Proper publications and mailings had been accomplished An Environmental Impact Report for the Project would also be considered as a part of the Public Hearing. PUBLIC HEARING REDEVELOPMENT PLAN & REPORT PROPOSED PUENTE-MERCED/SOUTH BALDWIN PARK REDEVELOP- MENT PROJECT PUBLICATIONS & MAILINGS E.I.R. FOR PROJECT ALSO CONSIDERED AS PART OF HEARING Mayor Hamilton asked for comments from the staff and the consultants. Mr. Mitchett said the Revised Redevelopment Plan had been reviewed by the Office of our City Attorney and by O'Melveny and Myers, Special Legal Counsel. The City needs development to enhance the tax base, to relieve the property owners tax burden and to provide job opportunities. To compete with neigh- boring cities CRA is the only State Legislative tool available. CRA will eliminate many problems which block private development. It wi11 bring new business, new jobs and help eliminate blight. Approval will be a major step in insuring the continued development of Baldwin Park. In order to meet a11 legal requirements, certain minor technical non-substantive changes were necessary in the Plan. The Plan does have in their opinion and in the opinion of bond counsel all the legal requirements required for being legally adopted. Mr. James Sexton outlined the highlights of the language changes to reflect the intent of the Plan revisions and deletions on various pages. He said a copy of the Plan with the precise changes is available in the office and a copy will be available in the Library tomorrow. Mr. Taylor Dark, representing Economic Research Associates, stated his firm had evaluated the four uses in the pro- ject area. Based upon their research they found there was market support for a small budget motel, a luxury hotel of 100 to 120 rooms, a retail facility and discount operation and a business park. They found there was a need for a business park along the freeway and they were surprised to find that Baldwin Park did have the land available. They were also surprised to find the 25 to 35 acres which exceeded the original site. At that time they recommended to the Redevelopment Agency that they consider the potential of developing under-developed, under-utilized large sites in the area. They feel the uses they recommended have good market support and the project areas recommended are very good utilization of the land atonq the freeway. George Bliss, representing William L. Pereira and Associates, stated they were retained to do the plan- ning for the redevelopment project. They developed the plan in two parts, the original site recommended by E.R.A. and the market demand indicated that ad- ditional property was required to cover both sites and the scope of their project expanded to cover both sites. Their plan designates uses within each of the project areas consistent with E.R.A. findings for commercial, hotel, business o,ffice and street uses. Ctair Port, principal in the relocation firm of Port and Flor Relocation Consultants, stated they will attempt to find relocation assistance for project residents displaced because of public action. The Relocation Assistance Act provides that relocation payments be made to tenants and home owners and businesses that are displaced in the project. Pay- ments wilt be handled on a case by case basis. James Magner, representing Magner Consultant As- sociates, Fiscal Administration, was retained by the Agency to study financial feasibility as to the plans prepared by Lee Herrara and Associates. He analyzed the project from two concepts by keeping the two areas separate and making some determination as to each area being able to support itself separately and by combining the two. His analysis was that the projects would not be supportable by the types of revenue that would be generated separately, and if they were to be a success they would require additional money from the city itself. This information has been prepared in a feasibility report which has been printed and circulated by the Redevelopment Agency. The area now generates about $40,000.00 annually to the City. They estimate that the revenue which wilt be generated with the Agency will be about $400,000.00 annually. Mayor Hamilton requested that each speaker limit their testimony to three minutes. Carpenter, 4346 Jerry, League to Preserve Constitutional and Civil Rights, protested CRA; this is attempt to use new development and vacant land which is not blighted and wilt be taken off taxes, and the only reason for it is to sell bonds The project is only for industrial and commercial development despite the need of residents in the areas. Carl Sharpe, 5018 Wimmer, President, People for Progress, urged approval. John Kuzen, 13049 Mastine, objected to interference by Supervisor Schabarum. Mayor Hamilton read a telegram sent to the Board of Supervisors, this date, which stated that their re- quest was not in the spirit of the proper division between Municipal and County governments. And, to reject the wi11 expressed by our citizens in favor of desires made by the County is not in the best interest of our Community, etc. Copy in official files) T. E. Carpenter, 4346 Jerry, regardinq the E.I.R., read from a report of Donald C. Cutbertson, Dept. of Regional Planning, that a cursory review of the E.I.R. reveals the following deficiencies: It fails to address or to document the need for the project; it fails to sufficiently detail the proposed actions or potential impacts of those actions; and provides inadequate discussion of the potential adverse effects of housing proposals, particularly the need for ad- ditional services and facilities to serve residents of the area. They had not had an opportunity to review a draft E.I.R. of the revised Plan. It appears that the project does not fully comply with the 15 Legislative proposals and State and County Guidelines for E.I.R., in particular blight, and need Mr. White stated that the report addresses itself to each one of those criteria as specified under Section 21,000 of the Public Resources Code. Edra Avenue, regarding the E.I.R., questioned how West Covina could build under CRA without any blight in sight. Also with the new underpass all our dollars will go to West Covina. As there was no further testimony either in favor of or in opposition to the Redevelopment Plan and Report for the proposed Puente-Merced/South Baldwin Park Redevelopment Project and the Environmental Impact Report for the Project, Mayor/Chairman Hamilton declared the public hearing closed. Mr. White stated that because of the technical changes in the reports, that prior to taking any action either adopting or disaffirming the Revised Redevelopment Plan it must first be referred to the Planning Com- mission for consideration at its July 3, 1975 meeting. Harry A. Fry, Attorney representing Armando G. Bojorquez, said that Mr. Bojorquez proposed that the restaurant would be open from 4:00 p.m. to 12:00 a.m., Monday through Thursday; 4:00 p.m. to 2:00 a.m., Friday; 12:00 noon to 2:00 a.m., Saturday and Sunday; that at the times music is provided for dancing, security personnel would be provided. He proposed that the hours, security personnel, and dancing on Friday, Saturday and Sunday be conditions of approval; improvement of the property would increase city revenue. The building, being open, is now dangerous. He pro- poses a nice restaurant with parking. The area is not R-1, it abuts C-1 and R-1. The General Plan designates this as commercial. The ABC will deny the permit if this is harmful. In answer to Councilman King, he said his client was aware of the extensive remodeling that will be necessary to comply with the building code and required sound proofing wilt be complied with in conformance with codes. In answer to Councilman Waldo, he said there was presently a lease-purchase agreement on the property Mr. Bojorquez does not intend to engage in food manufacturing business. In answer to Councilman King, Mr. White said Council could impose any reasonable conditions, which could include restrictions on noise, but this would have to be specific and would require measuring devices and enforcement guidelines would be necessary. Councilman King proposed holding action on the case pending a study of the noise problem. Mr. Fry said there are problems with measuring devices, and there is probably noise there now. This does not lend itself strictly to the restaurant business. If the applicant would limit operation then this could be considered with restrictions. Chief Adams recalled one incident involving a serious assault; that he could research this and make a report; that there was a certain degree of intoxication. Protests of the new location were received from citizens and the Police Department had protested to the ABC. The ABC is awaiting the decision of the Conditional Use Permit. Mr. Fry said it should be checked if there had been no other assault incidents since that date; that people would be leaving at various times and not all at 2:00 a.m. Mr. Bojorquez said he wished to serve a better group of people and that he would not be manufacturing food products. He wants to be open until 2:00 a.m. and after a year would tike to be open until 4:00 a.m. so they can serve food as other restaurants are not open late. Discussion followed that opening of a good restaurant was most commendable but there could be problems. As there was no further testimony either in behalf of or in opposition to CP-217, Mayor Hamilton declared the public hearing dosed. Discussion followed that the residents on La Rica had experienced problems with the apartment house; that another bar nearby had been a detriment; that the intent was not just a restaurant and the hours would be too long; that residents had their rights; that beer, wine, live music and debris would cause problems; that this operation would be detrimental to surrounding properties; and that the police department had recommended denial of the permit.
