TREASURER'S REPORT NOV. 30, 1975 REC'D AND FILED City Clerk Balkus read by title: RESOLUTION NO. 75-101, ALLOWING CLAIMS AND DEMANDS AGAINST THE CITY OF BALDWIN PARK Director of Finance Haltoway said that, as noted at the CRA meeting, they would like to amend the Resolution to include Warrant 3960 in the amount of $492.90, bringing the total amount to be amended in Section 3 to $471,186.85 Councilman King voiced objection to Warrant 3960, saying that when the bill was approved for preparation. Council was to review and approve the ad before it was submitted to the Chamber. He had seen a copy and said that while some of it was qood, some of it would have been chanqed had he had input to it and he does not condone something going out from an individual rather than the total Council Continued) RES. RESOLUTION NO. 75-101 ADOPTED AND FURTHER READING WAIVED. M/S/C: GREGORY/KING. There were no objections. Council- man McCaron was absent. Mayor Hamilton said that Warrant 3960 would be held over until the arrival of Councilman McCaron, who was attending another meeting. Asst. City Manager Hale spoke on behalf of the City Manager, who was i11, saying that due to the pressure of getting the ad to the Chamber it inadvertently had been printed before bringing it before the Council and he apologized for the oversight. Councilman Gregory said she had made the original motion on August 20th to go along with the fact sheet and was stilt in favor, but felt there was ample time between August and December for the staff to get the work done so that the Council could have seen the ad before it was printed. She felt if it were laxity on the part of the staff that they should be reprimanded, as it reflects on the City and she does not want to be a part of something that goes out without her input into it. The tetter was fine, but Council should have been called and the proof read to them. She hoped that in the future Council will be contacted when a motion is by a1t the Council. Mayor Hamilton felt the Council should have been notified by the City Manager, but felt a11 Council men had the obligation to follow through on this. He read the infor- mation on November 22 after it was printed and it had to be at the Printer by the 15th. Councilman Waldo objected to a Tribune article which he attributed to input by Councilman Gregory, in that it referred to his fiancee and he said he does not have a fiancee and he would appreciate making his own announce- ments. Mrs. Gregory said that was not her statement to the press. Judy Hammond, reporter, said that Mrs. Gregory had made the statement concerned, but that Judy herself had catted Mrs. Bond his fiancee because Councilman Waldo had called her his fiancee in public meetings. Mayor Hamilton said that the payment of the Warrant would come up under other agenda business when Councilman McCaron arrived. 00- It was the time and place fixed for a public hearing on an Aoptication for a Certificate of Public Convenience Yellow Cab of S. NO. 75-102 ADOPTED Assistant C-ity Manager Hale spoke regarding the U.S. Department of Housing and Urban Development revisions to the Community Development Block Grant Application, saying that the oriqinal application requested $374,000 and that $118,000 is available. Councilman King wants the Community Center for the City but is concerned that after the grant is received the City will be committed to in-kind services as well as hard cash, and that services might have to be curtailed in other areas. Councilman Gregory said that she has not had her questions answered since last meeting and felt that there should be further discussion. Mayor Hamilton said that the Community Center Corpor- ation had raised $24,000 and with their help and the federal funding of $118,000, the City is able to purchase the property. There wilt be some rental monies coming from the Community Center and with other grant money expected to rehabilitate the building. Mayor Hamilton had no qualms about the costs of operation. Councilman Waldo said the City has an opportunity to obtain a piece of property that will benefit both the young and the old, and he suggests that the Community Center be put in operation. He feels that there are enough organizations to take care of maintenance, if the City is unable to pay for it. Councilman King explained that he is concerned about police protection, fire protection and other services, and wants to look at all alternatives. He feels the Community Center is a vital need, but that it must be run in a businesslike manner. Mayor Hamilton said there would be a town halt meeting at 7:30 p.m., December 29, at Morgan Park Community Building on this item. The first meeting on this subject was held Monday night, December 15, but not many people were present, so he hoped for a better attendance at the next meeting. He explained that there is an application in for $164,000 and as much as $2 Million could be received in the next four years. He stated that it was a requirement to hold these two meetings to get input from the citizens and urged everyone to attend and te11 their neighbors. Following that meeting, a volunteer Citizens Committee of 15 win be formed to give input to the Council. 00- Grace Clemens, 3243 Syracuse, said she had worked hard for the community and for CRA until Tom Carpenter interfered and it was lost. She hopes he will find it in his heart to change his mind and work with her and the thousands of other people in Baldwin Park who want prosperity. Jerry Kitchel, 3308 North Athol Street, spoke regarding Ordinance No. 719, which he feels is discriminatory and that classified persons should have the same opportunity to run for elective office as the unclassified, if they have the qualifications and the ambition. The problem is that there is an administrative position held and an elective City Clerk position held. If the ordinance is adopted it should be on principle rather than expediency making it fair to all employees. 00- Gloria Zook, 4817 N. La Rica, spoke regarding Councilman Gregory and Councilman King, saying that she had checked the records and found that Councilman Gregory had received the highest amount of votes when elected and Councilman King second, but that tonight and last meeting she had heard them saying they were unaware of things that were happening without their knowledge and the people who voted for them are not being heard. She spoke of the Chamber of Commerce fact sheet and said that she felt that the payment of the warrant to Alan-Hall was a conflict of interest. Tom Carpenter, 4346 Jerry St., Chairman of the League to Preserve Constitutional and Civil Rights, spoke in rebuttal to Mrs. Clemens saying that he was interfering in CRA. He said that 3,000 people voted and that is the American way and that his group is hoping to show a better percentage of votes in the next election. Mr. Carpenter stated that Alan-Hail on Bogart St. printed the pamphlets inserted in the Chamber of Commerce Fact Book, but he claims that there was no such business at that address; that a license was issued for Nathine's to do composition lay-out work and art work, not printing. He claimed the fact sheets are propaganda. He said the United Parcel Service is not a part of the Redevelopment Agency as stated and the executives and Union of UPS had said when they came in that they were transferring all their employees in and that the City would get no jobs from this. He referred to the insert regarding Nichols Lumber Co. saying that this newly opened facility provides Baldwin Park residents with ready access to their building and hardware needs and that 50 new jobs have been created by this new business, while Mr. Nichots himself says we have 25 people to serve you. Carl Sharpe, 5018 Wimmer, requested that the City Manager release the figures on how much money has been spent on attorney fees by the City on the Regus vs. Baldwin Park CRA lawsuit. He believes Mrs. Regus is being used as a scapegoat by having her use her name rather than Tom Carpenter's on the lawsuit. He objected to Councilman King and Councilman Gregory putting a gag order" on releasing the costs on CRA when Tom Carpenter objected, rather than at the time they were requested. He requested that the people of-B-a1dw4n Park be furnished the figures on costs of the CRA lawsuit and also how many city hours have been expended in providing information. He suggested that people who come into City Hall sign a register stating their purpose for being there and the time spent, as is done at the newspaper and other offices. He used the example that in a public agency 1n Los Angeles, it is legal to provide such information as costs on expense reports if the request is put in writing. Halite Slater, 4814 No. Stancroft, said it was her under- standing that the staff that works for the City is here to provide services and information for the people. She requested that the County Pound be contacted about better service with the dogs and that the contract with them be cut down to less than six months and look into other areas. Duane Glass, 14345 E. Garvey, president of Glasstein Auto Parts and secretary of Attstar Auto Electric, spoke regarding improving the appearance of Garvey Avenue in Bladwin Park for the benefit of the freeway drivers. He would like to see work done on electrical wiring and undergrounding and have his customers be able to come off the freeway and be able to follow Garvey Avenue without being stopped every quarter of a mile. He has spent a quarter of a million dollars on improvements on his business and would like to see the City match his expenditure. He said that he would attend any meetings or get any number of buinessmen from along Garvey Avenue to sign petitions or push improvement of the freeway frontage. At 8:30 p.m. Councilman McCarron arrived. Councilman Gregory thanked Mr. Glass for speaking so constructively about improving the appearance of Baldwin Park. She said that for many years attempts have been made to get CAL TRANS to do something about this. She asked Director of Public works Lathrop to comment. Mr. Lathrop said he had been in contact with CAL TRANS regard- ing landscaping along the 605 freeway, north of the San Bernardino freeway, and in recent correspondence with them had been totd that due to their financial crunch landscaping could not be accomplished until at least 1980. The problem is not unique with Baldwin Park and relates back to the energy crisis. Councilman Gregory suggested that the City Manager look into some way that the businessmen could participate with the City to accomplish this improvement. The Council agreed. There was no further Oral Communication. Councilman Waldo asked Gloria Zook why she felt that having the printing done by Alan-Halt was conflict of interest. She replied that she felt that Mrs. Bond being Councilman Waldo's fiancee represented a conflict of interest. Councilman Waldo reiterated that Mrs. Bond was not his fiancee, but Mrs. Zook said that if she felt it was wrong she had a right to say so. Councilman King thought there was a misquote by Cart Sharpe when he referred to a gag" being put on CRA by Councilmen King and Gregory. NO. 75-103 CLAIMS & DEMANDS 3961, ALAN-HALL Councilman McCaron asked what was the reason for objection to payment of the bill. Councilman Gregory stated that she had not had the opportunity to peruse, correct or have any input to the flyer itself, that it had been given to someone other than the low bidder, and that she considered it a conflict of interest because it was given to Alan-Hall. She said that, most of all, she objected to the flyer itself. Councilman King said that he had no intention of not approving paying the bill as the City made the bill and Alan-Hall provided the service, so payment should be made for service rendered. He felt it was up to the City's legal source to determine whether or not it was a conflict of interest. Mayor Hamilton said it was his understanding that Alan- Hall was the low bid. Assistant City Manager Hale responded that three proposals had been received. The actual low bidder was not yet in business so was unable to perform as quickly as requested, Alan- Hall was second to the lowest bidder. RESOLUTION NO. 75-103 ADOPTED AND FURTHER READING WAIVED. There were no objections. 00- Assistant City Manager Hate said that at the direction of the City Council the City Manager has reviewed the request of the Upper San Gabriel Valley Water Association in which they requested the City support their position of opposing the proposal by the Southern California Association of Governments relative to designating the South Coast Basin area a 208 planning region. He referred to his report to the City Manager which contains three alternatives to be considered. Discussion followed. Assistant City Manager Hale said that the Association would appreciate some input; however, their hearing was for this date and that, unless it was being continued, nothing would be gained by passing the Resolution this meeting. Mayor Hamilton said this subject would be held over until December 29 meeting and Mr. Hale will research the results of the hearings. RES. WILL RESEARCH Councilman McCaron suggested that the City Manager's office get in touch with Mr. Carl Fossette, who has been a head of the water companies for years. 00- Assistant City Manager Hale gave a brief resume of a proposed budget amendment to transfer funds from the General Fund to the Sewer Connection Fund which the City Council had author- ized some years ago. During the 1975-1976 budgeting process, the appropriations for this fund were inadvertently overlooked Since this fund has in excess of $28,000 for sewer connections and laterals, it is recommended that $5,000 of this special fund be budgeted back into the sewer connection activities. Councilman McCaron asked how the funds were dispersed and Director of Public Works Lathrop explained that from time to time there is a need to extend the mainline sewer into areas that are not presently sewered to encourage growth or to provide service to areas that were not sewered when the area was covered by 1911 Act sewers years ago. A second use is to provide sewer laterals that occasionally ar^ missing that should have been constructed when the area was sewered. The service will be at no additional cost other than license fees and impound and redemption charges collected by the County. Mr. Lathrop attended the December 16 meeting and the action of the Board of Supervisors was in support of the Chief Administrative Officer's recommendation. The City will be receiving a renewal contract which win renew the existing contract for an additional 6 months, if the City wishes to enter into it. Further study wilt be made. City Attorney Flandrick recommended that the authorization be granted on the execution of the agreement. He said that the contract had not been received at this time, but it would be examined and if anything is not agreeable the Council wilt be notified at the next meeting. The cost is expected to be the same and the level of services would remain the same during the 6-month extention. Councilman McCaron noted that juveniles were the ones who had been parking and watching the x-rated movies and would be the ones who would be prohibited access to the theater itself. He suggested that if the Council were to protect the rights of minors, there must be a way to require the theater to screen the screen from any view outside the premises. City Attorney Flandrick said the matter has again been referred through Lt. Atdrich to the District Attorney's office and asked them in view of the peculiar circumstances; namely, juveniles not only in cars but in residential units dose by, to consider again the possibility of either a nuisance abatement action or alternatively a criminal action on the penal code. Mayor Hamilton instructed the City Manager's office to bring this up in 30 days, at which time hopefully the decision of the Supreme Court would be available. The motion carried. There were no objections. 00- Ordinance No. 719 was read by title: ORDINANCE NO. 719, AMENDING SECTION 2256 OF THE BALDWIN PARK MUNICIPAL CODE, RELATING TO CONDITIONS OF EMPLOYMENT ORD. NO. 719 AMENDING SECTION 2256 OF B.P. CODE RELATING TO CONDITIONS OF EMPLOYMENT City Attorney Flandrick explained that the ordinance had already been adopted as an urgency measure. He said this would be the second reading of the regular ordinance and would have the same effect as the urgency ordinance adopted the previous meeting. Councilman Waldo felt there was favoritism being shown to a few people who are employed by the City who have the right to enter into a municipal election white any employe that otherwise qualifies does not have the same right. He would tike to see the positions of City Clerk and City Treasurer put on the ballot and let the people make the decision whether they want to elect them or whether they should be appointed. He does not feet that it is fair that unclassified personnel be allowed to run for public office when the classifed personnel are not allowed to do so. Councilman McCaron asked if it was possible to consider putting the positions on the ballot. City Attorney Flandrick said the positions could be made appointive and it would not affect any incumbent office. There is a provision in the state law for these positions to be made appointive but only if approved by the electorate by a ballot measure. Mr. McCaron asked for clarification on how an employe could run for Council and then make decisions on his own position. It was explained that the employe would have to resign his second position. City Attorney Ftandrick explained that those involved unclass- ified personnel are City Council appointees and serve directly under the City Council, so if those people attempted to run for City Council it would be an automatic conflict of interest. If they were elected to the Council, they would automatically by law, not withstanding any Code provision, be elected to the Council but no longer hold those positions. Civil Service employees do not serve at the pleasure of the City Council but rather under the Civil Service system. He said there was no conflict of interest insofar as the City Clerk and City Treasurer are concerned because those two positions do not have any control over the other unrelated unclassified positions. The adoption of the ordinance would eliminate the prohibition.
