There were no objections Councilman Waldo was absent. 00" City Clerk Batkus administered the oath to those in the audience desiring to be heard during the meeting. 00- It was the time and place fixed for a public hearing on Z-390, an application for a zone change on Maine Avenue from C-1 Neighborhood Commercial) and/or C-2 Heavy Commercial) to R-1 Single Family Residential) or R-2 Light Multiple Residential) or R-3 heavy Multiple Residential) on the following properties: 4709, 4705, 4703-1/2, 4701, 4681-1/2, 4679-1/2, 4675, 4669, 4663, 4659, 4655, 4649, 4643 and 4637 Maine Avenue Area A); 14318, 14328, 14332, 14338 and 14342 Ohio Avenue Area B); 14402, 14403, 14408, 14409, 14412, 14415 Hallwood Drive Area C), and 4620, 4626, and 4630 Maine Avenue Area D). Initiated By: Planning Commission Publications, mailings and postings had been accomplished. There were no written protests. Director of Planning Kilgour explained that Z-390 involves three separate areas, and he reviewed the staff report in the agenda packet. The Planning Commission held two Public Hearings: November 12 and continued to December 10, 1975. Testimony was taken from property owners within the area and outside the area. The Commission directed the Staff to make an additional written contact with the seventeen affected property owners, asking for their comments on the proposal concerning their properties. In Area A, there were 2 in favor, 1 against, 5 with no response for a total of 8 owners. In Area B, there were 2 in favor, none against and no response for a total of 2 owners. In Area C, on Hallwood, there were 2 in favor, 1 against, 3 with no response for a total of 6. The one owner on Hallwood who was against zone change did not wish to have his property rezoned. The recommendation was to retain a C-1 zoning on his property on the corner. In Area D, there were 0 in favor, 0 against, and there has been no communication from the owner of the church. The Commission proposed to change Maine Avenue on the west side from C-1 to R-3. The main concern of the Commission was to remove commercial zoning to keep some residential zoning in there. Three voted in favor of the R-3 zoning and 2 thinking of the lesser residential density. The Convalescent Hospital to be changed from C-2 to R-1 in Area B. Area C to be changed from C-1 to R-1. This boundary was altered and involved 4 properties instead of six. Area D at the Baptist Church was C-1 to R-1. This is a residential land use on the General Plan and the change to R-1 would bring consistency. Mr. Kilgour said 162 letters were mailed to the property owners of record within 300 feet of the zone change area. Seventeen of these letters went to the affected property owners of the zone change. None of the 162 letters were returned as non-deliverable, and only one of the 17 letters to the affected property owners was returned. Only two signatures represented prooerties within the study area. The majority of signatures were from people on Landis Avenue and were outside the 300 foot radius. Others were located at Los Angeles Street, Ott Place, Scott Place and Gayhurst Avenue. There was no testimony in favor of the zone change. Testimony in opposition was given by Hub Bloxham, 332 W. Meda, Glendora, representing the South States Investment Company, 4532 N. Maine. He thought having four areas represented in one zone change was confusing. He mentioned lots in the middle of Maine Avenue in Area A that are planned for R-3, although he said at the Planning Commission hearing it had been agreed that Baldwin Park already had too much R-3 zoning. He questioned the first notice that came out on Area B on Ohio Street, saying that it was referred to as Maine Street and asKed if zhat was a legal posting. City Attorney Flandrick said that it appeared that the Planning Commission posting did contain an error in that it should have read Ohio Street, but that anyone checking with the attached map could see that it could not be on Maine Street, and that it had been corrected on the notice from the City Clerk. Mr. Bloxham was very much opposed to properties in Area B on Ohio having a zone change to R-1 from C-2 to satisfy a part owner of the properties and the Rest Home. He feels it win break up a very large piece of property, as the lots run 280 ft. deep and abut 2.8 acres of prime property on Maine which may one day be developed. Mr. Bloxham was also opposed to the church frontage being zoned back to R-1, as it would then be right in the middle of two pieces of Commercial property. He thinks the time will come when there will be more professional buildings or small commercial buildings, and that the zoning should be left as it is and the people should be given a variance to fix up their houses. Boyd Cummings, 4629 Maine Avenue, said that this was the third time he had attended zoning meetings concerning his property. He purchased C-1 property because he wishes to develop it commercially, but has been postponing this because of the constant zoning thing" concentrated on the north end of Maine Avenue. He stated that it is not a residential area as it is on a fast thoroughfare and no reason for any residences there. His complaint is that it is absolute nonsense to continue the proposed zoning changes for years, and not many businesses have come in to that area because of the nagging away on zone changes. He said if the citizens do not object to this pecking away" it will alt become R-1. He feels there is certainty something the Council or Planning Commission can do to gratify the property owner's desire to do something with his property as long as it doesn't bother anyone else. Mr. Bloxham presented a copy of the petition which was submitted to the Planning Commission opposing Z-390. John Taylor, 14242 Ohio, said that he has contacted lenders and not one would lend money for development along Maine Avenue with R-3 zoning. He feels that prospective buyers decline to buy because of the constant hearings on zoning changes. Tom Carpenter, 4346 Jerry Avenue, opposed plans to change comnercial property to residential simply because one man wanted to make an addition to his house, in spite of all the arguments heard in all the meetings opposing the zone change. He mentioned one person who spoke at a hearing, saying that he had paid twice as much for his commercial property as he would have for residential. Taxes are much higher in commercial zones, too. He objected to the statistics on notices sent out and returned, saying that just because people don't reply it doesn't necess- arily mean that they have acquiesed sometimes they are afraid to appear before a hearing or ask others to represent them. He questioned the validity of the petition presented before Planning Commission. The proposed zone change affects all homeowners, and everybody has the right to petition their government under the First Amendment without having the petition thrown out as of no value. He questioned the description of the proposed zone change which is proposed in accordance with the Baldwin Park General Plan and asked that the zoning be left just as it is. Councilman King asked why R-3 was protruding into a residential area in Area A, changing from C-1 to R-3. Director of Planning Kilgour explained that this was all one lot commercial in front and R-1 in back. It is almost impossible to legally create a line through them, so the entire parcel was included. Councilman King referred to the environmental impact report and asked what the social impact on the neighborhood would be with R-3 and whether the economic impact had been studied with regard to the higher density zoning. He said that he had asked Captain Hebert to determine, from a police standpoint, what the end results would be of more higher density zoning, and whether the police were able to cope with the situations they now have versus the situations the Council could impose. Acting Chief of Police Hebert responded by saying that his department is saturated with activity in the high density R-3 housing areas, as 3 to 4 times more police service is called for there as in a normal residential area. Whether those areas have strong or weak management is an important factor in controlling the population. A survey has been made on two specific locations. In 1975, at a La Rica Avenue location with 40 units, police had responded 107 times, while at a Puente Avenue address in 1974 police had been called approximately 700 times. Since then there has been a change of management, and in 1975 approximately 200 calls were made. Usually two officers are required to answer a call at an apartment complex, while one officer can handle a call to a single residence. Councilman King said that he did not think the City could afford the cost of more services and that, 1f the law mandates an environmental report, the Council should also mandate a social and an economic impact report. He felt the area would develop in time, but was not sure which zoning would be most useful at the present time. He asked Mr. Kllgour to repeat the Planning Commission's split vote. Mr. Kilgour said there had been 5 for and 2 against. Councilman King opposed Z-390 at this time and felt that a minor variance could be put on the property at 4663 Main Avenue and eliminate spot zoning. He mentioned that he had seen a For Sale" sign there and thought they may be moving. Councilman McCaron said this area has had the same zoning since before Baldwin Park became a city. When hearings were conducted at the time the first City Plan was drawn up, the owners stated they wanted to maintain the same zoning and there has been tittle change. He did not think changing from C-1 to R-1 was such an obstacle. It can be changed back to C-1 if someone needs that type of zoning. Even rezoned, there is still going to be mixed usage. He referred to the properties on Hallwood, saying he didn't think a substantial development could be made by buying a11 three parcels, even on either corner. He suggested letting it go for mixed uses. If a person wants to continue with his home. let him have that zoning; if the people are happier having C-1 zoning, let it stay C-1. He asked Director of Public Works Kilgour regarding the church property 1n Area D, which had the most latitude, under C-1 or R-1. Mr. Kilgour said the church is operated under a Conditional Use Permit and there 1s no advantage to them to have either zone to maintain their use. Councilman McCaron thinks It has been a problem keeping Improvements continued simply because properties have been zoned out of use. It should be made easier on the R-1 owners to repair and keep their property up automatically, even though they are In the C-1 zone. He thinks some regulations may have to be drawn up to cover this area and other areas that have the same problem. Mayor Hamilton said the problem was having a lot of mixed uses, and that the Planning Commission had started about 3 years ago to zone property back to Its present use. His own property is C-1 and should be brought back to R-1 usage, as he can not foresee it being developed Into commercial. He referred to the C-1 areas that have R-1 uses, but understands that the owners want to leave zoning as is because they have hopes of developing It into commercial. The City encourages development, but over all the years this hasn't happened. He understands why the Planning Commission has brought this a11 about. Councilman Gregory agreed with the testimony as given and felt that redassitying many of the areas back to R-1 or R-3 would be giving up commercial usage along Maine Street. She would like to hold the zoning as It is. Councilman McCaron felt that the person who asked for a zone change should receive some satisfaction. Mr. King thought possibly the gentleman didn't want to pursue it, as the property Is listed for sate. Mr. Kilgour said he has had no recent contact with the owner who had asked for a permit for an addition to his home. This question has also come up in Area B and Area C. The City zoning ordinance is being re- evaluated and in this and other areas, if it is left as commercial zoning, permissive language could be added to the ordinance to allow limited rehabilitation and additions to R-1 structures. Another way it could be done is by way of modification of the nonconforming use sections. He says it has always been the policy of the City to maintain their existing R-1 and R-2 structures while classified in either C or M zones, so it would be possible to pass some amendments to the Code so that it would not cost the property owner any filing fees or tie the City into any administrative proceedings. Councilman McCaron felt that any residence in a commercial zone should be able to be maintained the same as any other residence, using a Conditional Use Permit only when doing something to that property that is not allowed in R-1 zoning without a Conditional Use Permit or a zone variance. If usage is changed to commercial usage, it should be indicated clearly that any residential improvements on a parcel should be removed. City Attorney Flandrick said he was sure it would be the Staff's recommendation that a11 residential use terminate if any changes were made or if there was to be a conversion in the use by some commercial use. Otherwise, there would be the same problem as there had been in the past. Councilman McCaron was in favor of leaving the property a11 one zone, without the mixed usage, but that the property should not be allowed to deteriorate. Mayor Hamilton thought it would be wise to amend the Code to cover the residential usage homes that are commercially zoned, without any expense to the home owner. Mr. Flandrick said a draft on this would be given to Council, as well as the revisions of the zoning regulations hopefully in the near future. Councilman McCaron wanted it understood that the Planning Commission is operating under state laws and ordinances of this City, and most of what they do is recommendations to the City Council, so they should not be criticized for the changes they are trying to make. Mayor Hamilton said that the Planning Commission tries to follow the General Plan and has brought this out for help in getting a final decision. Director of Public Works Kitgour said that the parcel at 4675 Maine Avenue is vacant land and the property owner feels there is a market for R-3 and that he would be able to develop his property. He is the only one that said he could develop his property. It is the only vacant land in Area A. In Area B, the Convalescent Hospital and the single family home at 14342 Ohio, the uses would be allowed under R-1 and the owner of the home would tike to add on. He said that in Area C, two parcels that are shown for recommended change to R-1 are the most important, from an administrative standpoint, to dear up. In the easterly-most parcels, the zone line goes through the middle of the property. Mayor Hamilton asked what size the parcel was at 4675 Maine Avenue for development to R-3. Mr. Kilgour said that about 12 units could be put on it. Mr. McCaron asked if the area behind 4675 Maine Avenue was all vacant ground and if there was a way for it to be developed into residential or some sort of use. Mr. Kilgour said there was vacant land in there, clear beyond Laurens Avenue, and it could be developed if Laurens Avenue was extended. Mr. McCaron thought some of the individual problems should be brought out and sent back to the Planning Commission to search them out and find out which are important enough to take exception to, rather than to send back the entire plan, allowing it to remain as It is. City Attorney Flandrick suggested that the Hearing be continued to February 18, 1976 and refer it back to the Commission with instruction to Mr. Kilgour that he advise the Commission and the Council of any specific properties in any of the areas where problems exist, and that the tentative conclusion is to turn it down. Informal comment is requested from the Staff and the Commission about any problem. CONTINUE HEARING TO 18 FEBRUARY, 1976 AND REFER TO STAFF FOR WRITTEN REPORT ON ANY PROBLEM PARCEL INCLUDED IN THE REZONING AREAS WHICH MIGHT BE CONSIDERED FOR RE- CLASSIFICATION. THE COMMISSION IS TO BE ADVISED THAT THE COUNCIL'S TENTATIVE POSITION IS THAT THE ZONE CHANGES RECOMMENDED BE DENIED WITH THE POSSIBLE EXCEPTION OF SOME OF THE PROBLEM PARCELS. M/S: MC CARON/GREGORY. Mr. McCaron thought an ordinance should be brought up to cover the changes discussed. Mr. Kilgour said it would take longer than the 18th to have an advertised Hearing but that a Study Manual could be made available in the next couple of months. Mr. McCaron said that a determination should be made whether there is any urgency for the Ordinance before that time, and if there isn't, let it go until completed. Councilman King asked Director of Planning Kilgour if the problem area he had mentioned on Hallwood was the only problem area that he had encountered during the testimony given at the Planning Hearing. Mr. Kilgour said that this was the Staff's opinion that it was a problem area, from an administrative point of view, but the feelings of the individual property owner are not reflected in that opinion. Mayor Hamilton commented on the frontage area of the church in Area D, saying that he thought that should either be all R-1 or a11 C-1, and that it should be brought up in the zoning problems. He said that in June 1974, City Council Instructed the City Manager to put together a package on sales tax proration. Mr. Oargus said the package was ready to go in January 1975 and he wanted to know why nothing had been done about it. He quoted Governor Brown as saying the only salvation for small towns is to get a proration of sales tax, because the regional shopping centers draw all the money away from them. He said that 42 cities have letters of commitment sent in and are hanging in limbo. City Manager Mitchell said that the report that he had was that the cities who had signed were not sufficient o finance the case, but that he would report back at the next meeting. Councilman King said this Council did initiate this and he didn't know why it hadn't been pursued, but the Council would find out more about it. 00- Sherry Elmore, Chamber of Commerce Manager, announced a social mixer at the Chamber on January 15, hosted by Pot-pourri. The Baldwin Park Beauty Pageant will be held at the Civic Auditorium at 8 o'clock January 17. Baldwin Park Parade will be held January 24 at 10 a.m., with the theme B.P. is Be Patriotic." The Citizen of the Year Banquet will be at the California Country Club that evening with dinner at 7:30 p.m. Mrs. Elmore requested a waiver of the $25 fee required by the Municipal Code for anyone holding a parade, as she said that holding a parade is part of the contract with the City. Councilman King asked if there were any other service that Baldwin Park worked in conjunction with West Covina. Councilman McCaron answered only the radio repair. Councilman King thought it might be a good trade-off, rather than a cash flow, if this City might use their equipment in trade for the use of Baldwin Park's computer information system. Curbs can be painted blue; signs can be posted that designate parking areas for handicapped persons both on public streets and in private and public parking lots. The cost will be $350 a year. City Attorney Flandrick said that the by-laws do state that a City may not withdraw, but he was sure that if any Agency does not pay their dues they would be terminated. His concern was that the Association might run up some kind of bill or incur some liability that its members would be responsible for. He suggested that if the City wants to join the Association they could do so with the membership being conditional on being a member until a 30-day notice of intent to withdraw is given.
