- Mayor Hamilton asked for comments from Council on Oral Communications. Councilman Waldo said that although he would have liked to have seen the results of the motorcycle park study report, he would not like to see a motorcycle park near his house. He hoped all the people would band together and fight for such a project in the Santa Fe Dam area. Although the county is against the idea, there is a need and a tittle pressure can be exerted. The study area could be a fine little park and he would tike to see it developed. Councilman McCaron said those in the affected area were legally notified and there were numerous discussions before Council acted to stop the pro- ject study. If the original application included the motorcycle park and funds were available sub- ject to that then that's what they were available for, but the City can apply for funds to develop another type of recreational usage. This is state property acquired for freeway development. The money for the study is from surplus funds, money we would have to match in order to have state funds available to us. The people in the area were concerned that the motorcycle park would be put in despite their efforts to prevent it and he could see no reason why people should live under such conditions with- out coming to some conclusion. For this reason he had brought it up, to instruct the Recreation and Park Commission to find an alternate usage for the area. When Council makes a decision we have to consider who is being hurt and if they are being hurt sufficiently to warrant cancelling any pro- ject and that is what happened and Council readily went for the idea because they all felt the same. Noise definitely carries as illustrated by the racetrack adjacent to Baldwin Park and the drag- strip in El Monte. Much depends upon the barriers set up. The people of the area have had two free- ways encroach upon their property and it is not fair to add to their woes. There is a problem as far as recreation and young folks and their motor- cycles. They should have a place they can travel on without creating damage to public property. Development of the Santa Fe Dam park area began about 6 years ago and although nothing was said about a motorcycle park this does not mean it cannot be added to the list and an area for it developed. Although noise could also propose a problem. He felt the Council had taken the proper steps and that we should try for another area. Councilman King concurred with Councilman McCaron that he had considered the noise and especially the traffic being generated and the ingress and egress factor. He was in sympathy with the youth who have motorcycles and felt consideration of the Santa Fe Dam area should be vigorously pursued. Councilman Gregory concurred with her colleagues, saying she had thought at the meeting when she had presided as Mayor pro tern that the issue should be continued until after the Recreation and Park study but due to the extreme interest action was taken. The Santa Fe Dam possibility was discussed at that time. She and Councilman McCaron, had some years ago along with the Council then in office paid out of their own pockets the fee for appealing the approval of the Irwindale Raceway. She and Council are concerned with the people in the Americana Tract, many of whom have left and sold their homes at a loss because of the noise. She could not vote to inflict the noise which we have to put up with because of the insensitivity of another city on this area. Me should pursue a recreational area for young people and we will. Mayor Hamilton agreed with his colleagues' remarks, both the need.for the motorcycle park and the concern of those who do not want it near their homes all have a good reason. He commended the people on getting out information on what is happening and on letting the Council and the Supervisors know their feeling. The Council had good reason to discontinue the study. Letters and petitions from over 100 people protested the project and since he had recently received three letters and talked to four people who were in favor he thought they should be heard as Council tries to be fair to everyone. There is a need and Council will work toward that need. At the request of the Mayor, Mr. Hale explained that about a week ago a map of proposals for Santa Fe Dam was received. A 1970 letter from the County denied the mini-bike concept. City donations are used as 10% matching funds toward the Grant received from the Office of Criminal Justice Planning who have approved second year funding. Discussion followed that the $10,000.00 given last year was to be a one time donation; that the amount was not budgeted last year nor is it budgeted this year and the money would have to come from unap- propriated surplus; that there is a manpower shortage in the police department; that the City does not have firm revenue figures nor do we have figures for employee costs for the coming fiscal year.
