An invocation was given by Rev. Armen Johnson, Seventh- Day Adventist Church. Applicant: Vanguard Construction Company. Continued from 9/17/75) Proper mailings had been accomplished. There were no written protests. DROP FROM AGENDA AS PLANNING COMMISSION HAS GRANTED A ZONE VARIANCE. M/S/C: KING/GREGORY. There were no objections. 00- It was the time and place fixed for a public hearing on Z-387, an application for a zone change from C-1 Neighborhood Commercial) to R-1 Single Family Resi- dential) on property located at 4663 N. Maine Avenue, Baldwin Park. Applicant: Herb Johnston of Beaver Builders for Allan R. Burris, Owner. Proper publications, postings and mailings,had been accomplished. There were no written protests. Planning Director Kilgour reviewed his Agenda Report and stated that the Planning Commission recommended approval of the zone change. Robert Barnett, 1824 Otterbein, Rowland Heights, repre- senting Mr. Burris the owner, said the house was too small and they should be able to improve. If ten years from now, the area develops commercially, he could re- zone the property. R-1 conforms to the General Plan. T. E. Carpenter, 4346 Jerry Avenue, said this was pur- chased as C-1 property and adjoining owners wished it- to remain C-1. A zone change to R-1 for the area was protested not too long ago and it should remain C-1. Mr. Kilgour explained that any future rezoning would depend upon the General Plan and the Planning Commis- sion and Council in office at that time. Councilman King objected to spot zoning and questioned the possibility of a variance. City Attorney Flandrick expalined that the applicant would have to show the existence of circumstances upon which a zone variance could be granted. Councilman Waldo felt a variance would allow upgrading of the property. CARPENTER OPPOSED Councilman Gregory said that an R-1 zone change this should remain C-1, Planning Commission. this would be spot zoning, and should be block by block and or be referred back to the Mr. Kilgour explained that the Planning Commission had instructed the staff to review the entire area for proper land usage. This request could be premature and perhaps should be tabled. If this property were R-1, the adjoining property de- veloping commercially would be required to set back twenty 20) feet on the side property line and install a masonry wait for a zone buffer. After further discussion. Mayor pro tern McCaron declared the public hearing closed. There were no objections. 00- Planning Director Kilgour extended an invitation to the East San Gabriel Valley Planners' Sub-Committee Meeting on October 23, 1975, 6:30 p.m., at Lord Charley's, 730 North Azusa Avenue, West Covina; Speaker, Tom Burrell, Environmental Attorney with John McCarthy's office. Baldwin Park is the host city. 00- D. L. Wolfe, 4147 Downing, received overnight parking ticket, objected to the parking fee and would like the law repeated. He was referred to Captain Hebert for an explanation of the procedure. 00- Mrs. Beatrice M. Jackson, 3390 Paddy Lane, said she had a petition and was speaking for residents in the 3300 and 3400 block on Paddy Lane Petition was not submitted). She opposed buying an overnight parking permit, and that the fee was not refundable if a permit was not available. Also, the fee could go up in the future. This is a cul-de-sac street with many short driveways. She had found no parking" signs on entrance to the City. They had not received a no parking warning. Some have converted garages, and said they had a permit. Captain Hebert explained that the law has been in effect many years, and has helped reduce crime and allowed street sweeping. Councilman King said permits are not issued to convert garages unless arrangements are made for another garage. Councilman Gregory suggested that perhaps procedure should be to investigate first, and then collect the fee, and Mayor pro tern McCaron said the fee was to cover the added expense of the department to send a man to in- vestigate and therefore, was not refundable. Council concurred that the City Manager investigate overnight parking, and report at the next meeting; write a letter of acknowledgement to Mrs. Jackson, and that Mrs. Jackson call the City Manager Thursday, for an appointment to discuss this matter. E. Carpenter said that after 1962 a garage could not legally be converted. In 1967 he had submitted street parking plans from other cities, as no one could park on the street; that now there is a provision in the code which allows parking when certain conditions exist. He said salary negotiations were predicated on July 1st at 7-1/2%, but as pay was not retroactive, it was set up on a 9 months basis as 10%. He objected to hiring the Finance Director in August and granting the 10% a month later. October 15, 1975 Page 4 T. E. Hickok, 14203 Cloverside, spoke regarding the sidewalk location and the wall encroachment in the public right-of-way on the northeast corner of Feather Avenue and Cloverside Street. He presented photographs of various corner walls. This item continued from October 1, 1975. Mr. Lathrop explained that the public right-of-way is for the purpose of serving the public and not for private yards. When the staff observes a fence being constructed in the public right-of-way then it is corrected, but they do not have a program to seek out past violations. If a fence does encroach and the sidewalk pattern requires construction on the property line, then the owner has to remove the fence to ac- comodate the-sidewalk. Discussion followed and a study on the balance of sidewalks in the city where there is a similar problem is to be made. GRANT THE ENCROACHMENT PERMIT AND AUTHORIZE THE CITY CLERK TO ISSUE IN WRITTEN FORM, AN ENCROACHMENT PERMIT IN A FORM ACCEPTABLE TO THE COUNTY RECORDER, THAT WILL ALLOW MR. HICKOK TO CONTINUE THE EXISTING FENCE IN THE LOCATION, AND TO COMPLETE IT AS HE HAS DESCRIBED IT, WITH A SPECIFIC DESCRIPTION OF THE AREA AND WITH AP- PROPRIATE LANGUAGE PREPARED BY THE CITY ATTORNEY, IN- DICATING THAT IF ALL OR ANY PORTION OF THAT FENCE HAS TO BE REMOVED OR RELOCATED AS NECESSARY IN THE FUTURE, THAT IT WILL BE DONE AT HIS EXPENSE TO ACCOMODATE SIDE- WALKS, CURB REPAIR, ETC., OR UTILITIES TO SERVICE THEIR FACILITIES AND THAT THE AGREEMENT BE RECORDED AND MADE BINDING UPON THE OWNERS, FUTURE OWNERS, HEIRS AND SUCCESSORS OF INTEREST. The City Attorney will report. 00- City Manager Mitchell reviewed the September 30, 1975 letter from the Department of Animal Control, which would increase costs to the City. The present con- tract expires January 1, 1976. Staff authorized to complete animal control study and submit report and recommendation to Council in December, 1975. There were no objections. 00- The Honorable John H. Rousselot, 26th Congressional District, officially notified the City that Baldwin Park has been designated by the American Revolution Bicentennial Administration as a Bicentennial Com- munity for the 26th Congressional District and he presented a color foil etching of the Spirit of 76". NO. 715 ADOPTED An Ordinance adding Section 3615 to the Baldwin Park Municipal Code relating to the making of false state- ments or reports to City officials regarding City officers or employees was held over pending the re- turn of the Chief of Police. 00- Discussion followed regarding legislation. The Governor vetoed AB700, which will save cities dollars in the future. Supervisor Schabarum informed the City that a Department of Transportation request would re- quire cities to adopt a transportation plan. This is an encroachment into local government and City Manager Mitchell suggested opposition. Council directed that individual and collective letters of opposition be sent regarding transportation. Council man King requested that the Governor be thanked for vetoing AB700, 1793 and others. ORD. ETC. 00- City Manager Mitchell and Councilman King met with As- semblyman Montoya and representatives from the City of El Monte. They have a Grantsmanship and Legislation Program and it appeared that expansion of the Program to include other cities would be beneficial if they are interested. Councilman King and City Manager delegated to attend El Monte Inter-Govemmental Relationship Program. Letter to be sent to El Monte suggesting items for discussion.
