Proper notice was given. Acting City Manager Hale explained that the grounds for denial was late filing. Municipal Code Sections 3053 and 3054 stipulate that applications be submitted on or before the 1st day of May and that no more than 14 permits be issued in any calendar year. The V.F.W. filed after May 1st and 14 permits from other organi- zations had already been filed. City Attorney Flandrick stated the code explicitly requires filing by May 1st and limits total permits to 14. The request would require an urgency amend- ment to the code both sections, increasing the number of permits and waiving late filing. This situation has arisen before and Council action at that time was to refuse to allow filing of the application. Ronnie Scartett, Post Commander, V.F.W. Post #3197, said they were appealing the refusal of the permit because it was the organization's first fund raising activity this year for the new incoming officers which includes Viet Nam Veterans. The tate filing was due to an internal problem which is being looked into to prevent this happening again. He realized that the decision to deny was just but he asked for special consideration as many worthy organizational projects would be affected without these funds. He asked that Council consider a code change to authorize a fireworks permit this year. Discussion followed and Mayor Hamilton said he sympathized and he explained that permits had been limited to 14 organizations so that participants would make a good profit. Councilman King recommended adoption of a 60 day urgency Ordinance to allow the permit on the basis of the work the V.F.W. has done to help others. City Clerk Balkus explained that the new organization filing was the San Gabriel Valley Christian School of Baldwin Park. They filed in February with the under- standing that if the original 14 applicants filed they would not receive a permit. Mrs. Balkus explained that in 1965 the May 1st filing date was established and in February 1969 permits were limited to 14 organ- izations. Prior to that there had been 10 to 11 applications filed. Councilman Gregory said that Council feels close to alt organizations and tate filing could occur again; that the more stands the less organizations realize individually and that Council wi11 have to take a stand eventually. She belongs to a unit of the American Legion Auxiliary. Some servicemen come home with problems and these organizations give them a reason for being. Councilman King concurred with Councilman Gregory, but disagreed with Councilman Waldo as he felt each and every organization is just as viable as the other", although he felt the V.F.W. should be allowed to sell fireworks this year. Council concurred that the total permits remain at 14 but that a 60 day urgency ordinance be adopted to allow the V.F.W. permit. NO. 704 ADOPTED Mrs. Millie Whitley of 15116 Howellhurst, representa- tive of the Baldwin Park Service Council requested that Council send a tetter of release to Los Angeles Manpower Division designating the Baldwin Park Service Council as the city's delegate agency to the Los Anqeles County Summer Youth Employment Program. The purpose is to authorize the Service Council to adminis- ter and supervise the placement of youth into summer employment funded by the county aqency. In addition, the Baldwin Park Service Council requested that 103 summer youth employment positions be allocated to it, of which 20% may be used for the placement of dropout youth. Ascension Lutheran Church of Baldwin Park will donate the use of office space for this operation, It was further requested that funding in the amount of $100 per month for three months be granted to cover telephone and utility expenses of the church location. The Service Council feels that this request is impor- tant in order to continue the work which was begun two summers ago, which has proved very successful in placing the needy youth in summer work. Mr. Hale stated that he had been in communication with Jerry Holland and Foster Stanfield of the Baldwin Park Unified School District. Further, the County also had in mind to develop a year round program for youth employment. In the various meetings with the County things have changed slightly in that the school districts have in the past 10 years administered the Neighborhood Youth Corps program quite successfully and the suggestion that was made by the superintendents to the County was that they should be permitted to continue to operate this summer youth type program. The latest word is they have agreed to permit the school districts to conduct these summer youth employment programs. Further, not confirmed, that they would be required to administrate the entire program for the entire city working in conjunction with the city itself, the various agencies, and anybody else interested in placing youth. There will be a meeting May 29 with Los Angeles County Manpower Advisory Commission, at which time they will finalize the entire procedure. It appears that the school districts wilt administer the entire summer youth program, at least this year. They will have definite commitment by County after May 29, and the program win probably be funded by one central administrative agency to control and coor- dinate the entire operation. Mrs. Whitley said that Bassett, Azusa and Rowland Heights are independent and manage their own slots and the school district is separate from the community agency. The Serivce Council feels there should be an independent agency plus the school district, as the past two years the program was not run entirely by the school district. Last year she handled 106 youths at one time and was paid $3.45 per hour, and 14^ a mile, and many did not go through the district. The school district had three administrative staff and a secretary, paid for through administration funds and they handled 116 youths. She worked for the Los Angeles County Youth Program through the umbrella agency of coordinating agencies of the San Gabriel Valley and the Service Council, and this was a savings to the taxpayer and funds went to needy youngsters who needed jobs. She hoped the Council would support the Service Council in this effort. Mr. Hale said that the independent agencies mentioned were funded under CETA Title II, and Bassett and Azusa were funded by the County. The County wants the school district to coordinate the programs. The program has to be in effect by June 16 and proposals must be made by June 2nd. At 9:00 A.M.. May 29, there will be a meeting in Los Angeles and then they will make the final decision. He invited Mrs. Whitley to attend with him. The County controls funds and has the right Continued) MRS. They expect the school district to pick up the entire administrative costs by an in-kind service arrangement and monies will be used to employ youth. In answer to Councilman McCaron, Mrs. Whitley said the school district had cooperated and furnished her an office, but the office was inde- pendent. The youths she handled did not get on school rolls, some were dropouts and probation problems and there is a need to take care of these youngsters. They were successful and 90% improved with the program. Councilman McCaron said more information was necessary in order to make a determination. Mr. Hale said LACMAC has the final say on proposals made by the County and the County feels the city should be the coordinating agency. However, this year the school districts will handle, as they are set up to administer the program. The County proposes to mandate that cities develop a social element addressed to summer youths. Senior Citizens, transportation and social concerns of the city, The city does not have the money at this time and we have to wait for the LACMAC decision. Councilman Gregory suggested that Mrs. Whitley as a representative of the Service Council make an appointment with Mr. Stanfield prior to the meeting and explain their position and Mr. Hale can also tell them on May 29. Councilman Waldo commended Mrs. Whitley for working with the Service Council and Parent Youth Communica- tions Committee and about 15 people in the audience, for making contact with youngsters and being wilting to sit and listen. He would like to see them continue their efforts. Councilman King concurred with Councilman Waldo and requested that Mr. Hale pursue this, and that Mrs. Whitley attend the meeting and the Mayor send a letter if necessary. He stated we are not talking about hard core youth and that he felt the judicial system is too lenient in turning the hard core youth back to the community) to compound the problem. He suggested checking the school district as possibly they would have no objection to the Service Council getting the 103 summer youths. Mr. Hale said the program depends on what the County will give us in money and the County is asking that the school district be the coordinating agency. E. Carpenter, 4346 N. Jerry Avenue, stated that the May 7, 1975 minutes did not reflect what he said. He said, he pointed out that Mr. Waldo and Mayor Hamilton) were guest editors or publishers and he said how are you going to wiggle out of it" and the minutes said, how is it going to be resolved", he wants it to say wiggle". Page 4, May 7, 1975 minutes, first paragraph, last two lines). He said Tribune headlines say, CRA is going to be re-examined by County Supervisors". He hoped it is, especially in Baldwin Park. He reminded Councilman McCaron and Mayor Hamilton of their statements regarding bonding and inclusion of businesses in the study area and asked, in view of their statements, how were they going to wiggle out of it? He asked if the mayor was going to say the experts just told us now that we have to have much more bonding than we had, other than 19 acres. He stated he tramped the streets and brought this to a vote. Council said 19 acres and now its 73 1/2 acres. He had totd the people that CRA blankets the city and the city Attorney had confirmed this. He was concerned with Council's concern for their colleagues. Two Council men are guest editors of the paper. The paper came out and called Mr. King, in effect, a burglar they imply he is a burglar, etc. He asked, What did he ever burgle or steal?" In any business or organization he was ever with, gentlemen do not go out and cut their colleagues throats. He asked if they really believed that their paper was putting out the truth. He hoped the County Supervisors would stop this thing at 19 acres and not rip off United Parcel and others and spread through the city like a cancer. He was afraid this would happen when the Council voted on CRA and he asked how they were going to wiggle out of what they said. He hoped the people would hold them to the 19 acres and not let them wiggle out of it. 00- Joe Cale, 4457 N. Maine, said it had not been mentioned that there was an article in tonight's Tribune which said CRA in West Covina was off once again to another successful development. He did not say CRA was 100% perfect, but it's better than what we have now. He encouraged Council to stay together and work together and not be slighted because an individual says let's stay with the 19 acres. Gayhurst, said CRA is nothing but a racket and a reliable company can get money and build without having the city back them up. Taxes on this could go on for 30 40 years. When the state or city gets into private enterprise, our freedom is going to fall. The country has never recovered from the depression and we've lived on credit. The people should fight for their freedom and this takes away our freedom, when a few men have the say so and can take your home and land away from you. 00- Mayor Hamilton said that with all the ridicule he has heard the last two meetings about the Treasure Chest, the thing that concerns him and was not mentioned and that's freedom of the press". Regarding a statement made tonight, that he said only 19 acres. Mayor Hamilton said he had remarked that he could not control the newspapers. There were no objections. 00- Mr. Flandrick requested a five minute executive session at the end of the meeting to discuss litigation. 00- Acting City Manager Hale stated two requests were received from Pacific Installers, Inc. for refunds of permits in the amount of $5.00 each. They are required to take out permits for household appliance installations sold by organizations such as Sears. These services were cancelled and permits were not required. He recommended approval. AUTHORIZE MAYOR AND CITY CLERK TO EXECUTE THE ANIMAL CONTROL SERVICES AGREEMENT AND SUBMIT SIGNED COPY TO THE SPECIAL SERVICES DIVISION OF LOS ANGELES COUNTY. Councilman Waldo said that in his opinion either we have not been getting our money's worth or we have not been paying enough for animal control and he asked if the county was aware of our dissatis- faction. Mr. Hale said there had been various discussions and the county is developing a new service approach beginning January 1, 1976, at which time he assumed the agreement would include the option of additional services at an additional cost. At this time we do not pay for the services which are paid for by licenses and fees. Mayor Hamilton said there had been many complaints about service and there have been discussions with the Animal Control Services which indicated it was a case of money and a man power problem. The contract costs us nothing now. 00- Mr. Hale said Council had instructed him to inform the School District of the city's interest in the Ledford School site. The Board granted the city six weeks in which to make a preliminary study of the area. Sources of revenue and acquisition costs have been analyzed. The estimated acquisition cost would be $300,000 plus $15,000 for improvements. The city could sell the R-1 portion for approximately $160,000 and acquire $147,000 from California State Bond Issue monies. However, approximate cost to develop as a family type park would be $75,000, plus $30,000 yearly cost and $191,000 for a nature park plus $65,000 yearly cost. Depending upon use the cost could range from $83,000 to $200,000 to develop the property. The city's unappropriated surplus has been depleted for necessary items during the budget year and the alternative to finance the site would be a Bond issue or imposition of higher taxes. Although the Recreation and Park Commission recommended acquisition and development, Mr. Hale recommended the site not be acquired at this time and that the school district be notified accord- ingly. Councilman Gregory said these were very uncertain times for the people and the economy is very unstable. We have parks, and recreation is not in ration to the population, but because of the times she thought avail- able mojiey skould be used for additional safety services which are of Drimarv interest and also for services met by demands of the people. She had worked with the Recreation and Park Commission so she was aware of the need but she felt it was prudent to ACCEPT THE RECOM- MENDATION OF THE ACTING CITY MANAGER AND INSTRUCT HIM TO NOTIFY THE SCHOOL DISTRICT ACCORDINGLY. He said whoever the school district sells to, when they develop, there should be some access to the river bottom. The other site belongs to the state and it's possible this could be rented and developed. If we acquire $147,000 from the State, the funds could be used to develop a park, pay part of the lease and operate it for a period of time and this would perhaps be a little more regional in scope. Councilman Waldo asked to hear from Recreation and Parks' Chairman Hybarger. however, the Mayor and Council said the written agenda material furnished sufficient infor- mation. Councilman King concurred with Councilman Gregory and McCaron. Mr. Hale said that possibly the City could realize $160,000 selling the 8 houses on the property, however, the $147,000 is available when and if we apply for it. A joint powers agreement with the County could be an alternative as this would serve an unincorporated area, however, there had not been time enough to contact County Recreation people. LAFCO has placed emphasis on redefining boundaries of cities and has requested that cities get together and decide precisely what's to be done with un- incorporated areas of the County. There are about 12,000 people in this area. On the Ledford School site there is a time deadline as the school district has interested developers and the district wants to sell. Councilman King said that a joint powers agreement would be worth exploring. If we could afford the land we could not afford the maintenance. Mayor Hamilton stated there is a recreational need and he agreed with Councilman Gregory that due to economic conditions, the need for safety services is more important at this time. There may have to be budget cutbacks. Going to bond would mean taxes on the people. We could hold over and check with the County but we cannot afford this at this time. Councilman McCaron said other school sites will be available and recreational development of 16 acres in the river bottom would provide for the people in the area, but there is an access problem. The $147,000 could be used to develop the 16 acres. Councilman King agreed that the 16 acres should be pursued and the Ledford site dropped. Councilman Waldo asked if the item could be held over to investigate County input as he did not wish to lose the site, but Mr. Hale said the School District had asked for a decision on acquiring the property.
