An invocation was given by Rev. Paul Malone, Ascension Lutheran Church. Roll Call: Present: COUNCILMEN GREGORY, MC CARON. Blewett, 3562 Baldwin Park Blvd., said that a matter of concern to the well being of the City was the purchase of the theatre next door to City Halt by the Pussy Cat Theatres Incorporated. He did not believe this is the type of influence we'd tike in our Civic Center. He asked if the theatre was offered to the City at the same price Pussy Cat Theatres paid. The City Hall plans from Maurice Fleischman and Associates recommended ac- quisition of this property for the Civic Center. Councilman McCaron said Council was waiting for further information before taking action. Daniel Erbe, 4108 N. Larry Avenue, Bishop of the Morman Church, stated he and his congregation opposed this type of facility and asked if plans were being made to acquire the property. Mayor Hamilton said that the City Manager had con- tacted the former owner; that we had learned of this after escrow closed; that his personal opinion was that it is wrong procedure for a governmental agency to have to buy land to prevent undesirable usage; that we do not know this will be a Pussy Cat Theatre; that this is a rumor; that this property was included in plans for City Hall but the cost for purchase and clearing was too high; that legal preventative means for undesirable usage should be pursued, such as writing legislators. Council has discussed this problem with the District Attorney. The District Attorney's office has about 200 cases and they are taking about 8 of them to court. The Council will do everything legally to oppose an un- desirable usage. There is an organization in West Covina trying to get legislation passed to control pornography. City Manager Mitchell said State standards pre-empt local standards and citizens should write their legislators and let them know their concern. Councilman Gregory suggested individual letters from citizens and the Council to the District Attorney. Councilman Waldo favored use of the property for City Hall. He and the previous owner had tried to find a location for a new theatre, after selling the old one, which was offered to the City and discussed with Mr. Mocalis. The previous owner owns Westco, East!and and El Monte theatres. The Council gave authority, if the appraisal was acceptable, to enter into escrow and purchase the property, but the City Manager had left. Councilman McCaron said acquisition was included in City Hall plans and when we receive the assessed valuation we can proceed with acquisition and he thought the City Manager was working on this. Ralph Alfaro, Youth Minister Church of the Redeemer, residing at 4120 Richwood Avenue, El Monte, read a petition from the Church members stating that on hear- ing that a theatre will specialize in showing porno- graphic movies in our City, they are concerned for the moral result and effect upon our community. They re- quested that Council do all in its power to stop this project and offered their support. E. Carpenter, 4346 Jerry, Chairman of the League to Preserve Constitutional and Civil Rights, said recently he had been Invited by telephone to a home on Bresee and he tried to answer people's questions as to why they were Included In a study area en- compassing about 200 homes. He told them on the telephone and at the house that he did not know and this was tape recorded. Councilman Waldo, Mr. Gate and Mr. Sharpe were present. He referred to Mayor Hamilton's letter of August 18, 1975 copy in official files). which, he said, implies that they lied. He wanted to know who lied, and said they told them to go to the Council or the CRA and ask these questions. Regarding Proposition 9. Section 87203. Disclosure of Investments, he asked If the Mayor had disclosed all properties in- side and outside the State. If everything was not dis- closed it was a violation and he was going to make this public. Mayor Hamilton stated that under the direction of the City Attorney he had disclosed a11 properties the law requires; that he has no secrets and if he has violated any law he is not aware of it. Regarding the letter, Mayor Hamilton said no name was used. Councilman Waldo and Gregory said they had disclosed everything. 00- The following opposed the theatre usage and offered support. Joe Pierce, 3722 N. Willow, representing Mrs. Pierce, President of the PTA Council. William Watkins. 14524 Hallwood Dr. Merle Smith, Pastor, United Methodist Church within 300 feet of presumed usage. Joyce Hathaway, 3915 Merced, asked if signatures of citizens requesting purchase of the property would help. City Attorney Flandnck suggested that the people give Council a chance. The City Manager has prepared a report which will give details and recommended course of action. Mrs. Sue Gray, 4600 N. Walnut, spoke in opposition to the presumed theatre usage. Joe Cale, 3043 N. Maine, opposed the presumed theatre property usage and appreciated the community interest. He commended the Tribune and read from an article en- titled Duty to Constituents", as follows: Public officials are fair game for criticism. They also can expect to be the target of abuse deserved or not, but there are times when this abuse goes beyond the bounds of common decency or coimion sense." He read the arti- cle, he said, because a few people take it upon them- selves, whether they are asked, whether it concerns them or not, to be the lawyer for every taxpayer in Baldwin Park. One individual at every Council meeting has something to say and for years has been raking the Council over the coals. As a taxpayer he felt he was within his rights to speak. He thinks Mr. Carpenter was trying to confuse and use scare tactics that we were going to move in and take homes. He asked that Council take some action with this man; give him the money and get him out of the city as he is tearing us up and is up to no good. Mrs. Bertha M. Regus, 5013 Cutler Street, said they were invited to a persons home and were informed that some people were there without request. They have it available on tape and no statements were given out that were not true. Greg Lloyd, 13331 Waco Alien Ahlmann, 3679 Maine Councilman McCaron said the theatre area was included in the City Halt development plans and will be needed. Councilman Gregory thanked everyone for expressing their feelings and said that Mrs. Balkus has the names and addresses and Council would call on them for sup- port if necessary. Mayor Hamilton and Councilman Waldo also thanked everyone for attending. 00- City Manager Mitchell said we were informed by the Federal Department of Housing and Urban Development that upon application there may be additional monies coming to the City under the Community Development Act. Councilman McCaron requested that this item be held over for budget discussions. 00- Council discussed a proposed insertion in the Chamber of Commerce Facts Booklet. Cost to the City for the insertion would be approximately $500.00 and would be a method of getting more information to citizens. These will go to every home in the City at no charge. Advertisements will pay for the facts book.
